PRESIDENTA DE LA REPÚBLICA\n\nY\n\nEL MINISTRO DE RELACIONES EXTERIORES Y CULTO\n\nEn uso de las facultades que les confiere el artículo 140 y 146 de la\nConstitución Política y los artículos 27, inciso 1) y 28 incisos 1 y 2.b de la\nLey General de Administración Pública.\n\nConsiderando:\n\n1. Que el Decreto Ejecutivo Nº 36440-MP de fecha 21 de febrero del 2012,\nmediante el cual se \"Declara Estado de Emergencia la situación y el proceso\ndesencadenado ante la violación de la soberanía costarricense por parte de\nNicaragua\", establece en su artículo 3 la posibilidad de llevar a cabo todas\nlas acciones y obras necesarias para la protección de la vida, la integridad\nfísica, los bienes y el ambiente que se ubiquen dentro de la zona de cobertura\n(cantones, limítrofes con Nicaragua, de la Cruz, Upala, Los Chiles, Sarapiquí, San\nCarlos y Pococí)\n\n2. Que el Decreto Ejecutivo Nº 36427-MINAET de fecha 25 de enero del 2011,\nmediante el cual se \"Crea el Programa Nacional de Humedales y Comité Nacional\nde Humedales como Órgano Implementador de la Convención de Ramsar dentro del\nSistema Nacional de Áreas de Conservación y deroga Decretos Ejecutivos Nº 22839\ndel 22/01/1994 y Nº 28058 del 23/07/1999\", primeramente establece en su\nartículo 4 que el Comité Nacional sobre Humedales, tiene como funciones apoyar\nal SINAC en la inclusión y exclusión de Humedales en la lista de la Convención\nde Ramsar, donde sus recursos corran peligro de cambio o desaparición, para\naplicación del Registro de Montreux y el Procedimiento de Orientación para la\nGestión, según lo establecido en la Convención de Ramsar, así como dar\nseguimiento a la aplicación de las Resoluciones y Recomendaciones adoptadas por\nla Conferencia de las Partes Contratantes de la Convención de Ramsar. Por otra\nparte su numeral 5 establece que quedan autorizados los Ministerios e\nInstituciones del Estado, con facultades para ello, a colaborar con recursos\ntécnicos, administrativos y financieros con el Programa Nacional de Humedales.\n\n3. Que Costa Rica ha realizado algunas obras de infraestructura en el\nHumedal Caribe Noreste en aplicación de las medidas provisionales indicadas por\nla Corte Internacional, entre ellas la construcción de puestos para el personal\ndel Ministerio de Seguridad Pública y del Ministerio de Ambiente, Energía y\nTelecomunicaciones, así como la construcción de torres de vigilancia. Estas\nobras fueron oportunamente informadas a la Secretaría de la Convención, y se le\ninvitó a visitar el sitio para que las verificaran.\n\n4. Que el Ministro de Relaciones Exteriores y Culto recibió una nota del\nSecretario General de la Convención de Ramsar, con fecha de 19 de diciembre de\n2011, indicando que había recibido una denuncia de parte de Nicaragua en el\nsentido de que la construcción de la Ruta 1856 Juan Rafael Mora Porras estaba\ncausando daño al Humedal Caribe Noreste y a su biodiversidad. Costa Rica\nrespondió a esta nota en enero de 2012, rechazando la acusación nicaragüense y,\ncomo gesto de transparencia, invita a que la Secretaría designe un equipo\ntécnico que pueda venir a Costa Rica para verificar la situación del humedal. Esta\ninvitación se reiteró mediante otra nota posterior de febrero de 2012.\n\n5. Que a mediados de junio de 2012 la Cancillería recibió una nota de la\nSecretaría de Ramsar indicando su interés en visitar Costa Rica para verificar\ntanto la construcción de la Ruta 1856 Juan Rafael Mora Porras, como las obras\nque se realizan en el Humedal Caribe Noreste. No obstante, la Secretaría hace\nver que dado que \"estamos cerrando el trienio, en esta oportunidad los costos\nde la misión tendrían que ser asumidos por el Gobierno de Costa Rica\".\n\n6. That Executive Decree Nº 36440-MP dated February 21, 2012,\nby which the \"situation and process triggered by the violation of Costa Rican sovereignty by\nNicaragua is declared a State of Emergency,\" establishes in its article 3 the possibility of carrying out\nall actions and works necessary for the protection of life, physical\nintegrity, property, and the environment located within the coverage area\n(cantons bordering Nicaragua: La Cruz, Upala, Los Chiles, Sarapiquí, San\nCarlos, and Pococí).\n\n2. That Executive Decree Nº 36427-MINAET dated January 25, 2011,\nby which the \"National Wetlands Program and National Wetlands Committee\nare created as the Implementing Body of the Ramsar Convention within the\nNational System of Conservation Areas and Executive Decrees Nº 22839\nof 01/22/1994 and Nº 28058 of 07/23/1999 are repealed,\" first establishes in its\narticle 4 that the National Wetlands Committee has the functions of supporting\nSINAC in the inclusion and exclusion of Wetlands on the list of the Ramsar\nConvention, where their resources are in danger of change or disappearance, for\napplication of the Montreux Record and the Management Guidance Procedure,\nas established in the Ramsar Convention, as well as monitoring\nthe application of Resolutions and Recommendations adopted by\nthe Conference of the Contracting Parties of the Ramsar Convention. Furthermore,\nits provision 5 establishes that the Ministries and\nState Institutions, with authority to do so, are authorized to collaborate with\ntechnical, administrative, and financial resources with the National Wetlands Program.\n\n3. That Costa Rica has carried out some infrastructure works in the\nNortheast Caribbean Wetland in application of the provisional measures indicated by\nthe International Court of Justice, including the construction of posts for personnel\nof the Ministry of Public Security and the Ministry of Environment, Energy, and\nTelecommunications, as well as the construction of watchtowers. These\nworks were duly reported to the Secretariat of the Convention, and it was\ninvited to visit the site to verify them.\n\n4. That the Minister of Foreign Affairs and Worship received a note from the\nSecretary General of the Ramsar Convention, dated December 19, 2011,\nindicating that he had received a complaint from Nicaragua to the\neffect that the construction of the 1856 Juan Rafael Mora Porras Route was\ncausing damage to the Northeast Caribbean Wetland and its biodiversity. Costa Rica\nresponded to this note in January 2012, rejecting the Nicaraguan accusation and,\nas a gesture of transparency, inviting the Secretariat to designate a technical\nteam that could come to Costa Rica to verify the situation of the wetland. This\ninvitation was reiterated through another subsequent note in February 2012.\n\n5. That in mid-June 2012, the Foreign Ministry received a note from the\nRamsar Secretariat indicating its interest in visiting Costa Rica to verify\nboth the construction of the 1856 Juan Rafael Mora Porras Route and the works\nbeing carried out in the Northeast Caribbean Wetland. However, the Secretariat points\nout that given that \"we are closing the triennium, on this occasion the costs\nof the mission would have to be borne by the Government of Costa Rica.\"\n\n6.
