La\norganización que cuente con los requisitos indicados en la Solicitud de\nParticipación en Programa País, publicada en la página web de la Dirección de\nCambio Climático, y a la cual la Dirección de Cambio Climático, haya indicado\nvía correo electrónico, el número de expediente correspondiente, podrá utilizar\nel símbolo de la marca Carbono Neutral en la papelería, afiches y demás\nsímbolos externos de la organización, que se indican en esta disposición y que\nsean autorizados expresamente en forma individual para cada uso.\n\n2. El tiempo de\nvigencia de uso de la marca \"Carbono Neutral\" será de 1 año calendario, a\npartir de la fecha indicada en la declaración de certificación emitida por el\norganismo verificador/validador acreditado ante el Ente Costarricense de\nAcreditación, en cumplimiento con lo indicado en el Acuerdo 36-MINAET publicado\nen La Gaceta del 19 de junio 2012. Las organizaciones a las cuales se\n[es entregue la marca \"Carbono Neutral\" serán publicadas en la página de la\nDirección de Cambio Climático, en la sección de Carbono Neutralidad 2021.\nCuando la organización realice la renovación de su declaración de carbono\nneutralidad, deberá informarlo a la Dirección de Cambio Climático, con el fin\nde actualizar la fecha. De no ser así, se indicará por los medios apropiados\nque la organización no cuenta con la marca \"Carbono Neutral\" reconocida por el\nGobierno de Costa Rica, y por tanto, no podrá hacer uso de la misma, en cuyo\ncaso de hacerlo Sin permiso oficial, se establecerán las acciones legales\ncorrespondientes.\n\n3. La organización a\nla cual se le ha otorgado la marca \"Carbono Neutral\" autorizada por el MINAE,\ndebe solicitar a la Dirección de Cambio Climático la aprobación de uso de\nsímbolo o marca, cada vez que lo va a emplear en un documento o medio\ndiferente, al que le fue aprobado en ocasiones anteriores.\n\n4.       La organización puede solicitar el uso de\ndel símbolo \"Carbono Neutral\" en:\n\n. Documentos de tipo\npublicitario o de promoción, folletos, anuncios referentes al alcance de la\ndeclaración de carbono neutralidad, sitio web de la organización.\n\nCotizaciones\nrelativas a las actividades debidamente autorizadas en el alcance de la\ndeclaración de carbono neutralidad.\n\n2º-Restricciones de uso de símbolo. El\nsímbolo o marca de \"Carbono Neutral\" otorgado por el MINAE no puede utilizarse\nen los siguientes casos:\n\na. Si la organización está en proceso de evaluación por un organismo de tercera parte,  si cuenta\ncon la declaración de carbono neutralidad vencida, retirada o suspendida.\n\nb. En informes o\ndocumentos de la organización relacionados con actividades que se encuentran\nfuera del alcance indicado en la declaración de carbono neutralidad.\n\nc. En documentos emitidos por la organización como resultado de actividades distintas  de aquellas\nincluidas en el alcance de la declaración de carbono neutralidad.\n\nd. En encabezados,\npapelería corporativa, o facturas por parte de la organización, en tarjetas de\npresentación personal, uniformes, gafetes o identificaciones.\n\ne. En cualquier\nsituación que pueda dar lugar a una interpretación incorrecta de la condición\nde la organización (Ejemplo: que pueda inducir a considerar actividades no cubiertas\npor el alcance de la declaración de carbono neutralidad y que resulte abusiva\najuicio del MINAE).\n\nf. El símbolo\n\"Carbono Neutral\" asociado a la norma nacional INTE 12-01-06:2011 no deberá ser\nutilizada en productos de la organización.\n\ng. Las organizaciones\ncon autorización para uso de símbolo o marca \"Carbono Neutral\" no autorizarán a\nsus clientes que utilicen el símbolo, bajo ninguna circunstancia.\n\nh. No se permite el\nuso del símbolo \"Carbono Neutral\" en cualquier documento que no haya sido\naprobado con anterioridad por el MINAE.\n\ni. No se puede\nutilizar el símbolo \"Carbono Neutral\" en certificados e informes, en los cuales\ntodos los resultados de actividades que se registren, estén fuera del alcance\nde la declaración de carbono neutralidad de la organización.\n\nj. En los informes de\nla organización se permite que incluyan alcances indicados para la declaración\nde carbono neutralidad, así como los alcances no incluidos dentro de la\ndeclaración de carbono neutralidad. Esto se puede realizar por medio de una\nnota al pie, y dónde se haga referencia al número de expediente y publicación\noficial en la página de la Dirección de Cambio Climático.\n\nk. La organización no\npuede transferir su derecho de uso del símbolo de \"Carbono Neutral\" a\nsubcontratistas o a terceros. Así como, el uso del símbolo \"Carbono Neutral\" en\ndocumentos derivados de subcontratistas, reportes de cumplimiento de\nespecificaciones, reportes de opinión e interpretaciones.\n\nl. El símbolo \"Carbono Neutral\" no puede ser colocado en productos (según la      declaración de\ncarbono neutralidad bajo la norma INTE 12-01-06:2011)\n\nm. El uso del símbolo\n\"Carbono Neutral\", no implica que el MINAE apruebe un determinado producto o\nartículo, o una opinión emitida por la organización.\n\nn. El símbolo\n\"Carbono Neutral\" no debe ser utilizado de tal forma que pueda dar la impresión\nde que el MINAE está aceptando responsabilidad por los procesos asociados con\nla organización.\n\no. The organization that meets the requirements set forth in the Application for Participation in the Country Program, published on the website of the Climate Change Directorate, and to which the Climate Change Directorate has indicated, via email, the corresponding expediente number, may use the Carbon Neutral brand symbol on stationery, posters, and other external symbols of the organization, as indicated in this provision and as expressly authorized individually for each use.\n\n2. The period of validity for the use of the “Carbon Neutral” brand shall be 1 calendar year, starting from the date indicated in the certification declaration issued by the verification/validation body accredited by the Costa Rican Accreditation Body, in compliance with what is indicated in Agreement 36-MINAET published in La Gaceta of June 19, 2012. The organizations to which [the “Carbon Neutral” brand is granted will be published on the page of the Climate Change Directorate, in the Carbon Neutrality 2021 section. When the organization renews its carbon neutrality declaration, it must inform the Climate Change Directorate in order to update the date. Otherwise, it will be indicated by appropriate means that the organization does not hold the “Carbon Neutral” brand recognized by the Government of Costa Rica, and therefore, it may not make use of the same, in which case, if it does so without official permission, the corresponding legal actions will be taken.\n\n3. The organization to which the “Carbon Neutral” brand authorized by MINAE has been granted must request approval for the use of the symbol or brand from the Climate Change Directorate each time it is to be used on a document or medium different from the one approved on previous occasions.\n\n4. The organization may request the use of the “Carbon Neutral” symbol on:\n\n. Advertising or promotional documents, brochures, advertisements relating to the scope of the carbon neutrality declaration, the organization's website.\n\nQuotations relating to activities duly authorized within the scope of the carbon neutrality declaration.\n\n2º—Restrictions on the use of the symbol. The “Carbon Neutral” symbol or brand granted by MINAE may not be used in the following cases:\n\na. If the organization is in the process of evaluation by a third-party body, if it has an expired, withdrawn, or suspended carbon neutrality declaration.\n\nb. In reports or documents of the organization related to activities that fall outside the scope indicated in the carbon neutrality declaration.\n\nc. In documents issued by the organization as a result of activities other than those included in the scope of the carbon neutrality declaration.\n\nd. On the organization’s headers, corporate stationery, or invoices, on personal business cards, uniforms, badges, or identification cards.\n\ne. In any situation that may give rise to an incorrect interpretation of the organization’s status (Example: that may lead to considering activities not covered by the scope of the carbon neutrality declaration and that is abusive in the judgment of MINAE).\n\nf. The “Carbon Neutral” symbol associated with the national standard INTE 12-01-06:2011 must not be used on the organization’s products.\n\ng. Organizations authorized to use the “Carbon Neutral” symbol or brand shall not authorize their clients to use the symbol, under any circumstance.\n\nh. The use of the “Carbon Neutral” symbol is not permitted on any document that has not been previously approved by MINAE.\n\ni. The “Carbon Neutral” symbol may not be used on certificates and reports in which all the results of registered activities fall outside the scope of the organization’s carbon neutrality declaration.\n\nj. The organization’s reports may include scopes indicated for the carbon neutrality declaration, as well as scopes not included within the carbon neutrality declaration. This may be done by means of a footnote, referencing the expediente number and official publication on the page of the Climate Change Directorate.\n\nk. The organization may not transfer its right to use the “Carbon Neutral” symbol to subcontractors or third parties. The same applies to the use of the “Carbon Neutral” symbol on documents derived from subcontractors, specification compliance reports, opinion reports, and interpretations.\n\nl. The “Carbon Neutral” symbol may not be placed on products (according to the carbon neutrality declaration under the standard INTE 12-01-06:2011)\n\nm. The use of the “Carbon Neutral” symbol does not imply that MINAE approves a specific product or article, or an opinion issued by the organization.\n\nn. The “Carbon Neutral” symbol must not be used in such a way as to give the impression that MINAE is accepting responsibility for the processes associated with the organization.\n\no. It is prohibited to include any element within the “Carbon Neutral” logo or symbol. It is prohibited to place the “Carbon Neutral” logo or symbol as a background on sheets, as well as to render it with elements, images, or textures that cause distortion or alter its perception.\n\np. The “Carbon Neutral” symbol granted to one organization may not be placed alongside the symbol or logo of another organization that does not hold the granted “Carbon Neutral” symbol.\n\nq. Being in default of its tax obligations.\n\nr. Having a final judicial sanction for crimes or infractions of environmental legislation, or a final administrative sanction for violation of environmental regulations, or a conviction for environmental damage.\n\n3º—Form and color of the logo. The following “Carbon Neutral” logo is the officially registered one, which may be used by authorized organizations.\n\na. “Carbon Neutral,” “Carbon Neutral” logo.\n\nb.
