Bovino,\nPrevención y Sanción de su Robo, Hurto y Receptación, Nº 8799 del 17 de abril\ndel 2010; la Ley\nde Presupuesto Extraordinario, Nº 7138 del 16 de noviembre de 1989, artículo 46,\ninciso 22, que autoriza la apertura de Cuentas Especiales para recursos\nprovenientes de venta de servicios de Mercadeo, Salud y Producción Pecuaria e\nInvestigación Agrícola; el Acuerdo de Medidas Sanitarias y Fitosanitarias\naprobado mediante Ley de Ejecución de los Acuerdos de\nla Ronda Uruguay de\nNegociaciones Comerciales Multilaterales, Nº 7473 del 20 de diciembre del 1994;\nLey de la Promoción\nde la Competencia\ny Defensa Efectiva al Consumidor, Nº 7472 del 20 de diciembre de 1994.\n\n Considerando:\n\n1.- Que es función esencial del Estado proteger la salud de las personas,\nsistemas de producción primarios, los animales y el medio ambiente, así como\ngarantizar la protección de los cultivos de las plagas y enfermedades que\npuedan poner en riesgo o causar daños a la producción agropecuaria.\n\n2.- Que para la economía nacional y la seguridad alimentaria, la protección\nsanitaria de los productos de origen animal resulta fundamental, en especial en\naquellos que son esenciales en la dieta de los costarricenses, lo que obliga al\nEstado a adoptar todas las medidas de prevención, vigilancia y control\nnecesarias para evitar el ingreso y diseminación de plagas y enfermedades que\npongan en peligro o puedan causar daño a las personas o al patrimonio pecuario\nnacional.\n\n3.- Que mediante Ley Nº 8495 del 6 de abril del 2006, se creó el Servicio\nNacional de Salud Animal, (SENASA), como un órgano de desconcentración y\npersonería jurídica instrumental del Ministerio de Agricultura y Ganadería,\nderogándose la Ley Nº\n6343 del 2 de mayo de 1978, Ley sobre Salud Animal y sustituyendo por ello para\ntodo efecto legal a la\n Dirección de Salud Animal del Ministerio de Agricultura y\nGanadería.\n\n4.- Que a través del Servicio Nacional de Salud Animal (SENASA) se brindan\nuna serie de servicios a los productores y establecimientos agropecuarios y con\ncuya venta se generan los recursos necesarios para la sostenibilidad del\nServicio, permitiéndose con ello la reposición y compra de equipos, materiales,\nreactivos y otros insumos necesarios para la buena marcha y la atención\noportuna de los requerimientos que se le formulan al SENASA.\n\n5.- Que mediante Decreto Nº 27763-MAG del 10 de marzo de 1999 y sus\nreformas, se encuentran establecidas las tarifas de los servicios que el\nMinisterio de Agricultura y Ganadería ofrece al Sector Productivo Nacional y en\nespecial al Sector Agropecuario, correspondiendo las estipuladas en los\nartículos 3 y 4 bis a las del Servicio Nacional de Salud Animal.\n\n6.- Que conforme al mandato contenido en el artículo 8 bis del citado\nDecreto Nº 27763- MAG, las tarifas establecidas están sujetas a un incremento\nanual que rige a partir del 1 de febrero de cada año y que se calcula\nautomáticamente con base en el valor del índice de tarifas al consumidor del\naño anterior, modelo este de ajuste que es necesario cambiar, toda vez que\nla Ley N° 8495 del 6 de abril\ndel 2006, estableció que las tarifas por los servicios que brinde el Senasa\ndeben fijarse con base en estudios técnicos y tomando en consideración el principio\nde servicio al costo.\n\n7.- Que con el fin de cumplir con ese nuevo modelo de fijación tarifaria,\nel SENASA realizó un estudio técnico a través de una empresa especializada en\nese tipo de estudios, para determinar el monto de los diferentes servicios\nofrecidos con base en el principio de costeo real y por lo que en adelante, se\nmantiene como mecanismo de ajuste automático, la aplicación del Índice de\nPrecios al Consumidor (IPC), salvo que mediante resolución razonada de\nla Dirección General\ndel Servicio Nacional de Salud Animal, se establezca un ajuste mayor a dicho\níndice, posterior a un estudio técnico, que determine que los costos incrementales\nde los servicios aumentaron en una proporción mayor a la reflejada por el índice\nantes señalado.\n\n8.- Que las tarifas derivadas del estudio indicado han sido sometidas a\najustes tomando también en consideración el interés sanitario implícito en cada\nuno de los servicios y su impacto en el Sector Productivo Nacional, por lo que\nfueron sometidas a consulta y análisis de los diferentes actores entre otros,\nlos Sectores representados en el Consejo Nacional Asesor de Salud Animal.\n\n9.- Que adicionalmente es menester excluir algunas tarifas de servicios que\nya no tienen vigencia e incluir algunas tarifas para servicios que el SENASA,\nse encuentra en obligación  de brindar a\nlos Sectores productivos con fundamento a sus competencias establecidas en\nla Ley N° 8495 del 6 de abril\ndel 2006. environment, as well as\nto guarantee the protection of crops from pests and diseases that\nmay put at risk or cause damage to agricultural and livestock production.\n\n2.- That for the national economy and food security, the sanitary protection\nof products of animal origin is fundamental, especially\nfor those essential to the diet of Costa Ricans, which obliges the\nState to adopt all necessary prevention, surveillance, and control\nmeasures to prevent the entry and spread of pests and diseases that\nendanger or may cause harm to persons or the national livestock patrimony.\n\n3.- That through Law No. 8495 of April 6, 2006, the National Animal Health Service (Servicio Nacional de Salud Animal, SENASA) was created, as a deconcentrated body with\ninstrumental legal personality of the Ministry of Agriculture and Livestock,\nrepealing Law No. 6343 of May 2, 1978, the Law on Animal Health, and thereby substituting for\nall legal purposes the Animal Health Directorate of the Ministry of Agriculture and\nLivestock.\n\n4.- That through the National Animal Health Service (SENASA), a\nseries of services are provided to agricultural and livestock producers and establishments, and through\ntheir sale, the necessary resources for the sustainability of the\nService are generated, thereby allowing the replacement and purchase of equipment, materials,\nreagents, and other inputs necessary for the proper functioning and timely\nattention of the requirements made to SENASA.\n\n5.- That through Decree No. 27763-MAG of March 10, 1999, and its\namendments, the tariffs for the services that the\nMinistry of Agriculture and Livestock offers to the National Productive Sector and\nespecially to the Agricultural and Livestock Sector are established, those stipulated in\nArticles 3 and 4 bis corresponding to those of the National Animal Health Service.\n\n6.- That in accordance with the mandate contained in Article 8 bis of the cited\nDecree No. 27763-MAG, the established tariffs are subject to an annual\nincrease that takes effect as of February 1 of each year and is calculated\nautomatically based on the value of the consumer tariff index of the\nprevious year, an adjustment model that needs to be changed, since\nLaw No. 8495 of April 6, 2006, established that the tariffs for the services provided by SENASA\nmust be set based on technical studies and taking into consideration the principle\nof service at cost.\n\n7.- That in order to comply with this new tariff-setting model,\nSENASA conducted a technical study through a company specialized in\nsuch studies, to determine the amount of the different services\noffered based on the principle of actual costing, and for which, going forward, the\napplication of the Consumer Price Index (Índice de Precios al Consumidor, IPC) is maintained as\nan automatic adjustment mechanism, unless, by reasoned resolution of\nthe General Directorate of the National Animal Health Service, a greater adjustment to said\nindex is established, following a technical study, which determines that the incremental costs\nof the services increased in a greater proportion than reflected by the index\nmentioned above.\n\n8.- That the tariffs derived from the indicated study have been subjected to\nadjustments also taking into consideration the implicit sanitary interest in each\nof the services and their impact on the National Productive Sector, therefore they\nwere subjected to consultation and analysis by different stakeholders, among others,\nthe Sectors represented in the National Animal Health Advisory Council (Consejo Nacional Asesor de Salud Animal).\n\n9.- That additionally, it is necessary to exclude some service tariffs that\nare no longer valid and to include some tariffs for services that SENASA\nis obliged to provide to the Productive Sectors based on its competencies established in\nLaw No. 8495 of April 6, 2006.
