creada en el artículo 177\nde la Ley de\nAguas, Nº 276 del 27 de agosto de 1942.\n\n2º-Que el Transitorio V de la Ley Nº 7593, publicada\nen  La Gaceta Nº\n169 de 5 de setiembre de 1996 y sus reformas, reformó la Ley Nº 276 y trasladó el\nDepartamento de Aguas del Servicio Nacional de Electricidad, incluyendo su\npersonal, activos y funciones, al Ministerio del Ambiente y Energía;\ndisponiendo que el traslado se haría efectivo dentro del plazo máximo de un año\ndespués de entrar en vigencia esa ley, con el propósito de facilitar los\najustes presupuestarios y de otra naturaleza que fueran pertinentes.\n\n3º-Que el artículo 1° del Decreto Ejecutivo Nº 26635-MINAE, publicado\nen La Gaceta Nº\n22 de 2 de febrero de 1998, trasladó con base en el Transitorio V a la citada\nLey Nº 7593, el Departamento de Aguas al Instituto Meteorológico Nacional del Ministerio\ndel Ambiente y Energía; definiendo en el artículo 2° que su misión es la de\nadministrar oportuna y eficientemente los recursos hídricos en todo el\nterritorio nacional, procurando el desarrollo sostenible mediante su\nordenamiento y manejo racional y brindando un servicio excelente.\n\n4º-Que por medio del oficio 301-2013-IMN de 12 de setiembre de 2013, el\nDirector General del Instituto Meteorológico Nacional (IMN), solicitó la\nampliación del gasto presupuestario máximo de esa dependencia por un monto de\n¢75.000.000,00 (setenta y cinco millones de colones exactos) para el 2013,\nrecursos que se utilizarían para reforzar la partida presupuestaria\nTransferencias Corrientes a Órganos Desconcentrados, específicamente de la Comisión para el\nOrdenamiento y Manejo de la\n Cuenca del Río Reventazón (COMCURE).\n\n5º-Que corresponde ampliar por la vía del Decreto Ejecutivo, la citada\nsuma de ¢75.000.000,00 (setenta y cinco millones de colones exactos) de\nconformidad con lo establecido en el artículo 7° del Decreto Ejecutivo Nº\n37042-H, publicado en el Alcance Digital Nº 35 a La Gaceta Nº 59 de\n22 de marzo del 2012 y sus reformas, toda vez que los gastos que se atenderán\nson necesarios para la gestión sustantiva de la institución y serán financiados\ncon recursos provenientes de superávit libre generado por la Resolución Nº\nR-0473-AGUAS-MINAET-2012, relativa al proyecto denominado \"Protección del\nRecurso Hídrico mediante la reforestación de áreas de protección de nacientes,\ncauces y zonas de recarga acuífera en la cuenca alta de los cantones de\nAlvarado y Oreamuno\". Resolución que establece una serie de proyectos, entre\nlos que se encuentra el antes señalado que se financiarían con fondos que\nprovienen del Canon por Aprovechamiento de Agua.\n\n6º-Que mediante el Decreto Ejecutivo Nº 37042-H citado, se emitieron las\nDirectrices Generales de Política Presupuestaria para el 2013, estableciéndose\nen el artículo 5°, el porcentaje máximo en que podría incrementarse el gasto\npresupuestario de las entidades públicas, ministerios y demás órganos, con\nrespecto al del año precedente. En correspondencia con dicha disposición, el\nmonto de gasto presupuestario máximo resultante para el IMN-AGUAS, fue\nestablecido en la suma de ¢129.690.000,00 (ciento veintinueve millones\nseiscientos noventa mil colones exactos), el cual fue comunicado mediante el\noficio STAP-0934-2012 del 26 de abril del 2012; articles 25 subsection 1), 27 subsection 1), and 28 subsection 2) subparagraph b) of Law No. 6227, General Law of Public Administration of May 2, 1978, and its amendments; Law No. 8131, Law of the Financial Administration of the Republic and Public Budgets of September 18, 2001, and its amendments; its Regulation, Executive Decree No. 32988-H-MP-PLAN of January 31, 2006, and its amendments; Law No. 7593, Law of the Regulatory Authority for Public Services of August 9, 1996, and its amendments; Executive Decree No. 26635-MINAE of December 18, 1997; Executive Decree No. 32452-H of June 29, 2005, and its amendments; and Executive Decree No. 37042-H of March 13, 2012, and its amendments.\n\n Considering:\n\n1º-That the Water Directorate was created in article 177 of the Water Law, No. 276 of August 27, 1942.\n\n2º-That Transitory Provision V of Law No. 7593, published in La Gaceta No. 169 of September 5, 1996, and its amendments, amended Law No. 276 and transferred the Department of Waters from the National Electricity Service, including its personnel, assets, and functions, to the Ministry of Environment and Energy; ordering that the transfer be made effective within a maximum period of one year after the entry into force of said law, for the purpose of facilitating the pertinent budgetary and other adjustments.\n\n3º-That article 1 of Executive Decree No. 26635-MINAE, published in La Gaceta No. 22 of February 2, 1998, transferred, based on Transitory Provision V to the cited Law No. 7593, the Department of Waters to the National Meteorological Institute of the Ministry of Environment and Energy; defining in article 2 that its mission is to administer in a timely and efficient manner the water resources throughout the national territory, striving for sustainable development through their land-use planning (ordenamiento) and rational management and providing excellent service.\n\n4º-That by means of official communication 301-2013-IMN of September 12, 2013, the Director General of the National Meteorological Institute (IMN), requested the expansion of the maximum budget expenditure of that agency for an amount of ¢75,000,000.00 (seventy-five million exact colones) for 2013, resources that would be used to reinforce the budget line item Current Transfers to Deconcentrated Bodies, specifically of the Commission for the Land-Use Planning and Management of the Reventazón River Watershed (COMCURE).\n\n5º-That it is appropriate to expand, through an Executive Decree, the cited sum of ¢75,000,000.00 (seventy-five million exact colones), in accordance with the provisions of article 7 of Executive Decree No. 37042-H, published in Digital Supplement No. 35 to La Gaceta No. 59 of March 22, 2012, and its amendments, given that the expenses to be covered are necessary for the substantive management of the institution and will be financed with resources from free surplus generated by Resolution No. R-0473-AGUAS-MINAET-2012, concerning the project called \"Protection of Water Resources through reforestation of protection areas for springs (nacientes), watercourses, and aquifer recharge zones in the upper watershed of the cantons of Alvarado and Oreamuno.\" Resolution that establishes a series of projects, among which is the aforementioned, which would be financed with funds coming from the Water Use Fee (Canon por Aprovechamiento de Agua).\n\n6º-That through the cited Executive Decree No. 37042-H, the General Budgetary Policy Guidelines for 2013 were issued, establishing in article 5 the maximum percentage by which the budget expenditure of public entities, ministries, and other bodies could be increased, with respect to that of the previous year. In correspondence with said provision, the resulting maximum budget expenditure amount for IMN-AGUAS was established at the sum of ¢129,690,000.00 (one hundred twenty-nine million six hundred ninety thousand exact colones), which was communicated through official communication STAP-0934-2012 of April 26, 2012; subsequently amended by official communication STAP-1002-2013 and by Executive Decree No. 37809-H published on August 8, 2013, in La Gaceta Digital No. 151, to be finally set at the sum of ¢3,366,839,949.02 (three billion three hundred sixty-six million eight hundred thirty-nine thousand nine hundred forty-nine colones and two céntimos), an amount that does not contemplate the expenditure previously indicated in this decree.\n\n7º-That through Executive Decree No. 32452-H, published in La Gaceta No. 130 of July 6, 2005, and its amendments, the \"Guideline for the application of article 6 of Law No. 8131, Law of the Financial Administration of the Republic and Public Budgets, and the regulation of the class of Public Sector revenues called Financing\" is issued.\n\n8º-That article 7 of the Decree cited in the previous considering clause provides that financing resources coming from previous fiscal years -free surplus- are part of the equity of the bodies and entities and can be used in subsequent periods to finance expenses related to their ordinary activity, thereby serving the interest of the community, the public service, and institutional purposes, provided that they do not have a permanent character or generate an obligation that requires financing over time, such as the creation of positions for fixed posts, or any other commitment of the same nature.\n\n9º-That in light of the foregoing, it is necessary to expand the maximum budget expenditure set for IMN-AGUAS for 2013, increasing it by the sum of ¢75,000,000.00 (seventy-five million exact colones).
