Ley Nº\n8710, publicada en La\n Gaceta Nº 48 del 10 de marzo de 2009 se reforma el\nartículo 2 de la Ley Nº\n5695, Ley de Creación del Registro Nacional, y sus reformas, indicando que el\nCatastro Nacional pasa a formar parte del Registro Inmobiliario.\n\n2º-Que el Decreto Ejecutivo Nº\n35509-J de 30 de setiembre de 2009, Reglamento de Organización del Registro\nInmobiliario publicado en el Diario Oficial\nLa Gaceta Nº 198 del\n13 de octubre de 2009, establece que el Registro Inmobiliario está conformado\npor la Subdirección\nde Catastro y la\n Subdirección Registral.\n\n3º-Que el Registro Inmobiliario del\nRegistro Nacional, con fundamento en la\n Ley de Catastro Nacional Nº 6545 de 25 de marzo de 1981, en\nsu artículo 13 tiene como potestad exclusiva, la ejecución y mantenimiento del\nCatastro, función que puede delegar parcialmente en otras instituciones\nestatales.\n\n4º-Que\nla Asamblea Legislativa,\nel 27 de noviembre de 2001, aprobó la\n Ley Nº 8154, \"Convenio de Préstamo Nº 1284/OC-CR, Programa de\nRegularización del Catastro y Registro\", suscrito entre el Gobierno de\nla República y el Banco\nInteramericano de Desarrollo (BID), para la ejecución del Programa de\nRegularización del Catastro y Registro Nacional, que por disposición de la\nmisma ley, está a cargo de una Unidad Ejecutora adscrita al Ministro de\nHacienda como órgano desconcentrado.\n\n5º-Que el Programa de Regularización\ndel Catastro y Registro Nacional, tiene como tarea el levantamiento catastral\ncon el objetivo de formar el catastro nacional y compatibilizar la información\ncatastral y registral de los inmuebles, en aplicación de lo que dispone\nla Ley de Catastro Nº 6545 de 25\nde marzo de 1981.\n\n6º-Que de conformidad con lo que\nestablece el artículo 1º Decreto Ejecutivo Nº 30106-J donde se \"Declara Zona\nCatastral la Totalidad\nde los Cantones del Territorio Nacional\" publicado en\nLa Gaceta Nº 19 de 28\nde enero de 2002 y el artículo 7 del Reglamento a\nla Ley del Catastro Nacional,\nDecreto Ejecutivo Nº 34331, el cual rige desde el 27 de setiembre de 2008, la\ntotalidad de los cantones del territorio nacional fueron declarados zona catastral.\n\n7º-Que el Reglamento a\nla Ley de Catastro Nacional,\nDecreto Ejecutivo Nº 34331 el cual rige desde el 27 de setiembre de 2008,\nestablece los requerimientos técnicos para el levantamiento de planos de\nagrimensura.\n\n8º-Que por haber concluido los trabajos\nde levantamiento catastral de los Distritos 02\nLa Ribera y 03\nLa Asunción del Cantón 07\nBelén de la Provincia\nde Heredia y de conformidad con lo que establece el artículo 19 de\nla Ley de Catastro Nacional y 10\nde su reglamento, fueron convocados por el Registro Inmobiliario del Registro\nNacional y la Unidad\n Ejecutora del Programa de Regularización del Catastro y\nRegistro Nacional, los propietarios de inmuebles de dichos Distritos a una\nexposición pública para conocer los resultados del levantamiento y manifestar\nsu conformidad o disconformidad.\n\n9º-Que la convocatoria a la\nexposición pública de los resultados del levantamiento catastral de los\nDistritos 02 La Ribera\ny 03 La Asunción\ndel Cantón 07 Belén de la\n Provincia de Heredia fue publicada en el Diario Oficial\nLa Gaceta Nº 248 del\n22 de diciembre del 2009 (página 2) y en el diario de circulación nacional\nLa Nación, en fechas 10 y 11\nde enero de 2010.\n\n10.-Que en resolución de las doce\nhoras del siete de diciembre del año dos mil doce el Registro Inmobiliario del\nRegistro Nacional declaró firmes los datos catastrales resultantes del\nlevantamiento catastral efectuado en los Distritos 02\nLa Ribera y 03\nLa Asunción del Cantón 07\nBelén de la Provincia\nde Heredia.\n\n11.-Que ya transcurrieron los\ntérminos de los plazos establecidos en el artículo 20 de\nla Ley del Catastro Nacional y\nfueron resueltos, por la\n Dirección del Registro Inmobiliario del Registro Nacional,\nlos reclamos presentados por los propietarios. Por tanto:\n\nDecretan:\n\nSE DECLARA ZONA CATASTRADA LOS DISTRITOS\n\n02 LA\n RIBERA Y 03\nLA ASUNCIÓN DEL CANTON\n\n07 BELEN DE\nLA PROVINCIA 04 HEREDIA\n\nArtículo 1º-De\nconformidad con el artículo 20 de la\n Ley de Catastro Nacional Nº 6545 de 25 de marzo de 1981, se\ndeclara zona catastrada los Distritos 02\nLa Ribera  y 03\nLa Asunción  del Cantón 07\nBelén de la Provincia\n de Heredia.\n\n Ficha articulo\n\nArtículo\n2º-La descripción oficial de un asiento inmobiliario, está dada por los datos\ngráficos y alfanuméricos del predio correspondiente en el Mapa Catastral\noficializado, los cuales constan en las bases de datos del Registro\nInmobiliario. Deberá consignarse:\n\n1.1.1.\nEl derrotero del plano con las coordenadas de todos sus vértices en el Sistema\nde la Red Oficial\nde Coordenadas del Decreto Ejecutivo N° 33797-MJ-MOPT del 30 de marzo de 2007\n(Red Geodésica Nacional de Referencia Horizontal CRO5 y Proyección Transversal\nde Mercator para Costa Rica CRTM05);\n\n1.1.2. El método de agrimensura\nutilizado para el levantamiento del mismo y para su enlace a\nla Red Oficial de\nCoordenadas;\n\n1.1.3. La exactitud relativa\nobtenida en el levantamiento del plano, especificando si se trata de zona que\ncuenta con mapeo a escala 1:1000 o 1:5000;\n\n1.1.4. La exactitud absoluta de los\nvalores nominales de las coordenadas horizontales de los vértices del plano,\nserán indicadas con la cantidad de decimales acorde con sus exactitudes;\n\n1.1.5. Para la determinación de la\nexactitud relativa de los levantamientos de inmuebles con áreas menores a una\nhectárea y que se encuentren dentro del área mapeada a escala 1:5000, se\nutilizará la misma exactitud que en las áreas mapeadas a la escala 1:1000.\n\n1.1.6. Para el caso anterior 1.1.5,\nla exactitud absoluta a aplicar será la misma que corresponde a las áreas\nmapeadas a la escala 1:5000;\n\n1.1.7. En el caso de levantamientos\nde inmuebles, que se encuentren dentro de las áreas de transición mapeadas\nentre las escalas 1:1000 y 1:5000, el agrimensor deberá ajustarse a los\nlineamientos de exactitud, establecidos para el área en el que se encuentre la\nmayor superficie de dicho levantamiento. \n\n1.2.\nLa Subdirección Catastral\ndel Registro Inmobiliario del Registro Nacional, usará para la verificación de\nla geometría de los planos producto del ejercicio liberal de la agrimensura, lo\nque corresponda aplicar del Manual de procesos requeridos para lograr la\ncompatibilización de la información catastral y registral, sus anexos, así como\nsus futuras modificaciones.\n\n Ficha articulo\n\nArtículo 4º-La normativa de aplicación de exactitudes\nabsolutas y relativas para los levantamientos de agrimensura, anteriormente\ncitada, deberá ser utilizada también, en todas las zonas del país donde el\nRegistro Inmobiliario del Registro Nacional cuente con ortofoto a escala 1:\n1000 o 1:5000, aún y cuando se encuentren fuera de la zona declarada\ncatastrada.\n\n Ficha articulo\n\nArtículo\n5º-El Registro Inmobiliario del Registro Nacional determinará de acuerdo a los\nmedios tecnológicos a su disposición, cual es la forma en que se brindarán los\ndatos requeridos para realizar los enlaces de los levantamientos de aplicación\ncatastral a la Red\n Nacional de Coordenadas.\n\n Ficha articulo\n\nArtículo\n6º-El Registro Inmobiliario del Registro Nacional establecerá los medios\ntécnicos y tecnológicos para la presentación de planos de agrimensura en zonas\ncatastradas y donde existan ortofotos, conforme a lo dispuesto en el artículo\n28 del Reglamento a la Ley\nde Catastro Nacional, Decreto Ejecutivo No. 34331-J de 29 de noviembre de 2007,\nreformado por Decreto Ejecutivo Nº 34763 de 16 de setiembre de 2008, y con un\nrige a partir de 26 de setiembre de 2008. and in accordance with the provisions of article 19 of\nthe National Cadastre Law and 10\nof its regulation, the real property owners of said Districts were convened by the Real Property Registry of the National Registry\nand the\n Executing Unit of the Program for Cadastre and\nNational Registry Regularization, to a public exhibition to learn about the results of the survey and express\ntheir conformity or nonconformity.\n\n9º-That the call to the\npublic exhibition of the results of the cadastral survey (levantamiento catastral) of\nDistricts 02 La Ribera\nand 03 La Asunción\nof Canton 07 Belén of the\n Province of Heredia was published in the Official Gazette\nLa Gaceta Nº 248 of\nDecember 22, 2009 (page 2) and in the national circulation newspaper\nLa Nación, on dates January 10 and 11,\n2010.\n\n10.-That in a resolution of twelve o'clock noon\non December seven, two thousand twelve, the Real Property Registry of the\nNational Registry declared firm the cadastral data resulting from the\ncadastral survey (levantamiento catastral) carried out in Districts 02\nLa Ribera and 03\nLa Asunción of Canton 07\nBelén of the Province\nof Heredia.\n\n11.-That the terms of the deadlines established in article 20 of\nthe National Cadastre Law have already elapsed and\nthe claims filed by the owners were resolved, by the\n Directorate of the Real Property Registry of the National Registry. Therefore:\n\nDecree:\n\nIT IS DECLARED A CADASTRED ZONE (ZONA CATASTRADA) THE DISTRICTS\n\n02 LA\n RIBERA AND 03\nLA ASUNCIÓN OF CANTON\n\n07 BELEN OF\nTHE PROVINCE 04 HEREDIA\n\nArticle\n1º-In\naccordance with article 20 of the\n National Cadastre Law Nº 6545 of March 25, 1981,\nDistricts 02\nLa Ribera  and 03\nLa Asunción  of Canton 07\nBelén of the Province\n of Heredia are declared a cadastred zone (zona catastrada).\n\n Article tab\n\nArticle\n2º-The official description of a real property entry (asiento inmobiliario), is provided by the graphic\nand alphanumeric data of the corresponding property (predio) in the officialized Cadastral Map,\nwhich are recorded in the databases of the Real Property\nRegistry. In a non-cadastred zone, the respective cadastred plan (plano catastrado)\nshall be used.\n\n Article tab\n\nArticle\n3º-The survey plans (planos de\nagrimensura) that are drawn up for the real properties belonging to the districts\nmentioned in this decree, must comply, in addition to all the legal and technical\nprovisions established in\n Law Nº 6545, its Regulation and its amendments, specifically in\narticle 26 of the Regulation to the\n National Cadastre Law, Executive Decree Nº 34331 of November 29,\n2007, amended by Executive Decree Nº 34763 of September 16,\n2008, and effective as of September 27, 2008, regarding\nmethods and accuracies, as well as with the following indications and\nrequirements:\n\n1.1. The following must be recorded:\n\n1.1.1.\nThe boundary description (derrotero) of the plan with the coordinates of all its vertices in the\nSystem of the Official Coordinate\nNetwork of Executive Decree N° 33797-MJ-MOPT of March 30, 2007\n(National Geodetic Network of Horizontal Reference CRO5 and Transverse Mercator\nProjection for Costa Rica CRTM05);\n\n1.1.2. The survey (agrimensura) method\nused for its drawing up and for its connection to\nthe Official Coordinate Network;\n\n1.1.3. The relative accuracy\nobtained in the survey of the plan, specifying if it is a zone that\nhas mapping at a scale of 1:1000 or 1:5000;\n\n1.1.4. The absolute accuracy of the\nnominal values of the horizontal coordinates of the plan's vertices,\nwill be indicated with the number of decimal places according to their accuracies;\n\n1.1.5. For the determination of the\nrelative accuracy of surveys of real properties with areas less than one\nhectare and that are located within the area mapped at a 1:5000 scale, the\nsame accuracy as in the areas mapped at a 1:1000 scale will be used.\n\n1.1.6. For the previous case 1.1.5,\nthe absolute accuracy to be applied will be the same corresponding to the\nareas mapped at a 1:5000 scale;\n\n1.1.7. In the case of surveys\nof real properties, that are located within the transition areas mapped\nbetween the 1:1000 and 1:5000 scales, the surveyor (agrimensor) must adjust to the\naccuracy guidelines established for the area in which the\nlargest surface area of said survey is located.\n\n1.2.\nThe Cadastral Subdirectorate\nof the Real Property Registry of the National Registry, shall use for the verification of\nthe geometry of the plans resulting from the liberal exercise of surveying (agrimensura), what\nis applicable from the Manual of processes required to achieve the\ncompatibilization of cadastral and registral information, its annexes, as well as\nits future modifications.\n\n Article tab\n\nArticle\n4º-The regulations for the application of absolute\nand relative accuracies for survey (agrimensura) works, previously\ncited, must also be used, in all zones of the country where the\nReal Property Registry of the National Registry has orthophoto (ortofoto) at a scale of 1:\n1000 or 1:5000, even when they are located outside the zone declared\ncadastred.\n\n Article tab\n\nArticle\n5º-The Real Property Registry of the National Registry will determine, according to the\ntechnological means at its disposal, the manner in which the\ndata required to carry out the connections of cadastral application surveys\nto the National\n Coordinate Network will be provided.\n\n Article tab\n\nArticle\n6º-The Real Property Registry of the National Registry will establish the technical\nand technological means for the submission of survey plans (planos de agrimensura) in cadastred zones\nand where orthophotos (ortofotos) exist, in accordance with the provisions of article\n28 of the Regulation to the Law\nof National Cadastre, Executive Decree No. 34331-J of November 29, 2007,\namended by Executive Decree Nº 34763 of September 16, 2008, and effective\nas of September 26, 2008.
