utilización de las redes de arrastre en el\naprovechamiento del recurso camarón, manteniéndose la vigencia de las licencias de pesca de camarón\nsemiindustrial que se encontraren activas a la fecha del dictado de la sentencia de\nconstitucionalidad, bajo la consideración de que la actividad se ejerza con sujeción al ordenamiento\njurídico y que se adopten si fuera científicamente posible, tecnologías amigables con el ambiente\nbajo la supervisión del INCOPESCA.\n\n4º-Que el INCOPESCA\nha realizado y emitido a oficialmente en el mes de setiembre del año 2013 el\nInforme Técnico del Proyecto \"Evaluación del Uso de Dispositivos Excluidores de\nPeces (DEP), en Redes de Arrastre de Camarón, Pacífico, Costa Rica\", mediante\nel cual se concluye la razonabilidad y conveniencia como aprovechando el\ncomportamiento presentan varias especies de peces de nado contra corriente, ya\nque este aditamento se coloca de tal manera que origina un flujo de corriente\nhacia adentro de la red y, los peces al reaccionar ante ese flujo encuentran la\nsalida; por su parte el camarón es empujado por esta corriente al fondo del bolso\nasegurando su captura. Por tanto, \n\nACUERDAN: \n\n1º-Se establece como obligatorio el uso del dispositivo excluidor de peces, del tipo ojo de pescado,\nen la realización de las faenas de pesca por parte de la flota semiindustrial camaronera\ncostarricense, tanto en la pesca costera como en la pesca de profundidad. El aro se fija en los bordes del corte del paño\nubicando el vértice del triángulo hacia la boca de la red, las mallas del corte\nque quedan del lado del DET se fijan en el contorno inferior del aro y las del\notro lado del corte (las que quedan del lado del bolso o copo) se sujetan a la\nparte superior del aro del dispositivo excluidor de tortugas marinas. Para\ncompensar el peso del aditamento, junto al borde superior, por la parte\nexterna, se coloca un flotador rígido. El aditamento no puede ser obstruido por\nningún elemento de la red, en el caso del cabo de cobro (falso), sus elementos\nde fijación como argollas o anillos deberán estar en la parte posterior del\ndispositivo ojo de pescado.\n\n3º-La\nutilización obligatoria del uso del dispositivo excluidor de peces, para la\nflota semiindustrial camaronera costarricense, lo será a partir del 1 de enero\ndel año 2014. Therefore, \n\nTHEY AGREE: \n\n1º-It is established as mandatory the use of the fish excluder device, of the fisheye type,\nin the conduct of fishing operations by the Costa Rican semi-industrial shrimp\nfleet, both in coastal fishing and in deep-water fishing. Said device shall\nbe placed, one per trawl net, located in the upper part of the net bag (copo). The\nfisheye device consists of an elliptical-shaped frame, constructed with a stainless steel\nor aluminum rod, which keeps open the cut in the net through which the exit of\nthe fish is allowed, reinforced with a triangle of the same material, to fix the working position. The\ndevice must comply with the following design and measurements: with a dimension at its escape\nopening of a length of 320mm (32 centimeters) and a height of 220mm (22 centimeters) and a\nvertex depth of 440mm (44 centimeters), according to the following design:\n\n2º-The\nfisheye device must be installed in the net, at the center of the\nupper part of the capture bag or net bag (copo), measured from the closure of the\nbag towards the Turtle Excluder Device (TED) with the mesh stretched and\nis marked, cutting the upper central mesh to make a cut on each\nof its sides, making a hole in the bag or net bag (copo), adjusted to the diameter\nof the device ring. The ring is fixed to the edges of the mesh cut\nplacing the vertex of the triangle towards the mouth of the net, the meshes of the cut\nthat remain on the side of the TED are fixed to the lower contour of the ring and those on\nthe other side of the cut (those that remain on the side of the bag or net bag (copo)) are attached to the\nupper part of the turtle excluder device ring. To\ncompensate for the weight of the attachment, a rigid float is placed alongside the upper edge, on the outer\npart. The attachment cannot be obstructed by\nany element of the net; in the case of the lazy line, its\nfastening elements such as rings or loops must be located at the rear part of the\nfisheye device.\n\n3º-The\nmandatory use of the fish excluder device, for the\nCosta Rican semi-industrial shrimp fleet, shall be effective as of January 1,\n2014. The inspection and verification of the mandatory use of the\ndevice shall correspond to the exercise of the powers and competencies of the\nNational Coast Guard Service and of INCOPESCA, through the Fisheries\nProtection Unit or the corresponding body, both at sea and at the\nunloading of the shrimp boats.\n\n4º-Violation\nof the provisions herein, regarding the use of the fish\nexcluder device in fishing operations and its installation and use in the trawl\nnets of semi-industrial shrimp vessels, shall be sanctioned\nin accordance with the applicable provisions of Law 8436, both through administrative\nchannels and for the purpose of filing the corresponding judicial\ncomplaints.\n\n5º-INCOPESCA,\nthrough the Technical General Directorate and the Research\nand Development Department, shall carry out the corresponding studies for the\npurposes of monitoring and following up on the analysis of the results\nresulting from the use of the fish excluder device, in order\nto determine any actions that may be necessary to adjust and\nimprove the functioning of the device in the interest of the sustainable\nuse of hydrobiological resources.\n\n6º-Let it be published.\n\n7º-This agreement is final." }
