Posteriormente mediante acuerdo AJDIP/026-2018 del 12 de\nenero de 2018, \"Establece las tallas legales de primera captura (TLPC)\nrespondiendo a las tallas de primera madurez sexual (TPMS)\", se vuelve a\nderogar esta norma.)\n\n \n\nAJDIP/105-2013.-Puntarenas, a los ocho días del mes de marzo de dos mil\ntrece.\n\nConsiderando:\n\n1- Que de conformidad con la programación realizada por la Junta Directiva,\nrespecto al establecimiento de las tallas de primera madurez de las principales\nespecies de interés comercial; para lo cual se desarrollo\npor parte de la Dirección General Técnica una serie de consultas al sector\npesquero costarricense, en las zonas de Guanacaste, Puntarenas, Limón y Zona\nSur, a fin de que estos manifestaran sus posiciones sobre éste particular.\n\n2- Que la Junta Directiva recibió en esta sesión al Lic. Antonio Porras Porras, Director General\nTécnico, así como los biólogos Hubert Araya Umaña, Jefe del Departamento de Desarrollo e\nInvestigación, y Berny Marín Alpízar quienes presentaron la propuesta de tallas de primera\n\nmadurez.\n\n3- Que en ese mismo orden de ideas, presenta el Lic. Porras Porras, la propuesta señalada, bajo\noficio DGT-015-03-2013, indica que esta propuesta incluye los cambios generados en relación a la\npropuesta inicial y que se sustentan en el proceso de consulta realizado con el Sector Pesquero, así\ncomo producto de la revisión de la propuesta inicial en cuanto a la propuesta de entrada en vigencia\nde forma progresiva de esta medida de regulación, con las finalidad de evitar el colapso de la\npesquería de las especies incluidas en esta propuesta.\n\n4- Que debido a la selectividad de los artes de pesca y a la variabilidad\nen tallas y pesos de los especímenes objeto de captura, se presenta una\ndesviación en las tallas de las especies capturadas con respecto a la talla de\nprimera madurez., misma cuyo ámbito de distribución va a estar determinado por\nel tipo de arte de pesca y por la distribución poblacional de la especie objeto\nde pesca, situación que para efectos de cumplimiento racional de la medida de\nregulación requiere definir rangos de tolerancia en cuanto a los desembarques\nde especímenes que estén por debajo de la talla de primera madurez.\n\n5- Que esta propuesta no contempla otras especies de interés pesquero y\ncomercial debido a la falta de estudios actuales que permitan generar la\nrespectiva recomendación técnica, pero se programaran estos estudios en los\nplanes anuales operativos pertinentes, dependiendo de la capacidad con que se\ncuente, con base en los recursos económicos y humanos de los que se disponen y\nlas líneas de acción estratégicas definidas.\n\n6- Que tanto para el atún, dorado como para el grupo de los tiburones se toma\nen cuenta que estas especies son objeto de ordenamiento de la Comisión\nInteramericana de Atún Tropical - CIAT- y de la Organización del Sector\nPesquero y Acuícola del Istmo Centroamericano - OSPESCA-.\n\n7- Que igualmente consideran los Sres. Para efectos de la descarga y comercialización de las especies cuyas tallas\nde primera madurez se definen en el presente, se deberán aplicar los\nporcentajes de tolerancia establecidos respecto de cada una de las especies\nsobre la medida definida por ejemplar, estableciéndose entonces que no se\npermitirá la descarga, el transporte, acopio, procesamiento o comercialización\nde especies cuya medida esté por debajo del que resulte, después de aplicar el\nporcentaje de tolerancia permitido respecto a la talla de primera madurez.\n\n. Las tallas definidas de primera madurez, estarán sujetas a los cambios\nque pudieran resultar producto de las investigaciones científicas y técnicas\nque sean realizadas por el\n\nINCOPESCA, en relación con el comportamiento biológico de las especies.\n\n. Dentro de los plazos máximos para alcanzar las Tallas de Primera Madurez\nestablecidos en el presente ordenamiento, el INCOPESCA a través del\nDepartamento de Desarrollo e Investigación o de los sistemas de investigación\nque pueden resultar factibles e idóneos deberá realizar análisis, monitoreo\nbiológico y estudios o investigaciones que permitan validar, revisar y/o\najustar, las Tallas de Primera Madurez que se han establecido, para efectos de\nlos cual se dará prioridad al estudio de las especies del recurso sardina,\ncorvina, pargo, dorado y tiburón.\n\n. Se establece expresamente que en cuanto a las tallas definidas para las\nespecies de atún aleta amarilla, dorado y tiburones, las mismas deben de\naplicarse en concordancia con las medidas de ordenación que para estos efectos\nhaya establecido o establezca la Comisión Interamericana de Atún Tropical\n-CIAT- en lo relativo a la captura y aprovechamiento de dichas especies.\n\nTransitorio Único. Las\nmedidas de ordenamiento establecidas de las Tallas de Primera Madurez, empezarán\na regir tres meses calendario después de su publicación en el Diario Oficial La\nGaceta, a los efectos de que las mismas sean debidamente divulgadas y\nconocidas por el sector pesquero comercial.\n\n(Restablecido su texto\noriginal por acuerdo AJDIP/132\ndel 13 de marzo de 2015. Antonio Porras Porras, General Technical\nDirector, as well as the biologists Hubert Araya Umaña, Head of the Development and\nResearch Department, and Berny Marín Alpízar, who presented the proposal for sizes at first\nmaturity.\n\n3- That in this same line of thought, Lic. Porras Porras presents the aforementioned proposal, under\nofficial communication DGT-015-03-2013, indicating that this proposal includes the changes generated in relation to the\ninitial proposal and that are supported by the consultation process carried out with the Fishing Sector, as well\nas a product of the review of the initial proposal regarding the proposed entry into force\non a progressive basis of this management measure, with the purpose of preventing the collapse of the\nfishery for the species included in this proposal.\n\n4- That due to the selectivity of the fishing gear and the variability\nin sizes and weights of the specimens targeted for capture, there is a\ndeviation in the sizes of the captured species with respect to the size at\nfirst maturity, a deviation whose distribution range will be determined by\nthe type of fishing gear and by the population distribution of the target species,\na situation that, for the purposes of rational compliance with the management\nmeasure, requires defining tolerance ranges regarding the landings\nof specimens that are below the size at first maturity.\n\n5- That this proposal does not include other species of fishing and\ncommercial interest due to the lack of current studies that would allow for the generation of the\nrespective technical recommendation, but these studies will be scheduled in the\nrelevant annual operational plans, depending on the available capacity,\nbased on the economic and human resources available and\nthe defined strategic lines of action.\n\n6- That for tuna, dolphinfish, as well as for the group of sharks, it is taken\ninto account that these species are subject to management by the Inter-American\nTropical Tuna Commission - CIAT - and the Organization for the Fishing and Aquaculture\nSector of the Central American Isthmus - OSPESCA.\n\n7- That the Board Members equally consider the need to\nestablish a management framework on the issue of sizes at first maturity that\nallows for both the conservation and utilization of the resource, and the\nsustainability of the national fishing sector.\n\n8- In that same line of thought, compliance\nwith the provisions issued by the Comptroller General of the Republic on\nthis particular topic is also necessary.\n\n9- That having analyzed and discussed the issue and the proposal on sizes\nat first applicable to the implementation of the management\nmeasure relating to Sizes at First Maturity:\n\n \n\n. For the purposes of landing and commercialization of the species whose sizes\nat first maturity are defined herein, the established tolerance\npercentages for each of the species shall be applied to the defined measurement per specimen, thus establishing that\nthe landing, transport, stockpiling, processing, or commercialization\nof species whose measurement is below that resulting after applying the\npermitted tolerance percentage with respect to the size at first maturity shall not be permitted.\n\n. The defined sizes at first maturity shall be subject to changes\nthat may arise from scientific and technical investigations\ncarried out by\n\nINCOPESCA, in relation to the biological behavior of the species.\n\n. Within the maximum periods to reach the Sizes at First Maturity\nestablished in this management framework, INCOPESCA, through the\nDevelopment and Research Department or through investigation systems\nthat may be feasible and suitable, must conduct analyses, biological\nmonitoring, and studies or investigations that allow for the validation, review, and/or\nadjustment of the established Sizes at First Maturity, for which\npurpose priority shall be given to the study of the species of the sardine,\ncorvina, pargo, dolphinfish, and shark resources.\n\n. It is expressly established that regarding the sizes defined for the\nspecies of yellowfin tuna, dolphinfish, and sharks, they must be\napplied in accordance with the management measures that the Inter-American\nTropical Tuna Commission -CIAT- has established or may establish in relation to the capture and utilization of said species.\n\nSole Temporary Provision. The\nmanagement measures established for the Sizes at First Maturity shall come into\nforce three calendar months after their publication in the Official Gazette La\nGaceta, for the purpose of ensuring that they are duly disseminated and\nknown by the commercial fishing sector.\n\n(Its original text\nre-established by agreement AJDIP/132\nof March 13, 2015.
