artículos\n27 inciso 1 y 28 inciso 2 de la Ley General de Administración Pública Nº 6227 del\n2 de mayo de 1978; artículos 1, 2, 3, 4, 5 y el transitorio II de la Ley\nOrgánica del Ambiente Nº 7554 del 4 de octubre de 1995 y los artículos 25, 31,\n38 y transitorio I del \"Reglamento del Sistema de Reconocimientos Ambientales\n(SIREA) y derogatoria del Decreto Ejecutivo Nº 33525-MINAE, Reglamento para\notorgar el certificado Bandera Ecológica del 27 de noviembre de 2006, Decreto\nEjecutivo Nº 37109\" del 13 de febrero de 2012.\n\nConsiderando:\n\n1º-Que los habitantes de la República tienen derecho a un ambiente sano y\necológicamente equilibrado, siendo deber del Estado garantizar ese derecho,\ndefenderlo y preservarlo, según lo disponen la Constitución Política y la Ley\nOrgánica del Ambiente.\n\n2º-Que el Ministerio de Ambiente y Energía ha hecho esfuerzos por reconocer\na las empresas privadas y a las instituciones públicas, sus acciones en\nbeneficio del ambiente, más allá del cumplimiento de la normativa asociada.\n\n3º-Que el Ministerio de Ambiente y Energía en virtud de su rectoría en\nmateria ambiental dentro del Estado Costarricense considera oportuno otorgar\nmayores opciones a las empresas, instituciones públicas u organizaciones que\ndeseen someterse voluntariamente a los procesos de mejora ambiental continua, y\npor lo tanto, se hace necesario contar con instrumentos, procedimientos y la\ndefinición de responsabilidades claras, modernas y verificables.\n\n4º-Que de conformidad con lo anterior, el día 23 de mayo de 2012 salió\npublicado en La Gaceta Nº 99 el \"Reglamento del Sistema de\nReconocimientos Ambientales (SIREA) y derogatoria del Decreto Ejecutivo\nNº33525-MINAE, Reglamento para otorgar el certificado Bandera Ecológica del 27\nde noviembre de 2006 Decreto Ejecutivo Nº 37109\" del 13de febrero de 2012 cuyo\nobjetivo es crear el Sistema de Reconocimientos Ambientales (en adelante\nSIREA), que tiene como objetivo reconocer públicamente a aquellas\norganizaciones que se han destacado por provocar un cambio significativo en el\ncampo ambiental del país; contribuyendo al logro de los objetivos del Plan\nNacional de Desarrollo y a una estrategia nacional de desarrollo sostenible a\nlargo plazo.\n\n5º-Que el artículo 25 del Decreto Ejecutivo Nº 37109 del 13 de febrero de\n2012 establece que: \"los criterios para el establecimiento de los costos de\ninscripción y de evaluación serán definidos por el Poder Ejecutivo mediante\ndecreto ejecutivo. Los costos de evaluación para cada Organización dependerán\ndel alcance de ésta, para ello el Organizador de un reconocimiento determinará\nel tiempo requerido de evaluación, así como el perfil y número de evaluadores\nrequeridos y con base en esto, calculará los montos totales a pagar por las\norganizaciones por evaluación y seguimiento según los costos establecidos\".\n\n6º-Que en relación con lo anterior, el artículo 31 del Decreto Ejecutivo Nº\n37109 del 13 de febrero de 2012 señala que \"la Organización interesada en\nrenovar su reconocimiento deberá pagar el monto correspondiente para el proceso\nde renovación de acuerdo a los costos de inscripción y de evaluación definidos\nen el artículo 25º de este reglamento y que serán publicados por decreto\nejecutivo emitido por el Poder Ejecutivo\".\n\n7º-Así mismo, el artículo 38 inciso d) del Decreto Ejecutivo Nº 37109 del\n13 de febrero de 2012 indica que para que la persona jurídicas públicas o\nprivadas puedan participar en los Acuerdos Voluntarios de Producción más Limpia\ndeben de \"pagar los montos de inscripción y de evaluación, de acuerdo con lo\nestablecido en el artículo 25º de este reglamento\".\n\n8º-Que el Transitorio I del Decreto Ejecutivo Nº 37109 del 13 de febrero de\n2012 señala que: \"El Ministerio de Ambiente, Energía y Telecomunicaciones\ncontará con un plazo máximo de seis meses a partir de la publicación de este\nreglamento en el Diario Oficial La Gaceta para emitir el decreto ejecutivo de\ncostos de inscripción y evaluación consignado en el artículo 25° y costos de\ninscripción y evaluación de los Acuerdos Voluntarios de Producción más Limpia\nconsignados en el artículo 38. Por tanto,\n\nDECRETAN\n\n\"REGLAMENTO PARA EL ESTABLECIMIENTO DE LOS COSTOS\n\nDE INSCRIPCIÓN Y EVALUACIÓN EN EL MARCO DEL\n\nSISTEMA DE RECONOCIMIENTOS AMBIENTALES\"\n\nArtículo 1º-Objeto del Reglamento. El presente reglamento tiene por\nobjeto definir los costos de inscripción y evaluación en el marco del Sistema\nde Reconocimiento Ambientales (SIREA) las organizaciones que opten por:\n\na) Reconocimientos creados en el artículo 10 del Decreto Ejecutivo Nº 37109\ndel 13 de febrero de 2012, a excepción del reconocimiento en \"Emprendedurismo Ambiental\".\n\nb) Renovar alguno de los reconocimientos anteriormente señalados.\n\nc) Acuerdo voluntario de producción más limpia.\n\nArtículo 2º-Definiciones y abreviaciones. Para efectos de este\nreglamento se entenderá por:\n\na) Acuerdos Voluntarios de Producción más Limpia (AVP+L): Acuerdo de\ncarácter voluntario, que se lleva a cabo entre los ministerios con competencia\nen el tema del cual se trata éste, y un sector o ente productivo que se acoge a\nun mecanismo de autorregulación, mediante el establecimiento de metas claras y\ncompromisos de mutuo acuerdo en el tema de producción más limpia, que les\nllevarán a un mejor desempeño económico y ambiental.\n\nb) Alcance de evaluación: se refiere a la extensión y límites de una\nevaluación en una organización.\n\nc) Costos de inscripción para optar por algún reconocimiento: Costos\nque paga la Organización\nal inicio del proceso para participar en los reconocimientos del SIREA y que son\ncancelados al Organizador con la finalidad cubrir los costos operativos y\nlogísticos del sistema, incluyendo el pago del estado financiero auditado.\n\nd) Costos de evaluación: Costos calculados para cubrir el valor de\nlas evaluaciones a realizar a las organizaciones interesadas en participar en\nlos reconocimientos del SIREA o en un Acuerdo Voluntario de Producción más\nLimpia (AVP+L), y que son cancelados por los interesados al respectivo\nOrganizador, con la finalidad de determinar si cumplen con los criterios de\nevaluación definidos para el reconocimiento, o con los compromisos interesados\nal respectivo Organizador, con la finalidad de determinar si cumplen con los criterios\nde evaluación definidos para el reconocimiento, o con los compromisos asumidos en\nAVP+L respectivo.\n\ne) Costos de renovación de un reconocimiento: Costos que paga la Organización\nal Organizador para efectos de renovar su reconocimiento una vez vencido el\nplazo establecido en el artículo 29 del Decreto Ejecutivo Nº 37109 del 13 de\nfebrero de 2012; tienen por finalidad cubrir los costos operativos y logísticos\nde la renovación de su reconocimiento.\n\nf) Costos de inscripción de un Acuerdo Voluntario de Producción más\nLimpia: Costos que paga la Organización interesada al Organizador con la\nfinalidad de cubrir los costos operativos y logísticos del proceso de\nsuscripción de un AVP+L.\n\ng) Evaluador: Persona designada por el Organizador para realizar la\nevaluación de una Organización que aplica a un reconocimiento o a un acuerdo\nvoluntario del SIREA.\n\nh) Evaluador Líder: Persona designada por el Organizador como parte\nde un equipo evaluador cuya responsabilidad es coordinar las actividades de la\nevaluación y es el responsable de ésta ante el Organizador.\n\ni) Equipo evaluador: Uno o más evaluadores designados por el\nOrganizador, encargados de realizar una evaluación de una Organización que\naplica a un reconocimiento o a un acuerdo voluntario del SIREA.\n\nj) Experto Técnico: Persona asignada por el Organizador para aportar\nconocimientos técnicos específicos o experiencia en la evaluación de una\nOrganización que aplica a un reconocimiento o a un acuerdo voluntario del\nSIREA.\n\nk) Organización: se entenderá por Organización a todas las personas\nfísicas y jurídicas, públicas y privadas que opten por un reconocimiento del\nSIREA, que deseen renovar alguno de estos, o que requieran optar por un acuerdo\nvoluntario de producción más limpia\n\nl) Organizador: Es un ente público encargado de gestionar los\nprocesos técnicos y logísticos de algún reconocimiento del SIREA.\n\nm) Reconocimiento: Reconocimiento público al cual las organizaciones\npueden acceder de manera voluntaria, con el objeto de evidenciar logros\nespecíficos que demuestren que están realizando un esfuerzo sistemático,\nsostenido y exitoso en procura del desarrollo sostenible, de acuerdo con los\nprincipios y requerimientos del SIREA. Se otorga a una Organización que\nhabiéndose sometido al sistema de evaluación propuesto por el SIREA, obtiene el\npuntaje que la hace merecedora de dicho galardón.\n\nn) SE: Secretaría Ejecutiva del Sistema de Reconocimientos\nAmbientales.\n\no) SIREA: Es el Sistema de Reconocimientos Ambientales oficial de\ncarácter estatal que integra los reconocimientos ambientales indicados en el\nDecreto Ejecutivo Nº 37109 del 13 de febrero de 2012, así como otros que se\nincorporen en el futuro. Comprende una estructura organizativa y logística que\nle da soporte.\n\nArtículo 3º- Sobre los costos. Los rubros cobrados a las\nOrganizaciones para optar por un reconocimiento o un AVP+L en el marco del\nSIREA serán administrados por el Organizador; se calcularán con base en un\npresupuesto inicial de costos operativos y logísticos, el cual debe ser aprobado\npor la\n Secretaría Ejecutiva del SIREA. Dentro de estos costos se\nincluyen los siguientes:\n\na- Costos de inscripción para optar por algún reconocimiento.\n\nb- Costos de renovación de un reconocimiento.\n\nc- Costos de inscripción de un AVP+L\n\nd- Costos de evaluación.\n\nArtículo 4º- Tarifas para optar por algún reconocimiento del SIREA.\nLas Organizaciones que deseen optar por alguno de los reconocimientos del SIREA\ndeberán pagar:\n\na) Los costos de inscripción, que serán de US$750.00 por cada organización\ninteresada\n\nb) Los costos de evaluación, según lo indicado en el artículo 7 del\npresente reglamento.\n\nArtículo 5º- Tarifas para el proceso de renovación de un reconocimiento:\nlas Organizaciones que requieran renovar un reconocimiento, deberán cancelar:\n\na) Los costos de renovación, los cuales serán de US$375.00 por cada\norganización interesada\n\nb) Los costos de evaluación, según lo indicado en el artículo 7 del\npresente reglamento.\n\nArtículo 6º- Tarifas para optar por un AVP+L: las Organizaciones que\nrequieran suscribir un AVP+L, deberán cancelar:\n\na) Los costos de inscripción del AVP+L, que serán de US$375.00 por cada\norganización interesada\n\nb) Los costos de evaluación, según lo indicado en el artículo 7 del\npresente reglamento.\n\nArtículo 7º-Tarifas por costos de evaluación. En caso que la organización\ninteresada no realice el pago total de los montos estipulados en este\nreglamento, no se continuará con el trámite de inscripción o evaluación según\ncorresponda.\n\nArtículo 9º-Forma de pago. El pago se podrá realizar mediante depósito\no transferencia electrónica en una cuenta que el Organizador defina para tal\nfin, previa autorización de la Secretaría Ejecutiva del SIREA.\n\nLa La cuenta que el Organizador\nutilice para recibir el dinero de los interesados en participar en el SIREA, ya\nsea por costos de inscripción o de evaluación, tendrá este único uso.\n\nArtículo 10.-Presupuesto del Organizador y gastos del SIREA. El\nOrganizador presentará anualmente un presupuesto a la Secretaría Ejecutiva\ndel SIREA, quien tendrá la facultad de aprobarlo o improbarlo. Los gastos a\nrealizar por el Organizador deberán estar acordes con el presupuesto aprobado\npor la\n Secretaría Ejecutiva del SIREA.\n\nLos rubros que se podrán considerar en el presupuesto deberán estar acordes\ncon las facultades y responsabilidades indicados en el artículo 7 del Decreto\nEjecutivo Nº 37109 del 13 de febrero de 2012.\n\nArtículo 11.-Moneda en que deben realizarse los depósitos. Los\ndepósitos se deberán realizar en colones según el tipo de cambio oficial de\nventa establecido por el Banco Central de Costa Rica al momento en que se\nefectúe la transacción.\n\nArtículo 12.-Mecanismo para realizar ajustes. La Secretaría Ejecutiva\ndel SIREA revisará y actualizará, cada año, el sistema tarifario indicado en\nlos artículos 4, 5, 6 y 7 del presente reglamento con el fin de asegurar la\nsostenibilidad del sistema.\n\nArtículo 13.-Fondo Solidario para Micro y Pequeña empresa. Una vez\nsufragados los gastos aprobados en el presupuesto, según lo indicado en el\nartículo 10 de este reglamento, y en caso de existir excedentes se creará un\nfondo solidario en una cuenta independiente administrada por el Organizador y\nsupervisada por la SE\ndel SIREA. Estos fondos cubrirán hasta un 50 % de los costos de inscripción de\nlas Micro y Pequeñas empresas que se inscriban ante el Organizador el siguiente\naño en los plazos definidos en el artículo 20 del Decreto Ejecutivo Nº 37109\ndel 13 de febrero de 2012. El criterio de asignación para ser beneficiario del\nfondo solidario se hará siguiendo el orden cronológico de inscripción de las\nMicro y Pequeñas empresas.\n\nArtículo 14.-Convenios de Cooperación técnica para apoyo de Micro y\nPequeña Empresa. The evaluation costs for each Organization will depend on its scope; for this purpose, the Organizer (Organizador) of a recognition will determine the required evaluation time, as well as the profile and number of evaluators required, and based on this, will calculate the total amounts to be paid by the organizations for evaluation and follow-up according to the established costs.\"\n\n6th-That in relation to the above, Article 31 of Decreto Ejecutivo Nº 37109 of February 13, 2012, indicates that \"the Organization interested in renewing its recognition must pay the corresponding amount for the renewal process according to the inscription and evaluation costs defined in Article 25º of this regulation and which will be published by decreto ejecutivo issued by the Executive Branch.\"\n\n7th-Likewise, Article 38 subsection d) of Decreto Ejecutivo Nº 37109 of February 13, 2012, indicates that for public or private legal entities to participate in the Voluntary Cleaner Production Agreements (Acuerdos Voluntarios de Producción más Limpia), they must \"pay the inscription and evaluation amounts, in accordance with what is established in Article 25º of this regulation.\"\n\n8th-That Transitory I of Decreto Ejecutivo Nº 37109 of February 13, 2012, indicates that: \"The Ministry of Environment, Energy and Telecommunications shall have a maximum period of six months from the publication of this regulation in the Official Gazette La Gaceta to issue the decreto ejecutivo for inscription and evaluation costs set forth in Article 25° and inscription and evaluation costs for the Voluntary Cleaner Production Agreements set forth in Article 38. Therefore,\n\nTHEY DECREE\n\n\"REGULATION FOR THE ESTABLISHMENT OF INSCRIPTION\n\nAND EVALUATION COSTS WITHIN THE FRAMEWORK OF THE\n\nENVIRONMENTAL RECOGNITION SYSTEM\"\n\nArticle 1º-Purpose of the Regulation. The purpose of this regulation is to define the inscription and evaluation costs within the framework of the Environmental Recognition System (Sistema de Reconocimiento Ambientales, SIREA) for organizations that choose to:\n\na) Apply for Recognitions created in Article 10 of Decreto Ejecutivo Nº 37109 of February 13, 2012, with the exception of the recognition in \"Environmental Entrepreneurship\" (Emprendedurismo Ambiental).\n\nb) Renew any of the recognitions previously mentioned.\n\nc) Enter into a voluntary cleaner production agreement (acuerdo voluntario de producción más limpia).\n\nArticle 2º-Definitions and abbreviations. For the purposes of this regulation, the following shall be understood:\n\na) Voluntary Cleaner Production Agreements (Acuerdos Voluntarios de Producción más Limpia, AVP+L): A voluntary agreement, carried out between the ministries with competence in the subject matter thereof, and a productive sector or entity that avails itself of a self-regulation mechanism, through the establishment of clear goals and mutually agreed commitments on the topic of cleaner production, which will lead them to better economic and environmental performance.\n\nb) Evaluation scope: refers to the extent and limits of an evaluation in an organization.\n\nc) Inscription costs to apply for a recognition: Costs that the Organization pays at the beginning of the process to participate in the SIREA recognitions, and which are paid to the Organizer for the purpose of covering the system's operational and logistical costs, including the payment for the audited financial statement.\n\nd) Evaluation costs: Costs calculated to cover the value of the evaluations to be carried out on organizations interested in participating in the SIREA recognitions or in an AVP+L, and which are paid by the interested parties to the respective Organizer, for the purpose of determining if they meet the evaluation criteria defined for the recognition, or with the commitments assumed in the respective AVP+L.\n\ne) Recognition renewal costs: Costs that the Organization pays to the Organizer for the purpose of renewing its recognition once the term established in Article 29 of Decreto Ejecutivo Nº 37109 of February 13, 2012, has expired; their purpose is to cover the operational and logistical costs of renewing its recognition.\n\nf) Inscription costs for a Voluntary Cleaner Production Agreement: Costs that the interested Organization pays to the Organizer for the purpose of covering the operational and logistical costs of the AVP+L subscription process.\n\ng) Evaluator: Person designated by the Organizer to carry out the evaluation of an Organization that applies for a recognition or a voluntary agreement under SIREA.\n\nh) Lead Evaluator: Person designated by the Organizer as part of an evaluation team whose responsibility is to coordinate the evaluation activities and who is responsible for it before the Organizer.\n\ni) Evaluation team: One or more evaluators designated by the Organizer, responsible for carrying out an evaluation of an Organization that applies for a recognition or a voluntary agreement under SIREA.\n\nj) Technical Expert: Person assigned by the Organizer to provide specific technical knowledge or experience in the evaluation of an Organization that applies for a recognition or a voluntary agreement under SIREA.\n\nk) Organization: Organization shall be understood to mean all natural and legal persons, public and private, who choose a SIREA recognition, wish to renew any of these, or need to opt for a voluntary cleaner production agreement.\n\nl) Organizer (Organizador): It is a public entity responsible for managing the technical and logistical processes of a SIREA recognition.\n\nm) Recognition: Public recognition to which organizations can voluntarily accede, with the aim of demonstrating specific achievements that show they are making a systematic, sustained, and successful effort in pursuit of sustainable development, in accordance with the principles and requirements of SIREA. It is granted to an Organization that, having submitted to the evaluation system proposed by SIREA, obtains the score that makes it deserving of said award.\n\nn) ES: Executive Secretariat (Secretaría Ejecutiva) of the Environmental Recognition System.\n\no) SIREA: It is the official state-level Environmental Recognition System that integrates the environmental recognitions indicated in Decreto Ejecutivo Nº 37109 of February 13, 2012, as well as others that may be incorporated in the future. It comprises an organizational and logistical structure that supports it.\n\nArticle 3º- Regarding the costs. The items charged to Organizations to opt for a recognition or an AVP+L within the framework of SIREA will be administered by the Organizer; they will be calculated based on an initial budget of operational and logistical costs, which must be approved by the Executive Secretariat (Secretaría Ejecutiva) of SIREA. These costs include the following:\n\na- Inscription costs to apply for a recognition.\n\nb- Renewal costs of a recognition.\n\nc- Inscription costs for an AVP+L.\n\nd- Evaluation costs.\n\nArticle 4º- Tariffs for opting for a SIREA recognition. Organizations wishing to opt for any of the SIREA recognitions must pay:\n\na) The inscription costs, which shall be US$750.00 for each interested organization.\n\nb) The evaluation costs, as indicated in Article 7 of this regulation.\n\nArticle 5º- Tariffs for the renewal process of a recognition: Organizations that need to renew a recognition must pay:\n\na) The renewal costs, which shall be US$375.00 for each interested organization.\n\nb) The evaluation costs, as indicated in Article 7 of this regulation.\n\nArticle 6º- Tariffs for opting for an AVP+L: Organizations that need to subscribe to an AVP+L must pay:\n\na) The inscription costs for the AVP+L, which shall be US$375.00 for each interested organization.\n\nb) The evaluation costs, as indicated in Article 7 of this regulation.\n\nArticle 7º-Tariffs for evaluation costs. The tariffs corresponding to the evaluation costs indicated in Articles 4, 5, and 6 of this regulation will be charged according to the following table:\n\n| Type of evaluator | Amount to be paid per type of evaluator |\n| --- | --- |\n| Lead evaluator | US$ 200.00 per workday |\n| Evaluator | US$ 150.00 per workday |\n| Technical expert | US$ 100.00 per workday |\n\nThe total evaluation costs will be calculated by the Organizer based on:\n\na) The items previously indicated.\n\nb) The composition of the evaluation team as determined by the Organizer according to the scope requested and the type of activity to be evaluated.\n\nc) The time required for the designated evaluation team to cover the evaluation.\n\nArticle 8º-Non-compliance with payment. In the event that the interested organization does not make the full payment of the amounts stipulated in this regulation, the inscription or evaluation process will not continue, as applicable.\n\nArticle 9º-Form of payment. Payment may be made by deposit or electronic transfer into an account that the Organizer defines for this purpose, with prior authorization from the Executive Secretariat (Secretaría Ejecutiva) of SIREA.\n\nThe account that the Organizer uses to receive money from those interested in participating in SIREA, whether for inscription or evaluation costs, shall have this sole use.\n\nArticle 10.-Organizer's budget and SIREA expenses. The Organizer will annually submit a budget to the Executive Secretariat (Secretaría Ejecutiva) of SIREA, who will have the authority to approve or reject it. The expenses to be incurred by the Organizer must be in accordance with the budget approved by the Executive Secretariat (Secretaría Ejecutiva) of SIREA.\n\nThe items that may be considered in the budget must be in accordance with the powers and responsibilities indicated in Article 7 of Decreto Ejecutivo Nº 37109 of February 13, 2012.\n\nArticle 11.-Currency in which deposits must be made. Deposits must be made in colones according to the official selling exchange rate established by the Central Bank of Costa Rica at the time the transaction is carried out.\n\nArticle 12.-Mechanism for making adjustments. The Executive Secretariat (Secretaría Ejecutiva) of SIREA will review and update, every year, the tariff system indicated in Articles 4, 5, 6, and 7 of this regulation in order to ensure the system's sustainability.\n\nArticle 13.-Solidarity Fund for Micro and Small Enterprises. Once the expenses approved in the budget have been covered, as indicated in Article 10 of this regulation, and in the event of surpluses, a solidarity fund will be created in an independent account administered by the Organizer and supervised by the ES of SIREA. These funds will cover up to 50% of the inscription costs of Micro and Small Enterprises that register with the Organizer the following year within the deadlines defined in Article 20 of Decreto Ejecutivo Nº 37109 of February 13, 2012. The allocation criterion to be a beneficiary of the solidarity fund will be made following the chronological order of inscription of the Micro and Small Enterprises.\n\nArticle 14.-Technical Cooperation Agreements to support Micro and Small Enterprises. MINAE is authorized to sign cooperation agreements with public entities that have trained personnel and that meet the requirements established in Articles 8 and 9 of Decreto Ejecutivo Nº 37109 of February 13, 2012, in order to collaborate in the evaluation of Micro and Small Enterprises duly registered as such with the MEIC and, in the case of agricultural enterprises, with the MAG. For such purposes, the public entity must also comply with the training and updating processes established by the Organizer.\n\nArticle 15.-Oversight mechanisms. In order to guarantee the appropriate use of funds, the Organizer must submit the following to the Executive Secretariat (Secretaría Ejecutiva) of SIREA:\n\na) Bank reconciliations of the accounts used, on a monthly basis.\n\nb) Financial statements of its activity as an organizer, on a monthly basis.\n\nc) An annual financial report as indicated in subsection s of Article 7 of Decreto Ejecutivo Nº 37109 of February 13, 2012.\n\nd) An annual operations report that includes all activities related to its functions as Organizer, as indicated in subsection s of Article 7 of Decreto Ejecutivo Nº 37109 of February 13, 2012.\n\ne) An externally audited financial statement upon the expiration of the term established in the Agreement that authorizes it as organizer.\n\nArticle 16.-Supplementary regulations. In matters not expressly provided for in this regulation, the provisions contained in Decreto Ejecutivo Nº 37109 \"Regulation of the Environmental Recognition System (Sistema de Reconocimientos Ambientales, SIREA) and repeal of Decreto Ejecutivo Nº33525-MINAE, Regulation for granting the Ecological Blue Flag certificate of November 27, 2006\" of February 13, 2012, shall apply supplementarily.\n\nArticle 17.-Effective as of its publication.\n\nGiven at the Presidency of the Republic, on the nineteenth day of the month of April of two thousand thirteen." }
