  "body_es_text": "en la totalidad del texto\n\n                    -\n\n                        Texto Completo Norma 458\n\n                        Prorroga vigencia del acuerdo AJDIP/029-2012 \"Reforma Reglamento para la\nautorización de desembarques de productos pesqueros provenientes de las embarcaciones pertenecientes\na la flota pesquera comercial nacional o extranjera (Acuerdo A.J.I.D./042)\"\n\nTexto Completo acta: 140372\n\nINSTITUTO COSTARRICENSE DE\nPESCA Y ACUICULTURA\n\n(Esta norma fue derogada\npor el artículo 9° del Reglamento para la autorización de desembarques de\nproductos pesqueros provenientes de las embarcaciones pertenecientes a la flota\npesquera comercial nacional y extranjera, aprobado mediante acuerdo N°\nAJDIP/287-2020 del 25 de noviembre de 2020)\n\n \n\nAJDIP/ 458-2012.-Puntarenas, a los treinta días del mes de noviembre de dos\nmil doce.\n\nConsiderando:\n\n1- Que atendiendo criterios de oportunidad y necesidad a efecto coadyuvar\nal sector pesquero, dada la carencia de infraestructura portuaria adecuada que\npermita establecer la obligatoriedad de descarga de productos pesqueros en\ndichas instalaciones.\n\n2- Que en razón de lo anterior, la descarga de productos pesqueros en\ndeterminados lugares, está fundamentada en las disposiciones legales\nestablecidas en materia pesquera en las Leyes 7384 y 8436, así como en\nresoluciones vinculantes emitidas por\nla Sala Constitucional\nque han establecido la posibilidad de la descarga en muelles privados, hasta\ntanto el país no cuente con infraestructura pública adecuada para recibir la\ndescarga de tales productos y adicionalmente existen en la materia las\nfacultades y competencias del SENASA respecto de la inocuidad, calidad,\ncondiciones sanitarias y trazabilidad sanitaria de los productos cárnicos.\n\n3- Que por otra parte, la aprobación del Acuerdo AJDIP/029-2012 ha cumplido con los\nfines y objetivos bajo los cuales se sustentó su adopción, facilitando al\nsector pesquero costarricense la posibilidad de descargar en sitios idóneos,\ndebidamente registrados y autorizados por el INCOPESCA, así como el Certificado\nVeterinario de Operación (SENASA).\n\n4- Que por otra parte, la vigencia del acuerdo supra, se estableció\ntaxativamente a través del Acuerdo AJDIP/149-2012 por un plazo de seis meses\ncontados a partir del 23 de marzo de 2012, por lo que la misma feneció.\n\n5- Que en razón de la imposibilidad acarreada por\nla Junta Directiva en\ncuanto a no poder sesionar desde el pasado mes de setiembre hasta finales de\nnoviembre, lo cual no permitió atender y resolver oportunamente sobre los\nalcances del Acuerdo AJDIP/149-2012.\n\n6- Que actualmente se mantienen intactas las mismas condiciones y el espíritu\nque motivó en primera instancia la aprobación del Acuerdo AJDIP/029-2012, por\nlo que resulta procedente y necesario extender la vigencia del mismo.\n\n7- Que en ese giro, consideran los señores directores necesario normar la\nvigencia del mismo en forma indefinida hasta tanto se resuelva lo contrario;\npor lo que la Junta\n Directiva.   "body_en_text": "in the entirety of the text\n\n                    -\n\n                        Full Text of Norm 458\n\n                        Extends the validity of agreement AJDIP/029-2012 \"Reform of the Regulation for the authorization of landings of fishery products from vessels belonging to the national or foreign commercial fishing fleet (Agreement A.J.I.D./042)\"\n\nFull Text of record: 140372\n\nCOSTA RICAN INSTITUTE OF\nFISHERIES AND AQUACULTURE\n\n(This norm was repealed\nby Article 9 of the Regulation for the authorization of landings of\nfishery products from vessels belonging to the national\nand foreign commercial fishing fleet, approved by agreement No.\nAJDIP/287-2020 of November 25, 2020)\n\n \n\nAJDIP/ 458-2012.-Puntarenas, on the thirtieth day of November of two thousand\ntwelve.\n\nConsidering:\n\n1- That criteria of timeliness and necessity are being addressed in order to assist\nthe fisheries sector, given the lack of adequate port infrastructure that\nwould allow establishing the mandatory landing (descarga) of fishery products at\nsuch facilities.\n\n2- That by reason of the foregoing, the landing (descarga) of fishery products in\ncertain places is based on the legal provisions\nestablished in fisheries matters in Laws 7384 and 8436, as well as in\nbinding resolutions issued by\nthe Constitutional Chamber (Sala Constitucional)\nthat have established the possibility of landing (descarga) at private piers, until\nsuch time as the country has adequate public infrastructure to receive the\nlanding (descarga) of such products and additionally, there exist in the matter the\npowers and competencies of SENASA regarding the safety, quality,\nsanitary conditions and sanitary traceability of meat products.\n\n3- That on the other hand, the approval of Agreement AJDIP/029-2012 has fulfilled the\npurposes and objectives upon which its adoption was based, facilitating for the\nCosta Rican fisheries sector the possibility of landing (descargar) at suitable sites,\nduly registered and authorized by INCOPESCA, as well as the Veterinary\nOperation Certificate (SENASA).\n\n4- That on the other hand, the validity of the aforementioned agreement was\nexhaustively established through Agreement AJDIP/149-2012 for a period of six months\ncounted from March 23, 2012, and therefore it expired.\n\n5- That by reason of the impossibility brought about by\nthe Board of Directors (Junta Directiva)\nof being unable to meet from last September until the end of\nNovember, which did not allow timely addressing and resolving regarding the\nscope of Agreement AJDIP/149-2012.\n\n6- That at present, the same conditions and the spirit\nthat initially motivated the approval of Agreement AJDIP/029-2012 remain intact, and\ntherefore it is appropriate and necessary to extend its validity.\n\n7- That in this vein, the board members consider it necessary to regulate\nits validity indefinitely until resolved otherwise;\ntherefore the Board\n of Directors (Junta Directiva).
