Asimismo,\nartículos 13, 14, 15, 20, 21 de la Ley de Catastro Nacional N° 6545 de 25 de\nmarzo de 1981, artículos 7° y 26 de Reglamento a la Ley de Catastro Nacional, Decreto\nEjecutivo N° 34331 de 29 de noviembre del 2007 (reformado por Decreto Ejecutivo\nN° 34763 de 16 de setiembre del 2008), Ley N° 8154 de 27 de noviembre del 2001,\n\"Convenio de Préstamo N° 1284/OC-CR, Programa de Regularización Catastro y\nRegistro\", Decreto Ejecutivo N° 30106-J, de 6 de diciembre del 2001, \"Declara\nZona Catastral la Totalidad de los Cantones del Territorio Nacional\" y Decreto\nEjecutivo N° 35509-J de 30 de setiembre del 2009, \"Reglamento de Organización\ndel Registro Inmobiliario\".\n\nConsiderando:\n\n1º-Que mediante Ley N° 8710, publicada en La Gaceta N° 48 del 10 de\nmarzo del 2009 se reforma el artículo 2° de la Ley N° 5695, Ley de Creación del\nRegistro Nacional, y sus reformas, indicando que el Catastro Nacional pasa a\nformar parte del Registro Inmobiliario.\n\n2º-Que el Decreto Ejecutivo N° 35509-J de 30 de setiembre del 2009,\nReglamento de Organización del Registro Inmobiliario publicado en el Diario\nOficial La Gaceta N° 198 del 13 de octubre del 2009, establece que el Registro\nInmobiliario está conformado por la Subdirección de Catastro y la Subdirección\nRegistral.\n\n3º-Que el Registro Inmobiliario del Registro Nacional, con fundamento en\nla Ley de Catastro Nacional N° 6545 de 25 de marzo de 1981, en su artículo 13\ntiene como potestad exclusiva, la ejecución y mantenimiento del Catastro,\nfunción que puede delegar parcialmente en otras instituciones estatales.\n\n4º-Que la Asamblea Legislativa, el 27 de noviembre del 2001, aprobó la\nLey N° 8154, \"Convenio de Préstamo N° 1284/OC-CR, Programa de Regularización\ndel Catastro y Registro\", suscrito entre el Gobierno de la República y el Banco\nInteramericano de Desarrollo (BID), para la ejecución del Programa de\nRegularización del Catastro y Registro Nacional, que por disposición de la\nmisma ley, está a cargo de una Unidad Ejecutora adscrita al Ministro de\nHacienda como órgano desconcentrado.\n\n5º-Que el Programa de Regularización del Catastro y Registro Nacional,\ntiene como tarea el levantamiento catastral con el objetivo de formar el\ncatastro nacional y compatibilizar la información catastral y registral de los\ninmuebles, en aplicación de lo que dispone la Ley de Catastro N° 6545 de 25 de\nmarzo de 1981.\n\n6º-Que de conformidad con lo que establece el artículo 1° Decreto\nEjecutivo N° 30106-J donde se \"Declara Zona Catastral la Totalidad de los\nCantones del Territorio Nacional\" publicado en La Gaceta N° 19 de 28 de enero\ndel 2002 y el artículo 7° del Reglamento a la Ley del Catastro Nacional,\nDecreto Ejecutivo N° 34331, el cual rige desde el 27 de setiembre del 2008, la\ntotalidad de los cantones del territorio nacional fueron declarados zona\ncatastral. \n\n7º-Que el Reglamento a la Ley de Catastro Nacional, Decreto Ejecutivo N°\n34331 el cual rige desde el 27 de setiembre de 2008, establece los\nrequerimientos técnicos para el levantamiento de planos de agrimensura.\n\n8º-Que por haber concluido los trabajos de levantamiento catastral del\ncantón 03 La Unión, distritos 01 Tres Ríos, 02 San Diego, 03 San Juan, 04 San\nRafael, 05 Concepción, 06 Dulce Nombre, 07 San Ramón, 08 Río Azul de la\nprovincia de Cartago y de conformidad con lo que establece el artículo 19 de la\nLey de Catastro Nacional y 10 de su reglamento, fueron convocados por el\nRegistro Inmobiliario del Registro Nacional y la Unidad Ejecutora del Programa\nde Regularización del Catastro y Registro Nacional, los propietarios de\ninmuebles de dichos Distritos a una exposición pública para conocer los\nresultados del levantamiento y manifestar su conformidad o disconformidad.\n\n9º-Que la convocatoria a la exposición pública de los resultados del\nlevantamiento catastral del cantón 03 La Unión, distritos 01 Tres Ríos, 02 San\nDiego, 03 San Juan, 04 San Rafael, 05 Concepción, 06 Dulce Nombre, 07 San\nRamón, 08 Río Azul de la provincia de Cartago fue publicada en el Diario Oficial\nLa Gaceta N° 27 del 9 de febrero del 2010, página 8 y La Gaceta N° 44 del 4 de\nmarzo del 2010, página 19 y en el diario de circulación nacional La Nación, en\nfechas 7 y 8 de febrero del 2010.\n\n10.-Que en resolución de las diez horas treinta minutos del treinta y\nuno de octubre del dos mil trece el Registro Inmobiliario del Registro Nacional\ndeclaró firmes los datos catastrales resultantes del levantamiento catastral\nefectuado en el cantón 03 La Unión, distritos 01 Tres Ríos, 02 San Diego, 03\nSan Juan, 04 San Rafael, 05 Concepción, 06 Dulce Nombre, 07 San Ramón, 08 Río\nAzul de la provincia de Cartago.\n\n11.-Que ya transcurrieron los términos de los plazos establecidos en el\nartículo 20 de la Ley del Catastro Nacional y fueron resueltos, por la\nDirección del Registro Inmobiliario del Registro Nacional, los reclamos\npresentados por los propietarios. Por tanto,\n\nDecretan:\n\nSE DECLARA ZONA CATASTRADA LOS DISTRITOS\n\nPRIMERO TRES RÍOS, SEGUNDO SAN DIEGO, TERCERO\n\nSAN JUAN, CUARTO SAN RAFAEL, QUINTO CONCEPCIÓN,\n\nSEXTO DULCE NOMBRE, SÉTIMO SAN RAMÓN,\n\nOCTAVO RÍO AZUL DEL CANTÓN 03 LA UNIÓN\n\nDE LA PROVINCIA 03 CARTAGO\n\nArtículo 1º-De conformidad con el artículo 20 de la Ley de Catastro\nNacional N° 6545 de 25 de marzo de 1981, se declara zona catastrada el cantón\n03 La Unión, distritos 01 Tres Ríos, 02 San Diego, 03 San Juan, 04 San Rafael,\n05 Concepción, 06 Dulce Nombre, 07 San Ramón, 08 Río Azul de la provincia de\nCartago.\n\n Ficha articulo\n\nArtículo 2º-La descripción oficial de un asiento inmobiliario, está dada\npor los datos gráficos y alfanuméricos del predio correspondiente en el Mapa\nCatastral oficializado, los cuales constan en las bases de datos del Registro\nInmobiliario. En una zona no catastrada, se utilizará el plano catastrado\nrespectivo.\n\n Ficha articulo\n\nArtículo 3º-Los planos de agrimensura que se levanten de los inmuebles\nque pertenecen a los distritos mencionados en este decreto, deberán cumplir,\nademás de todas las disposiciones legales y técnicas, establecidas en la Ley N°\n6545, su Reglamento y sus reformas, específicamente en el artículo 26 del\nReglamento a la Ley del Catastro Nacional, Decreto Ejecutivo N° 34331 de 29 de\nnoviembre del 2007, reformado por Decreto Ejecutivo N° 34763 de 16 de setiembre\ndel 2008, y con un rige a partir del 27 de setiembre del 2008, en cuanto a\nmétodos y exactitudes, así como con las siguientes indicaciones y requisitos:\n\n1.1.    Deberá consignarse:\n\n1.1.1.     El derrotero del plano\ncon las coordenadas de todos sus vértices en el Sistema de la Red Oficial de\nCoordenadas del Decreto Ejecutivo N° 33797-MJ-MOPT del 30 de marzo de 2007 (Red\nGeodésica Nacional de Referencia Horizontal CRO5 y Proyección Transversal de\nMercator para Costa Rica CRTM05).\n\n1.1.2.     El método de\nagrimensura utilizado para el levantamiento del mismo y para su enlace a la Red\nOficial de Coordenadas.\n\n1.1.3.     La exactitud relativa\nobtenida en el levantamiento del plano, especificando si se trata de zona que\ncuenta con mapeo a escala 1:1000 o 1:5000.\n\n1.1.4.     La exactitud absoluta\nde los valores nominales de las coordenadas horizontales de los vértices del\nplano, serán indicadas con la cantidad de decimales acorde con sus exactitudes.\n\n1.1.5.     Para la determinación\nde la exactitud relativa de los levantamientos de inmuebles con áreas menores a\nuna hectárea y que se encuentren dentro del área mapeada a escala 1:5000, se\nutilizará la misma exactitud que en las áreas mapeadas a la escala 1:1000.\n\n1.1.6.     Para el caso anterior\n1.1.5, la exactitud absoluta a aplicar será la misma que corresponde a las\náreas mapeadas a la escala 1:5000.\n\n1.1.7.     En el caso de\nlevantamientos de inmuebles, que se encuentren dentro de las áreas de\ntransición mapeadas entre las escalas 1:1000 y 1:5000, el agrimensor deberá\najustarse a los lineamientos de exactitud, establecidos para el área en el que\nse encuentre la mayor superficie de dicho levantamiento.\n\n1.2.    La Subdirección Catastral\ndel Registro Inmobiliario del Registro Nacional, usará para la verificación de\nla geometría de los planos producto del ejercicio liberal de la agrimensura, lo\nque corresponda aplicar del Manual de procesos requeridos para lograr la\ncompatibilización de la información catastral y registral, sus anexos, así como\nsus futuras modificaciones.\n\n Ficha articulo\n\nArtículo 4º-La normativa de aplicación de exactitudes absolutas y\nrelativas para los levantamientos de agrimensura, anteriormente citada, deberá\nser utilizada también, en todas las zonas del país donde el Registro\nInmobiliario del Registro Nacional cuente con ortofoto a escala 1:1000 o\n1:5000, aún y cuando se encuentren fuera de la zona declarada catastrada.\n\n Ficha articulo\n\nArtículo 5º-El Registro Inmobiliario del Registro Nacional determinará\nde acuerdo a los medios tecnológicos a su disposición, cual es la forma en que\nse brindarán los datos requeridos para realizar los enlaces de los\nlevantamientos de aplicación catastral a la Red Nacional de Coordenadas.\n\n Ficha articulo\n\nArtículo 6º-El Registro Inmobiliario del Registro Nacional establecerá\nlos medios técnicos y tecnológicos para la presentación de planos de\nagrimensura en zonas catastradas y donde existan ortofotos, conforme a lo\ndispuesto en el artículo 28 del Reglamento a la Ley de Catastro Nacional,\nDecreto Ejecutivo N° 34331-J de 29 de noviembre del 2007, reformado por Decreto\nEjecutivo N° 34763 de 16 de setiembre del 2008, y con un rige a partir de 26 de\nsetiembre del 2008. Likewise,\narticles 13, 14, 15, 20, 21 of the National Cadastre Law N° 6545 of March\n25, 1981, articles 7 and 26 of the Regulation to the National Cadastre Law, Executive\nDecree N° 34331 of November 29, 2007 (amended by Executive Decree\nN° 34763 of September 16, 2008), Law N° 8154 of November 27, 2001,\n\"Loan Agreement N° 1284/OC-CR, Cadastre and Registry Regularization Program\",\nExecutive Decree N° 30106-J, of December 6, 2001, \"Declares\na Cadastral Zone the Entirety of the Cantons of the National Territory\" and Executive\nDecree N° 35509-J of September 30, 2009, \"Organization Regulation\nof the Real Property Registry\".\n\nConsidering:\n\n1º—That through Law N° 8710, published in La Gaceta N° 48 of March\n10, 2009, article 2 of Law N° 5695, Law of Creation of the\nNational Registry, and its amendments, is reformed, indicating that the National Cadastre becomes\npart of the Real Property Registry.\n\n2º—That Executive Decree N° 35509-J of September 30, 2009,\nOrganization Regulation of the Real Property Registry published in the Official\nGazette La Gaceta N° 198 of October 13, 2009, establishes that the Real Property\nRegistry is composed of the Subdirectorate of Cadastre and the Registry\nSubdirectorate.\n\n3º—That the Real Property Registry of the National Registry, based on\nthe National Cadastre Law N° 6545 of March 25, 1981, in its article 13\nhas as its exclusive power, the execution and maintenance of the Cadastre,\na function that may be partially delegated to other state institutions.\n\n4º—That the Legislative Assembly, on November 27, 2001, approved\nLaw N° 8154, \"Loan Agreement N° 1284/OC-CR, Cadastre and Registry Regularization\nProgram\", signed between the Government of the Republic and the Inter-American\nDevelopment Bank (IDB), for the execution of the Cadastre and National Registry\nRegularization Program, which by provision of the\nsame law, is under the charge of an Executing Unit attached to the Minister of\nFinance as a deconcentrated body.\n\n5º—That the Cadastre and National Registry Regularization Program\nhas as its task the cadastral survey with the objective of forming the\nnational cadastre and making the cadastral and registry information of\nproperties compatible, in application of the provisions of the Cadastre Law N° 6545 of March\n25, 1981.\n\n6º—That in accordance with the provisions of article 1 of Executive\nDecree N° 30106-J which \"Declares a Cadastral Zone the Entirety of the\nCantons of the National Territory\" published in La Gaceta N° 19 of January 28,\n2002, and article 7 of the Regulation to the National Cadastre Law,\nExecutive Decree N° 34331, which is in effect since September 27, 2008, the\nentirety of the cantons of the national territory were declared a cadastral\nzone.\n\n7º—That the Regulation to the National Cadastre Law, Executive Decree N°\n34331, which is in effect since September 27, 2008, establishes the\ntechnical requirements for the surveying of cadastral plans.\n\n8º—That having concluded the cadastral survey work\nof canton 03 La Unión, districts 01 Tres Ríos, 02 San Diego, 03 San Juan, 04 San\nRafael, 05 Concepción, 06 Dulce Nombre, 07 San Ramón, 08 Río Azul of the\nprovince of Cartago and in accordance with the provisions of article 19 of the\nNational Cadastre Law and 10 of its regulation, the property owners\nof said Districts were convened by\nthe Real Property Registry of the National Registry and the Executing Unit of the Cadastre and National Registry\nRegularization Program to a public display to learn the\nresults of the survey and express their conformity or non-conformity.\n\n9º—That the notice of the public display of the results of the\ncadastral survey of canton 03 La Unión, districts 01 Tres Ríos, 02 San\nDiego, 03 San Juan, 04 San Rafael, 05 Concepción, 06 Dulce Nombre, 07 San\nRamón, 08 Río Azul of the province of Cartago was published in the Official Gazette\nLa Gaceta N° 27 of February 9, 2010, page 8 and La Gaceta N° 44 of March 4,\n2010, page 19 and in the national circulation newspaper La Nación, on\ndates February 7 and 8, 2010.\n\n10.—That in a resolution at ten hours thirty minutes on October\nthirty-first, two thousand thirteen, the Real Property Registry of the National Registry\ndeclared the cadastral data resulting from the cadastral survey\ncarried out in canton 03 La Unión, districts 01 Tres Ríos, 02 San Diego, 03\nSan Juan, 04 San Rafael, 05 Concepción, 06 Dulce Nombre, 07 San Ramón, 08 Río\nAzul of the province of Cartago to be final.\n\n11.—That the terms of the deadlines established in\narticle 20 of the National Cadastre Law have now elapsed and the claims\nfiled by the property owners have been resolved by the\nDirectorate of the Real Property Registry of the National Registry. Therefore,\n\nThey decree:\n\nTHE DISTRICTS OF FIRST TRES RÍOS, SECOND SAN DIEGO, THIRD\n\nSAN JUAN, FOURTH SAN RAFAEL, FIFTH CONCEPCIÓN,\n\nSIXTH DULCE NOMBRE, SEVENTH SAN RAMÓN,\n\nEIGHTH RÍO AZUL OF CANTON 03 LA UNIÓN\n\nOF PROVINCE 03 CARTAGO ARE DECLARED A CADASTRAL ZONE\n\nArticle 1.—In accordance with article 20 of the National Cadastre\nLaw N° 6545 of March 25, 1981, canton\n03 La Unión, districts 01 Tres Ríos, 02 San Diego, 03 San Juan, 04 San Rafael,\n05 Concepción, 06 Dulce Nombre, 07 San Ramón, 08 Río Azul of the province of\nCartago are declared a cadastral zone.\n\n Article file\n\nArticle 2.—The official description of a real property entry is given\nby the graphic and alphanumeric data of the corresponding property in the officialized\nCadastral Map, which are recorded in the databases of the Real Property\nRegistry. In a non-cadastral zone, the respective cadastral plan\nwill be used.\n\n Article file\n\nArticle 3.—The cadastral plans that are surveyed for the properties\nbelonging to the districts mentioned in this decree must comply,\nin addition to all the legal and technical provisions established in Law N°\n6545, its Regulation, and its amendments, specifically article 26 of the\nRegulation to the National Cadastre Law, Executive Decree N° 34331 of November\n29, 2007, amended by Executive Decree N° 34763 of September 16,\n2008, and in effect as of September 27, 2008, regarding\nmethods and accuracies, as well as the following indications and requirements:\n\n1.1. The following must be recorded:\n\n1.1.1. The traverse of the plan\nwith the coordinates of all its vertices in the Official Coordinate Network System\nof Executive Decree N° 33797-MJ-MOPT of March 30, 2007 (National\nHorizontal Reference Geodetic Network CR05 and Transverse Mercator\nProjection for Costa Rica CRTM05).\n\n1.1.2. The surveying\nmethod used for the survey thereof and for its link to the Official\nCoordinate Network.\n\n1.1.3. The relative accuracy\nobtained in the survey of the plan, specifying whether it is an area that\nhas mapping at a scale of 1:1000 or 1:5000.\n\n1.1.4. The absolute accuracy\nof the nominal values of the horizontal coordinates of the vertices of the\nplan will be indicated with the number of decimals according to their accuracies.\n\n1.1.5. For the determination\nof the relative accuracy of surveys of properties with areas less than\none hectare and that are within the area mapped at a scale of 1:5000, the\nsame accuracy will be used as in the areas mapped at the scale of 1:1000.\n\n1.1.6. For the previous case\n1.1.5, the absolute accuracy to be applied will be the same as that corresponding to the\nareas mapped at the scale of 1:5000.\n\n1.1.7. In the case of\nsurveys of properties that are within the\ntransition areas mapped between the scales of 1:1000 and 1:5000, the surveyor must\nadhere to the accuracy guidelines established for the area in which\nthe largest surface area of said survey is located.\n\n1.2. The Cadastral Subdirectorate\nof the Real Property Registry of the National Registry will use, for the verification of\nthe geometry of the plans resulting from the liberal practice of surveying,\nthe applicable portions of the Manual of processes required to achieve the\nreconciliation of cadastral and registry information, its annexes, as well as\nits future modifications.\n\n Article file\n\nArticle 4.—The regulation for the application of absolute and relative\naccuracies for cadastral surveys, previously cited, must\nalso be used in all areas of the country where the Real Property\nRegistry of the National Registry has an orthophoto at a scale of 1:1000 or\n1:5000, even when they are outside the area declared a cadastral zone.\n\n Article file\n\nArticle 5.—The Real Property Registry of the National Registry will determine,\naccording to the technological means at its disposal, the manner in which\nthe data required to link the\nsurveys for cadastral application to the National Coordinate Network will be provided.\n\n Article file\n\nArticle 6.—The Real Property Registry of the National Registry will establish\nthe technical and technological means for the submission of cadastral\nplans in cadastral zones and where orthophotos exist, in accordance with\nthe provisions of article 28 of the Regulation to the National Cadastre Law,\nExecutive Decree N° 34331-J of November 29, 2007, amended by Executive\nDecree N° 34763 of September 16, 2008, and in effect as of September\n26, 2008.
