  "body_es_text": "Recuerde que Control F es una opción que le permite buscar\n                en la totalidad del texto\n\n                Ir al final del documento\n\n                    - Usted está en la última versión de la norma\n                    -\n\n                        Texto Completo Norma 07\n\n                        Establece la delimitación de Zona Pública en el Cantón de Carrillo\n\nTexto Completo acta: E50D7\n\nINSTITUTO\nGEOGRÁFICO NACIONAL\n\nAVISO N9 2012-07 ZONA MARÍTIMA TERRESTRE\n\nDELIMITACIÓN DE ZONA PUBLICA CANTÓN DE\nCARRILLO\n\nCon fundamento en las facultades que\nconfiere el artículo 140 y artículo 240 inciso 1 de la Ley No. 6227 General de\nla Administración Pública, y en lo dispuesto en la Ley No. 59 de creación del\nInstituto Geográfico Nacional, la Ley No. 8905 de traslado del Instituto\nGeográfico Nacional al Registro Nacional, la Ley No. 6043 sobre la Zona\nMarítimo Terrestre, y la Ley No.8154 del Programa de Regularización del\nCatastro y Registro. \n\nConsiderando: \n\n1°-Que mediante Ley No. 8905, se\nestablece el Instituto Geográfico Nacional, como una dependencia del Registro\nNacional y que la Junta Administrativa del Registro Nacional administrará el\npresupuesto del Instituto, suscribirá los contratos y convenios necesarios para\nel ejercicio de sus funciones. Asimismo, se establece que el Instituto\nGeográfico Nacional será la dependencia científica y técnica rectora de la\ncartografía nacional, destinada a la ejecución del Mapa básico oficial y la\nDescripción básica geográfica de ía República de Costa Rica y a los estudios,\nlas investigaciones o labores y el desarrollo de políticas nacionales de\ncarácter cartográfico, geográfico, geodésico, geofísico y de índole similar que\ntenga relación con dichas obras, con el fin de apoyar los procesos de\nplanificación. \n\n2°-Que la Ley de\nCreación del Instituto Geográfico Nacional, No. 59, lo constituye de manera\npermanente y en representación del Estado, como la autoridad oficial en materia\ngeodésica y de la representación espacial de la geografía de la República,\nextendiéndose su autoridad a las actividades de cualquier orden que tengan por\norigen los trabajos confiados a su cargo. \n\n3°-Que el Convenio\nde Préstamo No. 1284/OC-CR \"Programa de Regularización de Catastro y\nRegistro\", suscrito con el Banco Interamericano de Desarrollo, bajo la\nmodalidad de Financiamiento mixto, entre el citado Banco y El Estado de la\nRepública de Costa Rica, cuya Unidad Ejecutora es un órgano desconcentrado del\nMinisterio de Hacienda, tiene como objetivo: formar el catastro de la totalidad\nde los predios existentes en el país, debidamente georreferenciados, y\ncompatibilizar esta información con el Registro de la Propiedad Inmueble. \n\n4°-Que de conformidad\ncon la Ley de Creación del Instituto Geográfico Nacional (IGN), No. 59, y el\nartículo 62 del Reglamento a la Ley No. 6043, se reconoce la competencia del\nInstituto Geográfico Nacional para la delimitación de la zona pública de la\nZona Marítimo Terrestre, y su oficialización a través de publicación en el\nDiario Oficial La Gaceta, mientras que el artículo 63 del mismo Reglamento,\nseñala que \"El Instituto Geográfico Nacional deberá publicar aviso en\nei Diario Oficial, de cada porción de la zona marttimo-terrestre en que haya\ndemarcado la zona pública\". \n\n5°-Que en el\nDecreto Ejecutivo No. 36642-MP-MOPT-MINAET \"Reglamento de Especificaciones\npara la Delimitación de la zona pública de la Zona Marítimo Terrestre\", se\nestablece según el artículo 18 que para la delimitación de la zona pública de\nla Zona Marítimo Terrestre, el IGN podrá acudir a las dos metodologías de\nejecución que se indican en los artículos 19 y 20, correspondientes a la\ndelimitación de la zona pública de la Zona Marítimo Terrestre a través de la\ncolocación de mojones y/o a la delimitación digital georeferenciada, esto con\nel fin de agilizar las delimitaciones y proporcionar mayor seguridad técnica a\nlos interesados. \n\n6°-Que en el Decreto Ejecutivo No.\n33797-MJ-MOPT, el cual entre otros aspectos determina, a la Red Geodésica\nNacional de Referencia Horizontal CR05, y su proyección cartográfica asociada\nCRTM05, como el sistema oficial al cual deben estar referidas las coordenadas\nde todos los trabajos geodésicos, cartográficos y catastrales que se ejecuten\nen nuestro país, señalando específicamente en artículo 11 que: \"La Red\nGeodésica Nacional de Referencia Horizontal CR05 y el sistema de proyección\ncartográfica CRTM05, constituirán el único sistema oficial de coordenadas para\nla República de Costa Rica a partir del cual se debe referenciar todos los\nlevantamientos y actividades cartográficos y geodésicos que desarrollen en el\nTerritorio Nacional toda dependencia pública, persona o entidad privada\nnacional o extranjera...\"; mientras que el artículo 7 indica que \"Conforme\nse produzcan datos cartográficos en el nuevo sistema de proyección cartográfica\nCRTM05, el Instituto Geográfico Nacional publicará por los medios adecuados\naquella información que se ha oficializado...\" \n\n7°-Que el\nMinisterio de Obras Públicas y Transportes y el Programa de Regularización del\nCatastro y Registro (Ley No. 8154, publicada en \"La Gaceta\", número\n237 del 10 de diciembre de 2001, Contrato de Préstamo No 1284/OC-CR),\nsuscribieron un Convenio con fecha de rige 18 de diciembre de 2009, cuyo\nobjetivo principal fue formalizar el apoyo que brindó la Unidad Ejecutora (UE)\ndel Programa de Reguiarización del Catastro y Registro (PRCR) al Instituto\nGeográfico Nacional para determinar y georeferenciar al sistema nacional de\ncoordenadas la posición de: a) línea de pleamar ordinaria y consecuentemente la\nlínea que delimita la zona pública de la Zona Marítimo Terrestre (ZMT), y b)\nlos mojones que demarcan la zona pública de la ZMT en el litoral Pacífico de\nnuestro país. \n\n8°-Que la\ngeoreferenciación al sistema nacional de coordenadas como mecanismo para\ndelimitar la zona pública de la Zona Marítimo Terrestre, posibilita la correcta\ndelimitación de la zona pública a los efectos de la elaboración de planes\nreguladores, el visado de planos de agrimensura, el otorgamiento de concesiones\nen la Zona Restringida y otros aspectos de ordenamiento territorial costero. \n\n9°-Que la\ninformación digital georreferenciada sobre delimitación de la zona pública de\nla Zona Marítimo Terrestre con que cuenta el IGN, se le denomina Geodatabase\nDigital Georreferenciada (GDG) del Instituto Geográfico Nacional (IGN) sobre la\nZona Marítimo Terrestre (ZMT). \n\n10°-Que la\nGeodatabase Digital Georreferenciada (GDG) del Instituto Geográfico Nacional\n(IGN) sobre la Zona Marítimo Terrestre (ZMT) se fundamenta técnicamente en\naplicación de la regulación establecida por: a) el Decreto Ejecutivo No. 7841\n-P \"Reglamento a la Ley No. 6043 sobre la Zona Marítimo Terrestre\",\nb) el Decreto Ejecutivo No. 33797-MJ-MOPT declara como oficial la Red Geodésica\nNacional de Referencia Horizontal CR05, y su proyección cartográfica asociada\nCRTM05, y c) el Decreto Ejecutivo No. 36642-MP-MOPT-MINAET\n\"Reglamento de Especificaciones para la Delimitación de la zona pública de\nla Zona Marítimo Terrestre\". \n\n11°-Que el artículo\n140 de la Ley No. 6227 General de la Administración Pública señala que \"el\nacto administrativo producirá su efecto después de comunicado al administrado,\nexcepto si le concede únicamente derechos, en cuyo caso lo producirá desde que se\nadopte\", disposición que necesariamente debe relacionarse con el\nnumeral 204) del mismo cuerpo normativo, mismo que define el instrumento idóneo\npara comunicar actos de naturaleza genérica al señalar que; Likewise, it is established that the National\nGeographic Institute will be the scientific and technical dependency governing\nnational cartography, destined for the execution of the official Basic Map and the\nbasic geographic Description of the Republic of Costa Rica and for the studies,\ninvestigations or works and the development of national policies of a\ncartographic, geographic, geodetic, geophysical, and similar nature that\nare related to said works, with the purpose of supporting the processes of\nplanning.\n\n2°-That the Law\nCreating the National Geographic Institute, No. 59, of Finance, has as its objective: to form the cadastre of the totality\nof the existing properties in the country, duly georeferenced, and\nto make this information compatible with the Real Property Registry.\n\n4°-That in accordance\nwith the Law Creating the National Geographic Institute (IGN), No. 59, and\nArticle 62 of the Regulation to Law No. 6043, the competence of the\nNational Geographic Institute is recognized for the delimitation of the public zone of the\nMaritime Terrestrial Zone, and its officialization through publication in the\nOfficial Gazette La Gaceta, while Article 63 of the same Regulation\nindicates that “The National Geographic Institute must publish a notice in\nthe Official Gazette, for each portion of the maritime-terrestrial zone in which\nit has demarcated the public zone.”\n\n5°-That in the\nExecutive Decree No. 36642-MP-MOPT-MINAET “Regulation of Specifications\nfor the Delimitation of the public zone of the Maritime Terrestrial Zone,” it is\nestablished according to Article 18 that for the delimitation of the public zone of\nthe Maritime Terrestrial Zone, the IGN may resort to the two execution\nmethodologies indicated in Articles 19 and 20, corresponding to the\ndelimitation of the public zone of the Maritime Terrestrial Zone through the\nplacement of boundary markers (mojones) and/or through digital georeferenced delimitation, this with\nthe purpose of streamlining delimitations and providing greater technical certainty to\ninterested parties.\n\n6°-That in the Executive Decree No.\n33797-MJ-MOPT, which among other aspects determines the National Geodetic\nNetwork of Horizontal Reference CR05, and its associated cartographic projection\nCRTM05, as the official system to which the coordinates of all geodetic,\ncartographic, and cadastral works executed in our country must be referenced,\nspecifically stating in Article 11 that: “The National\nGeodetic Network of Horizontal Reference CR05 and the cartographic projection system\nCRTM05, will constitute the sole official coordinate system for\nthe Republic of Costa Rica, from which all cartographic and geodetic\nsurveys and activities developed within the National Territory by any public\ndependency, person, or national or foreign private entity must be referenced...”;\nwhile Article 7 indicates that “As cartographic data are produced\nin the new cartographic projection system CRTM05, the National Geographic Institute\nwill publish by adequate means that information which has been officialized...”\n\n7°-That the\nMinistry of Public Works and Transport and the Cadastre\nand Registry Regularization Program (Law No. 8154, published in “La Gaceta,” number\n237 of December 10, 2001, Loan Agreement No 1284/OC-CR),\nsigned an Agreement effective December 18, 2009, whose\nmain objective was to formalize the support provided by the Executing Unit (UE)\nof the Cadastre and Registry Regularization Program (PRCR) to the National\nGeographic Institute to determine and georeference to the national coordinate\nsystem the position of: a) the ordinary high-tide line (línea de pleamar ordinaria) and consequently the\nline delimiting the public zone of the Maritime Terrestrial Zone (ZMT), and b)\nthe boundary markers (mojones) demarcating the public zone of the ZMT on the Pacific\ncoast of our country.\n\n8°-That\ngeoreferencing to the national coordinate system as a mechanism for\ndelimiting the public zone of the Maritime Terrestrial Zone enables the correct\ndelimitation of the public zone for the purposes of elaborating regulatory\nplans, approving surveying plans, granting concessions\nin the Restricted Zone, and other aspects of coastal land-use planning.\n\n9°-That the\ngeoreferenced digital information on delimitation of the public zone of\nthe Maritime Terrestrial Zone held by the IGN is called the Digital Georeferenced\nGeodatabase (GDG) of the National Geographic Institute (IGN) on the\nMaritime Terrestrial Zone (ZMT).\n\n10°-That the\nDigital Georeferenced Geodatabase (GDG) of the National Geographic\nInstitute (IGN) on the Maritime Terrestrial Zone (ZMT) is technically based on\nthe application of the regulations established by: a) Executive Decree No. 7841\n-P “Regulation to Law No. 6043 on the Maritime Terrestrial Zone,”\nb) Executive Decree No. 33797-MJ-MOPT declaring as official the National Geodetic\nNetwork of Horizontal Reference CR05, and its associated cartographic projection\nCRTM05, and c) Executive Decree No. 36642-MP-MOPT-MINAET\n“Regulation of Specifications for the Delimitation of the public zone of\nthe Maritime Terrestrial Zone.”\n\n11°-That Article\n140 of Law No. 6227 General Law of Public Administration indicates that “the\nadministrative act will produce its effect after being communicated to the administered party,\nexcept if it grants only rights, in which case it will produce it from when it is\nadopted,” a provision that must necessarily be related to\nsubsection 204) of the same normative body, which defines the suitable instrument\nfor communicating acts of a generic nature by stating that: “General acts will be communicated\nby publication and specific ones, by notification.”\n\nCOMMUNICATES:\n\nFirst.-The National\nGeographic Institute used, in canton 05 Carrillo - province of\nGuanacaste, the ‘Digital Georeferenced Delimitation’ methodology\nto delimit the public zone of the Maritime Terrestrial Zone in specific\ncoastal sectors, where, as of the date of signing of this Notice, there exists no\ndelimitation of the public zone through the placement of boundary markers (mojones)\nofficialized via the respective publication in the Official Gazette La Gaceta.\n\nArticle record\n\nSecond.- The public zone\nof the Maritime Terrestrial Zone of canton 05 Carrillo - province of\nGuanacaste, determined by the National Geographic Institute with\ndigital georeferenced delimitation, was carried out in 2010 and corresponds to\nthe coastal sectors whose extreme point coordinates are indicated\nbelow, both in the official cartographic
