  "body_es_text": "en la totalidad del texto\n\n                    -\n\n                        Texto Completo Norma 244\n\n                        Reforma Regulaciones temporales para la realización de servicios de trabajo\ncomunal por parte de los pescadores y ayudantes beneficiarios de subsidios durante los periodos de\nveda\n\nTexto Completo acta: 116AC7\n\nINSTITUTO COSTARRICENSE DE PESCA\n\nY ACUICULTURA\n\n(Esta norma fue\nderogada por el artículo 14 del acuerdo N° AJDIP/166-2017 del 21 de abril del\n2017, \"Regulación para el cumplimiento del servicio de trabajo comunal por\nparte del pescador inscrito en veda\")\n\nA.J.D.I.P./244-2012.-Puntarenas, a los veinticinco\ndías del mes de mayo del dos mil doce.\n\nConsiderando:\n\n1º-Que al amparo del artículo 34 de\nla Ley de Pesca y Acuicultura,\nLey Nº 8436 del 1º de marzo del 2005, el INCOPESCA tiene la atribución y\ncompetencia de establecer conforme a criterios técnicos, científicos,\neconómicos y sociales, las zonas o épocas de veda, sea por áreas, artes de\npesca o por especies determinadas.\n\n2º-Que el Poder\nEjecutivo de conformidad con el artículo 36 de la ley supra citada, podrá\nautorizar el destino de fondos del Presupuesto Nacional a favor de INCOPESCA\npara la realización de los estudios sobre vedas, y a favor del Instituto Mixto\nde Ayuda Social (IMAS), con el propósito de desarrollar programas de asistencia\nsocioeconómica diseñados especialmente con tal propósito, a favor de los\npescadores que se vean afectados en los períodos de veda.\n\n3º-Que dichos\nprogramas de asistencia socioeconómica por parte del IMAS conllevan\nnecesariamente la realización de un Servicio de Trabajo Comunal por parte de\nlos beneficiarios.\n\n4º-Que con el fin de\nregular dicho Servicio el INCOPESCA emitió las Regulaciones Temporales para\nla Realización de\nServicios de Trabajo Comunal por parte de los Pescadores y Ayudantes\nBeneficiarios de Subsidios durante los Períodos de Veda, mediante el acuerdo Nº\nA.J.D.I.P./417-2005, publicado en el Diario Oficial\nLa Gaceta Nº 172 del\n7 de setiembre del 2005 y desde entonces esa actividad ha venido operando bajo\nlas regulaciones establecidas en esa normativa.\n\n5º-Que de conformidad\ncon los resultados y experiencias obtenidas en la realización y supervisión de\nese trabajo, por parte de los funcionarios del Departamento de Extensión y\nCapacitación del INCOPESCA y del IMAS, se ha considerado oportuno y conveniente\nmodificar algunas de las regulaciones del acuerdo supra citado, en aras de\nmejorar ese Servicio en el cumplimiento de los objetivos que éste conlleva en\nbeneficio de las comunidades pesqueras y otros entes públicos y privados. Por\ntanto,\n\nLA JUNTA DIRECTIVA DEL\nINSTITUTO COSTARRICENSE\n\nDE PESCA Y\nACUICULTURA, ACUERDA:\n\nArtículo 1º-Modificar los artículos 3º y 4º del\nacuerdo Nº A.J.D.I.P./417-2005, publicado en el Diario Oficial\nLa Gaceta Nº 172 del\n7 de setiembre del 2005, para que en lo sucesivo se lean de la siguiente manera:\n\n           \n\"Artículo 3º-Todo pescador beneficiario deberá de cumplir durante el período de\nlas vedas establecidas por el INCOPESCA, un Servicio de Trabajo Comunal, en\nadelante STC, que consistirá en un mínimo de 30 horas ponderadas por mes y para\nlo cual las Organizaciones y diferentes entes beneficiarios, deberán de aportar\nlos bienes recursos, materiales, equipos y cualquier otro apoyo logístico\nnecesario para la realización de las obras o actividades en cumplimiento del\nmismo.\n\nDentro de un plazo prudencial\nprevio al inicio de los períodos de vedas establecidos, las Organizaciones y\ndiferentes entes beneficiarios, deberán presentar para conocimiento del\nINCOPESCA y del IMAS, sus propuestas y actividades de STC en cada una de las\ncomunidades pesqueras.\n\nTanto para la\npresentación de sus propuestas como para el control, registro y reporte\nindividual de las diferentes actividades y horas ponderadas realizadas por cada\npescador, deberán de utilizarse los formularios establecidos para esos efectos.\n\nUna vez que las\nautoridades competentes del INCOPESCA y/o el IMAS, hayan analizado las\ndiferentes propuestas presentadas, comunicarán de manera oportuna a las\nOrganizaciones y diferentes entes beneficiarios, la respectiva autorización\npara que puedan iniciarse las actividades del STC en cada comunidad pesquera,\nlas cuales serán supervisadas en cualquier momento de forma conjunta y\ncoordinada, por las autoridades competentes del INCOPESCA y el IMAS, conforme a\nla disponibilidad de recurso humano y presupuestario en cada una de esas\ninstituciones.\n\nDados los plazos\nadministrativos requeridos por las autoridades competentes del INCOPESCA y el\nIMAS para realizar los procesos de supervisión y control sobre el cumplimiento\ndel STC por parte de los pescadores, así como la realización de los trámites\npara la formulación, emisión y entrega de las ayudas económicas otorgadas por\nel IMAS, será permitido que las actividades del STC puedan iniciarse 7 días\ncalendario antes del inicio de los períodos de veda.\n\nCumplidas las actividades\ny el total de horas ponderadas por mes por parte del pescador para un\ndeterminado mes calendario, se permitirá reconocer y sumar como válidas para el\nmes calendario posterior, aquellas otras actividades y horas ponderadas que se\nrealicen, siempre y cuando hayan dado inicio también 7 días calendario antes\ndel inicio del mes calendario correspondiente.\n\nConforme a sus\ncompetencias las autoridades del INCOPESCA y/o el IMAS, podrán establecer actividades\nde participación obligatoria para los pescadores, especialmente aquellas\norientadas a la capacitación.\"\n\n \"Artículo 4º-Para los efectos de lo indicado\nen el artículo anterior, los pescadores de las comunidades pesqueras en las\náreas definidas en la veda,   "body_en_text": "in the entirety of the text\n\n                    -\n\n                        Full Text of Regulation 244\n\n                        Amendment to the Temporary Regulations for the Performance of Community Work\nService by Fishermen and Assistants Who Are Beneficiaries of Subsidies During Closed\nSeasons\n\nFull Text of proceeding: 116AC7\n\nCOSTA RICAN INSTITUTE OF FISHERIES\n\nAND AQUACULTURE\n\n(This regulation was\nrepealed by Article 14 of Agreement No. AJDIP/166-2017 of April 21,\n2017, \"Regulation for the Fulfillment of Community Work Service by\nFishermen Registered During Closed Season\")\n\nA.J.D.I.P./244-2012.-Puntarenas, on the twenty-fifth\nday of May, two thousand twelve.\n\nConsidering:\n\n1º-That under Article 34 of\nthe Fisheries and Aquaculture Law,\nLaw No. 8436 of March 1, 2005, INCOPESCA has the authority and\ncompetence to establish, according to technical, scientific,\neconomic, and social criteria, the zones or periods of closed season (veda), whether by areas, fishing gear,\nor specific species.\n\n2º-That the Executive\nBranch, pursuant to Article 36 of the aforementioned law, may\nauthorize the allocation of funds from the National Budget in favor of INCOPESCA\nfor conducting studies on closed seasons (vedas), and in favor of the Joint Institute for\nSocial Aid (IMAS), for the purpose of developing socioeconomic assistance\nprograms specifically designed for such purpose, in favor of\nfishermen affected during closed season periods (períodos de veda).\n\n3º-That said\nsocioeconomic assistance programs by IMAS necessarily\nentail the performance of a Community Work Service (Servicio de Trabajo Comunal) by\nthe beneficiaries.\n\n4º-That in order to\nregulate said Service, INCOPESCA issued the Temporary Regulations for\nthe Performance of\nCommunity Work Services by Fishermen and Assistants Who Are Beneficiaries of Subsidies During Closed\nSeason Periods, through Agreement No.\nA.J.D.I.P./417-2005, published in the Official Gazette\nLa Gaceta No. 172 of\nSeptember 7, 2005, and since then this activity has been operating under\nthe regulations established in that provision.\n\n5º-That in accordance\nwith the results and experiences obtained in the performance and supervision of\nthis work, by the officials of the Department of Extension and\nTraining of INCOPESCA and of IMAS, it has been deemed timely and convenient\nto modify some of the regulations of the aforementioned agreement, in order to\nimprove this Service in meeting the objectives it entails for the\nbenefit of the fishing communities (comunidades pesqueras) and other public and private entities. Therefore,\n\nTHE BOARD OF DIRECTORS OF THE\nCOSTA RICAN INSTITUTE\n\nOF FISHERIES AND\nAQUACULTURE, AGREES:\n\nArticle 1º-To amend Articles 3º and 4º of\nAgreement No. A.J.D.I.P./417-2005, published in the Official Gazette\nLa Gaceta No. 172 of\nSeptember 7, 2005, so that henceforth they shall read as follows:\n\n           \n\"Article 3º-Every beneficiary fisherman must perform, during the period of\nthe closed seasons (vedas) established by INCOPESCA, a Community Work Service (Servicio de Trabajo Comunal),\nhereinafter STC, which shall consist of a minimum of 30 weighted hours per month, for\nwhich the Organizations and different beneficiary entities must provide\nthe goods, resources, materials, equipment, and any other logistical support\nnecessary for carrying out the works or activities in fulfillment of\nthe same.\n\nWithin a reasonable period\nprior to the start of the established closed season periods (períodos de vedas), the Organizations and\ndifferent beneficiary entities must submit, for the knowledge of\nINCOPESCA and IMAS, their proposals and STC activities in each of the\nfishing communities (comunidades pesqueras).\n\nBoth for the\nsubmission of their proposals and for the control, registration, and individual\nreporting of the different activities and weighted hours performed by each\nfisherman, the forms established for these purposes must be used.\n\nOnce the\ncompetent authorities of INCOPESCA and/or IMAS have analyzed the\ndifferent proposals submitted, they shall timely communicate to the\nOrganizations and different beneficiary entities the respective authorization\nso that the STC activities may begin in each fishing community (comunidad pesquera),\nwhich shall be supervised at any time jointly and\ncoordinately, by the competent authorities of INCOPESCA and IMAS, according to\nthe availability of human and budgetary resources in each of those\ninstitutions.\n\nGiven the\nadministrative deadlines required by the competent authorities of INCOPESCA and\nIMAS to carry out the supervision and control processes regarding the fulfillment\nof the STC by the fishermen, as well as the completion of the procedures\nfor the formulation, issuance, and delivery of the economic aid granted by\nIMAS, it shall be permitted that the STC activities may begin 7 calendar\ndays before the start of the closed season periods (períodos de veda).\n\nOnce the activities\nand the total weighted hours for a\ngiven calendar month have been completed by the fisherman, it shall be permitted to recognize and count as valid for the\nsubsequent calendar month those other activities and weighted hours that are\nperformed, provided they also began 7 calendar days before\nthe start of the corresponding calendar month.\n\nAccording to their\ncompetencies, the authorities of INCOPESCA and/or IMAS may establish mandatory participation\nactivities for fishermen, especially those\noriented toward training.\"\n\n \"Article 4º-For the purposes of what is indicated\nin the preceding article, the fishermen of the fishing communities (comunidades pesqueras) in the\nareas defined in the closed
