y 146 de la\nConstitución Política, los artículos 27 y 28 inciso 2 acápite b) de la Ley Nº\n6227 del 2 de mayo de 1978, Ley General de la Administración Pública y,\n\nConsiderando:\n\n1º-Que la\nConstitución Política de Costa Rica, establece en su artículo 50, el deber del\nEstado, para preservar un ambiente sano y ecológicamente equilibrado, siendo su\nobligación garantizar, difundir y salvaguardar ese derecho.\n\n2º-Que mediante el\nacuerdo de Junta Directiva del Instituto Costarricense de Acueductos y\nAlcantarillados (AYA) Nº 96-160 del 4 de junio de 1996, se creó el Programa\nBandera Azul Ecológica (PBAE), con la participación de otras entidades públicas\ny privadas como: Instituto Costarricense de Turismo (ICT), Ministerio de\nAmbiente, Energía y Telecomunicaciones (MINAET), Ministerio de Salud (MINSA),\nInstituto Costarricense de Acueductos y Alcantarillados (AYA), Cámara Nacional\nde Turismo (CANATUR), con el propósito de incentivar la participación\ncomunitaria en la protección de los recursos hídricos, el ambiente en general y\nla salud pública del país. Posteriormente, la iniciativa recibió el apoyo y se\nincorporaron otras instituciones a saber: Ministerio de Educación Pública\n(MEP), Asociación Red Costarricense de Reservas Privadas, Instituto\nCostarricense de Electricidad (ICE), Ministerio de Agricultura y Ganadería\n(MAG), la Caja Costarricense del Seguro Social (CCSS) y la Asociación\nEmpresarial para el Desarrollo (AED).\n\n3º-Que el Decreto\nEjecutivo N° 36481-MINAET-S publicado en el Diario Oficial La Gaceta Nº\n71 del 12 de abril del 2011, desarrolla 8 categorías de participación para el\nprograma Bandera Azul Ecológica.\n\n4º-Que resulta\nprocedente reformar los Anexos A, B y C del Decreto Ejecutivo 36481-MINAET-S,\ncon el propósito de modificar los parámetros, la conformación mínima del\ncomité, la nota mínima y la gradación de las estrellas en el galardón para la\nCategoría de Centros Educativos del nivel preescolar, primaria y secundaria,\ncon el propósito de contextualizar los procedimientos a las características del\nsistema educativo. Por tanto,\n\nDECRETAN:\n\nREFORMESE EL ARTÍCULO\n13, ADEMÁS DE LOS\n\nANEXOS A, B Y C DEL DECRETO EJECUTIVO\n\nNº 36481-MINAET-S DEL 17 DE MARZO\n\nDEL 2011\n\nArtículo 1º-Refórmese\nel Artículo 13 del Decreto Ejecutivo N° 36481-MINAET-S, publicado en el Diario\nOficial La Gaceta Nº 71 del 12 de abril del 2011, para que se lea de la\nsiguiente forma:\n\nArtículo 13.-Manuales\nde procedimientos de cada categoría: Cada categoría cuenta con su\nrespectivo manual de procedimientos, en el cual se detallan aspectos\nespecíficos para cada una de ellas. That by means of\nBoard of Directors Agreement of the Costa Rican Institute of Aqueducts and\nSewers (AYA) No. 96-160 of June 4, 1996, the Ecological Blue Flag Program (PBAE) was created, with the participation of other public\nand private entities such as: Costa Rican Tourism Institute (ICT), Ministry of\nEnvironment, Energy, and Telecommunications (MINAET), Ministry of Health (MINSA),\nCosta Rican Institute of Aqueducts and Sewers (AYA), National Chamber\nof Tourism (CANATUR), with the purpose of encouraging community\nparticipation in the protection of water resources, the environment in general, and\nthe country's public health. Subsequently, the initiative received support and\nother institutions joined, namely: Ministry of Public Education\n(MEP), Costa Rican Network of Private Reserves Association, Costa Rican\nInstitute of Electricity (ICE), Ministry of Agriculture and Livestock\n(MAG), the Costa Rican Social Security Fund (CCSS), and the Business\nAssociation for Development (AED).\n\n3.
