Asimismo, incorpora el derecho de toda persona\na un ambiente sano y ecológicamente equilibrado.\n\nIII.-Que corresponde al INCOPESCA como\nInstitución Rectora del sector pesquero y acuícola de nuestro país, establecer\nmedidas de ordenamiento para el aprovechamiento sostenible de los recursos hidrobiológicos,\nque permitan proteger áreas de reproducción, reclutamiento y de alimentación,\nque favorezcan el incremento de las especies y el aumento de su biomasa, de\nmanera que se garantice su sostenibilidad en provecho de los ecosistemas y de\nlos pescadores.\n\nIV.-Que de acuerdo al Código de Conducta para\nla Pesca Responsable, Decreto Ejecutivo Nº 27919-MAG reconoce en su Artículo 6,\nla importante contribución de la pesca artesanal en pequeña escala a la\ngeneración de empleo, ingresos y seguridad alimentaria. De ahí la necesidad de\nque el Estado garantice apropiadamente el derecho de los pescadores y\npescadoras, adoptando medidas de regulación que favorezcan el aprovechamiento\nde los recursos pesqueros en las aguas de jurisdicción nacional.\n\nV.-Que desde el año 1995, la junta directiva\ndel INCOPESCA emitió un acuerdo donde acogieron el proyecto de la comunidad de\nPalito de Chira, apoyados en fundamentos científicos de académicos de\ndiferentes instituciones para reservar un área marina de arrecifes y donde se\ndan altos niveles de reproducción de peces prohibiéndose todo tipo de arte de\npesca salvo la pesca con cuerda de mano.\n\nVI.-Que la Isla Caballo tiene una extensión\nterritorial de 3.7\n kilómetros cuadrados, se encuentra localizada en el\nGolfo de Nicoya. Habitada por pobladores locales quienes han ocupado la zona\npública. El 80% (zona concesionable)  fue\nvendida por los lugareños al señor James Zeller. El ICT elaboró un plan\nregulador parcial, éste promueve el desarrollo hotelero en el 42% de la isla.\nIsla Caballo se encuentra ubicada en el Golfo de Nicoya, abarca aproximadamente\n150 hectáreas\ny habitan en ella unas 30 familias integradas por más de 200 personas, de las\ncuales muchas viven en casas sencillas. Se llega por medio de botes que tardan\naproximadamente 30 minutos desde Puntarenas.\n\nVII.-Que el área de pesca I. Caballo está\nubicada en la zona 202 del Golfo de Nicoya y esta es la primera propuesta de\nÁrea Marina de Pesca Responsable que se tiene en esa zona, que es precisamente\nla parte intermedia de ese Golfo. Las AMPR creadas hasta el momento están en la\nzona 203 (Tárcoles) y en la 201 (Palito-Montero, además de que existen varias\npropuestas más como Níspero e I. Venado). Para conocer las clases comerciales y\nlas especies que se capturan en esa área de pesca, se analizaron 132 muestreos\nbiológicos realizados en el año 2006 por el Dpto. de Investigación y\nDesarrollo, para un total de 676 kilogramos de productos pesqueros\nmuestreados, la cual fue la información biológica más accesible que se\ntuvo.  La clase comercial más importante\ncapturada en I. Caballo fue la primera pequeña (tabla 1), la cual comprende\n67.9% de las mismas, pero también se pescaron otras clases como la Primera\ngrande, clase, chatarra y otros.  La\nprimera pequeña y la primera grande son las clases comerciales que comprenden\nlas especies de mayor interés comercial como las corvinas y róbalos.\n\nVIII.-Que con el establecimiento de ésta Área\nMarina, se pretende dentro de los fines y objetivos; determinar y desarrollar:\n\n- Apoyar a los pescadores artesanales para que\nsu actividad sea sostenible, \neconómicamente relevante y que contribuya a la seguridad alimentaria.\n\n- Establecer y regular las artes y métodos de\npesca a utilizar en el área.\n\n- Proteger y aprovechar de una manera\nsostenible los recursos marinos del área.\n\n- Consolidar el aporte a la conservación de la\nbiodiversidad marina que realizan los pescadores artesanales que pertenecen a\nla asociación de Pescadores de la isla.\n\n- Desarrollar un Programa de control y vigilancia\nen conjunto con las instituciones gubernamentales que tenga que ver con el\nfuncionamiento del manejo del Área Marina de Pesca Responsable.\n\n- Procurar que el producto pesquero capturado\nen el Área Marina de Pesca Responsable de Isla Caballo tenga un precio y\nmercado diferenciado, con base en  su\nmejor calidad y que es un producto sostenible.\n\n- Gestionar apoyo adicional financiero y\ntécnico para las diferentes necesidades que se requiera en el manejo adecuado\ndel área marina de pesca responsable.\n\n- Elaborar y desarrollar proyectos productivos\nsostenibles.\n\nIX.-Que\nsiendo para la Junta Directiva de vital importancia el fortalecimiento e\nimplementación de éste tipo de modelos de gobernanza pesquera, la junta\ndirectiva.   "body_en_text": "throughout the entire text\n\n                    -\n\n                        Full Text of Regulation 169\n\n                        Creation of the Isla Caballo Responsible Fishing Marine Area and its Management Plan\n\nFull Text of Act: E7CF0\n\nINSTITUTO COSTARRICENSE DE PESCA\n\nY ACUICULTURA\n\nA.J.D.I.P/169-2012.-Puntarenas,\non the thirteenth day of\nthe month of April, 2012.\n\nConsidering:\n\nI.-Mr.\nAntonio Porras Porras, by means of official communication DGT-A-026-2012 of March 19,\n2012, submits a Proposal for a Fisheries Management Plan for the\nestablishment of the Isla Caballo Responsible Fishing Marine Area,\nPuntarenas.\n\nII.-According to Article 50 of the Political\nConstitution, it is the obligation of the State to procure the greatest well-being for\nall inhabitants of the country, organizing and stimulating production and the most\nadequate distribution of wealth. Likewise, it incorporates the right of every person\nto a healthy and ecologically balanced environment.\n\nIII.-It is incumbent upon INCOPESCA, as the\nGoverning Institution of the fisheries and aquaculture sector of our country, to establish\nmanagement measures for the sustainable use of hydrobiological resources,\nwhich allow for the protection of reproduction, recruitment, and feeding areas,\nthat favor the increase of species and the growth of their biomass, in\nsuch a way as to guarantee their sustainability for the benefit of the ecosystems and\nthe fishers.\n\nIV.-In accordance with the Code of Conduct for\nResponsible Fisheries, Executive Decree No. 27919-MAG recognizes in its Article 6,\nthe important contribution of artisanal, small-scale fishing to the\ngeneration of employment, income, and food security. Hence the need for\nthe State to appropriately guarantee the right of male and female fishers,\nby adopting regulatory measures that favor the use\nof fishery resources in the waters of national jurisdiction.\n\nV.-Since 1995, the board of directors\nof INCOPESCA issued an agreement where they embraced the project of the community of\nPalito de Chira, supported by scientific foundations from academics of\ndifferent institutions to reserve a marine reef area where\nhigh levels of fish reproduction occur, prohibiting all types of fishing gear (arte de pesca) except handline fishing.\n\nVI.-Isla Caballo has a territorial extension\nof 3.7\n square kilometers, and is located in the\nGolfo de Nicoya. Inhabited by local residents who have occupied the public\nzone. 80% (concessionable zone) was\nsold by the locals to Mr. James Zeller. The ICT developed a partial\nregulatory plan; it promotes hotel development on 42% of the island.\nIsla Caballo is located in the Golfo de Nicoya, covers approximately\n150 hectares,\nand is inhabited by some 30 families made up of more than 200 people, of\nwhom many live in simple houses. It is reached by boat, which takes\napproximately 30 minutes from Puntarenas.\n\nVII.-The I. Caballo fishing area is\nlocated in zone 202 of the Golfo de Nicoya, and this is the first proposal for a Responsible Fishing Marine Area (Área Marina de Pesca Responsable, AMPR) in that zone, which is precisely\nthe intermediate part of that Gulf. The AMPRs created to date are in\nzone 203 (Tárcoles) and in 201 (Palito-Montero), in addition to the existence of several\nmore proposals such as Níspero and I. Venado). To understand the commercial classes and\nthe species that are caught in that fishing area, 132 biological\nsamplings carried out in 2006 by the Research and\nDevelopment Department were analyzed, for a total of 676 kilograms of sampled fishery products,\nwhich was the most accessible biological information\navailable. The most important commercial class caught at I. Caballo was the first small (tabla 1), which comprises\n67.9% of them, but other classes were also fished, such as first\nlarge, class, scrap (chatarra), and others. The\nfirst small and the first large are the commercial classes that comprise\nthe species of greatest commercial interest, such as croakers (corvinas) and snooks (róbalos).\n\nVIII.-With the establishment of this Marine\nArea, the following are intended among its purposes and objectives; to determine and develop:\n\n- Support artisanal fishers so that\ntheir activity is sustainable,\neconomically relevant, and contributes to food security.\n\n- Establish and regulate the fishing gear and methods (artes y métodos de pesca)\nto be used in the area.\n\n- Protect and sustainably use\nthe marine resources of the area.\n\n- Consolidate the contribution to the conservation of marine\nbiodiversity made by the artisanal fishers who belong to\nthe association of Fishers of the island.\n\n- Develop a Control and surveillance Program\njointly with the government institutions related to the\nfunctioning of the management of the Responsible Fishing Marine Area.\n\n- Ensure that the fishery product caught\nin the Isla Caballo Responsible Fishing Marine Area has a differentiated price and\nmarket, based on its\nbetter quality and that it is a sustainable product.\n\n- Seek additional financial and\ntechnical support for the different needs required for the adequate management\nof the responsible fishing marine area.\n\n- Develop and implement sustainable\nproductive projects.\n\nIX.-Whereas\nfor the Board of Directors it is of vital importance the strengthening and\nimplementation of this type of fisheries governance models, the board\nof directors.
