el artículo 6 inciso 2) de la Ley del\nServicio Parques Nacionales, Nº 6084 del 24 de agosto de 1977; los artículos 9,\n11 y 42 de la Ley de Biodiversidad, Nº 7788 del 23 de abril de 1998; los\nartículos 59 y 70 del Reglamento a la Ley de Biodiversidad, Decreto Ejecutivo\nNº 34433-MINAE del 11 de marzo del 2008 y los artículos 6 inciso d), 16 y 27\ninciso 1) de la Ley General de la Administración Pública Nº 6227 del 2 de mayo\nde 1978.\n\nConsiderando:\n\n1º-Que el artículo 50 de la Constitución Política consagra a favor de\ntodos los habitantes de la Nación el derecho a un ambiente sano y\necológicamente equilibrado, siendo que este derecho incluye la conservación,\nuso y manejo sostenible de la biodiversidad y la equitativa distribución de\nbeneficios derivados de esta, asegurando la mayor participación de la\ncomunidad.\n\n2º-Que de conformidad con el artículo 22 de la Ley de Biodiversidad Nº\n7788, el Sistema Nacional de Áreas de Conservación (SINAC) es un órgano de\ndesconcentración máxima del Ministerio de Ambiente y Energía, el cual tiene\npersonería jurídica instrumental y es un sistema de gestión y coordinación\ninstitucional desconcentrado y participativo, que integra las competencias en\nmateria forestal, vida silvestre, áreas protegidas, con el fin de dictar\npolíticas, planificar y ejecutar procesos dirigidos a lograr la sostenibilidad\nen el manejo de los recursos naturales de Costa Rica.\n\n3º-Que la Ley de Biodiversidad tiene como objeto la conservación de la\nbiodiversidad, el uso sostenible de los recursos y la distribución justa de los\nbeneficios y costos derivados de la misma, autorizando para ello al Ministerio\nde Ambiente y Energía por medio del Sistema Nacional de Áreas de Conservación,\npara el cobro de tarifas para el ingreso y la prestación de servicios en todas\nlas áreas silvestres protegidas estatales.\n\n4º-Que el ingreso a las áreas silvestres protegidas es una actividad que\nva más allá de lo recreativo, de diversión, alegría o deleite.
