A las quince horas y cuarenta y cinco minutos del seis de\njulio del dos mil doce.\n\n SE DICTA MEDIDA\nSANITARIA\n\n CONSIDERANDO:\n\nPrimero: Que de conformidad\ncon los artículos 1, 4, 6, de la Ley General del Servicio Nacional de Salud\nAnimal, número 8495 del 6 de abril del 2006, es competencia del Ministerio de\nAgricultura y Ganadería por medio del Servicio Nacional de Salud Animal\n(SENASA) regular y proteger la Salud Pública, la Salud Pública Veterinaria y el\nMedio Ambiente y por lo cual según dicha Ley, el SENASA tendrá entre otras las\nsiguientes competencias: administrar, planificar, dirigir y tomar medidas\npertinentes en todo el país, para cumplir con sus servicios, programas y\ncampañas, en materia de prevención, control y erradicación de plagas y\nenfermedades de los animales.\n\nSegundo: Que la Ley 8495\nantes citada declara de interés público la salud de los animales domésticos,\nsilvestres, acuáticos y cualesquiera otros, debiéndose interpretar dicha Ley en\nbeneficio de la salud humana, la salud animal y el ambiente e igualmente para\nla protección de cada uno de ellos y por lo que la jurisprudencia, la doctrina\ny los principios generales del Derecho, entre los cuales se encuentra el\nprincipio precautorio o de cautela, servirán para interpretar, integrar y\ndelimitar el campo de aplicación del ordenamiento escrito, y tendrán el rango\nde la norma que interpretan, integran o delimitan.\n\nTercero: Que la Stomoxys\ncalcitrans es una especie de mosca también conocida como mosca del\n\nestablo, la cual se alimenta de sangre\n(hematófaga), por lo que se le considera un parásito del ganado pero que sin\nembargo, se alimenta de todos los animales de sangre caliente incluido el ser\nhumano y la cual pone sus huevos en sustratos orgánicos en descomposición,\ntales como basura, rastrojos vegetales y detritos animales, en los cuales se\ndesarrolla para transformarse en larva, luego en pupa y finalmente en mosca\nadulta para volver a iniciar el ciclo de vida.\n\nCuarto: Que dicho díptero\nes común encontrarlo ligado a explotaciones ganaderas pero que sin embargo,\ncuando la cantidad de rastrojos, desechos, o residuos de origen animal y\nvegetal a su alcance es desmedido se propicia un exacerbo de la población,\nconvirtiéndose entonces en una plaga.\n\nQuinto: Que aunado a lo\nanterior y considerando que la mosca pica todo tipo de animales de sangre\ncaliente saludables o enfermos, puede volverse portadora de enfermedades con el\nconsiguiente riesgo para la Salud de las personas.  \n\nSexto: Que de conformidad\ncon informes de funcionarios del Servicio Fitosanitario del Estado (SFE) y de este\nServicio Nacional destacados en la Región Huetar Norte y que han venido\nrealizando acciones de monitoreo y control de las poblaciones de ese insecto,\nen los últimos días, con la entrada del invierno, la cantidad de moscas se ha\nexacerbado desmedidamente, en concreto el sector del Distrito de Cutris, Cantón\nde San Carlos, Provincia de Alajuela, se encuentra seriamente afectado por un\nbrote de Stomoxys calcitrans dada la presencia de grandes cantidades de\nrastrojos de piña, poniéndose en riesgo la salud de las personas y los\nanimales, especialmente el ganado de leche y engorde, lo cual ha producido a\neste Sector graves pérdidas económicas y por lo que esta Dirección General,\nconsidera con base en la información obtenida, que hoy en día la Stomoxys\ncalcitrans puede considerarse una plaga en el sector de Cutris y por lo que\nse vuelve imperioso tomar medidas paliativas para disminuir la carga del\nparásito en el ambiente y así bajar también el riesgo que representa el mismo\npara la salud de los humanos y las pérdidas que está ocasionando a los\nganaderos de la zona.\n\nSétimo: Que con base en los\nestudios y monitoreos del Servicio Fitosanitario del Estado (SFE) y del SENASA se\nha comprobado que los rastrojos de piña son de especial preferencia de la Stomoxys\ncalcitrans para ovopositar. Además, se ha comprobado que las malas\nprácticas agrícolas de dichos rastrojos han contribuido a la producción de esta\nplaga de mosca del establo por lo que resulta de especial urgencia eliminar\ndicho rastrojo y contener su generación por un plazo determinado, con el fin de\nbajar la población adulta en el medio ambiente.\n\nOctavo: Que con base en los\nanteriores considerandos, resulta imperioso ordenar una medida sanitaria de\nprohibición de derribo de plantaciones de piña por al menos 90 días en todas\nlas fincas piñeras ubicadas en el Distrito de Cutris, medida que no afectaría\nla siembra, la cosecha y otras prácticas que sean necesarias para el normal\ndesempeño de las fincas piñeras y por lo que entonces no se podrán derribar\nlotes nuevos para preparar nuevas siembras hasta tanto no transcurra dicho\nplazo y con ello baje la población de mosca adulta en el ambiente. Asimismo\ndichas fincas productoras de piña deberán continuar aplicando insecticidas,\ninhibidores de crecimiento en aquellas áreas ya derribadas o en preparación y\nponiendo trampas tanto dentro de sus fincas como en las fincas de los ganaderos\nvecinos y facilitando a éstos, productos como repelentes e insecticidas que\nsirvan para repeler y controlar la mosca adulta que ya se encuentra en el\nambiente.\n\nPor su parte, los otros finqueros en\ngeneral deberán maximizar las medidas de limpieza de sus establecimientos\nespecialmente las lecherías, porquerizas, estabulados y otros a fin de evitar\nmateria orgánica que permita la reproducción de la mosca.\n\nNoveno: Que conforme a\ndirectrices e instrucciones especificas dictadas por la señora Ministra de\nAgricultura y Ganadería , las autoridades del Servicio Fitosanitario del\nEstado, (SFE), la Dirección\nRegional Huetar Norte de la Dirección Superior de Operaciones Regionales y\nExtensión Agropecuaria de (DSOREA), el Programa Nacional de Piña y el Instituto\nNacional de Innovación y Transferencia de Tecnología Agropecuaria (INTA) y este Servicio\nNacional se encuentran desarrollando acciones conjuntas para atender la\nproblemática antes indicada.\n\nPor tanto,  \n\nEL DIRECTOR GENERAL\n\nDEL SERVICIO NACIONAL DE SALUD ANIMAL\n\nRESUELVE:\n\nPrimero: Ordenar, como medida sanitaria de\ncarácter general y obligatoria, la prohibición, en todas las fincas piñeras\nubicadas en el Distrito de Cutris, Cantón de San Carlos, Provincia de Alajuela,\nde realizar nuevos derribos de plantaciones de piña por al menos 90 días, a\npartir de la fecha que se dirá en la presente resolución, medida ésta que no\nafectará el desarrollo de otras prácticas culturales en la producción piñera\ntales como siembra y cosecha que son necesarias para el normal desempeño de\ndichas fincas. NATIONAL ANIMAL HEALTH SERVICE. At three forty-five in the afternoon on the sixth of\nJuly, two thousand twelve.\n\n A SANITARY MEASURE\n IS ISSUED\n\n CONSIDERING:\n\nFirst: That in accordance\nwith articles 1, 4, 6, of the General Law of the National Animal Health Service,\nnumber 8495 of April 6, 2006, it is the competence of the Ministry of\nAgriculture and Livestock through the National Animal Health Service\n(SENASA) to regulate and protect Public Health, Veterinary Public Health, and the\nEnvironment, and therefore according to said Law, SENASA shall have, among others, the\nfollowing competencies: to administer, plan, direct, and take pertinent\nmeasures throughout the country to fulfill its services, programs, and\ncampaigns regarding the prevention, control, and eradication of animal pests and\ndiseases.\n\nSecond: That the aforementioned Law 8495\ndeclares the health of domestic, wild, aquatic, and any other animals to be of public interest,\nsaid Law being interpreted for the benefit of human health, animal health, and the environment, and likewise for the protection of each of them, and therefore jurisprudence, doctrine, and the general principles of Law, among which is found the precautionary principle (principio precautorio) or principle of caution, shall serve to interpret, integrate, and delimit the field of application of the written legal order, and shall have the rank of the norm they interpret, integrate, or delimit.\n\nThird: That Stomoxys\ncalcitrans is a species of fly also known as the stable\n\nfly, which feeds on blood\n(hematophagous), and is therefore considered a livestock parasite; however, it feeds on all warm-blooded animals, including humans, and it lays its eggs in decomposing organic substrates,\nsuch as garbage, plant residue (rastrojos), and animal detritus, in which it\ndevelops to transform into a larva, then into a pupa, and finally into an adult\nfly to begin the life cycle again.\n\nFourth: That this dipteran\nis commonly found linked to livestock operations; however,\nwhen the amount of plant residue (rastrojos), waste, or residues of animal and\nvegetable origin within its reach is excessive, an exacerbation of the population is fostered,\nthereby becoming a pest (plaga).\n\nFifth: That in addition to\nthe foregoing, and considering that the fly bites all types of warm-blooded animals, whether healthy or sick, it can become a carrier of diseases, with the\nconsequent risk to human health.\n\nSixth: That in accordance\nwith reports from officials of the State Phytosanitary Service (SFE) and of this\nNational Service stationed in the Huetar Norte Region, who have been\ncarrying out monitoring and control actions for the populations of that insect,\nin recent days, with the arrival of the rainy season, the quantity of flies has\nbecome excessively exacerbated; specifically, the sector of the District of Cutris, Canton\nof San Carlos, Province of Alajuela, is seriously affected by an\noutbreak of Stomoxys calcitrans given the presence of large quantities of\npineapple residue (rastrojos), posing a risk to the health of people and\nanimals, especially dairy and beef cattle, which has caused this\nSector serious economic losses; and therefore this General Directorate\nconsiders, based on the information obtained, that today Stomoxys\ncalcitrans can be considered a pest (plaga) in the sector of Cutris, and therefore\nit becomes imperative to take palliative measures to reduce the parasite load\nin the environment and thus also reduce the risk it represents\nto human health, and the losses it is causing to the\nlivestock farmers of the area.\n\nSeventh: That based on the\nstudies and monitoring of the State Phytosanitary Service (SFE) and of SENASA, it\nhas been proven that pineapple residue (rastrojos) is especially preferred by Stomoxys\ncalcitrans for oviposition. Furthermore, it has been proven that poor\nagricultural practices regarding said residue have contributed to the production of this\nstable fly pest (plaga), which makes it especially urgent to eliminate\nsaid residue and contain its generation for a determined period, in order to\nreduce the adult population in the environment.\n\nEighth: That based on the\nforegoing considerations, it becomes imperative to order a sanitary measure\nprohibiting the knockdown (derribo) of pineapple plantations for at least 90 days on all\npineapple farms (fincas piñeras) located in the District of Cutris, a measure that would not affect\nplanting, harvesting, and other practices necessary for the normal\nperformance of the pineapple farms, and therefore it will not be possible to knock down (derribar)\nnew lots to prepare new plantings until said\nperiod has elapsed and the population of adult flies in the environment decreases. Likewise,\nsaid pineapple-producing farms must continue applying insecticides and\ngrowth inhibitors in those areas already knocked down (derribadas) or under preparation, and\nsetting traps both within their farms and on neighboring livestock farms,\nand providing the latter with products such as repellents and insecticides that\nserve to repel and control the adult flies already present in the\nenvironment.\n\nFor their part, other farm operators in\ngeneral must maximize the cleaning measures in their establishments,\nespecially dairies, pigsties, stables, and others, in order to avoid\norganic matter that allows the reproduction of the fly.\n\nNinth: That in accordance with\ndirectives and specific instructions issued by the Minister of\nAgriculture and Livestock, the authorities of the State Phytosanitary\nService (SFE), the Huetar Norte Regional Directorate of the Senior Directorate of Regional Operations and\nAgricultural Extension (DSOREA), the National Pineapple Program, and the National\nInstitute of Innovation and Transfer of Agricultural Technology (INTA), and this National\nService are carrying out joint actions to address the\nproblem indicated above.\n\nTherefore,\n\nTHE GENERAL DIRECTOR\n\nOF THE NATIONAL ANIMAL HEALTH SERVICE\n\nRESOLVES:\n\nFirst: To order, as a general and mandatory sanitary measure,\nthe prohibition, on all pineapple farms (fincas piñeras)\nlocated in the District of Cutris, Canton of San Carlos, Province of Alajuela,\nagainst carrying out new knockdowns (derribos) of pineapple plantations for at least 90 days, starting\nfrom the date stated in this resolution, a measure that\nwill not affect the development of other cultural practices in pineapple production,\nsuch as planting and harvesting, which are necessary for the normal performance of\nsaid farms. Due to the foregoing, new lots cannot be knocked down (derribar) to prepare\nnew plantings until said period has elapsed and consequently the\npopulation of adult Stomoxys calcitrans flies in the environment decreases.\n\nLikewise, said pineapple-producing farms\nmust continue applying insecticides and\ngrowth inhibitors in those areas already knocked down (derribadas) or under preparation, and\nsetting traps both within their farms and on neighboring livestock farms,\nand providing the latter with products such as repellents and insecticides that\nserve to repel and control the adult flies already present in the\nenvironment.\n\nSecond: Other farm operators in\ngeneral must maximize cleaning measures in their establishments,\nespecially dairies, pigsties, stables, and others, in order to\ncontrol and prevent the presence of organic matter in their establishments that\nserves as a substrate for the reproduction of the stable fly.\n\nThird: To order the Huetar Norte Regional Directorate of this National Service to implement the actions necessary to ensure that the pineapple farms located in the District of Cutris comply with the prohibition established above, for which purpose it must issue the particular ordinances to each of the farms located there, and for which it may request the necessary aid and collaboration from any authority.\n\nFurthermore, said Directorate must make the necessary provisions so that the remaining farm operators maximize the control measures for Stomoxys calcitrans in their establishments.\n\nFourth: This resolution takes effect as of July 9, 2012. Notify for their knowledge the Minister of Agriculture and Livestock and the General Directorates of the State Phytosanitary Service (SFE), the Huetar Norte Regional Directorate of the Senior Directorate of Regional Operations and Agricultural Extension (DSOREA), the National Pineapple Program, and the National Institute of Innovation and Transfer of Agricultural Technology (INTA).
