Inmobiliario\".\n\n    Considerando:\n\nI.-Que mediante Ley Nº 8710, publicada en\nLa Gaceta Nº 48 del\n10 de marzo de 2009 se reforma el artículo 2 ° de\nla Ley Nº 5695, Ley de Creación\ndel Registro Nacional, y sus reformas, indicando que el Catastro Nacional pasa\na formar parte del Registro Inmobiliario.\n\nII.-Que\nel Decreto Ejecutivo Nº 35509-J de 30 de setiembre de 2009, Reglamento de\nOrganización del Registro Inmobiliario publicado en el Diario Oficial\nLa Gaceta Nº 198 del\n13 de octubre de 2009, establece que el Registro Inmobiliario está conformado\npor la Subdirección\nde Catastro y la\n Subdirección Registral.\n\nIII.-Que\nel Registro Inmobiliario del Registro Nacional, con fundamento en\nla Ley de Catastro Nacional Nº\n6545 de 25 de marzo de 1981, en su artículo 13 tiene como potestad exclusiva,\nla ejecución y mantenimiento del Catastro, función que puede delegar\nparcialmente en otras instituciones estatales.\n\nIV.-Que\nla Asamblea\n Legislativa, el 27 de noviembre de 2001, aprobó\nla Ley Nº 8154, \"Convenio de\nPréstamo Nº 1284/OC-CR, Programa de Regularización del Catastro y Registro\",\nsuscrito entre el Gobierno de la\n República y el Banco Interamericano de Desarrollo (BID), para\nla ejecución del Programa de Regularización del Catastro y Registro Nacional,\nque por disposición de la misma ley, está a cargo de una Unidad Ejecutora\nadscrita al Ministro de Hacienda como órgano desconcentrado.\n\nV.-Que\nel Programa de Regularización del Catastro y Registro Nacional, tiene como\ntarea el levantamiento catastral con el objetivo de formar el catastro nacional\ny compatibilizar la información catastral y registral de los inmuebles, en\naplicación de lo que dispone la\n Ley de Catastro Nº 6545 de 25 de marzo de 1981.\n\nVI.-Que\nde conformidad con lo que establece el artículo 1º Decreto Ejecutivo Nº 30106-J\ndonde se \"Declara Zona Catastral\nla Totalidad de los Cantones del Territorio\nNacional\" publicado en La\n Gaceta Nº 19 de 28 de enero de 2002 y el artículo 7° del\nReglamento a la Ley\ndel Catastro Nacional, Decreto Ejecutivo Nº 34331, el cual rige desde el 27 de\nsetiembre de 2008, la totalidad de los cantones del territorio nacional fueron\ndeclarados zona catastral.\n\nVII.-Que\nel Reglamento a la Ley\nde Catastro Nacional, Decreto Ejecutivo Nº 34331 el cual rige desde el 27 de\nsetiembre de 2008, establece los requerimientos técnicos para el levantamiento\nde planos de agrimensura.\n\nVIII.-Que\npor haber concluido los trabajos de levantamiento catastral del Distrito 05\nSanto Domingo del Cantón 04 Santa Bárbara de\nla Provincia de Heredia y\nde conformidad con lo que establece el artículo 19 de\nla Ley de Catastro Nacional y 10\nde su reglamento, fueron convocados por el Registro Inmobiliario del Registro\nNacional y la Unidad\n Ejecutora del Programa de Regularización del Catastro y\nRegistro Nacional, los propietarios de inmuebles de dicho Distrito a una\nexposición pública para conocer los resultados del levantamiento y manifestar\nsu conformidad o disconformidad.\n\nIX.-Que\nla convocatoria a la exposición pública de los resultados del levantamiento\ncatastral del Distrito 05 Santo Domingo del Cantón 04 Santa Bárbara de\nla Provincia de Heredia fue\npublicada en el Diario Oficial La\n Gaceta Nº 89 del 9 de mayo del 2012 (página 6) y los\ndiarios de circulación nacional Al Día y\nLa Teja, en fechas 13 y 14 de mayo 2012.\n\nX.-Que\nen resolución de las diez horas del siete de diciembre del año dos mil doce el\nRegistro Inmobiliario del Registro Nacional declaró firmes los datos\ncatastrales resultantes del levantamiento catastral efectuado en el Distrito 05\nSanto Domingo Cantón 04 Santa Bárbara de\nla Provincia de Heredia.\n\nXI.-Que\nya transcurrieron los términos de los plazos establecidos en el artículo 20 de\nla Ley del Catastro Nacional y\nfueron resueltos, por la\n Dirección del Registro Inmobiliario del Registro Nacional,\nlos reclamos presentados por los propietarios. Por tanto,\n\nDecretan:\n\nSE DECLARA ZONA CATASTRADA EL DISTRITO 05\n\nSANTO DOMINGO DEL CANTÓN 04 SANTA\n\nBÁRBARA DE\nLA PROVINCIA 04 HEREDIA\n\nArtículo 1º-De conformidad con el artículo 20 de\nla Ley de Catastro Nacional Nº\n6545 de 25 de marzo de 1981, se declara zona catastrada el distrito 05 Santo\nDomingo cantón 04 Santa Bárbara Provincia de Heredia.\n\n Ficha articulo\n\nArtículo\n2º-La descripción oficial de un asiento inmobiliario, está dada por los datos\ngráficos y alfanuméricos del predio correspondiente en el Mapa Catastral oficializado,\nlos cuales constan en las bases de datos del Registro Inmobiliario. En una zona\nno catastrada, se utilizará el plano catastrado respectivo.\n\n Ficha articulo\n\nArtículo\n3º-Los planos de agrimensura que se levanten de los inmuebles que pertenecen a\nlos distritos mencionados en este decreto, deberán cumplir, además de todas las\ndisposiciones legales y técnicas, establecidas en\nla Ley Nº 6545, su Reglamento y\nsus reformas, específicamente en el artículo 26 del Reglamento a\nla Ley del Catastro Nacional,\nDecreto Ejecutivo Nº 34331 de 29 de noviembre de 2007, reformado por Decreto\nEjecutivo Nº 34763 de 16 de setiembre de 2008, y con un rige a partir del 27 de\nsetiembre de 2008, en cuanto a métodos y exactitudes, así como con las\nsiguientes indicaciones y requisitos:\n\n1.1. Deberá consignarse:\n\n1.1.1.\nEl derrotero del plano con las coordenadas de todos sus vértices en el Sistema\nde la Red Oficial\nde Coordenadas del Decreto Ejecutivo N° 33797-MJ-MOPT del 30 de marzo de 2007\n(Red Geodésica Nacional de Referencia Horizontal CRO5 y Proyección Transversal\nde Mercator para Costa Rica CRTM05);\n\n1.1.2. El método de agrimensura\nutilizado para el levantamiento del mismo y para su enlace a\nla Red Oficial de\nCoordenadas;\n\n1.1.3. La exactitud relativa\nobtenida en el levantamiento del plano, especificando si se trata de zona que\ncuenta con mapeo a escala 1:1000 o 1:5000;\n\n1.1.4. La exactitud absoluta de los\nvalores nominales de las coordenadas horizontales de los vértices del plano,\nserán indicadas con la cantidad de decimales acorde con sus exactitudes;\n\n1.1.5. Para la determinación de la\nexactitud relativa de los levantamientos de inmuebles con áreas menores a una\nhectárea y que se encuentren dentro del área mapeada a escala 1:5000, se\nutilizará la misma exactitud que en las áreas mapeadas a la escala 1:1000.\n\n1.1.6. Para el caso anterior 1.1.5,\nla exactitud absoluta a aplicar será la misma que corresponde a las áreas\nmapeadas a la escala 1:5000;\n\n1.1.7. En el caso de levantamientos de\ninmuebles, que se encuentren dentro de las áreas de transición mapeadas entre\nlas escalas 1:1000 y 1:5000, el agrimensor deberá ajustarse a los lineamientos\nde exactitud, establecidos para el área en el que se encuentre la mayor\nsuperficie de dicho levantamiento.\n\n1.2.\nLa Subdirección Catastral del Registro Inmobiliario\ndel Registro Nacional, usará para la verificación de la geometría de los planos\nproducto del ejercicio liberal de la agrimensura, lo que corresponda aplicar\ndel Manual de procesos requeridos para lograr la compatibilización de la\ninformación catastral y registral, sus anexos, así como sus futuras\nmodificaciones.\n\n Ficha articulo\n\nArtículo 4º-La normativa de aplicación de exactitudes\nabsolutas y relativas para los levantamientos de agrimensura, anteriormente\ncitada, deberá ser utilizada también, en todas las zonas del país donde el\nRegistro Inmobiliario del Registro Nacional cuente con ortofoto a escala 1:\n1000 o 1:5000, aún y cuando se encuentren fuera de la zona declarada\ncatastrada.\n\n Ficha articulo\n\nArtículo\n5º-El Registro Inmobiliario del Registro Nacional determinará de acuerdo a los\nmedios tecnológicos a su disposición, cual es la forma en que se brindarán los\ndatos requeridos para realizar los enlaces de los levantamientos de aplicación\ncatastral a la Red\n Nacional de Coordenadas.\n\n Ficha articulo\n\nArtículo\n6º-El Registro Inmobiliario del Registro Nacional establecerá los medios\ntécnicos y tecnológicos para la presentación de planos de agrimensura en zonas\ncatastradas y donde existan ortofotos, conforme a lo dispuesto en el artículo\n28 del Reglamento a la Ley\nde Catastro Nacional, Decreto Ejecutivo No. 34331-J de 29 de noviembre de 2007,\nreformado por Decreto Ejecutivo Nº 34763 de 16 de setiembre de 2008, y con un\nrige a partir de 26 de setiembre de 2008. Property Registry of the National Registry, on the basis of\nthe National Cadastre Law Nº\n6545 of March 25, 1981, in its article 13 has as its exclusive power,\nthe execution and maintenance of the Cadastre, a function it may partially delegate\nto other state institutions.\n\nIV.-That\nthe Legislative\n Assembly, on November 27, 2001, approved\nLaw Nº 8154, \"Loan\nAgreement Nº 1284/OC-CR, Cadastre and Registry Regularization Program\",\nsigned between the Government of the\n Republic and the Inter-American Development Bank (IDB), for\nthe execution of the Cadastre and National Registry Regularization Program,\nwhich by provision of the same law, is under the charge of an Executing Unit\nattached to the Minister of Finance as a deconcentrated body.\n\nV.-That\nthe Cadastre and National Registry Regularization Program has as its\ntask the cadastral survey with the objective of forming the national cadastre\nand making cadastral and registry information on properties compatible, in\napplication of what is provided in the\n Cadastre Law Nº 6545 of March 25, 1981.\n\nVI.-That\nin accordance with what is established in article 1 of Executive Decree Nº 30106-J\nwhich \"Declares a Cadastral Zone\nthe Totality of the Cantons of the National\nTerritory\" published in La\n Gaceta Nº 19 of January 28, 2002 and article 7 of the\nRegulations to the National\nCadastre Law, Executive Decree Nº 34331, which has been in effect since September\n27, 2008, the totality of the cantons of the national territory were\ndeclared a cadastral zone.\n\nVII.-That\nthe Regulations to the National\nCadastre Law, Executive Decree Nº 34331 which has been in effect since September\n27, 2008, establishes the technical requirements for the preparation\nof survey plans (planos de agrimensura).\n\nVIII.-That\ndue to the conclusion of the cadastral survey work for District 05\nSanto Domingo of Canton 04 Santa Bárbara of\nthe Province of Heredia and\nin accordance with what is established in article 19 of\nthe National Cadastre Law and 10\nof its regulations, the Real Property Registry of the National\nRegistry and the Executing\n Unit of the Cadastre and National Registry Regularization Program convened\n the property owners of said District to a\npublic exhibition to learn the results of the survey and express\ntheir conformity or non-conformity.\n\nIX.-That\nthe call to the public exhibition of the results of the cadastral\nsurvey of District 05 Santo Domingo of Canton 04 Santa Bárbara of\nthe Province of Heredia was\npublished in the Official Gazette La\n Gaceta Nº 89 of May 9, 2012 (page 6) and the\nnational circulation newspapers Al Día and\nLa Teja, on dates May 13 and 14, 2012.\n\nX.-That\nin a resolution at ten o'clock on December seventh of the year two thousand twelve, the\nReal Property Registry of the National Registry declared the cadastral data\nresulting from the cadastral survey carried out in District 05\nSanto Domingo Canton 04 Santa Bárbara of\nthe Province of Heredia to be final.\n\nXI.-That\nthe terms of the deadlines established in article 20 of\nthe National Cadastre Law have now elapsed and\nthe claims presented by the owners were resolved, by the\n Directorate of the Real Property Registry of the National Registry. Therefore,\n\nThey Decree:\n\nDISTRICT 05 IS DECLARED A MAPPED ZONE\n\nSANTO DOMINGO OF CANTON 04 SANTA\n\nBÁRBARA OF\nPROVINCE 04 HEREDIA\n\nArticle 1-In accordance with article 20 of\nthe National Cadastre Law Nº\n6545 of March 25, 1981, district 05 Santo\nDomingo canton 04 Santa Bárbara Province of Heredia is declared a mapped zone (zona catastrada).\n\n Article file\n\nArticle\n2-The official description of a real property entry (asiento inmobiliario) is given by the graphic\nand alphanumeric data of the corresponding property (predio) on the officialized Cadastral Map,\nwhich are recorded in the databases of the Real Property Registry. In a non-mapped\nzone, the respective cadastral plan (plano catastrado) will be used.\n\n Article file\n\nArticle\n3-The survey plans that are prepared for the properties belonging to\nthe districts mentioned in this decree, must comply, in addition to all\nlegal and technical provisions established in\nLaw Nº 6545, its Regulations and\nits amendments, specifically in article 26 of the Regulations to\nthe National Cadastre Law,\nExecutive Decree Nº 34331 of November 29, 2007, amended by Executive\nDecree Nº 34763 of September 16, 2008, and effective as of September\n27, 2008, regarding methods and accuracies, as well as with the\nfollowing indications and requirements:\n\n1.1. The following must be stated:\n\n1.1.1.\nThe boundary description (derrotero) of the plan with the coordinates of all its vertices in the\nSystem of the Official Coordinate\nNetwork of Executive Decree N° 33797-MJ-MOPT of March 30, 2007\n(National Geodetic Network of Horizontal Reference CRO5 and Transverse Mercator\nProjection for Costa Rica CRTM05);\n\n1.1.2. The surveying method (método de agrimensura)\nused for its preparation and for its link to\nthe Official Coordinate Network;\n\n1.1.3. The relative accuracy (exactitud relativa)\nobtained in the preparation of the plan, specifying whether it concerns an area that\nhas mapping at a scale of 1:1000 or 1:5000;\n\n1.1.4. The absolute accuracy (exactitud absoluta) of the\nnominal values of the horizontal coordinates of the plan's vertices,\nwill be indicated with the number of decimals according to their accuracies;\n\n1.1.5. For the determination of the\nrelative accuracy of surveys of properties with areas of less than one\nhectare and that are located within the area mapped at a scale of 1:5000,\nthe same accuracy will be used as in the areas mapped at the scale of 1:1000.\n\n1.1.6. For the preceding case 1.1.5,\nthe absolute accuracy to be applied will be the same as that corresponding to the areas\nmapped at the scale of 1:5000;\n\n1.1.7. In the case of surveys of\nproperties that are located within the transition areas mapped between\nthe scales of 1:1000 and 1:5000, the surveyor (agrimensor) must adjust to the accuracy\nguidelines established for the area in which the largest\nsurface area of said survey is located.\n\n1.2.\nThe Cadastral Subdirectorate (Subdirección Catastral) of the Real Property Registry\nof the National Registry will use, for the verification of the geometry of the plans\nresulting from the liberal practice of surveying, whatever is applicable\nfrom the Manual of processes required to achieve the compatibility of\ncadastral and registry information, its annexes, as well as its future\nmodifications.\n\n Article file\n\nArticle 4-The regulations for the application of absolute\nand relative accuracies for survey work, previously\ncited, must also be used in all areas of the country where the\nReal Property Registry of the National Registry has an orthophoto at a scale of 1:\n1000 or 1:5000, even when they are located outside the zone declared\nmapped.\n\n Article file\n\nArticle\n5-The Real Property Registry of the National Registry will determine, according to the\ntechnological means at its disposal, the manner in which the\ndata required to perform the links of cadastral surveys to the National\n Coordinate Network will be provided.\n\n Article file\n\nArticle\n6-The Real Property Registry of the National Registry will establish the technical\nand technological means for the submission of survey plans in zones\nmapped and where orthophotos exist, in accordance with the provisions of article\n28 of the Regulations to the National\nCadastre Law, Executive Decree No. 34331-J of November 29, 2007,\namended by Executive Decree Nº 34763 of September 16, 2008, and effective\nas of September 26, 2008.
