catorce.\n\nConsiderando:\n\n1º-Que Costa Rica al igual que los países que forman parte del Sistema de\nIntegración Centroamericana, ha venido promoviendo y armonizando esfuerzos a lo\ninterno de sus legislaciones y regulaciones a fin de prevenir, desalentar y\neliminar la Pesca Ilegal, No Declarada y No Reglamentada (INDNR), los cuales\nhan sido coherentes con el Código de Conducta para la Pesca Responsable de la\nOrganización de las Naciones Unidas para la Alimentación y la Agricultura\n(FAO).\n\n2º-Que\nde igual manera, en el ámbito regional la puesta en marcha de la Política de\nIntegración de Pesca y Acuicultura en el Istmo Centroamericano y el Código de\nÉtica para la Pesca y Acuicultura Responsable en los Estados del Istmo\nCentroamericano ha permitido sumar esfuerzos que le permiten a los Estados\nMiembros del Sistema de Integración Centroamericana: Belize,\nCosta Rica, El Salvador, Guatemala, Honduras, Nicaragua, Panamá y República\nDominicana, concretar la adopción del Reglamento Regional Para Prevenir\nDesalentar y Eliminar la Pesca Ilegal No Declarada y No Reglamentada en los\nPaíses Miembros del SICA, a través del Reglamento Regional OSP-08-2014,\nratificado por las máximas autoridades de Pesca, reunidas en el Comité de\nDirección de SICA/OSPESCA.\n\n3º-Que\nen virtud de ello debe nuestro país, establecer las medidas y acciones que\nresulten necesarias a efecto de cumplir con dicha disposición, razón por la\ncual, la Junta Directiva del INCOPESCA,\n\nACUERDA:\n\n1º-Adoptar el Reglamento Regional para Prevenir\nDesalentar y Eliminar la Pesca Ilegal No Declarada y No Reglamentada N° OSP-08-\n2014, mismo que fue ratificado por las máximas autoridades de Pesca, reunidas\nen el Comité de Dirección de SICA/OSPESCA en Punta Cana, República Dominicana,\nel cual rige a partir del 01 de julio de 2014, y se encuentra depositado en la\nSecretaría General de SICA.\n\n2º-Rige\na partir de su publicación.\n\n3º-Acuerdo\nfirme.\n\n(Nota de Sinalevi: El Reglamento Regional para Prevenir Desalentar y\nEliminar la Pesca Ilegal No Declarada y No Reglamentada N° OSP-08- 2014 fue\nproporcionado por el Instituto Costarricense de Pesca y Acuicultura y se\ntranscribe a continuación:)\n\nPRESENTACIÓN\n\n  \n     En el marco de la Política de Integración de la Pesca\ny la Acuicultura del Istmo Centroamericano las autoridades nacionales de la\npesca de los países del Sistema de la Integración Centroamericana que conforman\nOSPESCA, han impulsado en forma coordinada diversas acciones para abordar la\npesca ilegal, no declarada y no reglamentada.\n\n  \n     En primer lugar, con el apoyo de la Organización de\nlas Naciones Unidas para la Agricultura y la Alimentación (FAO), elaboraron sus\nrespectivos planes nacionales y luego un Plan de Acción de alcance regional\npara prevenir, desalentar y eliminar la pesca ilegal, no declarada y no\nreglamentada. Estas herramientas han sido abordadas con un enfoque\nparticipativo, interinstitucional e intersectorial.\n\n  \n     La tarea no es fácil pues requiere de voluntades y\nrecursos los cuales pueden ser más posibles al trabajar en el marco regional e\nintegrado. Por ello en este proceso hay liderazgos importantes como el\ndesarrollado por el Grupo de Armonización de Normativas Pesqueras (GANP)\nintegrado por asesores jurídicos pesqueros y de integración de los diferentes\npaíses centroamericanos, quienes aseguran la coherencia jurídica de las\nherramientas que se elaboran sobre todo al considerar el modelo de gobernanza\nde acuerdos vinculantes que impulsa OSPESCA.\n\n  \n     Así es como se elabora, se consulta, se aprueba por\nlas máximas autoridades de la Pesca reunidas\nen el Comité de Dirección de SICA/OSPESCA, el presente Reglamento Regional\nOSP-08-2014, que luego es Depositado en la Secretaría General del Sistema de la\nIntegración Centroamericana quien lo certifica, y asi\nentre en vigencia el 1º de julio del 2014. Estos acuerdos son un una muestra\ndel resultado positivo de un trabajo regional e integrado de los 8 países del\nSICA/OSPESCA que han decidido impulsar esquemas para asegurar que se desarrolle\nen sus mares una pesca responsable. La invitación es que fortalezcamos el\ntrabajo conjunto, aunando esfuerzos para la aplicación del contenido del\npresente Reglamento.\n\n  \n     Expresamos un agradecimiento a la República de China\n(Taiwán), a la Administración Nacional del Océano y la Atmósfera de los Estados\nUnidos (NOAA), a la FAO y a todos los que en una u otra forma han participado\npor toda la valiosa asistencia dada a OSPESCA.\n\nCONSIDERANDO\n\n  \n     I. Que los Países Miembros del Sistema de la\nIntegración Centroamericana (SICA), deben impulsar estrategias dirigidas a\nprevenir y sancionar los delitos y las faltas administrativas cometidas en\ncontra del ordenamiento jurídico pesquero y acuícola, en armonía con su modelo\nde seguridad democrática.\n\n  \n     II. Que la Organización del Sector Pesquero y Acuícola\ndel Istmo Centroamericano (OSPESCA), ha puesto en marcha la Política de\nIntegración de Pesca y Acuicultura en el Istmo Centroamericano y el Código de\nÉtica para la Pesca y Acuicultura Responsable en los Estados del Istmo\nCentroamericano, en coherencia con el Código de Conducta para la Pesca\nResponsable de la Organización de las Naciones Unidas para la Alimentación y la\nAgricultura (FAO) y el Plan de Acción Internacional para Prevenir, Desalentar y\nEliminar la Pesca Ilegal, No Declarada y No Reglamentada (INDNR).\n\n  \n     III. Que tanto la Política como ambos Códigos, mencionados\nen el considerando anterior, promueven la armonización de esfuerzos orientados\na prevenir, desalentar y eliminar la Pesca Ilegal, No Declarada y No\nReglamentada (Pesca INDNR).\n\n  \n     IV. Que para fortalecer los esfuerzos de\naprovechamiento sostenible de los recursos pesqueros, así como prevenir,\ndesalentar y eliminar la pesca INDNR, se hace necesario establecer normativas y\nplanes de acción regionales, basados en el modelo de gobernanza de OSPESCA en\nel marco del SICA.\n\nPOR TANTO\n\n  \n     Las Autoridades competentes de las Actividades\nPesqueras y Acuícolas de Belize, Costa Rica, El\nSalvador, Guatemala, Honduras, Nicaragua, Panamá y República Dominicana\naprueban el siguiente:\n\nREGLAMENTO REGIONAL PARA PREVENIR, DESALENTAR Y ELIMINAR\n\nLA PESCA ILEGAL, NO DECLARADA Y NO REGLAMENTADA EN LOS\n\nPAÍSES MIEMBROS DEL SICA\n\n  \n     Artículo 1. Objeto\n\n  \n     El presente Reglamento tiene como objeto fomentar la\nadopción de disposiciones armónicas orientadas a prevenir, desalentar y\neliminar la Pesca INDNR.\n\nArtículo\n2. Ámbito de Aplicación\n\nEl\npresente Reglamento es de cumplimiento obligatorio en la jurisdicción de cada\nuno de los Estados Miembros del SICA.\n\nArtículo 3. Definiciones\n\n  \n         Para los efectos del presente\nReglamento, se entiende por:\n\nA.\nPesca Ilegal, las actividades pesqueras:\n\na.\nrealizadas por embarcaciones nacionales o extranjeras en aguas bajo la\njurisdicción de un Estado, sin el permiso de éste, o contraviniendo sus leyes\ny reglamentos;\n\nb.\nrealizadas por embarcaciones que enarbolan el pabellón de Estados que son\npartes de una organización regional de ordenación pesquera competente, pero\nfaenan contraviniendo las medidas de conservación y ordenación adoptadas por\ndicha organización y en virtud de las cuales están obligados los Estados, o\nlas disposiciones pertinentes del derecho internacional aplicable; o\n\nc.\nen violación de leyes nacionales u obligaciones internacionales, inclusive las\ncontraídas por los Estados cooperantes con respecto a una organización\nregional de ordenación pesquera competente.\n\nB.\nPesca No Declarada, las actividades pesqueras:\n\na.\nque no han sido declaradas, o han sido declaradas de modo inexacto, a la\nautoridad nacional competente, en contravención de leyes y reglamentos\nnacionales; o\n\nb.\nllevadas a cabo en la zona de competencia de una organización regional de\nordenación pesquera competente, que no han sido declaradas o han sido\ndeclaradas de modo inexacto, en contravención de los procedimientos de\ndeclaración de dicha organización.\n\nC.\nPesca No Reglamentada, las actividades pesqueras:\n\na.\nen la zona de aplicación de una organización regional de ordenación pesquera\ncompetente que son realizadas por embarcaciones sin nacionalidad, o por\nembarcaciones que enarbolan el pabellón de un Estado que no es parte de esa\norganización, o por una entidad pesquera, de una manera que no está en\nconsonancia con las medidas de conservación y ordenación de dicha organización,\no que las contraviene; o\n\nb.\nen zonas o en relación con poblaciones de peces respecto de las cuales no\nexisten medidas aplicables de conservación u ordenación y en las que dichas\nactividades pesqueras se llevan a cabo de una manera que no está en consonancia\ncon las responsabilidades relativas a la conservación de los recursos marinos\nvivos que incumben al Estado en virtud del derecho internacional.\n\nD.\nMonitoreo:\n\nSeguimiento\nde la actividad, a través de la información y documentos que se van\nrecopilando y que permiten configurar la presencia o no de una acción de pesca\nINDNR. El monitoreo incluye información de registros, de desembarques, de\nventas, de exportaciones, de operaciones pesqueras, lances, zarpes, recaladas, número\nde entradas, salidas y cambios de puertos, entre otros.\n\nE.\nControl:\n\nEs\nla utilización de la información monitoreada, con el propósito de vigilar el\ncumplimiento del ordenamiento jurídico pesquero y ejercer las acciones\ncorrespondientes.\n\nF.\nVigilancia:\n\nEs\nla observación y supervisión de las actividades pesqueras, utilizando métodos\ntécnicos de detección e identificación, para asegurar que la legislación,\nlos términos y condiciones de acceso, así como las medidas de gestión están\nsiendo cumplidos.\n\n     Artículo 4. Principios\n\n  \n     Los esfuerzos para fomentar la adopción de\ndisposiciones orientadas para prevenir, desalentar y eliminar la Pesca Ilegal,\nNo Declarada y No Reglamentada entre los Estados miembros del SICA, tomarán en\ncuenta los Principios de: Cooperación y Coordinación, Participación,\nGradualidad, Integración, Conservación, Transparencia, No discriminación,\nPreventivo, Precautorio.\n\n  \n     A. Cooperación y Coordinación:\n\n  \n     Las actividades que se desarrollen contemplarán la\ncolaboración y comunicación entre los Estados miembros del SICA y con otros\nEstados y Organizaciones internacionales pertinentes.\n\n  \n     B. Participación:\n\n  \n     Se debe involucrar a las partes interesadas en la lucha\ncontra la pesca INDNR, incluyendo la industria, las comunidades pesqueras, el\nsector público y privado, los centros de investigación, las universidades, las\nfuerzas navales e instituciones de seguridad marítima, así como organizaciones\nno gubernamentales.\n\n  \n     C. Gradualidad:\n\n  \n     Las medidas establecidas deberán tener una aplicación\ngradual, coordinada y consecutiva, dando énfasis a los enfoques regionales de\ntemas comunes.\n\n  \n     D. Integración:\n\n  \n     Las medidas que se adopten deben tener presentes los\nfactores que afectan a todos los tipos de pesca, industrial y artesanal. En el\nmarco de ese enfoque, la Región deberá adoptar medidas tomando como base la\nresponsabilidad del Estado del pabellón y recurriendo a todas las normas\ndisponibles sobre jurisdicción conforme al derecho internacional.\n\n  \n     E. Conservación:\n\n  \n     Las medidas para prevenir, desalentar, y eliminar la\npesca INDNR serán compatibles con la conservación y uso sostenible a largo\nplazo de las poblaciones de peces y con la protección del medio ambiente.\n\n  \n     F. Transparencia:\n\n  \n     Las actividades serán aplicadas de forma transparente,\ncon arreglo a lo dispuesto en el Código de Ética para la Pesca y Acuicultura\nResponsable en los Estados del Istmo Centroamericano y el Código de Conducta\npara la Pesca Responsable de la FAO.\n\n  \n     G. No discriminación:\n\n  \n     Las acciones que se emprendan deben ser aplicado sin\ndiscriminación formal o efectiva, de ningún y con ningún Estado ni sus\nembarcaciones pesqueras.\n\n  \n     H. Preventivo:\n\n  \n     Deber de adoptar, conforme a las capacidades y\nposibilidades, las medidas necesarias y razonables para prevenir la pesca\nilegal, no declarada y no reglamentada y, en lo posible, anticiparse a\nsituaciones de riesgo.\n\n  \n     I. Precaución:\n\n  \n     Es la opción de tomar decisiones conjuntas temporales\ndirigidas a combatir la pesca INDNR, conforme a las capacidades y posibilidades,\nante signos que demuestren su conveniencia, aunque no se disponga de evidencias\ncientíficas o técnicas.\n\nArtículo\n5. Acciones\n\nLos\nEstados Parte del SICA procurarán:\n\na)\narmonizar las disposiciones que aseguren la pesca legal, declarada y\nreglamentada en los países del SICA;\n\nb)\nvelar por la actualización y adaptación permanente del presente Reglamento y\nde otros Reglamentos de SICA/OSPESCA que tengan relación con los objetivos\nperseguidos por este instrumento;\n\nc)\ncoordinar acciones con entidades nacionales y regionales que tengan competencia\ncon el monitoreo, el control y la vigilancia pesquera; y\n\nd)\ncoordinar con Organizaciones Regionales de Ordenación Pesquera el intercambio\nde información encaminado a erradicar la pesca INDNR.\n\nArtículo\n6. Monitoreo,\ncontrol y vigilancia\n\nSe\ncrea una Red Regional, integrada por las autoridades de pesca y acuicultura de\ncada país miembro, con el apoyo de la Unidad Regional SICA/OSPESCA, la cual\ntendrá como objetivo la cooperación, coordinación, obtención e intercambio\nde información entre instituciones nacionales y organizaciones regionales e\ninternacionales para prevenir, desalentar y eliminar la Pesca INDNR.\n\nLas\nautoridades de Pesca y Acuicultura de cada país deberán coordinar con las\nautoridades competentes de sus respectivos países lo pertinente a la\nimplementación de la Red Regional para realizar las labores de monitoreo,\ncontrol y vigilancia.\n\nArtículo\n7. Inspección\n\nLas\nautoridades pesqueras de los Estados miembros del SICA/OSPESCA fortalecerán el\nnivel de formación de los oficiales e inspectores de pesca, por medio de\nacciones de capacitación y actualización continua de conocimientos.\n\nArtículo\n8. Cooperación\nregional e internacional\n\nLos\nEstados Parte del SICA cooperarán entre sí y con otros Estados y\norganizaciones internacionales en la obtención, intercambio y transmisión de\ninformación.\n\nArtículo 9. These tools have been addressed with a participatory, inter-institutional and intersectoral approach.\n\nThe task is not easy because it requires wills and resources, which can be more feasible when working within the regional and integrated framework. Therefore, in this process there are important leadership roles, such as that developed by the Fisheries Regulations Harmonization Group (GANP), composed of legal advisors on fisheries and integration from the different Central American countries, who ensure the legal coherence of the tools being developed, especially when considering the governance model of binding agreements promoted by OSPESCA.\n\nThis is how this Regional Regulation OSP-08-2014 is developed, consulted, and approved by the highest Fisheries authorities meeting in the Steering Committee of SICA/OSPESCA, which is then Deposited with the General Secretariat of the Central American Integration System, which certifies it, and thus it enters into force on July 1, 2014. These agreements are a symbol of the positive result of a regional and integrated work of the 8 SICA/OSPESCA countries that have decided to promote schemes to ensure that responsible fishing is carried out in their seas. The invitation is for us to strengthen joint work, joining efforts for the application of the content of this Regulation.\n\nWe express our gratitude to the Republic of China (Taiwan), the United States National Oceanic and Atmospheric Administration (NOAA), the FAO, and to all those who have participated in one way or another for all the valuable assistance given to OSPESCA.\n\nWHEREAS\n\nI. That the Member Countries of the Central American Integration System (SICA) must promote strategies aimed at preventing and sanctioning crimes and administrative offenses committed against the fisheries and aquaculture legal system, in harmony with their democratic security model.\n\nII. That the Organization of the Fisheries and Aquaculture Sector of the Central American Isthmus (OSPESCA) has implemented the Fisheries and Aquaculture Integration Policy in the Central American Isthmus and the Code of Ethics for Responsible Fisheries and Aquaculture in the States of the Central American Isthmus, consistent with the Code of Conduct for Responsible Fisheries of the Food and Agriculture Organization of the United Nations (FAO) and the International Plan of Action to Prevent, Deter and Eliminate Illegal, Unreported and Unregulated (IUU) Fishing.\n\nIII. That both the Policy and both Codes, mentioned in the preceding whereas clause, promote the harmonization of efforts aimed at preventing, deterring and eliminating Illegal, Unreported and Unregulated Fishing (IUU Fishing).\n\nIV. That to strengthen efforts for the sustainable use of fishery resources, as well as to prevent, deter and eliminate IUU fishing, it is necessary to establish regional regulations and action plans, based on the OSPESCA governance model within the SICA framework.\n\nTHEREFORE\n\nThe competent Authorities for Fisheries and Aquaculture Activities of Belize, Costa Rica, El Salvador, Guatemala, Honduras, Nicaragua, Panama and the Dominican Republic approve the following:\n\nREGIONAL REGULATION TO PREVENT, DETER AND ELIMINATE\n\nILLEGAL, UNREPORTED AND UNREGULATED FISHING IN THE\n\nSICA MEMBER COUNTRIES\n\nArticle 1. Purpose\n\nThis Regulation aims to promote the adoption of harmonized provisions aimed at preventing, deterring and eliminating IUU Fishing.\n\nArticle 2. Scope of Application\n\nThis Regulation is of mandatory compliance in the jurisdiction of each of the SICA Member States.\n\nArticle 3. Definitions\n\nFor the purposes of this Regulation, the following definitions apply:\n\nA. Illegal Fishing, the fishing activities:\n\na. conducted by national or foreign vessels in waters under the jurisdiction of a State, without the permission of that State, or in contravention of its laws and regulations;\n\nb. conducted by vessels flying the flag of States that are parties to a competent regional fisheries management organization but operate in contravention of the conservation and management measures adopted by that organization and by which the States are bound, or the relevant provisions of the applicable international law; or\n\nc. in violation of national laws or international obligations, including those undertaken by cooperating States with respect to a competent regional fisheries management organization.\n\nB. Unreported Fishing, the fishing activities:\n\na. that have not been reported, or have been misreported, to the competent national authority, in contravention of national laws and regulations; or\n\nb. undertaken in the area of competence of a competent regional fisheries management organization, which have not been reported or have been misreported, in contravention of the reporting procedures of that organization.\n\nC. Unregulated Fishing, the fishing activities:\n\na. in the area of application of a competent regional fisheries management organization that are conducted by vessels without nationality, or by vessels flying the flag of a State not party to that organization, or by a fishing entity, in a manner that is not consistent with or contravenes the conservation and management measures of that organization; or\n\nb. in areas or in relation to fish stocks for which there are no applicable conservation or management measures and where such fishing activities are conducted in a manner inconsistent with State responsibilities for the conservation of living marine resources under international law.\n\nD. Monitoring:\n\nFollowing up on the activity, through the information and documents that are being compiled and that allow determining the presence or absence of an IUU fishing action. Monitoring includes information from records, landings, sales, exports, fishing operations, hauls (lances), departures, arrivals (recaladas), the number of port entries, exits and changes, among others.\n\nE. Control:\n\nIt is the use of monitored information for the purpose of overseeing compliance with the fisheries legal system and exercising the corresponding actions.\n\nF. Surveillance:\n\nIt is the observation and supervision of fishing activities, using technical methods of detection and identification, to ensure that the legislation, the terms and conditions of access, as well as the management measures are being complied with.\n\nArticle 4. Principles\n\nEfforts to promote the adoption of provisions aimed at preventing, deterring and eliminating Illegal, Unreported and Unregulated Fishing among the SICA Member States shall take into account the Principles of: Cooperation and Coordination, Participation, Gradualism, Integration, Conservation, Transparency, Non-discrimination, Preventive, Precautionary.\n\nA. Cooperation and Coordination:\n\nThe activities developed shall contemplate collaboration and communication among the SICA Member States and with other relevant States and international Organizations.\n\nB. Participation:\n\nStakeholders must be involved in the fight against IUU fishing, including the industry, fishing communities, the public and private sector, research centers, universities, naval forces and maritime security institutions, as well as non-governmental organizations.\n\nC. Gradualism:\n\nThe established measures shall have a gradual, coordinated and consecutive application, emphasizing regional approaches to common issues.\n\nD. Integration:\n\nThe measures adopted must keep in mind the factors affecting all types of fishing, industrial and artisanal. Within the framework of this approach, the Region shall adopt measures based on the responsibility of the flag State and resorting to all available rules on jurisdiction in accordance with international law.\n\nE. Conservation:\n\nThe measures to prevent, deter, and eliminate IUU fishing shall be compatible with the conservation and long-term sustainable use of fish stocks and with the protection of the environment.\n\nF. Transparency:\n\nThe activities shall be applied in a transparent manner, in accordance with the provisions of the Code of Ethics for Responsible Fisheries and Aquaculture in the States of the Central American Isthmus and the FAO Code of Conduct for Responsible Fisheries.\n\nG. Non-discrimination:\n\nThe actions undertaken must be applied without formal or effective discrimination, of any kind and with no State or its fishing vessels.\n\nH. Preventive:\n\nThe duty to adopt, according to capabilities and possibilities, the necessary and reasonable measures to prevent illegal, unreported and unregulated fishing and, as far as possible, to anticipate risk situations.\n\nI. Precaution:\n\nIt is the option of making joint temporary decisions aimed at combating IUU fishing, according to capabilities and possibilities, in the face of signs that demonstrate its advisability, even if scientific or technical evidence is not available.\n\nArticle 5. Actions\n\nThe SICA States Parties shall seek to:\n\na) harmonize the provisions that ensure legal, reported and regulated fishing in the SICA countries;\n\nb) ensure the permanent updating and adaptation of this Regulation and other SICA/OSPESCA Regulations that are related to the objectives pursued by this instrument;\n\nc) coordinate actions with national and regional entities that have competence in fisheries monitoring, control and surveillance; and\n\nd) coordinate with Regional Fisheries Management Organizations the exchange of information aimed at eradicating IUU fishing.\n\nArticle 6. Monitoring, control and surveillance\n\nA Regional Network is created, composed of the fisheries and aquaculture authorities of each member country, with the support of the SICA/OSPESCA Regional Unit, whose objective shall be cooperation, coordination, obtaining and exchanging information among national institutions and regional and international organizations to prevent, deter and eliminate IUU Fishing.\n\nThe Fisheries and Aquaculture authorities of each country shall coordinate with the competent authorities of their respective countries regarding the implementation of the Regional Network to carry out monitoring, control and surveillance tasks.\n\nArticle 7. Inspection\n\nThe fisheries authorities of the SICA/OSPESCA Member States shall strengthen the training level of fisheries officers and inspectors, through training actions and continuous updating of knowledge.\n\nArticle 8. Regional and international cooperation\n\nThe SICA States Parties shall cooperate among themselves and with other States and international organizations in obtaining, exchanging and transmitting information.\n\nArticle 9. Port measures\n\nThe fisheries authorities of the SICA Member States shall coordinate with their respective maritime and port authorities to create procedures that prevent the entry of vessels from within the region and from outside the region that have engaged in IUU fishing activities or participated in activities related to supporting it.\n\nArticle 10. Commercialization\n\nThe SICA Member States, within the framework of their respective legislation and competent entities, shall adopt the necessary measures to prevent fishery products caught by national or foreign-flagged vessels, whose IUU fishing practice has been determined, from being commercialized or imported into their territories.\n\nArticle 11. Fisheries research\n\nThe SICA Member States, in coordination with the SICA/OSPESCA Unit, shall promote scientific research aimed at providing methods for identifying fishery species, from the processed or unprocessed product, for the purpose of identifying the population of origin. The information obtained shall be used to create a network of databases on genetic markers, with the aim of preventing, deterring and eliminating IUU Fishing.\n\nArticle 12. Information security\n\nThe SICA member countries shall implement security measures to protect information considered sensitive, reserving its use exclusively for that agreed upon by the States.\n\nArticle 13. Regional Action Plan\n\nAs part of the harmonization and coordination efforts, the SICA Member States shall develop a Regional Action Plan to Prevent, Deter and Eliminate IUU Fishing, with deadlines and terms for its implementation.\n\nArticle 14. Regional coordination\n\nFor the execution of this Regulation, a regional coordination shall be established, composed of a representative designated by the fisheries authority of each country, who shall be in charge of monitoring the application of this Regulation and the respective Regional Action Plan provided for in the preceding article.\n\nArticle 15. Harmonization\n\nThis regulation does not contravene the protection, conservation and sustainable use measures that have been or are issued by the SICA Member States.\n\nArticle 16. Interpretation\n\nThe provisions of this regulation may not be interpreted to the detriment of the sovereignty and jurisdiction of the SICA Member States; likewise, its application shall not undermine the obligations contracted under International Law.\n\nArticle 17. Validity and deposit\n\nThis Regulation shall enter into force on July 1, of the year two thousand fourteen and shall be deposited by the Pro Tempore Presidency of OSPESCA with the SICA General Secretariat and must be published in each of the Member States.\n\nGiven in the city of Punta Cana, Dominican Republic, on the twenty-fifth day of the month of April of the year two thousand fourteen." }
