Considerando: \n\nI.-Que toda persona tiene\nderecho a un ambiente sano y ecológicamente equilibrado. \n\nII.-Que para una mejor calidad de\nvida de las presentes y futuras generaciones debemos de brindar los medios y la\neducación ambiental adecuada en pro del bienestar de la población en general. \n\nIII.-Que para un disfrute sano de\nlos recursos disponible y para obtener un mayor conocimiento de las diferentes\ntécnicas y productos actuales en pro de un desarrollo sustentable, se deben\ncrear los medios y actividades adecuadas con el fin de obtener el mayor\nprovecho de las mismas. \n\nIV.-Que la MSRH, impulsa, planifica,\ncrea y ejecuta las estrategias, instrumentos y acciones ambientales necesarias\npara la conservación, prevención y protección de los recursos naturales siendo\nademás vigilante de las actividades humanas que generen un impacto ambiental\nnegativo, todo acorde con la legislación ambiental vigente, de tal forma que\npermita desarrollar una cultura ambiental tendiente a mejorar la calidad de\nvida de sus habitantes. \n\n DECRETAN: \n\n REGLAMENTO DE LA FERIA ECOLÓGICA\n\n DEL CANTÓN DE SAN RAFAEL DE HEREDIA \n\nTabla de en relación con la realización de la Feria Ecológica, a\nrealizarse en el mes de junio de todos los años; a su vez podría ser utilizado\ncomo referencia para otras ferias ecológicas con propósitos similares.\n\nArtículo\n2º-Objetivos: El presente reglamento tiene como objetivo, normar la\nrealización de una feria ecológica, en donde se garantice una educación\nambiental adecuada se tengan opciones de servicios y productos sostenibles y\namigables con el ambiente.\n\nCAPÍTULO II \n\n Sobre la organización y el carácter de la Feria Ecológica\n\nArtículo 3º-La Feria Ecológica\nserá coordinada por una Comisión nombrada por el Concejo Municipal y\nfiscalizada por la Comisión\nde Asuntos Ambientales de la\n MSRH.\n\nArtículo 4º-La MSRH a través de la Comisión de Feria\nEcológica invitará a los interesados en participar de la Feria Ecológica\ndel cantón de San Rafael de Heredia, a realizarse el fin de semana que coincida\ncon la celebración de la semana del Medio Ambiente (viernes, sábado, domingo).\n\nArtículo\n5º-La Feria Ecológica\ndeberá incluir: venta de productos y servicios ecológicos, exposiciones,\nconsultorías, talleres y/o charlas en educación ambiental y un único puesto de\ncomidas.\n\nArtículo\n6º-Los productos de los oferentes (vendedores, consultores, expositores),\ndeberán: tener la connotación de amigables con el medio ambiente por poseer una\nde las siguientes características: ser un producto orgánico, estar fabricados a\nbase de materiales sostenibles, reciclables o de fibras naturales y/o promover\nel uso de tecnologías limpias y eficientes.\n\nArtículo\n7º-Estos productos serán por ejemplo: productos agrícolas orgánicos, productos\nagroindustriales sostenibles, artesanales o caseros (compoteras, abonos\norgánicos, hidroponía), plantas ornamentales y/o medicinales, servicios eco\nturísticos, servicios bioenergéticas, eco materiales, muebles y decoración,\nproductos naturales para la higiene, salud, belleza y cosmética, productos\nalimenticios (mermeladas, dulces, conservas, miel de abeja, cacao, productos\nlácteos) calzado, textiles o fibras naturales, terapia y medicina alternativa,\nmateriales y sistemas eficientes para la construcción, productos naturales para\nmascotas, energía renovable entre otros, preferiblemente producidos en nuestro\npaís.\n\nArtículo\n8º-La MSRH\nmediante la Comisión\nde la Feria Ecológica\nde San Rafael propiciará lo siguiente: \n\na) Un espacio físico para la realización de la feria, con la\nparticipación de todos los oferentes e interesados, con el objetivo de hacer\nuna verdadera Feria Ecológica en el Cantón. \n\nb) Otorgar un carnet de identificación a las personas debidamente autorizadas\npara participar en la oferta de productos, comercio y servicios. \n\nc) Espacios de encuentro entre productores, organizaciones de promoción\nde la agro ecología y cuidado del medio ambiente, consumidor orgánico y público\nen general, interesado en conocer y aprender las ventajas de los productos\norgánicos y la defensa del medio ambiente. \n\nd) Un espacio para la difusión de publicaciones y materiales educativos\nrelacionados con la cultura verde, la agricultura orgánica, la comida sana,\nprotección del ambiente. \n\ne) Poner a disposición del participante, mediante la página web de la MSRH, una copia del presente\nreglamento para su aplicación. \n\nf) Un espacio para promocionar las iniciativas ambientales y de cambio\nclimático del cantón que permitan dar a conocer los esfuerzos que realizan los\ndiferentes grupos organizados del cantón.\n\nCAPÍTULO III \n\n Obligaciones de los organizadores \n\nArtículo 9º-A continuación se describirán cada una de\nlas obligaciones que deben cumplir los organizadores de la Feria Ecológica: \n\na) Realizar coordinaciones previas de los productos a ofertarse con la\nfinalidad de tener la mayor diversidad y a la vez buscar un equilibrio entre la\noferta, la demanda y la necesidad de la información. \n\nb) Difundir la\n Feria Ecológica a través de diferentes medios como página web\nde la municipalidad, radio, correo electrónico, folletos, revistas y televisión\nentre otros. \n\nc) Velar por el cumplimiento del presente Reglamento. \n\nd) Designar los stands de acuerdo al tipo de participante. \n\ne) Supervisar que los productos a ofertarse sean de buena calidad y\npresentación, pudiendo retirar aquellos, que a criterio de la Comisión, no cumplan con\neste requisito. \n\nf) Organizar charlas, talleres o consultorías o de intercambio de\nexperiencias en temas ambientales. \n\ng) Coordinar la seguridad con la Policía Municipal,\nla fuerza pública del Cantón y la\n Cruz Roja Costarricense. \n\nh) Velar, conjuntamente con los participantes por el orden, aseo y\nseguridad del lugar donde se realizará la Feria.\n\ni) Mantener un archivo actualizado de cada uno de los participantes de\nla feria para llevar un record de los proveedores u oferentes y que puedan ser\ntomados en cuenta en próximas ocasiones. \n\nj) Administrar los fondos que se recauden en la realización de la Feria Ecológica,\nde conformidad con la legislación vigente. \n\nk) Asegurar el debido resguardo de toda la documentación que maneje la\ncomisión en el ejercicio de sus funciones.\n\nCAPÍTULO IV \n\n Sobre los participantes \n\nArtículo 10.-Una vez cumplidos los artículos 7 y 9 del\npresente reglamento y obtenido el carnet de autorización podrán participar\nproductores de manera individual, organizaciones de productores, procesadores,\nempresas agropecuarias, agroindustriales, artesanales, empresas o instituciones\nque ofrecen servicios o insumos y o Organismos no Gubernamentales (ONG).\n\nArtículo\n11.-Los participantes deberán informar las calidades y cualidades de su\nproducto, que demuestren el cumplimiento del artículo 7 del presente reglamento\nen el momento de obtener la autorización para la participación en la feria.\nAsimismo deben ajustarse a las políticas ambientales de la MSRH.\n\nArtículo\n12.-Las personas participantes en esta Feria Ecológica deberán firmar el\nConvenio de Compromiso y cumplir con los requisitos indicados en el presente\nReglamento.\n\nCAPÍTULO V \n\n Obligaciones de los participantes \n\nArtículo 13.-A continuación se describirán cada una de\nlas obligaciones que deben cumplir los participantes de la Feria Ecológica: \n\na) Llenar el Formulario de Inscripción, indicando los productos,\ncantidades y presentaciones que espera vender y/o exponer en la Feria a más tardar el 30 de\nabril. \n\nb) Firmar el contrato de compromiso o convenio de participación con la Comisión de Feria\nEcológica a cargo. \n\nc) Colocar en lugar visible como en una pizarra, banner o cartel, la\nlista de productos, precios de venta y categoría, así como las certificaciones\nde productos orgánicos, eco amigable, eco turístico (quienes lo posean) o\npermisos aprobados por parte del Ministerio de Salud. \n\nd) Portar en lugar visible carné de identificación dado por parte de la MSRH, todos los días de la\nferia ecológica. \n\ne) Acatar en conformidad las indicaciones que la Comisión de Feria\nEcológica le indique en relación con sanidad, medidas de prevención y\ncorrección y otras indicaciones requeridas en el momento. \n\nf) Tener buena conducta, excelente presentación personal, normas de\nhigiene adecuadas y trato amable al público. \n\ng) Cancelar la cuota por concepto de uso de espacio mínimo dos semanas\nantes del inicio de la Feria.\n\nh) Colaborar con la limpieza de la Feria Ecológica,\ntanto de su stand, como a nivel general. \n\ni) Cumplir y hacer cumplir este Reglamento. \n\nj) Respetar y cumplir las leyes y reglamentos nacionales y locales, Ley\nde Tránsito, Ley General de Salud, etc.\n\nCAPÍTULO VI \n\n Sobre los puestos y la presentación \n\nArtículo 14.-La Comisión de Feria Ecológica elaborará, para cada\naño, un diseño de sitio que incluirá: croquis de distribución de puestos, áreas\npara las actividades culturales ecológicas, área para las exposiciones,\ntalleres, charlas o consultorías, áreas comunes de reunión, áreas donde se\nubicarán los servicios sanitarios, áreas de evacuación y seguridad y el área de\ncomida .\n\nArtículo\n15.-La Comisión\nde Feria Ecológica distribuirá y designará el espacio para la realización de las\ndiferentes actividades de conformidad con las características de cada una.\n\nArtículo\n16.-Cada participante podrá comercializar sus productos en un puesto designado\npor los organizadores. Los mismos deberán velar por el orden y el aseo en cada\nespacio designado, así como el cuidado del puesto durante el uso los días de la\nferia y devolverlo conforme a los requerimientos de la Comisión de Feria\nEcológica.\n\nArtículo 17.-En el caso de las actividades que\ngeneren recursos económicos, el participante deberá cancelar un monto fijo\nestablecido por la Comisión\nde Feria Ecológica.\n\nArtículo\n18.-Cada puesto de venta deberá estar debidamente identificado, indicando el\nnombre de la persona productora u organización correspondiente, comunidad\norigen del producto y precio de cada producto en caso de requerirlo.\n\nArtículo\n19.-La parte interior de los puestos podrá ser acondicionada por cada\nparticipante.\n\nCAPÍTULO VII \n\n Educación, Cultura y Servicios \n\nArtículo 20.-A continuación se describirán las\nactividades y servicios que se pueden ofrecer durante la realización de la Feria Ecológica: \n\nExposiciones, talleres, charlas o\nconsultorías.\n\na) Las exposiciones sobre los temas ambientales permitidos en la Feria Ecológica\npodrán llevarse a cabo en el parque, el Ateneo o en lugares que la Comisión de Feria\nEcológica designe para ese fin. \n\nb) La información sobre lo expuesto en cada taller, charla o\nexposición, deberá estar a disposición de todo aquel que la requiera y se\ndeberá de dejar una copia del material de manera digital a la Unidad de Gestión\nAmbiental, con el fin de que dicha información se mantenga en la MSRH.\n\nc) Las diferentes talleres en temas ambientales se llevarán a cabo en\nel lugar, día y hora que la\n Comisión de Feria Ecológica designe para tal efecto y estarán\na cargo de La Asociación\nde Gestión Ambiental y Centro de Acopio, de la Comisión de Cambio\nClimático o de otra empresa, universidad o institución que lo proponga. \n\nd) Las actividades de educación ambiental tales como charlas, talleres,\nexposiciones, serán coordinadas por la Comisión de Feria Ecológica y la información de\nlas mismas se mantendrá en la\n Unidad de Gestión Ambiental de la MSRH las cuales estarán\ndisponibles al público. \n\ne) Establecer las coordinaciones pertinentes para promover la\nparticipación de los centros educativos del cantón. \n\nDe las actividades culturales.\n\nf) Las actividades culturales a presentarse deben tener la connotación\ntradicional y/o estar avocado a temas ambientales ecológicos. \n\nServicios de Alimentación.\n\ng) Establecer un único servicio de alimentos y bebidas para la venta\ncomidas durante la feria ecológica, cuyos alimentos deben tener como enfoque\nprincipal la salud del consumidor, utilizando preferiblemente productos\norgánicos, frescos y sostenibles. \n\nh) En el caso de la comida típica debe ser preparada en el momento, no\npodrá estar expuesta sin su debida protección ni recalentada y además deberá de\nseguir las normas de higiene y seguridad alimenticia. \n\ni) El servicio de alimentación deberá ser operado por una sola\norganización o grupo y el dinero que se recaude se utilizará en lo que dicha\norganización o grupo acuerden junto con la Comisión de Feria Ecológica debiendo ser\nutilizado para promover iniciativas ambientales en el cantón. \n\nj) La venta de comidas debe de contar con el permiso del Ministerio de\nSalud, según se indica en la legislación vigente para ese caso. \n\nk) Las aguas provenientes de la preparación de comidas deben de\ndisponerse en los lugares adecuados para ese fin. \n\nl) No se permitirá la venta de bebidas gaseosas o alcohólicas durante\nla realización de la feria ecológica. \n\nm) Será la municipalidad quien coordine la recolección de la basura que\nse produzca de esta actividad. \n\nRige a partir de su publicación. ecological fairs with similar purposes.\n\nArticle\n2º-Objectives: The objective of this regulation is to regulate\nthe holding of an ecological fair, where adequate environmental\neducation is guaranteed and there are options for sustainable and environmentally\nfriendly services and products.\n\nCHAPTER II \n\n On the organization and the nature of the Ecological Fair\n\nArticle 3º-The Ecological Fair\nshall be coordinated by a Commission appointed by the Municipal Council and\nsupervised by the Commission\nof Environmental Affairs of the\n MSRH.\n\nArticle 4º-The MSRH, through the Commission of the Ecological\nFair, shall invite those interested in participating in the Ecological Fair\nof the canton of San Rafael de Heredia, to be held on the weekend coinciding\nwith the celebration of Environment Week (Friday, Saturday, Sunday).\n\nArticle\n5º-The Ecological Fair\nshall include: the sale of ecological products and services, exhibitions,\nconsultancies, workshops and/or talks on environmental education, and a single food and beverage\nstand.\n\nArticle\n6º-The products of the offerors (vendors, consultants, exhibitors)\nmust: have the connotation of being environmentally friendly by possessing one\nof the following characteristics: being an organic product, being manufactured\nfrom sustainable, recyclable materials or natural fibers, and/or promoting\nthe use of clean and efficient technologies.\n\nArticle\n7º-These products shall be, for example: organic agricultural products, sustainable,\nartisanal, or homemade agro-industrial products (compost bins, organic\nfertilizers, hydroponics), ornamental and/or medicinal plants, ecotourism\nservices, bioenergetic services, eco-materials, furniture and decoration,\nnatural products for hygiene, health, beauty, and cosmetics, food\nproducts (jams, sweets, preserves, bee honey, cocoa, dairy\nproducts), footwear, textiles or natural fibers, alternative therapy and medicine,\nefficient materials and systems for construction, natural products for\npets, renewable energy, among others, preferentially produced in our\ncountry.\n\nArticle\n8º-The MSRH,\nthrough the Commission\nof the Ecological Fair\nof San Rafael, shall promote the following: \n\na) A physical space for the holding of the fair, with the\nparticipation of all offerors and interested parties, with the objective of holding\na true Ecological Fair in the Canton. \n\nb) Issuing an identification card to persons duly authorized\nto participate in the offer of products, commerce, and services. \n\nc) Meeting spaces between producers, organizations for the promotion\nof agro-ecology and environmental protection, organic consumers, and the public\nin general, interested in knowing and learning the advantages of organic\nproducts and the defense of the environment. \n\nd) A space for the dissemination of publications and educational materials\nrelated to green culture, organic agriculture, healthy food, and\nenvironmental protection. \n\ne) Making a copy of this regulation available to the participant\nfor its application, through the MSRH website. \n\nf) A space to promote the canton's environmental and climate\nchange initiatives that allow for publicizing the efforts made by the\ndifferent organized groups of the canton.\n\nCHAPTER III \n\n Obligations of the organizers \n\nArticle 9º-The obligations that the organizers of the Ecological Fair must comply with are described below: \n\na) Conduct prior coordination of the products to be offered with the\npurpose of having the greatest diversity while seeking a balance between\nsupply, demand, and the need for information. \n\nb) Disseminate the\n Ecological Fair through different means such as the municipality's\nwebsite, radio, email, brochures, magazines, and television,\namong others. \n\nc) Ensure compliance with this Regulation. \n\nd) Assign the stands according to the type of participant. \n\ne) Supervise that the products to be offered are of good quality and\npresentation, being able to remove those that, at the discretion of the Commission, do not\nmeet this requirement. \n\nf) Organize talks, workshops, consultancies, or exchange of\nexperiences on environmental topics. \n\ng) Coordinate security with the Municipal Police,\nthe public force of the Canton, and the\n Costa Rican Red Cross. \n\nh) Ensure, jointly with the participants, the order, cleanliness,\nand security of the place where the Fair will be held.\n\ni) Maintain an updated file of each of the participants of\nthe fair to keep a record of the suppliers or offerors so that they can be\ntaken into account on future occasions. \n\nj) Administer the funds collected during the holding of the Ecological Fair,\nin accordance with current legislation. \n\nk) Ensure the proper safekeeping of all documentation handled by the\ncommission in the exercise of its functions.\n\nCHAPTER IV \n\n On the participants \n\nArticle 10.-Once Articles 7 and 9 of\nthis regulation are complied with and the authorization card is obtained, the following may participate:\nindividual producers, producer organizations, processors,\nagricultural, agro-industrial, and artisanal companies, companies or institutions\noffering services or supplies, and Non-Governmental Organizations (NGOs).\n\nArticle\n11.-Participants must report the qualities and characteristics of their\nproduct, demonstrating compliance with Article 7 of this regulation\nat the time of obtaining authorization for participation in the fair.\nLikewise, they must conform to the environmental policies of the MSRH.\n\nArticle\n12.-Persons participating in this Ecological Fair must sign the\nCommitment Agreement and comply with the requirements indicated in this\nRegulation.\n\nCHAPTER V \n\n Obligations of the participants \n\nArticle 13.-The obligations that the participants of the Ecological Fair must comply with are described below: \n\na) Complete the Registration Form, indicating the products,\nquantities, and presentations expected to be sold and/or exhibited at the Fair, no later than April\n30th. \n\nb) Sign the commitment contract or participation agreement with the Ecological\nFair Commission in charge. \n\nc) Place in a visible location, such as on a blackboard, banner, or poster, the\nlist of products, sales prices, and category, as well as the certifications\nfor organic, eco-friendly, or ecotourism products (for those who possess them) or\npermits approved by the Ministry of Health. \n\nd) Wear the identification card provided by the MSRH in a visible location every day of the\necological fair. \n\ne) Comply with the indications that the Ecological\nFair Commission provides regarding sanitation, prevention and\ncorrection measures, and other indications required at the time. \n\nf) Maintain good conduct, excellent personal presentation, adequate\nhygiene standards, and courteous treatment of the public. \n\ng) Pay the fee for space usage at least two weeks\nbefore the start of the Fair.\n\nh) Collaborate with the cleaning of the Ecological Fair,\nboth at their own stand and at a general level. \n\ni) Comply with and enforce this Regulation. \n\nj) Respect and comply with national and local laws and regulations, the Traffic\nLaw, the General Health Law, etc.\n\nCHAPTER VI \n\n On the stands and the presentation \n\nArticle 14.-The Ecological Fair Commission shall prepare, for each\nyear, a site design that shall include: a layout sketch of the distribution of stands, areas\nfor ecological cultural activities, an area for exhibitions,\nworkshops, talks, or consultancies, common meeting areas, areas where\nsanitary services will be located, evacuation and security areas, and the food\narea.\n\nArticle\n15.-The Commission\nof the Ecological Fair shall distribute and designate the space for holding the\ndifferent activities in accordance with the characteristics of each one.\n\nArticle\n16.-Each participant may market their products at a stand designated\nby the organizers. They must ensure order and cleanliness in each\ndesignated space, as well as the care of the stand during its use on the days of the\nfair, and return it according to the requirements of the Ecological\nFair Commission.\n\nArticle 17.-In the case of activities that\ngenerate economic resources, the participant must pay a fixed amount\nestablished by the Commission\nof the Ecological Fair.\n\nArticle\n18.-Each sales stand must be duly identified, indicating the\nname of the corresponding producer or organization, the community\nof origin of the product, and the price of each product, if required.\n\nArticle\n19.-The interior of the stands may be conditioned by each\nparticipant.\n\nCHAPTER VII \n\n Education, Culture, and Services \n\nArticle 20.-The activities and services that can be offered during the holding of the Ecological Fair are described below: \n\nExhibitions, workshops, talks, or\nconsultancies.\n\na) Exhibitions on the environmental topics permitted at the Ecological Fair\nmay be held in the park, the Athenaeum, or in places that the Ecological\nFair Commission designates for that purpose. \n\nb) The information on what is presented in each workshop, talk, or\nexhibition must be available to anyone who requires it, and\na copy of the material must be left in digital format with the Environmental\nManagement Unit, so that said information is kept at the MSRH.\n\nc) The different workshops on environmental topics shall be held at\nthe place, day, and time that the\n Ecological Fair Commission designates for that purpose and shall be\nin charge of the Association\nfor Environmental Management and Collection Center, the Climate\nChange Commission, or another company, university, or institution that proposes it. \n\nd) Environmental education activities such as talks, workshops, and\nexhibitions shall be coordinated by the Ecological Fair Commission, and the information\non them shall be kept at the\n Environmental Management Unit of the MSRH and shall be\navailable to the public. \n\ne) Establish the relevant coordination to promote the\nparticipation of the canton's educational centers. \n\nOn cultural activities.\n\nf) The cultural activities to be presented must have a traditional\nconnotation and/or be focused on ecological environmental topics. \n\nFood Services.\n\ng) Establish a single food and beverage service for the sale\nof meals during the ecological fair, whose foods must have as their main\nfocus consumer health, preferentially using organic,\nfresh, and sustainable products. \n\nh) In the case of typical food, it must be prepared at the moment; it may not\nbe displayed without proper protection nor reheated, and it must also\nfollow food hygiene and safety standards. \n\ni) The food service shall be operated by a single\norganization or group, and the money collected shall be used for what that\norganization or group agrees upon together with the Ecological Fair Commission, and must be\nused to promote environmental initiatives in the canton. \n\nj) The sale of food must have the permit from the Ministry of\nHealth, as indicated in the legislation in force for that case. \n\nk) Water from food preparation must be\ndisposed of in appropriate places for that purpose. \n\nl) The sale of carbonated or alcoholic beverages shall not be permitted during\nthe holding of the ecological fair. \n\nm) The municipality shall coordinate the collection of waste\nproduced from this activity. \n\nIt shall enter into force upon its publication.
