setiembre de\n2023)\n\nDIRECTRIZ\nSENASA-DG-D007-2012\n\nConsiderando:\n\n1º-Que el Protocolo de Cartagena sobre Seguridad de\nla Biotecnología,\nratificado y aprobado mediante la\n Ley N° 8537, publicada en\nLa Gaceta N° 227 del 27\nde noviembre del 2006, tiene como objetivo \ncontribuir a garantizar un nivel adecuado de protección en la esfera de\nla transferencia, manipulación y utilización seguras de los organismos vivos\nmodificados resultantes de la biotecnología moderna que puedan tener efectos\nadversos para la conservación y la utilización sostenible de la diversidad\nbiológica, teniendo también en cuenta los riesgos para la salud humana, y\ncentrándose concretamente en los movimientos transfronterizos.\n\n2º-Que\nla Ley General del Servicio\nde Salud Animal, N° 8495 de 6 de abril 2006, en su artículo 5 establece al\nServicio Nacional de Salud Animal (SENASA) como el órgano competente encargado\nde reglamentar, planificar, administrar, coordinar, ejecutar y aplicar\nactividades de carácter nacional, regional e internacional, relativas a la\nsalud de la población animal, control veterinario de zoonosis, la protección y\nla seguridad de los alimentos de origen animal, los alimentos para los\nanimales, el material genético animal, los productos y subproductos, la\nproducción, el uso, la liberación o la comercialización de los Organismos\nGenéticamente Modificados (OGM).\n\n3º-Que además el inciso h)\ndel artículo 6 de la Ley N°\n8495, establece entre las competencias del SENASA establecer y ejecutar las medidas\nnecesarias sobre la producción o la comercialización de OGM que sean animales,\nsus productos y subproductos de origen animal, los agentes de control biológico\nu otros que puedan representar cualquier tipo de Publíquese\nigualmente en la página Web del SENASA.\n\nDado en Heredia a las ocho horas y treinta minutos del\nveintiocho de agosto de dos mil doce.-", "body_en_text": "in the entirety of the text\n\n -\n\n Full Text of Regulation 007\n\n Creates the Internal Biosafety Commission (Comisión Interna de Bioseguridad, CIBio)\n\nFull Text of Act: 160B7A\n\nSERVICIO NACIONAL\nDE SALUD ANIMAL\n\n(This regulation was repealed by Article 1 of Directive No. SENASA-DG-D0031-2023 of September 11, 2023)\n\nDIRECTIVE\nSENASA-DG-D007-2012\n\nConsidering:\n\n1º—That the Cartagena Protocol on Biosafety, ratified and approved by Law 8537, published in La Gaceta No. 227 of November 27, 2006, has the objective of contributing to ensuring an adequate level of protection in the field of the safe transfer, handling, and use of living modified organisms resulting from modern biotechnology that may have adverse effects on the conservation and sustainable use of biological diversity, also taking into account risks to human health, and specifically focusing on transboundary movements.\n\n2º—That the General Law of the Animal Health Service, No. 8495 of April 6, 2006, in its Article 5, establishes the National Animal Health Service (Servicio Nacional de Salud Animal, SENASA) as the competent body responsible for regulating, planning, administering, coordinating, executing, and applying activities of a national, regional, and international nature, relating to animal population health, veterinary control of zoonoses, protection and safety of food of animal origin, animal feed, animal genetic material, products and by-products, and the production, use, release, or commercialization of Genetically Modified Organisms (GMOs).\n\n3º—That, in addition, subsection h) of Article 6 of Law No. 8495 establishes among the competencies of SENASA to establish and execute the necessary measures regarding the production or commercialization of GMOs that are animals, their products and by-products of animal origin, biological control agents, or others that may represent any type of unacceptable risk to the environment, human health, animal health, or the surrounding biological environment.\n\n4º—That to develop the competencies attributed to SENASA in relation to GMOs, it is necessary to create an internal body to oversee the matter and thereby advise the Office of the Director General (Dirección General) for the purpose of complying with the legal mandate established in the aforementioned Law No. 8495. Therefore,\n\nTHE DIRECTOR GENERAL\n\nOF THE NATIONAL\nANIMAL HEALTH SERVICE\n\nOF THE MINISTRY OF\nAGRICULTURE AND LIVESTOCK\n\nIssues the following Directive:\n\nArticle 1—To create the Internal Biosafety Commission (Comisión Interna de Bioseguridad, CIBio), which shall have among its functions reviewing and evaluating the information provided by individuals or legal entities that request to import, export, research, multiply, mobilize, or release into the environment Genetically Modified Organisms (GMOs) of animal origin and/or intended for direct use as human or animal food or for processing, GMOs used as biological control agents, or any other GMOs applied to animals.\n\nArticle 2—The CIBio shall be responsible for issuing technical recommendations to the Coordinator of the National Animal Biotechnology Program regarding the aforementioned information, to facilitate the adoption of a decision by the Office of the Director General on the production, use, release, research, commercialization, or any other activity with GMOs of animal origin, GMOs intended for direct use as human or animal food or for processing, GMOs used as biological control agents, or any other GMOs applied to animals.\n\nArticle 3—The CIBio shall advise the National Animal Biotechnology Program on procedures, techniques, scientific methods, legislation, policies, strategies, and other aspects related to the biosafety of GMOs of animal origin, GMOs intended for direct use as human or animal food or for processing, GMOs used as biological control agents, or any other GMOs applied to animals.\n\nArticle 4—Said Commission shall be appointed by the Office of the Director General of SENASA and shall be composed of:\n\na) Two officials representing the Office of the Director General.\n\nb) Three officials representing the National Laboratory of Veterinary Services (Laboratorio Nacional de Servicios Veterinarios, LANASEVE).\n\nc) One representative of the National Aquatic Health Program.\n\nd) One representative of the Animal Quarantine Directorate.\n\nThe Office of the Director General shall appoint the Coordinator of the Internal Biosafety Commission (Comisión Interna de Bioseguridad, CIBio).\n\nArticle 5—It shall take effect upon its publication in the Official Gazette La Gaceta.
