  "body_es_text": "en la totalidad del texto\n\n                    -\n\n                        Texto Completo Norma 37547\n\n                        Amplia para el el Instituto Costarricense de Acueductos y Alcantarillados\n(ICAA), el gasto presupuestario fijado para el 2013\n\nTexto Completo acta: ECF87\n\nN°\n37547-H\n\n    El SEGUNDO VICEPRESIDENTE EN\nEJERCICIO\n\n    DE\nLA PRESIDENCIA DE\nLA REPÚBLICA\n\n    Y EL MINISTRO DE HACIENDA\n\nCon fundamento en\nlas atribuciones que les confieren los artículos 140 incisos 3) y 18) y 146 de\nla Constitución\n Política; los artículos 25 inciso 1), 27 inciso 1) y 28\ninciso 2) acápite b) de la Ley\n No. 6227, Ley General de\nla Administración\n Pública de 2 de mayo de 1978 y sus reformas;\nla Ley No. 8131, Ley de\nla Administración\n Financiera de\nla República y Presupuestos Públicos de 18 de\nsetiembre de 2001 y sus reformas; su Reglamento, el Decreto Ejecutivo No.\n32988-H-MP-PLAN de 31 de enero de 2006 y sus reformas;\nla Ley No. 2726, Ley\nConstitutiva del Instituto Costarricense Acueductos y Alcantarillados (ICAA) de\n14 de abril de 1961 y sus reformas;\nla Ley No. 8641, Declaratoria del Servicio de\nHidrantes como Servicio Público y reforma de leyes conexas de 11 de junio de\n2008; y el Decreto Ejecutivo No. 37042-H de 13 de marzo de 2012 y sus reformas.\n\n    Considerando:\n\n1º-Que mediante\nla Ley No. 2726, publicada en\nLa Gaceta No.\n89 de 20 de abril de 1961 y sus reformas, se creó el Instituto Costarricense de\nAcueductos y Alcantarillados (ICAA), encargado de suplir a los costarricenses\nlos servicios públicos de agua potable y alcantarillado sanitario.\n\n2º-Que el artículo\nsegundo de la Ley No.\n8641, publicada en La\n Gaceta No. 121 de 24 de junio de 2008, establece que el\ndesarrollo de la red de hidrantes, su instalación, operación y mantenimiento,\nserán responsabilidad de los operadores de los sistemas de distribución del\nservicio de agua potable, públicos o privados, según el área concesionada.\n\n3º-Que mediante el\noficio PRE-1483-2012 del 23 de noviembre del 2012,\nla Presidenta Ejecutiva\ndel ICAA, solicita modificar el gasto presupuestario máximo del 2013 en la suma\nde ¢60.369.690.000,00 (sesenta mil trescientos sesenta y nueve millones\nseiscientos noventa mil colones exactos) para el cumplimiento de una serie de\nprogramas como lo son\nla Administración Superior y Apoyo Institucional;\nOperación, Mantenimiento y Comercialización de Acueductos; Inversiones;\nOperación, Mantenimiento y Comercialización de Alcantarillado e Hidrantes.\n\n4º-Que de dicho\nmonto corresponde ampliar ¢8.157.120.000,00 (ocho mil ciento cincuenta y siete\nmillones ciento veinte mil colones exactos) por la vía del Decreto Ejecutivo,\nde conformidad con lo establecido en el artículo 7° del Decreto Ejecutivo No.\n37042-H, publicado en el Alcance No. 35 a\nLa Gaceta No. 59 de 22 de marzo de 2012 y sus\nreformas, ya que se destinarán a gastos por incrementos extraordinarios en\nsueldos y salarios y en bienes duraderos no recurrentes, así como en gastos de\ncapital; egresos que se derivan de las nuevas plazas de cargos fijos, que serán\nutilizadas en los nuevos sistemas asumidos a través de los años tanto del Sistema\nde Agua Potable como los Sistemas de Aguas Residuales y la necesidad de comprar\nequipo de transporte, edificios y terrenos, para dar continuidad a proyectos\nque ya están en funcionamiento y otros que inician en este año.\n\n5º-Que mediante el\nDecreto Ejecutivo No. 37042-H citado, se emitieron las Directrices Generales de\nPolítica Presupuestaria para el año 2013, estableciéndose en el artículo 5°, el\nporcentaje máximo en que podría incrementarse el gasto presupuestario de las\nentidades públicas, ministerios y demás órganos, con respecto al del año\nprecedente. En correspondencia con dicha disposición, el monto de gasto\npresupuestario máximo resultante para el Instituto Costarricense de Acueductos\ny Alcantarillados (ICAA), fue establecido en la suma de ¢73.664.210.000,00\n(setenta y tres mil seiscientos sesenta y cuatro millones doscientos diez mil\ncolones exactos), el cual fue comunicado mediante el oficio STAP-0946-2012 del\n27 de abril de 2013, cifra que no contempla los gastos indicados previamente en\neste decreto.\n\n6º-Que por lo\nanterior, resulta necesario ampliar el gasto presupuestario máximo fijado al\nInstituto Costarricense de Acueductos y Alcantarillados, incrementándolo en la\nsuma de ¢8.157.120.000,00 (ocho mil ciento cincuenta y siete millones ciento\nveinte mil colones exactos).   "body_en_text": "in the entirety of the text\n\n                    -\n\n                        Full Text of Regulation 37547\n\n                        Amends, for the Costa Rican Institute of Aqueducts and Sewers (Instituto Costarricense de Acueductos y Alcantarillados, ICAA), the budget expenditure set for 2013\n\nFull Text of record: ECF87\n\nNo.\n37547-H\n\n    The SECOND VICE PRESIDENT EXERCISING\nTHE PRESIDENCY OF THE REPUBLIC\n    AND THE MINISTER OF FINANCE\n\nBased on the powers conferred by Articles 140, subsections 3) and 18), and 146 of the Political Constitution; Articles 25, subsection 1), 27, subsection 1), and 28, subsection 2) paragraph b) of Law No. 6227, General Public Administration Law of May 2, 1978, and its amendments; Law No. 8131, Financial Administration of the Republic and Public Budgets Law of September 18, 2001, and its amendments; its Regulation, Executive Decree No. 32988-H-MP-PLAN of January 31, 2006, and its amendments; Law No. 2726, Constitutive Law of the Costa Rican Institute of Aqueducts and Sewers (Instituto Costarricense de Acueductos y Alcantarillados, ICAA) of April 14, 1961, and its amendments; Law No. 8641, Declaration of the Hydrant Service as a Public Service and amendment of related laws of June 11, 2008; and Executive Decree No. 37042-H of March 13, 2012, and its amendments.\n\n    Considering:\n\n1.—That through Law No. 2726, published in La Gaceta No. 89 of April 20, 1961, and its amendments, the Costa Rican Institute of Aqueducts and Sewers (ICAA) was created, responsible for supplying Costa Ricans with the public services of potable water and sanitary sewerage.\n\n2.—That Article 2 of Law No. 8641, published in La Gaceta No. 121 of June 24, 2008, establishes that the development of the hydrant network, its installation, operation, and maintenance, shall be the responsibility of the operators of the potable water distribution systems, public or private, according to the concessioned area.\n\n3.—That through official communication PRE-1483-2012 of November 23, 2012, the Executive President of the ICAA requests to modify the maximum budget expenditure for 2013 in the amount of ¢60,369,690,000.00 (sixty billion three hundred sixty-nine million six hundred ninety thousand exact colones) for the fulfillment of a series of programs such as Senior Administration and Institutional Support; Operation, Maintenance, and Commercialization of Aqueducts; Investments; Operation, Maintenance, and Commercialization of Sewerage and Hydrants.\n\n4.—That of said amount, it is appropriate to increase by ¢8,157,120,000.00 (eight billion one hundred fifty-seven million one hundred twenty thousand exact colones) via Executive Decree, in accordance with the provisions of Article 7 of Executive Decree No. 37042-H, published in Supplement No. 35 to La Gaceta No. 59 of March 22, 2012, and its amendments, since they will be allocated to expenditures for extraordinary increases in wages and salaries and in non-recurring durable goods, as well as in capital expenditures; disbursements derived from new fixed-position posts, which will be used in the new systems taken over through the years, both the Potable Water System and the Wastewater Systems, and the need to purchase transportation equipment, buildings, and land, to provide continuity to projects already in operation and others beginning this year.\n\n5.—That through the aforementioned Executive Decree No. 37042-H, the General Budget Policy Guidelines for the year 2013 were issued, establishing in Article 5 the maximum percentage by which the budget expenditure of public entities, ministries, and other bodies could be increased with respect to the preceding year. In accordance with said provision, the resulting maximum budget expenditure amount for the Costa Rican Institute of Aqueducts and Sewers (ICAA) was established in the sum of ¢73,664,210,000.00 (seventy-three billion six hundred sixty-four million two hundred ten thousand exact colones), which was communicated through official communication STAP-0946-2012 of April 27, 2013, a figure that does not contemplate the expenditures previously indicated in this decree.\n\n6.—That for the foregoing, it is necessary to amend the maximum budget expenditure set for the Costa Rican Institute of Aqueducts and Sewers, increasing it by the sum of ¢8,157,120,000.00 (eight billion one hundred fifty-seven million one hundred twenty thousand exact colones). Therefore,\n\n    DECREE:\n\nArticle 1.—The maximum budget expenditure for 2013, established in accordance with Executive Decree No. 37042-H, published in Supplement No. 35 to La Gaceta No. 59 of March 22, 2012, and its amendments, is hereby amended for the Costa Rican Institute of Aqueducts and Sewers (ICAA), by the sum of ¢8,157,120,000.00 (eight billion one hundred fifty-seven million one hundred twenty thousand exact colones), for that period.\n\nArticle 2.—It shall be effective as of its publication.\n\nGiven in the Presidency of the Republic, on the twenty-eighth day of January, two thousand thirteen."
