Directores señalados en el considerando 2°, así\ncomo las recomendaciones y observaciones presentadas por el Sr. Auditor y la Directora Ghiselle\nRodríguez Muñoz, la\n Junta Directiva, Por tanto, \n\n ACUERDA: \n\n1º-Modificar el \"Reglamento para la\nregulación y control del uso eficiente del combustible a precio competitivo a\nnivel internacional, destinado a la flota pesquera nacional comercial no\ndeportiva y a la flota pesquera nacional turística, en las aguas\njurisdiccionales costarricenses o fuera de ellas\"; en los términos y\ncondiciones que se detallan a continuación: \n\n- En todo el texto del Acuerdo\nAJDIP/085-2010, sustitúyase donde dice combustible a precio preferencial, por\ncombustible a precio competitivo, de conformidad con el nombre de este\nReglamento. \n\n- Léase correctamente el Artículo\n15.- En contra de las resoluciones dictadas por las jefaturas regionales o\nsubregionales, podrá interponerse el Recurso de Revocatoria ante quien emitió\nel acto administrativo y el Recurso de Apelación en subsidio, ante la Presidencia Ejecutiva\ndel INCOPESCA, dentro del plazo de cinco días hábiles contados a partir del día\nsiguiente a la notificación de la resolución. Dichas resoluciones serán\ncomunicadas a la\n Dirección General de Transporte y Comercialización de\nCombustibles del Ministerio del Ambiente, Energía y Telecomunicaciones\n(MINAET), Departamento de Relaciones Comerciales de RECOPE para las acciones\ncorrespondientes. \n\n- Léase correctamente el Artículo\n18.- Cada beneficiario podrá realizar el trámite de combustible a precio\ncompetitivo en forma personal, o por medio de apoderado(s) especial (es). \n\n- Modifíquese el inciso b) del Artículo\n24, para que se lea correctamente: b) Copia(s) o Fotocopia(s) confrontada con\nsu original de la(s) Factura(s) de Venta del producto emitida por el\npermisionario, debidamente autorizada por el ente competente, esto para\naquellos casos en los cuales no se cuente con la inspección de descarga de\nproductos pesqueros (FIAD). \n\n- Adiciónese un párrafo antes del\núltimo enunciado del Artículo 24 que se lea; \"En los casos en que se vaya a\nrealizar el primer trámite para la autorización del combustible a precio competitivo\na un beneficiario, sea este perteneciente a cualquiera de las Flotas\nestablecidas en el presente Reglamento, se omitirá la documentación solicitada\nestablecida en el inciso F de este artículo\". \n\n- Léase correctamente el Artículo\n47. \"La orden de compra individual tendrá fecha de vencimiento una vigencia de\ntres meses calendario.\". \n\n- Léase correctamente el Artículo\n51.- \"Con tal propósito, las personas físicas o jurídicas que cuenten con\ncódigo para la compra de combustible a precio competitivo ante RECOPE y que\ntramiten ante el INCOPESCA la respectiva emisión de autorización de\nconsolidación de órdenes de compra de combustible, deberán cumplir los\nsiguientes requerimientos: \n\n- Debe previamente aportar\nautorización respectiva por parte del beneficiario, mediante oficio dirigido al\nINCOPESCA debidamente autenticado o en presencia de los funcionarios de la SCAC o a través de poder\nespecial. \n\n- Presentar las órdenes de compra de\ncombustible a precio competitivo individuales (original y copias) en buenas\ncondiciones sin roturas, tachaduras, alteraciones o borrones, las cuales serán\nobjeto del consolidado. Dichas órdenes deberán estar vigentes. \n\n- Presentar la solicitud de compra\nde combustible que pretende adquirir. Dicha solicitud debe contener nombre completo\ny código de la\n Organización, la cantidad y clase de producto a retirar.\" \n\n- Léase correctamente el primer\npárrafo del Artículo 57.- \" La autorización de consolidación de órdenes de\ncompra de combustible a precio competitivo, tendrá una vigencia de diez días\nhábiles, contados a partir de su emisión, prorrogables por plazos iguales a\ngestión expresa del interesado, por motivos justificables, prórroga que podrá\nrealizarse dentro del plazo de vigencia de la orden de compra que le dio origen\na la emisión de la autorización de consolidación respectiva, en casos de\nautorizaciones que correspondan a varias órdenes de compra el plazo de\nrevalidación será aquel de la orden de compra de combustible última en\nvencerse.\" \n\n- Adiciónese una columna en el\nformulario de entrega de solicitudes a INCOPESCA para su tramitación en modo\ngrupal en la cual se indique por parte de la persona que realiza el trámite el\nnúmero de orden de combustible que se emitió para cada beneficiario. Said resolutions will be communicated to the General Directorate of Transportation and Fuel Commercialization of the Ministry of Environment, Energy and Telecommunications (MINAET), RECOPE's Department of Commercial Relations for the corresponding actions.\n\n- Correctly read Article 18.- Each beneficiary may carry out the fuel at a competitive price procedure personally, or through special proxy(ies).\n\n- Amend subsection b) of Article 24, so that it correctly reads: b) Copy(ies) or Photocopy(ies) verified against their original of the Product Sale Invoice(s) issued by the permit holder, duly authorized by the competent entity, this for those cases in which there is no fishery product discharge inspection (FIAD).\n\n- Add a paragraph before the last statement of Article 24 that reads; \"In cases where the first procedure for the authorization of fuel at a competitive price is to be carried out for a beneficiary, whether belonging to any of the Fleets established in this Regulation, the required documentation established in subsection F of this article shall be omitted.\"\n\n- Correctly read Article 47. \"The individual purchase order will have an expiration date with a validity of three calendar months.\"\n\n- Correctly read Article 51.- \"For that purpose, natural or legal persons who have a code for purchasing fuel at a competitive price from RECOPE and who process the respective issuance of a consolidation authorization for fuel purchase orders before INCOPESCA, must meet the following requirements:\n\n- Must previously provide the respective authorization from the beneficiary, by means of an official letter addressed to INCOPESCA, duly authenticated or in the presence of SCAC officials or through a special power of attorney.\n\n- Submit the individual fuel at a competitive price purchase orders (originals and copies) in good condition without tears, crossing-outs, alterations or erasures, which will be the subject of the consolidation. Said orders must be valid.\n\n- Submit the fuel purchase request to be acquired. Said request must contain the full name and code of the Organization, the quantity and class of product to be withdrawn.\"\n\n- Correctly read the first paragraph of Article 57.- \"The consolidation authorization for fuel at a competitive price purchase orders shall have a validity of ten business days, counted from its issuance, extendable for equal periods upon express request of the interested party, for justifiable reasons, an extension that may be carried out within the validity period of the purchase order that gave rise to the issuance of the respective consolidation authorization; in cases of authorizations corresponding to several purchase orders, the revalidation period shall be that of the last fuel purchase order to expire.\"\n\n- Add a column to the form for submission of requests to INCOPESCA for group-mode processing, in which the person carrying out the procedure indicates the fuel order number that was issued for each beneficiary.
