La presente Convención estará abierta a la adhesión de cualquier\norganización de integración económica regional constituida por Estados\nsoberanos con competencia para negociar, concluir y hacer aplicar acuerdos\ninternacionales relativos a cuestiones que les hayan sido remitidas por sus\nEstados miembros y que están cubiertas por la presente Convención.\n\n2. En sus instrumentos de adhesión dichas organizaciones declararán su grado\nde competencia en los asuntos cubiertos por\nla Convención. Estas\norganizaciones informarán asimismo al Gobierno Depositario de cualquier\nmodificación sustancial en su grado de competencia. Las notificaciones enviadas\npor las organizaciones que tengan por objetivo una integración económica\nregional en relación con su competencia en los asuntos cubiertos por esta\nConvención y las modificaciones a dicha competencia serán distribuidas a las\nPartes por el Gobierno Depositario.\n\n3. En los asuntos de su competencia, esas organizaciones ejercerán los\nderechos y cumplirán las obligaciones que\nla Convención\natribuye a sus Estados miembros, que son Partes de\nla Convención. El\nhecho generador ocurre en el momento en que cualquier persona física salga del\nterritorio nacional por un puesto fronterizo terrestre. Para estos efectos, se\nentenderá por salida del territorio nacional el momento en que las personas\npasen los puestos oficiales de la Dirección General de Migración y Extranjería,\nen cada puesto fronterizo terrestre, con el fin de salir del país.\n\nEstarán exentas del pago de este tributo, sin necesidad de pronunciamiento\nadministrativo previo, las personas contempladas en el artículo 7 de la Ley N.°\n8316, Ley Reguladora de los Derechos de Salida del Territorio Nacional, de 26\nde setiembre de 2002, así como los conductores de vehículos automotores de\ntransporte de carga y de transporte remunerado de personas en autobuses, según\nlo precise el reglamento.\n\n2) Veinticinco dólares estadounidenses (US$ 25,00) cuyo contribuyente será el\ndeclarante en cada declaración aduanera de exportación que ampare mercancías\ndestinadas a salir del país por un puesto fronterizo terrestre. Este tributo se\nestablece en contraprestación por los servicios suministrados por el Estado,\nrelacionados con la salida de mercancías del territorio nacional por vía\nterrestre. El hecho generador ocurre con la presentación de la declaración\naduanera de exportación que ampare mercancías destinadas a salir del territorio\nnacional por un puesto fronterizo terrestre.\n\nLos tributos indicados podrán ser cancelados en colones, al tipo de cambio\nde venta establecido por el Banco Central de Costa Rica, vigente el día de\npago. Su recaudación se realizará por medios electrónicos o por medio de los\nbancos estatales u otros entes estatales, según lo precise el reglamento.\n\nLos recursos que se recauden con motivo de los tributos indicados se\nadministrarán de acuerdo con lo indicado en el párrafo segundo del artículo 66\nde la Ley N.° 8131, Administración Financiera de la República y Presupuestos\nPúblicos, de 18 de setiembre de 2001, y sus reformas, y tendrán el siguiente\ndestino específico:\n\na) Un cincuenta por ciento (50%) del total recaudado\npor ambos tributos se utilizará tanto para sufragar las obligaciones del\nContrato de Préstamo N.º 3488/OC-CR, suscrito entre la República de Costa Rica\ny el Banco Interamericano de Desarrollo, para financiar el Programa de\nIntegración Fronteriza de Costa Rica, hasta la finalización del período de\namortización correspondiente, como para cubrir el costo de todas aquellas\nactividades y adquisiciones relacionadas con el desarrollo, la operación, la\nconservación y la ampliación de los puestos fronterizos terrestres, incluyendo\nlas obras de infraestructura, el mantenimiento, el personal, los bienes\nduraderos, los servicios, los materiales y los suministros, ya sea que esas\nactividades o adquisiciones se realicen directamente por la Administración,\nmediante la incorporación de los recursos respectivos a los presupuestos de los\nministerios que conforman el Consejo de Puestos Fronterizos Terrestres o el\nórgano que llegue a asumir sus competencias, como también transferencias a\nsujetos de derecho público o privado idóneos para administrar los fondos\npúblicos, o bien, por medio de esquemas de fideicomiso o cualquier otra figura\nque el ordenamiento jurídico permita, si así lo autoriza el Consejo de Puestos\nFronterizos Terrestres, mediante acuerdo. The present Convention shall be open to accession by any regional economic integration organization constituted by sovereign States with competence to negotiate, conclude, and implement international agreements on matters transferred to them by their Member States and covered by this Convention.\n\n2. In their instruments of accession, such organizations shall declare the extent of their competence in matters covered by the Convention. These organizations shall also inform the Depositary Government of any substantial modification in the extent of their competence. Notifications sent by organizations aiming at regional economic integration regarding their competence in matters covered by this Convention and modifications to such competence shall be distributed to the Parties by the Depositary Government.\n\n3. In matters within their competence, such organizations shall exercise the rights and fulfill the obligations that the Convention attributes to their Member States, which are Parties to the Convention. In such cases, the Member States of those organizations shall not exercise such rights individually.\n\n4. In the fields of their competence, organizations aiming at regional economic integration shall exercise their right to vote with a number of votes equal to the number of their Member States that are Parties to the Convention. Such organizations shall not exercise their right to vote in the event that their Member States exercise theirs, and vice versa.\n\n5. This certificate is issued, for the corresponding legal purposes, at the Dirección General de Política Exterior, at eleven o'clock on the twenty-third of August, two thousand twelve.\n\nARTICLE 3.- (Repealed by Article 6 of International Treaty No. 9430 approving the Protocol Amending the Marrakesh Agreement Establishing the World Trade Organization, Geneva, November 27, 2014, and its annex (Agreement on Trade Facilitation) and creating the Consejo Nacional de Facilitación del Comercio, of April 4, 2017.)\n\nARTICLE 4.- The following levies (tributos) are created, subject to the provisions set forth below and those set forth in the respective regulation (reglamento):\n\n1) Five United States dollars (US$ 5.00) whose taxpayer (contribuyente) shall be any natural person (persona física) leaving the national territory through a land border post (puesto fronterizo terrestre). The taxable event (hecho generador) occurs at the moment any natural person leaves the national territory through a land border post. For these purposes, leaving the national territory shall be understood as the moment persons pass the official posts of the Dirección General de Migración y Extranjería, at each land border post, in order to leave the country.\n\nThe following shall be exempt from payment of this levy (tributo), without the need for a prior administrative pronouncement: persons referred to in Article 7 of Law No. 8316, Ley Reguladora de los Derechos de Salida del Territorio Nacional, of September 26, 2002, as well as drivers of motor vehicles for cargo transport and for remunerated passenger transport in buses, as specified by the regulation (reglamento).\n\n2) Twenty-five United States dollars (US$ 25.00) whose taxpayer (contribuyente) shall be the declarant in each export customs declaration covering goods destined to leave the country through a land border post. This levy (tributo) is established in return for the services provided by the State related to the departure of goods from the national territory by land. The taxable event (hecho generador) occurs upon the submission of the export customs declaration covering goods destined to leave the national territory through a land border post.\n\nThe indicated levies (tributos) may be paid in colones, at the selling exchange rate established by the Banco Central de Costa Rica, in effect on the day of payment. Their collection shall be made by electronic means or through state banks or other state entities, as specified by the regulation (reglamento).\n\nThe resources collected from the indicated levies (tributos) shall be managed in accordance with the second paragraph of Article 66 of Law No. 8131, Administración Financiera de la República y Presupuestos Públicos, of September 18, 2001, and its amendments, and shall have the following specific destination:\n\na) Fifty percent (50%) of the total collected from both levies (tributos) shall be used both to meet the obligations of Loan Contract No. 3488/OC-CR, signed between the Republic of Costa Rica and the Inter-American Development Bank, to finance the Programa de Integración Fronteriza de Costa Rica, until the end of the corresponding amortization period, and to cover the cost of all activities and acquisitions related to the development, operation, conservation, and expansion of land border posts, including infrastructure works, maintenance, personnel, durable goods, services, materials, and supplies, whether those activities or acquisitions are carried out directly by the Administration, through the incorporation of the respective resources into the budgets of the ministries that make up the Consejo de Puestos Fronterizos Terrestres or the body that may assume its competencies, as well as transfers to suitable public or private law subjects to manage public funds, or through trust schemes or any other figure that the legal system allows, if so authorized by the Consejo de Puestos Fronterizos Terrestres, by agreement.
