de Relaciones\nExteriores y Culto y la nota diplomática de fecha 27 de agosto de 2012 suscrita\npor el Excelentísimo Señor Rómulo Roux, Ministro de Relaciones Exteriores de\nla República de\nPanamá, de sumo interés para ambos países\ndesarrollar acciones articuladas en el Sector Agropecuario que contribuyan a\nmejorar las condiciones de vida y reduzcan la vulnerabilidad ambiental de las\npoblaciones en la cuenca binacional del río Sixaola, bajo el amparo del\nConvenio entre el Gobierno de\nla República de Costa Rica y el Gobierno de\nla República de\nPanamá sobre Cooperación para el Desarrollo Fronterizo y su Anexo, suscrito en\nSixaola,  el 3 de mayo de 1992. \n\n2º-Que según el artículo\ncuarto del Convenio mencionado, las Altas Partes Contratantes adoptarán todas las\nmedidas necesarias para el cumplimiento de los objetivos y fines de los\nprogramas, proyectos o actividades que se realizarán con fundamento en éste,\nmediante el respectivo Canje de Notas Diplomáticas. Por tanto,\n\nEn uso de las facultades conferidas por el artículo\n140, incisos 10) y 12) de\nla Constitución Política.\n\n Decretan:\n\nArtículo 1º-Promulgar teniéndolo como vigente para los\nefectos internos y externos, el Acuerdo constituido mediante la nota\ndiplomática de fecha 23 de julio de 2012 suscrita por el señor Enrique Castillo\nBarrantes, Ministro de Relaciones Exteriores y Culto y la nota diplomática de\nfecha 27 de agosto de 2012 suscrita por el Excelentísimo Señor Rómulo Roux,\nMinistro de Relaciones Exteriores de\nla República de Panamá, para el fortalecimiento de\nlas acciones del Sector Agropecuario en la cuenca binacional del río Sixaola\nbajo la modalidad de Canje de Notas, cuyos \ntextos son los siguientes:\n\nEl Ministro de Relaciones\nExteriores y Culto\n\n San José, \n23 de julio de 2012\n\nDM-DGPE/458-12\n\nSeñor Ministro:\n\nAnimado por el deseo de fortalecer la cooperación\nbilateral en temas fronterizos y al amparo del Convenio sobre Cooperación para\nel Desarrollo Fronterizo y su Anexo, firmado en Sixaola, el 3 de mayo de 1992 y\nel Acuerdo de Asociación, hecho en la\n Ciudad de Panamá el 29 de octubre de 2009, el Gobierno de\nla República de\nCosta Rica propone al Honorable Gobierno de\nla República de\nPanamá, el siguiente Acuerdo para el fortalecimiento de las acciones del Sector\nAgropecuario en la cuenca binacional del Río Sixaola, bajo la modalidad de\nCanje de Notas, el cual se regirá por los siguientes términos:\n\n1. El presente Acuerdo tienen los siguientes\nobjetivos:\n\na) Afianzar los lazos de cooperación entre los\nMinisterios de Agricultura y Ganadería de Costa Rica y de Desarrollo\nAgropecuario de Panamá para impulsar acciones que contribuyan a mejorar las\ncondiciones de vida y reduzcan la vulnerabilidad ambiental de las poblaciones\nen la cuenca binacional del río Sixaola.\n\nExcelentísimo Señor\n\nFrancisco Álvarez de Soto\n\nMinistro de Relaciones\nExteriores Encargado\n\nde\nla República de\nPanamá\n\nb) Optimizar el uso de los recursos existentes en\nlos programas y proyectos en ejecución en la cuenca binacional, para lograr\nsinergias en el uso y destino de los fondos de los proyectos y lograr con estos\nmejoras efectivas en la calidad de vida de ambos países.\n\nc) Impulsar la colaboración con el sector\nempresarial de ambos países para lograr alianzas que contribuyan al desarrollo\nlocal y provean beneficios económicos, sociales y ambientales potenciando con\nestos las oportunidades que ofrece la región para lograr una economía\ndiversificada consistente con las normas ambientales de ambos países.\n\nd) Desarrollar un programa de actividades\nprioritarias conjuntas dirigidas a mejorar el clima de inversión y la\ndiversificación económica de la región, fortaleciendo la capacidad de las\ncomunidades y sus organizaciones para lograr una participación más equitativa\nen los mercados de productos y de bienes y servicios ambientales.\n\ne) Transmitir a instancias superiores del Poder\nEjecutivo y sus dependencias, en sus respectivos países, la necesidad urgente\nde atender otras demandas que escapan al mandato sectorial de los Ministros de\nAgricultura, como son, infraestructura vial para una movilización segura, salud\ne impacto de las inundaciones.\n\n2. Los Ministros del Sector Agropecuario, a través\nde sus respectivas Unidades Administrativas e Instituciones asociadas a su\nsector, han dispuesto apoyar las siguientes acciones:\n\na) Impulsar los proyectos que competen al sector\nagropecuario, como parte de las acciones para poner en funcionamiento la red\ninterinstitucional binacional para enfrentar la pobreza transfronteriza y la\nsostenibilidad ambiental, social, económica y cultural, acordada entre los\nPresidentes de Panamá y Costa Rica en los acuerdos y convenios entre ambos\npaíses.\n\nb) Apoyar a los micro, pequeños y medianos\nproductores de la región transfronteriza facilitando la implementación de las\nacciones de los proyectos nacionales en ejecución, de forma que se promueva una\ncultura diversificada, y aporten nuevas oportunidades de generar ingresos por\nlos propios moradores de la región.\n\nc) Apoyar las iniciativas nacionales y regionales\ndirigidas a la formación de alianzas entre el sector público y el privado para\nel desarrollo de proyectos productivos y de conservación, que contribuyan a\ncombatir la pobreza, la desigualdad y la exclusión social, y que provean\ncondiciones para mitigar los impactos del clima.\n\nd) Intensificar las acciones para que la\nproducción regional cumpla con las políticas de producción más limpia y que\nresponda a las normas ambientales de ambos países, fortaleciendo un desarrollo\nproductivo amigable con el ambiente y que contribuya a mejorar la salud y el\nnivel de vida de las poblaciones.\n\ne) Reorientar la gestión institucional de ambos\nMinisterios de forma que se atienda con urgencia las necesidades de generación\nde empleos e ingresos del área transfronteriza, por medio de la provisión de\nasistencia técnica, recursos de inversión y facilitación a los pequeños\nnegocios.\n\nf)  Interceder ante otras instituciones,\nprincipalmente en las de salud, obras públicas y prevención de emergencias para\nque intensifiquen sus acciones, de forma que las mismas tengan una incidencia\nefectiva en la solución de estos problemas en la región.\n\n3. Alianzas para la ejecución de las acciones:\n\na) Solicitar a la cooperación internacional el\napoyo para la implementación de iniciativas transfronterizas que faciliten los\nmedios económicos y de asistencia necesarios.\n\nb) Fortalecer la cooperación con el sector\nempresarial para la financiación y ejecución de acciones dentro del marco de la\nresponsabilidad social empresarial, facilitando replicar las experiencias que\nya se vienen desarrollando en la región.\n\nc) Reconocer la importancia de las autoridades y\norganizaciones locales y sus capacidades para el desarrollo de la zona, para\nque en coordinación con las entidades regionales competentes sean colaboradores\nen la implementación de las actividades que promueven dichas instituciones.\n\nd) Instruir a las oficinas regionales de estos\nacuerdos para que coadyuven en su implementación y provean informes periódicos\nde avance a sus Ministros.\n\n4. Este Acuerdo sustituye el Acuerdo de\nColaboración entre la\n Ministra de Agricultura y Ganadería de Costa Rica y el\nMinisterio de Desarrollo Agropecuario de Panamá con el objetivo de fortalecer\nel desarrollo transfronterizo de la cuenca Binacional de río Sixaola, suscrito\nen la ciudad de Changuinola el 27 de agosto de 2010.\n\n5. El presente Acuerdo tendrá un plazo indefinido\ny entrará en vigor en la fecha de la segunda de las notas en que las Partes se\ncomuniquen del cumplimiento de las formalidades de sus ordenamientos jurídicos\npara su entrada en vigencia. \n\n6. Este Acuerdo podrá ser denunciado en cualquier\nmomento, por cualquiera de las Partes, mediante notificación escrita a\nla Otra Parte por medio de\nla vía diplomática. The Ministers of the Agricultural Sector, through\ntheir respective Administrative Units and Institutions associated with their\nsector, have arranged to support the following actions:\n\na) To promote the projects that fall within the purview of the agricultural\nsector, as part of the actions to put into operation the binational\ninter-institutional network to address cross-border poverty and the\nenvironmental, social, economic, and cultural sustainability, agreed upon between the\nPresidents of Panama and Costa Rica in the agreements and conventions between both\ncountries.\n\nb) To support micro, small, and medium\nproducers of the cross-border region by facilitating the implementation of the\nactions of national projects under execution, in a manner that promotes a diversified\nculture and provides new opportunities to generate income for the\nregion's own inhabitants.\n\nc) To support national and regional initiatives\naimed at forming alliances between the public and private sectors for\nthe development of productive and conservation projects that contribute to\ncombating poverty, inequality, and social exclusion, and that provide\nconditions for mitigating climate impacts.\n\nd) To intensify actions so that regional\nproduction complies with cleaner production policies and\nresponds to the environmental norms of both countries, strengthening productive\ndevelopment that is environmentally friendly and that contributes to improving health and the\nliving standards of the populations.\n\ne) To reorient the institutional management of both\nMinistries so that the employment and income generation needs of the\ncross-border area are urgently addressed, through the provision of\ntechnical assistance, investment resources, and facilitation for small\nbusinesses.\n\nf) To intercede before other institutions,\nmainly those for health, public works, and emergency prevention, for\nthem to intensify their actions, so that they have an\neffective impact on solving these problems in the region.\n\n3.
