los artículo 2\ny 3 de la Ley del Sistema Nacional de Archivos Nº 7202 de 24 de octubre de\n1990; el artículo 5 de la Ley de Protección al Ciudadano del Exceso de\nRequisitos y Trámites Administrativos Nº 8220 de 4 de marzo del 2002 y el\nDecreto Ejecutivo Nº 29540 del 11 de mayo del 2001, Constitución del Centro\nNacional de Información Geoambiental.\n\nConsiderando:\n\nI.-Que el Principio 10 de la Declaración de Río de\nJaneiro de 1992, estipula \nque  toda persona deberá\ntener acceso adecuado a la información sobre el medio ambiente de que dispongan\nlas autoridades públicas para lo cual deberá facilitar y fomentar la\nsensibilización y la participación de la población a través de un acceso\nefectivo.\n\nII.-Que para ejercer el derecho a un ambiente sano y\necológicamente equilibrado, establecido en la Constitución Política, se\nrequiere que los habitantes dispongan de un acceso eficiente a la información\nsobre el estado del ambiente, los recursos naturales y la gestión institucional.\n\nIII.-Que toda persona\ntendrá igualdad al acceder y peticionar información de naturaleza pública ante\nlas autoridades, para lo cual se garantiza el libre acceso, quedando a salvo\nlos secretos de Estado.\n\nIV.-Que la Ley\nOrgánica del Ambiente, que el Estado propiciará, la puesta en marcha de un\nsistema de información con indicadores ambientales, destinados a medir la\nevolución y la correlación con los indicadores económicos y sociales para el\npaís.\n\nV.-Que la Ley de\nSistema Nacional de Archivos regula el funcionamiento de los órganos del\nSistema Nacional de Archivos, el cual involucra los archivos de las\ninstituciones que conforman el Poderes Ejecutivo, Legislativo y Judicial, y\ndemás entes públicos.\n\nVI.-Que la Ley de\nProtección al Ciudadano del Exceso de Requisitos y Trámites Administrativos,\nestablece como obligación institucional el proveer al administrado de la\ninformación sobre los trámites y requisitos que se realicen en la respectiva\nunidad administrativa o dependencia.\n\nVII.-Que la Ley\nOrgánica del Ambiente establece como una de las obligaciones del Estado, el\ndefinir y ejecutar políticas nacionales de ordenamiento territorial que\ncontribuyan a regular y promover los asentamientos humanos, las actividades\neconómicas y sociales y el desarrollo físico-espacial con el fin de lograr\nmayor bienestar de la población, el aprovechamiento de los recursos naturales y\nla conservación del ambiente.\n\nVIII.-Que el Centro\nNacional de Información Geoambiental del Ministerio\nde Ambiente, Energía y Telecomunicaciones es el órgano especializado para el\ndesarrollo de  sistemas\nde información, implementación de plataformas, gestión de datos y metadatos y\notras actividades afines para generación de información medio ambiental y de\nordenamiento territorial nacional.\n\nIX.-Que es de alta\nimportancia integrar y publicitar la información geoambiental\nde Costa Rica, para que sea puesta en conocimiento de los actores y usuarios,\npor lo que resulta necesario oficializar el Sistema Nacional de Información\nAmbiental (SINIA), como plataforma oficial de coordinación y vinculación\ninstitucional y sectorial del Estado costarricense para facilitar la gestión y\ndistribución del conocimiento de la información ambiental nacional. Para tal efecto,\nse deberá considerar la normativa vigente que dicta la responsabilidad de las\ndiferentes dependencias y entidades nacionales ligadas a la información\nambiental nacional, así como de otros grupos nacionales organizados.\n\nArtículo 4º-Organización.\nPara el funcionamiento del SINIA, se contará con la siguiente organización:\n\na) (Derogado por el artículo 21 del Reglamento Operativo de la Secretaría de Planificación Sectorial\nde Ambiente, Energía, Mares y Ordenamiento Territorial (SEPLASA), aprobado mediante decreto\nejecutivo N° 40710  del 4 de agosto del 2017)\n\nb) Una unidad para la coordinación del desarrollo\ny funcionamiento del SINIA, en adelante UC-SINIA.\n\nc) Un Comité Interinstitucional de Información\nAmbiental del SINIA, en adelante CIIA-SINIA.\n\nArtículo 5º-Constitución del CD-SINIA. (Derogado por el\nartículo 21 del Reglamento Operativo de la\nSecretaría de Planificación Sectorial de Ambiente, Energía, Mares y\nOrdenamiento Territorial (SEPLASA), aprobado mediante decreto ejecutivo N° 40710  del 4\nde agosto del 2017)\n\nArtículo 6º-Funciones\ndel Consejo Directivo (CD-SINIA). El Consejo Directivo (CD-SINIA) tendrá\nlas siguientes funciones: \n\na) Establecer los requerimientos estratégicos de\nalto nivel para el desarrollo y funcionamiento del SINIA. \n\nb) Controlar la ejecución de los objetivos\nestratégicos del SINIA.\n\nc) Aprobar las alianzas estratégicas con otras\ninstancias de información.\n\nd) Aprobar los reglamentos internos del SINIA.\n\ne) Aprobar los informes presentados por la Unidad para\nla Coordinación\ndel SINIA (UC-SINIA).\n\nPara el cumplimiento de sus funciones el Consejo\nDirectivo (CD-SINIA) deberá de reunirse al menos dos veces al año, pudiendo\nconvocar a reuniones extraordinarias según se requiera. La convocatoria a estas\nreuniones será facilitada desde el Despacho del Ministro de Ambiente, Energía y\nTelecomunicaciones, en coordinación con la Unidad para la Coordinación\n(UC-SINIA).\n\nArtículo 7º-Constitución\nde la Unidad\npara la\n Coordinación para el desarrollo y funcionamiento del SINIA\n(UC-SINIA). Se crea la\n Unidad para la Coordinación para el desarrollo y funcionamiento\ndel SINIA (UC-SINIA), la cual será ejercida por el CENIGA.\n\nArtículo 8º-Funciones\nde la Unidad\npara la\n Coordinación (UC-SINIA). Las funciones de la Unidad para la Coordinación\n(UC-SINIA) serán:\n\na) Coordinar y velar por el desarrollo y\nfuncionamiento del SINIA, según las directrices emitidas por el CD-SINIA.\n\nb) Convocar al CIIA-SINIA a reuniones, al menos\nuna vez al mes y dar seguimiento a los acuerdos que se tomen en dicha Comisión.\n\nc) Servir de enlace entre el CD-SINIA y el\nCIIA-SINIA para transmitir las directrices y acuerdos que sean generados en\nambas instancias.\n\nd) Velar por el cumplimiento de las directrices y\nacuerdos generados por el CD-SINIA y el CIIA-SINIA.\n\ne) Rendir informes periódicos al CD-SINIA sobre el\nestado de avance y funcionamiento del SINIA. Estos informes deberán ser\nsemestrales o cada vez que el CD-SINIA los solicite.\n\nf)  La\n UC-SINIA en conjunto con el CIIA-SINIA identificará y\ngestionará la incorporación oficial de los diferentes nodos que conformarán la RENIA.\n\ng) Gestionar la publicación de la información\nambiental, garantizando que la misma esté a disposición de todos los tipos de\nusuarios nacionales e internacionales.\n\nArtículo 9º-Creación del Comité Interinstitucional\nde Información Ambiental CIIA-SINIA.  Se crea el Comité Interinstitucional de Información\nAmbiental (CIIA-SINIA) como la comisión técnica interinstitucional de apoyo en\nla consecución del desarrollo del SINIA. La coordinación del CIIA-SINIA recae\nen la UC-SINIA.\n\nArtículo 10.-Constitución\ndel Comité Interinstitucional de Información Ambiental (CIIA-SINIA). El\nComité Interinstitucional de Información Ambiental (CIIA-SINIA) estará\nconformado por representantes (titular y suplente) de los principales nodos de\ninformación de la RENIA. La\nUC-SINIA deberá gestionar, a través del Despacho Ministerial, la oficialización\nde cada uno de los representantes del CIIA-SINIA.\n\nArtículo 11.-De\nlos nodos.  Cada nodo de información\nserá el encargado de canalizar al SINIA la información institucional que\ncorresponda, según su área de responsabilidad.\n\nArtículo 12.-Funciones\ndel Comité Interinstitucional de Información Ambiental (CIIA-SINIA).  \n\na) Apoyar a la UC-SINIA en el desarrollo del SINIA de acuerdo\ncon las directrices emitidas por el CD-SINIA \n\nb) Apoyar a la UC-SINIA en el diagnóstico sobre la situación de\nla información ambiental en cada una de las instancias que representan.\n\nc) Suministrar los requerimientos técnicos y de\ngestión institucional para el desarrollo del SINIA según las necesidades del\nárea que representa.\n\nd) Evaluar, en coordinación con la UC-SINIA, los perfiles de\nlos proyectos nacionales relacionados con la generación de información\nambiental y realizar sugerencias que mejoren la gestión del conocimiento a\ntravés del SINIA.\n\ne) Definir, en coordinación con la UC-SINIA, los estándares\nmás adecuados para la generación e intercambio de la información ambiental.\n\nf)  Gestionar los recursos necesarios para el\ndesarrollo del sistema.\n\nArtículo 13.-Financiamiento. El principal\nfinanciamiento del SINIA se realizará a través de los recursos financieros y\nhumanos existentes en las instituciones y aquellos aportes de organismos\nnacionales y de cooperación internacional.\n\nArtículo 14.-Modificaciones.\nModifíquese el Artículo 3º del Decreto Ejecutivo No. 29540 del 11 de mayo del\n2001, para que se lea de la siguiente manera:\n\n           \n \"Artículo 3º-De los objetivos: El Centro\nNacional de Información Geoambiental tendrá los siguientes objetivos:\n\n           \na.         Consolidar la organización del CENIGA para atender\nadecuadamente los alcances de su misión y visión.\n\n           \nb.         Desarrollar los instrumentos legales para la conformación y\noperación del SINIA y la RENIA.\n\n           \nc.         Establecer una estrecha relación de coordinación y soporte\ncon el SINIA y la RENIA\na través de los mecanismos que se establezcan en el instrumento legal que se\ndefina.\n\n           \nd.         Desarrollar el sistema oficial de estadísticas e indicadores\nambientales nacionales.\n\n           \ne.         Desarrollar el sistema integral de información geográfica de\ncobertura nacional para la incorporación y difusión de la información\ngeográfica ambiental y fundamental.\n\n           \nf.          Elaborar los informes anuales sobre el estado del ambiente.\n\n           \ng.         Representar al MINAET en las instancias nacionales y en los\norganismos internacionales relacionados con el ámbito de acción del CENIGA y\ndel SINIA.\n\n           \nh.         Desarrollar los catálogos de información ambiental para\ndisponerlos a los usuarios interesados.\n\n           \ni.          Compilar y distribuir información ambiental relevante.\n\n           \nj.          Brindar apoyo en la temática de ordenamiento territorial\nnacional, conforme lo estipula la Ley Orgánica del Ambiente. \n\n           \nk.         Cualquier otra que se le asigne.\"\n\nArtículo 15.-Rige. Rige a partir de su publicación en\nel Diario Oficial La\n Gaceta.\n\nDado en la Presidencia de la República, a los\nveintinueve días del mes de enero del dos mil trece.", "body_en_text": "in the entirety of the text\n\n -\n\n Full Text of Norm 37658\n\n Establishes the National Environmental Information System (Sistema Nacional de Información Ambiental, SINIA) and amends\nExecutive Decree No. 29540 \"Constitutes the National Geo-environmental Information Center as an organ\nof the General Directorate of Hydrocarbons of the Ministry of Environment and Energy\"\n\nFull Text of act: 17878E\n\nNo. 37658-MINAET\n\n(This executive decree was repealed\nby Article 19 of Executive Decree No. 45138 of February 20,\n2025 \"Creation\nof the National Geo-environmental Information Center (CENIGA) and establishment\nof the National Environmental Information System (SINIA), and declaration\nof public interest\")\n\nTHE PRESIDENT OF THE\nREPUBLIC\n\nAND THE MINISTER OF\nENVIRONMENT, ENERGY\n\nAND TELECOMMUNICATIONS\n\nExercising the powers conferred by articles\n9, 27, 30, 33, 46, 50, and 140, subsections 3) and 18), of the Political Constitution of\nthe Republic of Costa Rica; articles 25.1) and 27.1) of the General Law of\nPublic Administration No. 6227 of May 2, 1978; article 2 subsection e) and\n5 of the Organic Law of the Environment No. 7554 of October 4, 1995; article\n22 of the Biodiversity Law, No. 7788 of April 30, 1998; articles 2\nand 3 of the Law of the National Archives System No. 7202 of October 24,\n1990; article 5 of the Law for the Protection of Citizens from the Excess of\nAdministrative Requirements and Procedures No. 8220 of March 4, 2002 and\nExecutive Decree No. 29540 of May 11, 2001, Constitution of the National\nGeo-environmental Information Center.\n\nWhereas:\n\nI.-That Principle 10 of the 1992 Rio de Janeiro Declaration stipulates that every person shall have adequate access to information concerning the environment held by public authorities, for which purpose they shall facilitate and encourage public awareness and participation by making information effectively accessible.\n\nII.-That to exercise the right to a healthy and ecologically balanced environment, established in the Political Constitution, it is required that inhabitants have efficient access to information on the state of the environment, natural resources, and institutional management.\n\nIII.-That every person shall have equality in accessing and requesting information of a public nature from the authorities, for which free access is guaranteed, with State secrets remaining safeguarded.\n\nIV.-That the Organic Law of the Environment stipulates that the State shall promote the implementation of an information system with environmental indicators, intended to measure their evolution and correlation with economic and social indicators for the country.\n\nV.-That the Law of the National Archives System regulates the functioning of the organs of the National Archives System, which involves the archives of the institutions that make up the Executive, Legislative, and Judicial Branches, and other public entities.\n\nVI.-That the Law for the Protection of Citizens from the Excess of Administrative Requirements and Procedures establishes as an institutional obligation the provision to the administered party of information on the procedures and requirements carried out in the respective administrative unit or dependency.\n\nVII.-That the Organic Law of the Environment establishes as one of the State's obligations, the defining and executing of national land-use planning (ordenamiento territorial) policies that contribute to regulating and promoting human settlements, economic and social activities, and physical-spatial development in order to achieve greater well-being for the population, the use of natural resources, and the conservation of the environment.\n\nVIII.-That the National Geo-environmental Information Center of the Ministry of Environment, Energy and Telecommunications is the specialized organ for the development of information systems, platform implementation, data and metadata management, and other related activities for generating environmental and national land-use planning (ordenamiento territorial) information.\n\nIX.-That it is of high importance to integrate and publicize the geo-environmental information of Costa Rica, so that it is made known to actors and users, making it necessary to formalize the National Environmental Information System (SINIA), as the official platform for coordination and institutional and sectoral linkage of the Costa Rican State to facilitate the management and distribution of knowledge of national environmental information. Therefore:\n\nDecree:\n\n\"ESTABLISHMENT OF THE NATIONAL ENVIRONMENTAL INFORMATION SYSTEM (SINIA) AND AMENDMENT\n\nOF ARTICLE 3 OF EXECUTIVE DECREE\n\nNo. 29540-MINAE OF MAY 11,\n\n2001\"\n\nArticle 1.-Establishment of the System. The National Environmental Information System is established, hereinafter referred to as SINIA, which shall be under the responsibility of the Ministry of Environment, Energy and Telecommunications, coordinated by the National Geo-environmental Information Center (CENIGA). The National Environmental Information System is constituted as the official platform for coordination and institutional and sectoral linkage of the Costa Rican State to facilitate the management and distribution of knowledge of national environmental information.\n\nArticle 2.-Abbreviations:\n\nCENIGA: National Geo-environmental Information Center.\n\nCD-SINIA: SINIA Board of Directors.\n\nCIIA-SINIA: SINIA Inter-institutional Committee on Environmental Information.\n\nDTI: Information Technology Directorate.\n\nIDE: Spatial data infrastructure.\n\nMINAET: Ministry of Environment, Energy and Telecommunications.\n\nRENIA: National Environmental Information Network.\n\nSINIA: National Environmental Information System.\n\nUC-SINIA: Unit for the Coordination of the development and operation of the SINIA.\n\nArticle 3.-Operation of the SINIA. For the operation of the SINIA, it will be required to constitute the National Environmental Information Network, hereinafter RENIA, coordinated by CENIGA and made up of environmental information nodes, understood as the technical units of those governmental and non-governmental entities related to the generation and use of environmental information. For this purpose, the current regulations that dictate the responsibility of the different dependencies and national entities linked to national environmental information, as well as other organized national groups, must be considered.\n\nArticle 4.-Organization. For the operation of the SINIA, it shall count on the following organization:\n\na) (Repealed by Article 21 of the Operational Regulation of the Sectoral Planning Secretariat for Environment, Energy, Seas and Land-Use Planning (SEPLASA), approved by executive decree No. 40710 of August 4, 2017)\n\nb) A unit for the coordination of the development and operation of the SINIA, hereinafter UC-SINIA.\n\nc) An Inter-institutional Committee on Environmental Information of the SINIA, hereinafter CIIA-SINIA.\n\nArticle 5.-Constitution of the CD-SINIA. (Repealed by Article 21 of the Operational Regulation of the Sectoral Planning Secretariat for Environment, Energy, Seas and Land-Use Planning (SEPLASA), approved by executive decree No. 40710 of August 4, 2017)\n\nArticle 6.-Functions of the Board of Directors (CD-SINIA). The Board of Directors (CD-SINIA) shall have the following functions:\n\na) Establish the high-level strategic requirements for the development and operation of the SINIA.\n\nb) Control the execution of the strategic objectives of the SINIA.\n\nc) Approve strategic alliances with other information agencies.\n\nd) Approve the internal regulations of the SINIA.\n\ne) Approve the reports submitted by the Unit for the Coordination of the SINIA (UC-SINIA).\n\nTo fulfill its functions, the Board of Directors (CD-SINIA) must meet at least twice a year, and may convene extraordinary meetings as required. The call for these meetings shall be facilitated by the Office of the Minister of Environment, Energy and Telecommunications, in coordination with the Unit for the Coordination (UC-SINIA).\n\nArticle 7.-Constitution of the Unit for the Coordination for the development and operation of the SINIA (UC-SINIA). The Unit for the Coordination for the development and operation of the SINIA (UC-SINIA) is created, which shall be exercised by CENIGA.\n\nArticle 8.-Functions of the Unit for the Coordination (UC-SINIA). The functions of the Unit for the Coordination (UC-SINIA) shall be:\n\na) Coordinate and ensure the development and operation of the SINIA, according to the guidelines issued by the CD-SINIA.\n\nb) Convene the CIIA-SINIA to meetings, at least once a month, and follow up on the agreements reached in said Commission.\n\nc) Serve as a liaison between the CD-SINIA and the CIIA-SINIA to transmit the guidelines and agreements generated in both agencies.\n\nd) Ensure compliance with the guidelines and agreements generated by the CD-SINIA and the CIIA-SINIA.\n\ne) Render periodic reports to the CD-SINIA on the status of progress and operation of the SINIA. These reports shall be semi-annual or whenever the CD-SINIA requests them.\n\nf) The UC-SINIA jointly with the CIIA-SINIA shall identify and manage the official incorporation of the different nodes that will make up the RENIA.\n\ng) Manage the publication of environmental information, guaranteeing that it is available to all types of national and international users.\n\nArticle 9.-Creation of the Inter-institutional Committee on Environmental Information CIIA-SINIA. The Inter-institutional Committee on Environmental Information (CIIA-SINIA) is created as the inter-institutional technical commission for support in achieving the development of the SINIA. The coordination of the CIIA-SINIA falls to the UC-SINIA.\n\nArticle 10.-Constitution of the Inter-institutional Committee on Environmental Information (CIIA-SINIA). The Inter-institutional Committee on Environmental Information (CIIA-SINIA) shall be composed of representatives (titular and alternate) from the main information nodes of the RENIA. The UC-SINIA must manage, through the Ministerial Office, the official designation of each of the CIIA-SINIA representatives.\n\nArticle 11.-On the nodes. Each information node shall be responsible for channeling to the SINIA the corresponding institutional information, according to its area of responsibility.\n\nArticle 12.-Functions of the Inter-institutional Committee on Environmental Information (CIIA-SINIA).\n\na) Support the UC-SINIA in the development of the SINIA in accordance with the guidelines issued by the CD-SINIA.\n\nb) Support the UC-SINIA in the diagnosis of the situation of environmental information in each of the agencies they represent.\n\nc) Provide the technical and institutional management requirements for the development of the SINIA according to the needs of the area they represent.\n\nd) Evaluate, in coordination with the UC-SINIA, the profiles of national projects related to the generation of environmental information and make suggestions that improve knowledge management through the SINIA.\n\ne) Define, in coordination with the UC-SINIA, the most suitable standards for the generation and exchange of environmental information.\n\nf) Manage the necessary resources for the development of the system.\n\nArticle 13.-Financing. The principal financing of the SINIA shall be carried out through the financial and human resources existing in the institutions and those contributions from national agencies and international cooperation.\n\nArticle 14.-Amendments. Amend Article 3 of Executive Decree No. 29540 of May 11, 2001, to read as follows:\n\n \"Article 3.-On the objectives: The National Geo-environmental Information Center shall have the following objectives:\n\n a. Consolidate the organization of CENIGA to adequately address the scope of its mission and vision.\n\n b. Develop the legal instruments for the formation and operation of the SINIA and the RENIA.\n\n c. Establish a close relationship of coordination and support with the SINIA and the RENIA through the mechanisms established in the defined legal instrument.\n\n d. Develop the official system of national environmental statistics and indicators.\n\n e. Develop the comprehensive geographic information system of national coverage for the incorporation and dissemination of geographic environmental and fundamental information.\n\n f. Prepare the annual reports on the state of the environment.\n\n g. Represent MINAET in national agencies and in international organizations related to the scope of action of CENIGA and SINIA.\n\n h. Develop environmental information catalogs to make them available to interested users.\n\n i. Compile and distribute relevant environmental information.\n\n j. Provide support in the area of national land-use planning (ordenamiento territorial), as stipulated by the Organic Law of the Environment.\n\n k. Any other that is assigned.\"\n\nArticle 15.-Effective Date.
