Cantón\nCentral de Cartago comunica que mediante el artículo N° 5 de la sesión\nordinaria Nº 259-2013, del día 22 de octubre del 2013, y de conformidad con lo\nestablecido en los artículos 4, inciso a), articulo 13, incisos c) y d) y\narticulo 43 del Código Municipal, acordó las siguientes reformas al \"Reglamento\nde Uso de las Instalaciones del Parque Ambiental Río Loro\": \n\nREFORMAS AL Todo interesado en\nreservar las instalaciones y/o los servicios que brinda el PAM, deberá\nsolicitarlo en forma escrita (mediante el Formulario de Solicitud que\nsuministra la administración del PAM y con antelación de al menos ocho días\nnaturales a la fecha que se desea ingresar al PAM. Dicho formulario será\nentregado en las oficinas del PAM de forma personal o por medio de correo\nelectrónico con previa solicitud del interesado, e] cual será sometido a\nestudio por la administración de acuerdo a la disponibilidad que tenga. En toda\nsolicitud deberá señalarse medio o lugar para recibir notificaciones.\n\nArtículo 7º-Trámite. Recibida la solicitud, la\nAdministración procederá a verificar el cumplimiento de los requisitos\nseñalados en el formulario. En caso de aprobarse la gestión del solicitante, se\nhará entrega de un documento en el que se establecerán las condiciones de uso\nde las instalaciones y términos generales relativos al aprovechamiento del PAM.\n\nArtículo 8º-Obligaciones. \"Léase punto g\ncorrectamente\"\n\ng) No podrá cederse el permiso a personas u organización diferente a la\nsolicitante y la actividad autorizada no podrá ser variada sin la autorización\nprevia de la Administración.\n\nArtículo 10.-Comité Gestor y administrador/a del PAM:\nEl PAM será administrado por un Comité Gestor integrada por a) Encargado/a Área\nTécnica Acueductos, b) Gestor/a Ambiental del Área Técnica Acueductos, c)\nAdministrador /a del PAM. d) Encargado/a Unidad Ambiental e) Encargado/a\nOficina de Turismo.\n\nCorresponderán\na dicho comité las siguientes funciones:\n\nmargin-right:0cm;margin-bottom:0cm;\nmargin-left:24.0pt;margin-bottom:.0001pt;text-align:justify'>a) Solicitar en los\ntérminos del capítulo III de este reglamento, el estudio para el cambio de\ntarifa de ingreso al PAM, ante la administración Municipal.\n\nb) Elevar a la\nAlcaldía los cambios que se realicen a este reglamento, para su aprobación por\nparte del Concejo Municipal.\n\nc) Atender aspectos\nadministrativos y/o ambientales en conjunto con el Administrador del PAM,\ncuando así lo solicite este último de manera justificada.\n\nCorresponderá\nal Administrador del PAM:\n\na. Velar por el\nadecuado cumplimiento de las funciones que le otorga este Reglamento.\n\nb. Confeccionar,\nsolicitar y ejecutar el presupuesto, asignado al PAM.\n\nc. Ejecutar la\nplanificación del programa de mantenimiento de las instalaciones del PAM.\n\nd. Desarrollar el programa\nde educación Ambiental que se genere en el PAM de acuerdo a lo establecido en\nel artículo 5. \n\ne. Recibir de la\nUnidad Ambiental las solicitudes para ingreso, uso de los espacios y servicios\nbrindados por el PAM.\n\nf. Aprobar o denegar\ndichas solicitudes conforme los términos del presente reglamento, en forma\njustificada.\n\ng. Emitir a los\nusuarios del PAM, las recomendaciones u órdenes, verbales o escritas, que se\nestimen pertinentes para el mejor desarrollo de la actividad a realizar en el\nespacio cedido y suspender o revocar de inmediato el permiso cuando estas no\nsean cumplidas a satisfacción, o se produzca algún uso indebido de las\ninstalaciones.\n\nh. Llevar el control\nde las actividades autorizadas en cuanto a fechas, horarios espacios, con la\nfinalidad de procurar el mayor aprovechamiento y un servicio de calidad a los\nvisitantes así como para cumplir con los requerimientos de control interno.\n\ni. Mantener un\nregistro de los permisos concedidos ordenados cronológicamente.\n\nj. Mantener una\nestadística de los visitantes o personas que ingresan al PAM.\n\nk. Generar\nalternativas o iniciativas que propicien la sostenibilidad del PAM.\n\nl. Ser el enlace con\nel Área de Acueductos Municipal para que el área total del Parque tenga la\noperación y mantenimiento debido, protegiendo de esta forma el recurso hídrico\ndisponible en el lugar.\n\nArtículo 11.-Prohibiciones\n\na) Las instalaciones\ndel PAM solo podrán ser utilizadas para actividades relacionadas con educación\nambiental, protección del recurso hídrico, desarrollo turístico sostenible y\ngestión municipal; por lo que toda autorización de uso contraria a dichos fines\nse encuentra prohibida . Igualmente la administración se encuentra facultada\npara ordenar la suspensión inmediata de cualquier actividad que se desarrolle\nen oposición a ese destino o incumpla alguno de los requisitos de utilización,\npudiéndose hacer uso de la Policía Municipal y de la Fuerza Pública inclusive.\n\no) No realizar\nactividades recreativas en los senderos del PAM, en la zona de captación u en\notra área que la administración considere necesaria.\n\nArtículo 12.-Horario de uso. El PAM permanecerá\nabierto al público de miércoles a domingo de 8:00 am a 3:00 pm, inclusive días\nferiados; esto sin perjuicio de que la Unidad Ambiental y/o el Alcalde Municipal\ndispongan. En el lapso entre las 3:00 pm y las 4 pm los funcionarios del PAM se\nencargarán de retirar a los visitantes que aún permanezcan en los senderos así\ncomo de inspeccionar las instalaciones de los mismos, haciendo efectivo el\ncierre de las instalaciones del PAM a las 4:00 pm. \n\nArtículo\n13.-Capacidad de las instalaciones. Según estimación realizada por el\nCentro de Investigación en Protección Ambiental del Instituto Tecnológico de\nCosta Rica se determina una capacidad de carga de 80 visitantes diarios para el\nPAM según sus características de extensión, ubicación y recursos naturales que\nposee.\n\nSerá\nresponsabilidad de los funcionarios municipales y efectivos de la seguridad\nmunicipal destacados en el PAM, velar por que se respete dicha capacidad de\ncarga y no se supere el máximo de personas permitidas.\n\nSerá\nobligación de cada funcionario efectivo de seguridad municipal el poner en\nconocimiento a la Administración de Parque y este al Comité Gestor de cualquier\nanomalía o irregularidad de la que tengan conocimiento durante el desarrollo de\nlas actividades dentro del PAM, sin perjuicio de las facultades que éstos\nconservan de adoptar las medidas pertinentes e inmediatas, que procuren cesar\nel acto o conducta irregular. La Municipalidad a través del Departamento de\nSeguridad Municipal, podrá reservarse el derecho de admisión con el objetivo de\nsalvaguardar los recursos e instalaciones del PAM\".\n\n\"Artículo 2º-Corríjase la numeración del Reglamento\nMunicipal de Uso y Control del Parque Ambiental Municipal Río Loro, a partir\ndel numeral 18 achial, para que en adelante digan:\n\nArtículo 19.-Casos de excepción: No pagarán el\nprecio a que se refiere el artículo 14:\n\n3. Los beneficiarios de convenios suscritos\ncon la Municipalidad, que tengan por objeto el desarrollo y promoción de\nproyectos de interés ambiental y de desarrollo turístico sostenible en el Parque\nAmbiental Municipal Río Loro.\n\n4. Estudiantes\nnacionales o extranjeros de instituciones públicas o privadas que deseen\nrealizar su Trabajo Comunal, voluntariado o Prácticas Profesionales en el\nParque Ambiental Municipal Río Loro.\n\nPara optar por esta\nexcepción, los interesados deberán aportar a la Unidad Ambiental de la\nMunicipalidad de Cartago, una nota expedida por la Institución Educativa a la\nque pertenezcan, debidamente firmada y sellada por el representante de la\nmisma, mediante la cual se solicite formalmente la admisión del interesado en\nactividades dentro del Parque Ambiental. La nota debe incluir el nombre de las\npersonas interesadas con su número de carnet o cédula de identidad y la póliza\nde riesgos que le permiten a la Municipalidad quedar exonerado en un eventual\naccidente que incurran los usuarios de este beneficio. En caso de ser aceptada\nla solicitud, la Unidad Ambiental notificará por escrito al centro educativo\ndel o los solicitantes y los requerimientos que deben aportar, así mismo notificará\npor escrito a la Administración del Parque Ambiental Municipal Río Loro, lo que\ncorresponda.\n\n5. Instituciones\npúblicas o privadas y grupos de distinta índole que aporten con su ingreso y\nactividad dentro del Parque Ambiental Municipal , desarrollo y promoción de\nproyectos de interés ambiental y de desarrollo turístico sostenible, cuyos\nresultados deben ser siempre proyectados hacia el mismo Parque Ambiental y/o\nhacia la comunidad. De igual manera se eximirá del pago a personas de\ninstituciones participantes en iniciativas alrededor de la gestión y proyectos\nmunicipales de naturaleza ambiental turística y municipal.\n\nPara optar por esta\nexcepción, los interesados deberán solicitarlo por escrito a la Unidad\nAmbiental, indicando el objetivo de la visita al Parque, el tiempo que\npermanecerán en el Parque, las actividades que allí realizarán y el nombre y su\nnúmero de identificación. La Unidad Ambiental comunicará a la Administración\ndel PAM lo que corresponda.\n\n6. Funcionarios\nmunicipales debidamente identificados con su carnet vigente.\n\nArtículo 20.-Condiciones\nde las Excepciones de Pago:\n\na) La\nexcepción del pago por el ingreso y uso de las instalaciones del PAM, se\naplicará en los casos anteriores siempre y cuando exista una solicitud aprobada\ny presentada con al menos una semana de anterioridad. Any person interested in reserving the facilities and/or services provided by the PAM must submit a written request (using the Application Form supplied by the administration of the PAM, and at least eight calendar days prior to the date they wish to enter the PAM). Said form shall be delivered to the PAM offices in person or by email following a prior request by the interested party, and it will be subject to study by the administration based on availability. Every application must indicate a means or place for receiving notifications.\n\nArticle 7.—Procedure. Once the application is received, the Administration will proceed to verify compliance with the requirements indicated in the form. If the applicant's request is approved, a document will be issued setting forth the conditions for the use of the facilities and general terms related to the use of the PAM.\n\nArticle 8.—Obligations. \"Read point g correctly\"\n\ng) The permit may not be transferred to a person or organization different from the applicant, and the authorized activity may not be changed without prior authorization from the Administration.\n\nArticle 10.—Management Committee and Administrator of the PAM: The PAM shall be administered by a Management Committee composed of a) Head of the Aqueducts Technical Area, b) Environmental Manager of the Aqueducts Technical Area, c) Administrator of the PAM. d) Head of the Environmental Unit e) Head of the Tourism Office.\n\nThe following functions shall correspond to said committee:\n\na) Request, under the terms of Chapter III of these regulations, a study for a change in the PAM entrance fee from the Municipal administration.\n\nb) Submit changes made to these regulations to the Mayor's Office for approval by the Municipal Council.\n\nc) Address administrative and/or environmental aspects jointly with the PAM Administrator when so requested by the latter in a justified manner.\n\nThe following shall correspond to the PAM Administrator:\n\na. Ensure the proper fulfillment of the functions granted by these Regulations.\n\nb. Prepare, request, and execute the budget allocated to the PAM.\n\nc. Execute the planning of the maintenance program for the PAM facilities.\n\nd. Develop the environmental education program generated in the PAM in accordance with the provisions of Article 5.\n\ne. Receive from the Environmental Unit the applications for entry, use of spaces, and services provided by the PAM.\n\nf. Approve or deny said applications in accordance with the terms of these regulations, in a justified form.\n\ng. Issue to PAM users the pertinent recommendations or orders, verbal or written, deemed appropriate for the better development of the activity to be carried out in the assigned space, and immediately suspend or revoke the permit when these are not fulfilled satisfactorily, or any improper use of the facilities occurs.\n\nh. Keep control of authorized activities regarding dates, schedules, and spaces, with the aim of ensuring the best use and quality service to visitors as well as complying with internal control requirements.\n\ni. Maintain a chronologically ordered record of granted permits.\n\nj. Maintain statistics on visitors or persons entering the PAM.\n\nk. Generate alternatives or initiatives that promote the sustainability of the PAM.\n\nl. Serve as the liaison with the Municipal Aqueducts Area so that the total area of the Park has proper operation and maintenance, thereby protecting the water resource (recurso hídrico) available at the site.\n\nArticle 11.—Prohibitions\n\na) The PAM facilities may only be used for activities related to environmental education, protection of water resources (recurso hídrico), sustainable tourism development, and municipal management; therefore, any authorized use contrary to these purposes is prohibited. Likewise, the administration is empowered to order the immediate suspension of any activity carried out in opposition to this purpose or that fails to comply with any of the use requirements, and may make use of the Municipal Police and even the Public Force (Fuerza Pública).\n\no) Do not carry out recreational activities on the PAM trails, in the spring catchment area (zona de captación), or in any other area deemed necessary by the administration.\n\nArticle 12.—Hours of Use. The PAM shall remain open to the public from Wednesday to Sunday from 8:00 a.m. to 3:00 p.m., including holidays; this is without prejudice to any provisions made by the Environmental Unit and/or the Municipal Mayor. In the period between 3:00 p.m. and 4:00 p.m., PAM staff will be responsible for removing any visitors who still remain on the trails as well as inspecting their facilities, making the closure of the PAM facilities effective at 4:00 p.m.\n\nArticle 13.—Capacity of the facilities. According to an estimate made by the Centro de Investigación en Protección Ambiental (Environmental Protection Research Center) of the Instituto Tecnológico de Costa Rica, a carrying capacity of 80 daily visitors is determined for the PAM based on its characteristics of size, location, and natural resources it possesses.\n\nIt shall be the responsibility of the municipal officials and municipal security personnel assigned to the PAM to ensure that said carrying capacity is respected and that the maximum permitted number of persons is not exceeded.\n\nIt shall be the obligation of each municipal security officer to bring to the attention of the Park Administration, and the latter to the Management Committee, any anomaly or irregularity they become aware of during the development of activities within the PAM, without prejudice to the powers they retain to adopt the pertinent and immediate measures to stop the irregular act or conduct. The Municipality, through the Municipal Security Department, may reserve the right of admission with the aim of safeguarding the resources and facilities of the PAM.\"\n\n\"Article 2.—The numbering of the Municipal Regulations for the Use and Control of the Río Loro Municipal Environmental Park (Parque Ambiental Municipal Río Loro) is hereby corrected, starting from numeral 18 onwards, to read as follows henceforth:\n\nArticle 19.—Exception Cases: The following shall not pay the price referred to in Article 14:\n\n3. Beneficiaries of agreements signed with the Municipality, which aim at the development and promotion of projects of environmental interest and sustainable tourism development in the Río Loro Municipal Environmental Park.\n\n4. National or foreign students from public or private institutions who wish to perform their Community Service (Trabajo Comunal), volunteering, or Professional Internships (Prácticas Profesionales) in the Río Loro Municipal Environmental Park.\n\nTo opt for this exception, interested parties must provide the Environmental Unit of the Municipality of Cartago with a note issued by the Educational Institution to which they belong, duly signed and sealed by its representative, formally requesting the admission of the interested party to activities within the Environmental Park. The note must include the name of the interested persons with their student ID or national identity card number and the risk insurance policy that allows the Municipality to be exempted from liability in the event of an accident incurred by users benefiting from this. If the application is accepted, the Environmental Unit shall notify the educational center of the applicant(s) in writing of the corresponding requirements they must provide, and shall likewise notify the Administration of the Río Loro Municipal Environmental Park in writing, as appropriate.\n\n5. Public or private institutions and groups of various kinds that contribute, through their entry and activity within the Municipal Environmental Park, to the development and promotion of projects of environmental interest and sustainable tourism development, the results of which must always be projected toward the Environmental Park itself and/or toward the community. Likewise, payment shall be waived for persons from institutions participating in initiatives related to municipal management and projects of an environmental, tourism, and municipal nature.\n\nTo opt for this exception, interested parties must request it in writing from the Environmental Unit, indicating the purpose of the visit to the Park, the length of time they will remain in the Park, the activities they will conduct there, and their name and identification number. The Environmental Unit shall communicate the appropriate details to the PAM Administration.\n\n6. Municipal officials duly identified with their valid ID card.\n\nArticle 20.—Conditions for Payment Exceptions:\n\na) The exception from payment for entry and use of the PAM facilities shall apply in the above cases only if an approved application exists and was submitted at least one week in advance. (Except in point 4).\n\nb) The exception shall apply to the person or group that meets the characteristics and requirements stated above and shall not be effective for third parties, relatives, or companions.\n\nc) To make the exception effective, the interested party must appear at the toll booth with valid identification matching the approved applications.\n\nd) For anyone not qualifying for the payment exception, the fee shall be charged in accordance with Article 14.\n\ne) Children under three years of age shall be exempt from payment.\"\n\nLet it be published in the Official Gazette La Gaceta, for the purpose of submitting it to a non-binding public consultation, for a minimum period of 10 business days." }
