El jurado deberá quedar nombrado\ndurante este mismo mes.\n\nArtículo\n2º-Impedimento para ser miembro del jurado\n\nLos\nmiembros del jurado deberán actuar bajo la observancia de los principios de\nimparcialidad, ética y discrecionalidad, por ese motivo, los miembros del\njurado deberán guardar secreto profesional sobre sus actuaciones propias del\ncargo de integrante del jurado.\n\nEs\nincompatible con el puesto el hecho de ser promotor o participante activo de\nuna oferta concursante con la de miembro del jurado.\n\nSerá causal\nde excusa o recusación, cualquier vínculo de consanguinidad o afinidad hasta\ntercer inclusive, de algún miembro del jurado respecto a alguno de los\nproyectos postulados.\n\nArtículo\n3º-Juramentación del jurado\n\nEl\nDirectorio convocará a los miembros que fueron designados como jurado para su\nrespectiva juramentación e instalación, así como para entregarles copias del\ndecreto legislativo y su reglamento, e instruirlos acerca de la metodología que\nse debe seguir respecto de la labor que deben realizar.\n\nArtículo\n4º-Nombramiento del coordinador del jurado\n\nUna vez\nque se haya integrado el jurado, este debe nombrar de su seno a un coordinador\nque será el encargado de mantener la comunicación con la Oficina de Iniciativa\nPopular, por ser esta instancia la responsable de la coordinación y la\nejecución del concurso por parte de la Asamblea Legislativa.\n\nArtículo\n5º-Convocatoria del concurso\n\nEl\nDirectorio Legislativo, durante el mes de marzo de cada año, anunciará la\nconvocatoria del concurso, en al menos un medio de comunicación escrita de\ncirculación nacional, así como en otros medios informativos.\n\nPodrán\nparticipar los centros educativos del país, públicos y privados, que impartan\nel I, II y III ciclos de la educación general básica y la educación\ndiversificada. El anuncio que se divulgará debe contener:\n\nEl\nnombre del galardón ambiental, de acuerdo con el artículo 1 este reglamento.\n\nLa\nmotivación de la convocatoria al concurso Galardón Ambiental Legislativo.\n\nLos\nrequisitos que se deben cumplir por parte de los centros educativos\nparticipantes.\n\nEl\nmonto del beneficio económico del Galardón Ambiental Legislativo.\n\ne) Las fechas de admisión de los proyectos, la\ndeclaratoria y la entrega del galardón.\n\nf) El formato de los proyectos.\n\ng) Los temas participantes.\n\nh) Cualesquiera otros elementos que el Directorio\nconsidere pertinente.\n\nArtículo\n6º-Requisitos de presentación de los proyectos\n\nLos\nproyectos deberán estar relacionados con los programas de educación ambiental,\no bien, promover la conservación y la protección del medio ambiente; asimismo,\ndeben cumplir con los siguientes requisitos:\n\na) Presentación por escrito, en letra arial 12, con\ninterlineado de espacio y medio, con márgenes de tres centímetros en su parte\ninferior, superior y derecha, y de tres y medio centímetros en el extremo\nizquierdo.\n\nb) Extensión máxima de 60 cuartillas.\n\nc) Especificación del nombre del proyecto,\nantecedentes, justificación, problema, objetivo general y específicos,\nmetodología, presupuestación, plazo de implementación y modo de ejecución.\n\nd) En caso de que el monto del premio no sea\nsuficiente para llevar a cabo el proyecto, debe indicarse la forma en que\nobtendrán los recursos para lograr el financiamiento restante.\n\nArtículo\n7º-Plazo de recibo de proyectos\n\nLos\nproyectos se recibirán a partir del primer día hábil del mes de abril de cada\naño y hasta el último día hábil del mes de junio de ese mismo año.\n\nArtículo\n8º-Deliberación por parte del jurado\n\nEl\njurado puede iniciar las deliberaciones acerca de la adjudicación del galardón,\na partir de la primera sesión que se celebre.\n\nArtículo\n9º-Atribuciones del jurado\n\nLas\natribuciones correspondientes al jurado son:\n\na) Coordinar acciones con la Oficina de Iniciativa\nPopular.\n\nb) Redactar la motivación de la convocatoria al\nGalardón Ambiental Legislativo.\n\nc) Establecer los requisitos que deben cumplir los\ncentros educativos participantes en el concurso.\n\nd) Seleccionar los temas participantes.\n\ne) Definir la evaluación, así como los puntajes que se\nle aplicarán a cada aspecto que se valorará.\n\nf) Proponer al Directorio legislativo cualquier otro\nelemento que considere oportuno.\n\ng) Escoger el proyecto ganador.\n\nh) Declarar desierto el concurso, de acuerdo con el\nartículo 12 de este reglamento.\n\nArtículo\n10.-Asesoramiento técnico\n\nEl\njurado podrá recurrir al asesoramiento técnico especializado de las\nuniversidades públicas o privadas, institutos especializados o colegios\nprofesionales.\n\nArtículo\n11.-Puntaje asignado a los proyectos\n\nPara\ndefinir al ganador del concurso, el jurado, de acuerdo con la metodología\npreviamente determinada, ponderará los puntajes; el proyecto que obtenga el\nmayor puntaje será al que se le otorgue el Galardón Ambiental Legislativo. El\nfallo del jurado es inapelable.\n\nArtículo\n12.-Concurso desierto\n\nEl\njurado, por voto de la mayoría calificada, podrá declarar desierto el concurso,\nen cuyo caso presentará su criterio técnico al Directorio legislativo. Dicho\ncriterio técnico o un extracto de él se publicará al menos en un medio escrito\nde circulación nacional y podrá anunciarse en otros medios informativos.\n\nArtículo\n13.-Entrega del premio al ganador del concurso o en su defecto declaratoria\ndesierta\n\nEl\njurado deberá entregar a más tardar el 16 de julio de cada año, al Directorio\nLegislativo, un sobre cerrado que contendrá el nombre del centro educativo\nganador del concurso Galardón Ambiental Legislativo, o en su defecto, indicará\nsi el concurso debe ser declarado desierto. En ambos casos deberá mediar\nrazonamiento fundado.\n\nArtículo\n14.-Declaratoria del ganador\n\nLa\nOficina de Iniciativa Popular anunciará el proyecto ganador, a más tardar,\ndentro del periodo de los treinta días anteriores a la premiación. Este anuncio\nse publicará al menos en un medio escrito de circulación nacional, sin\nperjuicio de ser anunciado en otros medios informativos.\n\nArtículo\n15.-Prohibiciones\n\nEl\njurado no podrá conceder audiencias, ni entrevistas a los concursantes;\nasimismo, está imposibilitado para informar en relación con las deliberaciones\nque surjan de su seno, las cuales son consideradas confidenciales.\n\nArtículo\n16.-Otorgamiento del Galardón Ambiental Legislativo\n\nEl\ngalardón será entregado por el Directorio Legislativo, en una ceremonia que\ntambién contará con la presencia del jurado, el 24 de agosto de cada año, fecha\nen que se celebra el Día de los Parques Nacionales, a la hora y en el lugar que\nacuerde este órgano legislativo. Los años en que la fecha indicada sea un día\ninhábil, la entrega del galardón se realizará el día hábil siguiente.\n\nArtículo\n17.-Presupuesto\n\nLa\nOficina de Iniciativa Popular presupuestará cada año una partida, destinada a\nfinanciar el premio que se entregará al centro educativo que resulte ganador\ndel Galardón Ambiental Legislativo.\n\nPara\ndefinir la cantidad que se va a presupuestar, se deberá considerar al menos\ncinco veces el salario base de un oficinista 1, definido en el artículo 2 de la\nLey Nº 7337. Asimismo, esta misma Oficina debe incluir las partidas necesarias\npara las publicaciones y la ejecución de las actividades que genere el\nprocedimiento a seguir para la premiación del Galardón Ambiental Legislativo.\n\nArtículo\n18.-Fiscalización\n\nCorresponde\na la Oficina de Iniciativa Popular velar por el cumplimiento de las normas y\nlos procedimientos establecidos durante todo el proceso para el otorgamiento\ndel Galardón Ambiental Legislativo, así como en la aplicación del proyecto\nganador.\n\nPara tal\nfin, dicha Oficina podrá solicitar informes al ganador sobre los avances del\nproyecto. Además, en el plazo de un año contado a partir de que se otorgue el\npremio, la Oficina de Iniciativa Popular deberá realizar al menos dos visitas\npara corroborar el desarrollo del proyecto. Para cumplir tal propósito, podrá\nhacerse acompañar de uno o varios de los miembros que integraron el jurado que\notorgó el galardón o, en su defecto, de un profesional especialista en la materia\nque pueda asesorar de forma ad honórem.\n\nArtículo\n19.-Incumplimiento en la ejecución del proyecto\n\nUna vez\nsolicitados los informes sobre los avances y/o efectuadas las visitas, la\nOficina de Iniciativa Popular deberá redactar un informe en el que haga referencia\nal grado de ejecución del proyecto.\n\nEn caso\nde que no existan avances significativos o que no se haya iniciado, se le\ninformará al Directorio legislativo, con el fin de que este órgano legislativo\nhaga la prevención de cumplimiento correspondiente.\n\nSi\ntranscurridos tres meses a partir de la prevención el problema subsiste, el\nDirectorio podrá realizar una segunda prevención, previo informe de la Oficina\nde Iniciativa Popular.\n\nSi\ntranscurrido el plazo de un año se mantiene el incumplimiento del desarrollo\ndel proyecto, el Directorio legislativo declarará el desacato y, en\nconsecuencia, el centro educativo galardonado deberá realizar la devolución del\npremio que le fue otorgado.\n\nRige a\npartir de su publicación en el Diario Oficial La Gaceta.\n\nSan\nJosé, a los diecinueve días del mes de abril de dos mil trece.", "body_en_text": "throughout the entire text\n\n-\n\nFull Text of Norm 159\n\nRegulations for Awarding the Legislative Environmental Distinction\n\nFull Text of record: EEA42\n\nNo. 61-12-13\n\nTHE LEGISLATIVE DIRECTIVE BOARD\nOF THE LEGISLATIVE ASSEMBLY\nOF THE REPUBLIC OF COSTA RICA\n\nIn ordinary session No. 159, held on February 19, 2013\n\nIT IS AGREED:\n\nTo endorse the following regulations:\n\nREGULATIONS FOR AWARDING THE\nLEGISLATIVE ENVIRONMENTAL DISTINCTION\n\nArticle 1.—Holding the competition and designating the jury.\n\nEach year, in the month of February, the Office of Popular Initiative shall present to the Legislative Directive Board the proposal to hold the Legislative Environmental Distinction competition, as well as a shortlist with the names of experts in environmental matters to form the deliberating jury and decide on the dedication of that year's competition, which must be closely related to the Costa Rican environment or geography. The jury must be appointed during this same month.\n\nArticle 2.—Impediment to being a member of the jury\n\nThe members of the jury must act in observance of the principles of impartiality, ethics, and discretion; for this reason, the members of the jury must maintain professional secrecy regarding their actions inherent to the position of jury member.\n\nBeing a promoter or active participant in a competing proposal is incompatible with the position of jury member.\n\nAny blood relationship or affinity up to the third degree, inclusive, of a jury member with respect to any of the nominated projects shall be grounds for excuse or recusal.\n\nArticle 3.—Swearing-in of the jury\n\nThe Directive Board shall convene the members designated as the jury for their respective swearing-in and installation, as well as to provide them with copies of the legislative decree and its regulations, and instruct them on the methodology to be followed regarding the work they must perform.\n\nArticle 4.—Appointment of the jury coordinator\n\nOnce the jury has been formed, it must appoint from among its members a coordinator who will be responsible for maintaining communication with the Office of Popular Initiative, as this entity is responsible for the coordination and execution of the competition on behalf of the Legislative Assembly.\n\nArticle 5.—Call for entries for the competition\n\nThe Legislative Directive Board, during the month of March of each year, shall announce the call for entries for the competition in at least one nationally circulated print medium, as well as in other media outlets.\n\nThe country's public and private educational centers that offer the I, II, and III cycles of basic general education and diversified education may participate. The announcement to be disseminated must contain:\n\nThe name of the environmental distinction, in accordance with Article 1 of these regulations.\n\nThe rationale for the call for entries for the Legislative Environmental Distinction competition.\n\nThe requirements that must be met by the participating educational centers.\n\nThe amount of the financial benefit of the Legislative Environmental Distinction.\n\ne) The dates for admission of projects, the declaration, and the awarding of the distinction.\n\nf) The format of the projects.\n\ng) The participating themes.\n\nh) Any other elements that the Directive Board considers pertinent.\n\nArticle 6.—Requirements for the presentation of projects\n\nThe projects must be related to environmental education programs, or promote the conservation and protection of the environment; likewise, they must meet the following requirements:\n\na) Presentation in writing, in Arial 12-point font, with one-and-a-half line spacing, with margins of three centimeters on the bottom, top, and right, and three and a half centimeters on the left edge.\n\nb) Maximum length of 60 pages (cuartillas).\n\nc) Specification of the project name, background, justification, problem, general and specific objectives, methodology, budgeting, implementation deadline, and mode of execution.\n\nd) In the event that the prize amount is not sufficient to carry out the project, the manner in which they will obtain the resources to achieve the remaining financing must be indicated.\n\nArticle 7.—Deadline for receipt of projects\n\nProjects shall be received from the first business day of the month of April of each year until the last business day of the month of June of that same year.\n\nArticle 8.—Deliberation by the jury\n\nThe jury may begin deliberations regarding the awarding of the distinction as of the first session held.\n\nArticle 9.—Powers of the jury\n\nThe powers corresponding to the jury are:\n\na) Coordinating actions with the Office of Popular Initiative.\n\nb) Drafting the rationale for the call for entries for the Legislative Environmental Distinction.\n\nc) Establishing the requirements that educational centers participating in the competition must meet.\n\nd) Selecting the participating themes.\n\ne) Defining the evaluation, as well as the scores to be applied to each aspect to be assessed.\n\nf) Proposing any other element it deems appropriate to the Legislative Directive Board.\n\ng) Choosing the winning project.\n\nh) Declaring the competition void, in accordance with Article 12 of these regulations.\n\nArticle 10.—Technical advice\n\nThe jury may resort to specialized technical advice from public or private universities, specialized institutes, or professional associations.\n\nArticle 11.—Score assigned to the projects\n\nTo determine the winner of the competition, the jury, in accordance with the previously determined methodology, shall weigh the scores; the project obtaining the highest score shall be the one awarded the Legislative Environmental Distinction. The jury's decision is final and unappealable.\n\nArticle 12.—Competition declared void\n\nThe jury, by a qualified majority vote, may declare the competition void, in which case it shall present its technical opinion to the Legislative Directive Board. Said technical opinion or an excerpt thereof shall be published in at least one nationally circulated print medium and may be announced in other media outlets.\n\nArticle 13.—Awarding of the prize to the competition winner or, failing that, declaration of the competition as void\n\nThe jury must deliver, no later than July 16 of each year, to the Legislative Directive Board, a sealed envelope containing the name of the educational center that won the Legislative Environmental Distinction competition, or, failing that, it shall indicate if the competition must be declared void. In both cases, a reasoned basis must be provided.\n\nArticle 14.—Declaration of the winner\n\nThe Office of Popular Initiative shall announce the winning project, no later than within the period of thirty days prior to the award ceremony. This announcement shall be published in at least one nationally circulated print medium, without prejudice to being announced in other media outlets.\n\nArticle 15.—Prohibitions\n\nThe jury may not grant hearings or interviews to the contestants; likewise, it is barred from providing information regarding the deliberations that arise within it, which are considered confidential.\n\nArticle 16.—Awarding of the Legislative Environmental Distinction\n\nThe distinction shall be awarded by the Legislative Directive Board, in a ceremony that will also be attended by the jury, on August 24 of each year, the date on which National Parks Day is celebrated, at the time and place agreed upon by this legislative body. In years when the indicated date is a non-business day, the awarding of the distinction shall take place on the following business day.\n\nArticle 17.—Budget\n\nThe Office of Popular Initiative shall budget an item each year, destined to finance the prize to be awarded to the educational center that wins the Legislative Environmental Distinction.\n\nTo define the amount to be budgeted, at least five times the base salary of an Office Clerk 1, as defined in Article 2 of Law No. 7337, must be considered. Likewise, this same Office must include the necessary items for the publications and the execution of the activities generated by the procedure to be followed for the awarding of the Legislative Environmental Distinction.\n\nArticle 18.—Oversight\n\nIt is the responsibility of the Office of Popular Initiative to ensure compliance with the rules and procedures established throughout the entire process for awarding the Legislative Environmental Distinction, as well as in the implementation of the winning project.\n\nFor this purpose, said Office may request reports from the winner on the progress of the project. Furthermore, within a period of one year from the awarding of the prize, the Office of Popular Initiative must conduct at least two visits to verify the project's development. To fulfill this purpose, it may be accompanied by one or more of the members who formed the jury that awarded the distinction or, failing that, by a specialist professional in the field who can advise on an ad honorem basis.\n\nArticle 19.—Non-compliance in the execution of the project\n\nOnce the reports on progress have been requested and/or the visits carried out, the Office of Popular Initiative must draft a report referring to the degree of execution of the project.\n\nIn the event that there is no significant progress or that it has not been initiated, the Legislative Directive Board shall be informed, so that this legislative body may issue the corresponding compliance warning (prevención de cumplimiento).\n\nIf three months after the warning the problem persists, the Directive Board may issue a second warning, following a report from the Office of Popular Initiative.\n\nIf non-compliance in the development of the project continues after a period of one year, the Legislative Directive Board shall declare contempt (desacato) and, consequently, the distinguished educational center must return the prize that was awarded to it.\n\nIt takes effect upon its publication in the Official Gazette La Gaceta.\n\nSan José, on the nineteenth day of the month of April of two thousand thirteen." }
