  "body_es_text": "en la totalidad del texto\n\n                    -\n\n                        Texto Completo Norma 37352\n\n                        Implementación de la Secretaría Ejecutiva de Apoyo para el Establecimiento y\nEjecución de las estrategias Redd+Costa Rica\n\nTexto Completo acta: 1189C3\n\nNº 37352-MINAET\n\n(Este decreto\nejecutivo fue derogado por el artículo 19 del Reglamento para la Ejecución de\nla Estrategia Nacional REDD+, aprobado mediante decreto ejecutivo N° 40464 de 3\nde abril del 2017)\n\nLA PRESIDENTA DE\nLA REPÚBLICA\n\nY EL MINISTRO DE\nAMBIENTE, ENERGÍA\n\nY TELECOMUNICACIONES\n\nCon fundamento en las atribuciones que les confiere\nlos artículos 50 y 140 incisos 3) y 18) de\nla Constitución\n Política; los artículos 25 incisos 1), 27 inciso 1) y 28\ninciso 2), acápite b) de la\n Ley General de Administración Pública Nº 6227 del 2 de mayo\nde 1978, y los artículos 1º, 5º, 46 y 47 de\nla Ley Forestal Nº 7575\ndel 13 de febrero de 1996.\n\nConsiderando:\n\n1º-Que el artículo 50 de\nla Constitución\n Política de Costa Rica y la jurisprudencia de\nla Sala Constitucional\nestablecen como un derecho de los ciudadanos un ambiente sano y ecológicamente\nequilibrado.\n\n2º-Que\nla Ley Forestal\nestablece como función esencial y prioritaria del Estado, velar por la\nconservación, protección y la administración de los bosques naturales y por la\nproducción, el aprovechamiento, la industrialización y el fomento de los\nrecursos forestales. Velando además por la generación de empleo y el incremento\ndel nivel de vida de la población rural, mediante su efectiva incorporación a\nlas actividades silviculturales. Para cumplir con\nestos cometidos la Ley\n Forestal crea el Fondo Nacional de Financiamiento Forestal\n(FONAFIFO), quien debe canalizar los recursos para cumplir los mandatos de la\nley y\nla Constitución Política.\n\n3º-Que en el marco de\nla Convención\n Marco de las Naciones Unidas sobre el Cambio Climático\n(CMNUCC) se desarrolla el mecanismo conocido como Reducción de Emisiones de\nla Deforestación\ny la Degradación\nde Bosques (REDD+), que es un esfuerzo internacional para combatir el cambio\nclimático mediante la promoción de políticas y acciones para disminuir, detener\ny revertir la pérdida de cubierta forestal y carbono en los países en\ndesarrollo, particularmente en los trópicos y ofrecer incentivos financieros o\nrecompensas por esas reducciones, mecanismo en el cual el Ministerio de\nAmbiente, Energía y Telecomunicaciones ha participado activamente.\n\n4º-Que el The Forest Carbon\nPartnership Facility (FCPF)\nes un proyecto piloto y de generación de aprendizaje que se ejecutará mediante\nun Fondo constituido por el Banco Mundial para asistir a un país REDD en sus\nesfuerzos por reducir sus emisiones de deforestación y/o la degradación del\nbosque, proveyéndole a estos con asistencia financiera y técnica para\ndesarrollar capacidades para beneficio de un futuro sistema de incentivos\npositivos para REDD+.\n\n5º-Que el Ministerio\nde Ambiente, Energía y Telecomunicaciones, en conjunto con el Fondo Nacional de\nFinanciamiento Forestal (FONAFIFO), sometió en\nla Asamblea PC6 celebrada\nen el marco de la reunión The Forest\nCarbon Partnership Facility (FCPF) realizada del 28 de junio al 1º de julio\ndel 2010, en Georgetown, Guyana una propuesta para elaborar\nla Estrategia REDD+Costa Rica, la cual fue aceptada.\n\n6º-Que en la reunión\ndel Comité de Participantes PC6, se aprobó mediante resolución Nº PC-2008-2 la\nimplementación de la\n Propuesta de Preparación para REDD+ (R-PP) que pretende\nestablecer un paquete de preparación para REDD+ que consiste en una Estrategia\nde REDD+, un Sistema Nacional de Monitoreo, Reporte y Verificación, un nivel de\nReferencia Nacional, y un Sistema de Gestión Socio Ambiental.\n\n7º-Que mediante\nresolución Nº PC-2008-2 el Comité de Participantes de The\nForest Carbon Partnership Facility (FCPF)\naprobó una donación a favor de Costa Rica por un monto de $3.6 millones de\ndólares americanos con posibilidad de ampliación de hasta $5 millones de\ndólares americanos.\n\n8º-Que con fecha 29 de junio del 2012, se firmó el Supplementary Grant Agreement for Costa Rica\nReadiness Preparation Proposal entre el The Forest Carbon Partnership Facility (FCPF) y el Fondo\nNacional de Financiamiento Forestal (FONAFIFO) para implementar el proyecto.\n\n9º-Que para apoyar el establecimiento y la ejecución de la Estrategia REDD+, según los términos y\ncondiciones que se establecen en el Acuerdo de Donación FCPF Readiness entre The Forest Carbon\nPartnership Facility (FCPF) y el Fondo Nacional de Financiamiento Forestal (FONAFIFO), se requiere\ncontar con una infraestructura y logística para llevar a cabo el proyecto dentro del Fondo Nacional\nde Financiamiento Forestal (FONAFIFO) para la ejecución de la Estrategia REDD+Costa Rica, de la cual\nel FONAFIFO será el responsable de la administración de la donación TF012692 por un monto de $3.6\nmillones de dólares americanos; además de procurar la colaboración de las instituciones involucradas\npara alcanzar las metas del proyecto. Por tanto,\n\nDecretan:\n\nIMPLEMENTACIÓN DE\nLA SECRETARÍA EJECUTIVA\n\nDE APOYO PARA EL\nESTABLECIMIENTO Y EJECUCIÓN\n\nDE\nLA ESTRATEGIA REDD+COSTA\nRICA\n\nArtículo 1º-Se implementa\nla Secretaría Ejecutiva\nde apoyo para el establecimiento y la ejecución de\nla Estrategia REDD+Costa Rica, según los términos y condiciones que se\nestablecen en el acuerdo de Donación FCPF Readiness,\ndonación TF012692.\nLa Secretaría Ejecutiva tendrá su sede en el Fondo\nNacional de Financiamiento Forestal (FONAFIFO) del Ministerio de Ambiente,\nEnergía y Telecomunicaciones, como órgano responsable de la administración de\nla donación.\n\nArtículo 2º-Serán funciones\nde la\n Secretaría Ejecutiva de apoyo para el establecimiento y la\nejecución de la\n Estrategia REDD+Costa Rica:\n\n1.    Apoyar al Comité Ejecutivo.\n\n2.    Desarrollar una estrategia de\ncomunicación.\n\n3.    Preparación y ejecución de\ntalleres con grupos involucrados relevantes especialmente con comunidades\ncampesinas e indígenas.\n\n4.    Desarrollar un plan de\npreparación y consulta.\n\n5.    Desarrollo de\nla Estrategia de\nREDD+Costa Rica, realizando estudios de uso del suelo, uso de la tierra,\npolíticas forestales y gobernanza, incluyendo la dinámica del uso de la tierra,\nla degradación y restauración de bosques y los costos de oportunidad o uso\nalternativo de la tierra.\n\n6.    Desarrollar los estudios para\ndiseñar una estrategia de financiamiento de\nla Estrategia REDD+Costa\nRica.\n\n7.    Apoyar el establecimiento del\nmarco de la implementación de\nla Estrategia REDD+Costa Rica.\n\n8.    Ejecutar una Estrategia de\nEvaluación Socio Ambiental (SESA) de las futuras actividades, proyectos o\nEstrategias de REDD+Costa Rica.\n\n9.    Desarrollo de un nivel de\nReferencia llevando a cabo estudios y trabajo de campo para desarrollar un\nnivel de referencia para los stocks de carbono.\n\n10.  Diseñar un sistema de medición,\nreporte y verificación de los cambios en los stocks de carbono y co-beneficios\nde REDD+, considerando los impactos sociales y ambientales del programa de Pago\npor Servicios Ambientales.\n\n11.  Ejercer como punto focal y\nrepresentar al país ante el Fondo Cooperativo de los Bosques, Proyecto REDD+ de\nla\n Cooperación Alemana (GIZ) y cualquier otro proyecto que apoye\nla Estrategia REDD+Costa\nRica.\n\n12.  Llevar un registro de donaciones\ncontabilizadas para REDD+ y reportar a la base de datos voluntaria que para\nestos efectos lleva el Fondo Cooperativo de los Bosques.\n\n13.  Decidir los aspectos esenciales\nde la Estrategia\nde acuerdo con los mejores intereses nacionales.\n\n14.  Buscar el Financiamiento\nposterior de la\n Estrategia REDD+Costa Rica.\n\n15.  Elaborar la versión final de\nla Estrategia REDD+ y\nsometerla a aprobación del Ministro de Ambiente, Energía y Telecomunicaciones.\n\nArtículo 3º-Se crea el Comité Ejecutivo de acuerdo a\nlo establecido en la\n Propuesta de Preparación para REDD+ (R-PP), el cual estará\nintegrado por los siguientes miembros designados por cada organización, en\ncalidad de titular y suplente:\n\n1.    Un representante de los pequeños\nproductores forestales.\n\n2.    Un representante de los\nindustriales de la madera.\n\n3.    Un representante del sistema\nbancario nacional.\n\n4.    Un representante de los pueblos\nindígenas.\n\n5.    Un representante del Ministerio\nde Agricultura y Ganadería.\n\n6.    Un representante del Ministerio\nde Ambiente, Energía y Telecomunicaciones.\n\n7.    Un representante de\nla Sociedad Civil o de\nlos dueños de terrenos en sobreuso.\n\nLas funciones de este Comité Ejecutivo serán las siguientes:\n\n1.    Emitir las recomendaciones de\npolíticas para REDD+.\n\n2.    Resolver los conflictos en el\nmarco de la Propuesta\nde Preparación a REDD+.\n\n3.    Garantizar la participación\nsustancial y consistente de los actores claves involucrados.\n\n4.    Promover el intercambio e\ninformación coherente, transparente entre las partes interesadas relevantes.\n\n5.    Apoyar el diseño desarrollo e\nimplementación de las políticas nacionales relativas a REDD+, incluyendo a\ntodos los sectores y en los distintos niveles de gobierno.\n\n6.    Aprobación de Estudios Técnicos\nrequeridos para la propuesta de preparación de REDD+.\n\n7.    Seguimiento del Sistema de\nGestión Socio Ambiental (SESA).\n\n8.    Sistematización de los procesos\nde consulta de todos los sectores y canalizar los resultados.\n\n9.    Desarrollar y aprobar el\nReglamento del grupo de trabajo.\n\n10.  Garantizar la atención de quejas\ny su respuesta.\n\n11.  Garantizar la propuesta de\nla Estrategia REDD+\ncon el consentimiento libre, previo e informado.\n\nArtículo 4º-El Fondo Nacional de Financiamiento\nForestal (FONAFIFO), a través de\nla Secretaría Ejecutiva,\nserá el responsable de la administración de los recursos de la donación\nTF012692 para el establecimiento de\nla Propuesta de Preparación para REDD+. Estos\nrecursos podrán ser administrados por el Fideicomiso 544 BNCR-FONAFIFO.\n\nArtículo 5º-\nLa Secretaría Ejecutiva\ndeberá emitir informes semestrales de avance y resultado, así como sobre la\nadministración de los recursos de la donación.\n\nArtículo 6º-Una vez\nconcluido el proceso y preparado el borrador final de la estrategia, la misma\ndeberá ser aprobada por el Ministro de Ambiente, Energía y Telecomunicaciones,\nquien la oficializará.\n\nArtículo\n7º-Corresponderá a las instituciones públicas involucradas en este proyecto\ndesignar una persona que ejercerá como contacto con el proyecto.\n\nArtículo 8º-Rige a\npartir de su publicación.\n\nDado en\nla Presidencia de\nla República.-San\nJosé, a los veintisiete días del mes de agosto del dos mil doce.",

To fulfill these purposes, the Forest Law (Ley Forestal) creates the National Forest Financing Fund (Fondo Nacional de Financiamiento Forestal, FONAFIFO), which must channel resources to fulfill the mandates of the law and the Political Constitution.\n\n3rd-That within the framework of the United Nations Framework Convention on Climate Change (UNFCCC), the mechanism known as Reduction of Emissions from Deforestation and Forest Degradation (REDD+) is being developed, which is an international effort to combat climate change by promoting policies and actions to decrease, halt, and reverse the loss of forest cover (cobertura forestal) and carbon in developing countries, particularly in the tropics, and to offer financial incentives or rewards for these reductions, a mechanism in which the Ministry of Environment, Energy and Telecommunications has actively participated.\n\n4th-That The Forest Carbon Partnership Facility (FCPF) is a pilot and learning-generation project to be executed through a Fund established by the World Bank to assist a REDD country in its efforts to reduce its emissions from deforestation and/or forest degradation, providing them with financial and technical assistance to build capacities for the benefit of a future system of positive incentives for REDD+.\n\n5th-That the Ministry of Environment, Energy and Telecommunications, together with the National Forest Financing Fund (FONAFIFO), submitted at the PC6 Assembly held within the framework of The Forest Carbon Partnership Facility (FCPF) meeting from June 28 to July 1, 2010, in Georgetown, Guyana, a proposal to develop the REDD+Costa Rica Strategy, which was accepted.\n\n6th-That at the PC6 Participants Committee meeting, the implementation of the Readiness Preparation Proposal for REDD+ (R-PP) was approved through Resolution No. PC-2008-2, which aims to establish a readiness package for REDD+ consisting of a REDD+ Strategy, a National Monitoring, Reporting and Verification System, a National Reference Level, and a Socio-Environmental Management System.\n\n7th-That through Resolution No. PC-2008-2, the Participants Committee of The Forest Carbon Partnership Facility (FCPF) approved a grant in favor of Costa Rica for an amount of $3.6 million US dollars, with the possibility of expansion up to $5 million US dollars.\n\n8th-That on June 29, 2012, the Supplementary Grant Agreement for Costa Rica Readiness Preparation Proposal was signed between The Forest Carbon Partnership Facility (FCPF) and the National Forest Financing Fund (FONAFIFO) to implement the project.\n\n9th-That to support the establishment and execution of the REDD+ Strategy, according to the terms and conditions established in the FCPF Readiness Donation Agreement between The Forest Carbon Partnership Facility (FCPF) and the National Forest Financing Fund (FONAFIFO), it is necessary to have infrastructure and logistics to carry out the project within the National Forest Financing Fund (FONAFIFO) for the execution of the REDD+Costa Rica Strategy, for which FONAFIFO will be responsible for the administration of Grant TF012692 for an amount of $3.6 million US dollars; in addition to seeking the collaboration of the institutions involved to achieve the project goals. Therefore,\n\nThey Decree:\n\nIMPLEMENTATION OF THE EXECUTIVE SECRETARIAT\n\nTO SUPPORT THE ESTABLISHMENT AND EXECUTION\n\nOF THE REDD+COSTA RICA STRATEGY\n\nArticle 1-The Executive Secretariat to support the establishment and execution of the REDD+Costa Rica Strategy is implemented, according to the terms and conditions established in the FCPF Readiness Donation Agreement, Grant TF012692. The Executive Secretariat will be based at the National Forest Financing Fund (FONAFIFO) of the Ministry of Environment, Energy and Telecommunications, as the body responsible for the administration of the grant.\n\nArticle 2-The functions of the Executive Secretariat to support the establishment and execution of the REDD+Costa Rica Strategy shall be:\n\n1. Support the Executive Committee.\n\n2. Develop a communication strategy.\n\n3. Preparation and execution of workshops with relevant involved groups, especially with peasant and indigenous communities.\n\n4. Develop a preparation and consultation plan.\n\n5. Development of the REDD+Costa Rica Strategy, carrying out studies on land use (uso del suelo), land use, forest policies, and governance, including land-use dynamics, forest degradation and restoration, and opportunity costs or alternative land use.\n\n6. Develop studies to design a financing strategy for the REDD+Costa Rica Strategy.\n\n7. Support the establishment of the implementation framework for the REDD+Costa Rica Strategy.\n\n8. Execute a Socio-Environmental Assessment Strategy (SESA) for future REDD+Costa Rica activities, projects, or Strategies.\n\n9. Development of a Reference Level, carrying out studies and fieldwork to develop a reference level for carbon stocks.\n\n10. Design a measurement, reporting, and verification system for changes in carbon stocks and co-benefits of REDD+, considering the social and environmental impacts of the Payment for Environmental Services (Pago de Servicios Ambientales) program.\n\n11. Act as a focal point and represent the country before the Forest Cooperative Fund, the REDD+ Project of the German Cooperation (GIZ), and any other project that supports the REDD+Costa Rica Strategy.\n\n12. Maintain a record of accounted donations for REDD+ and report to the voluntary database kept for these purposes by the Forest Cooperative Fund.\n\n13. Decide on the essential aspects of the Strategy in accordance with the best national interests.\n\n14. Seek subsequent financing for the REDD+Costa Rica Strategy.\n\n15. Prepare the final version of the REDD+ Strategy and submit it for approval to the Minister of Environment, Energy and Telecommunications.\n\nArticle 3-The Executive Committee is created in accordance with the provisions of the Readiness Preparation Proposal for REDD+ (R-PP), which will be composed of the following members designated by each organization, as principal and alternate:\n\n1. A representative of small forest producers.\n\n2. A representative of timber industrialists.\n\n3. A representative of the national banking system.\n\n4. A representative of indigenous peoples.\n\n5. A representative of the Ministry of Agriculture and Livestock.\n\n6. A representative of the Ministry of Environment, Energy and Telecommunications.\n\n7. A representative of Civil Society or of owners of overused land.\n\nThe functions of this Executive Committee shall be as follows:\n\n1. Issue policy recommendations for REDD+.\n\n2. Resolve conflicts within the framework of the Readiness Preparation Proposal for REDD+.\n\n3. Guarantee the substantial and consistent participation of the key actors involved.\n\n4. Promote coherent and transparent exchange of information among relevant interested parties.\n\n5. Support the design, development, and implementation of national policies related to REDD+, including all sectors and at different levels of government.\n\n6. Approval of Technical Studies required for the REDD+ preparation proposal.\n\n7. Monitoring of the Socio-Environmental Management System (SESA).\n\n8. Systematization of the consultation processes of all sectors and channeling the results.\n\n9. Develop and approve the Regulations of the working group.\n\n10. Guarantee the attention to complaints and their response.\n\n11. Guarantee the proposal of the REDD+ Strategy with free, prior, and informed consent.\n\nArticle 4-The National Forest Financing Fund (FONAFIFO), through the Executive Secretariat, will be responsible for the administration of the resources of Grant TF012692 for the establishment of the Readiness Preparation Proposal for REDD+. These resources may be administered by the Trust 544 BNCR-FONAFIFO.\n\nArticle 5-The Executive Secretariat must issue semi-annual progress and results reports, as well as reports on the administration of the grant resources.\n\nArticle 6-Once the process is concluded and the final draft of the strategy is prepared, it must be approved by the Minister of Environment, Energy and Telecommunications, who will formalize it.\n\nArticle 7-The public institutions involved in this project shall designate a person to act as a contact with the project.\n\nArticle 8-It shall be effective as of its publication.\n\nGiven at the Presidency of the Republic.-San José, on the twenty-seventh day of the month of August of two thousand twelve."
