abril de 2016,\nse declaró sin lugar la acción, siempre y cuando se interprete que INCOPESCA\ndebe regular las condiciones técnicas para el uso de carnada viva, al momento\nde otorgar aquellas licencias de pesca que correspondan según la ley o su\nreglamento.)\n\nAJDIP/280-2014.-Puntarenas, a los ocho días del mes de agosto\ndel dos mil catorce.\n\nConsiderando:\n\nI.-Que corresponde al\nInstituto Costarricense de Pesca y Acuicultura, INCOPESCA, coordinar el sector\npesquero, así como promover y ordenar el desarrollo de la Pesca y la\nAcuicultura.\n\nII.-Que es de\nespecial interés el promover el desarrollo de las actividades de la pesca\nturística y la pesca deportiva, lo mismo que los diferentes sectores de la\npesca comercial, por lo que se considera que con el correcto ordenamiento del\nuso de carnada viva para el aprovechamiento sostenible de la pesca, se puede\nlograr el equilibrio necesario entre todas estas actividades y disminuir los\nconflictos que se podrían generar por el espacio donde se desarrollan estas\nactividades pesqueras.\n\nIII.-Que según lo\ndeterminado por la Dirección General Técnica del INCOPESCA. Se requieren\nmedidas de ordenación, así como determinar aquellas especies que pueden ser\nutilizadas como carnada viva por parte de la embarcaciones que utilizan\npalangre, así como aquellas que realizan pesca turística y pesca deportiva, ya\nque se ha determinado que el uso de carnada viva en la pesca de palangre\nincrementa significativamente las capturas de pez vela, especie de especial\ninterés para la pesca turística y la pesca deportiva, convirtiéndolo en un arte\nde pesca dirigido a la captura de pez vela en aquella zonas donde haya\npresencia de esta especie.\n\nIV.-Que mediante los\nacuerdos de Junta Directiva de INCOPESCA JDIP/476-2008 de 18 de diciembre de\n2008, AJDIP/090-2009 de 12 de marzo de 2009 y AJDIP/081-2014 de 26 de marzo de\n2014, se han establecido regulaciones tendientes a lograr la implementación de\nmedidas de ordenamiento pesquero para el uso de carnada viva, por parte de la\nflota pesquera comercial y deportiva y que se hace necesario establecer una\nregulación única para ordenar el uso y aprovechamiento sostenible de carnada\nviva.\n\nV.-Que ante las\nobservaciones de los diferentes sectores de la actividad pesquera comercial y\nde la pesca deportiva y de las consultas hechas a los mismos; así como con el\ncriterio técnico de la Dirección General Técnica del INCOPESCA y de la\nexperiencia que ha generado la aplicación de los acuerdos indicados en el\nconsiderando 4 de esta disposición, se considera necesario establecer estas\nmedidas de ordenamiento para normar el uso de carnada viva por parte de la\nflota pesquera comercial y de la pesca deportiva.\n\nVI.-Que en\ncumplimiento de los que dispone el artículo 50 de la Constitución Política de\nCosta Rica, así como de la aplicación de los principios de desarrollo\nsostenible, precautorio, preventivo y de acceso democrático a los recursos\npesqueros y de conformidad con lo dispuesto en la Ley 7384 Ley de Creación del\nInstituto Costarricense de Pesca y Acuicultura, Ley 8436 Ley de Pesca y\nAcuicultura, considera la Junta Directiva del INCOPESCA de especial interés, el\nreglamentar el uso y aprovechamiento sostenible de carnada viva, por parte de\nla flota pesquera comercial y de la pesca deportiva. Por tanto,\n\nLA\nJUNTA DIRECTIVA DEL INSTITUTO COSTARRICENSE DE PESCA Y ACUICULTURA\n\nACUERDA\n\nMEDIDAS DE ORDENAMIENTO PARA EL USO DE\n\nCARNADA VIVA PARA LA FLOTA PESQUERA\n\nCOMERCIAL Y DE PESCA DEPORTIVA EN EL\nOCÉANO\n\nPACÍFICO COSTARRICENSE.\n\nArtículo 1º-Se\nprohíbe en el Océano Pacífico Costarricense, la pesca dirigida al pez vela,\nutilizando palangre de superficie adaptada para ese fin y con carnada viva como\narte de pesca, en las zonas expresamente establecidas en el presente acuerdo, a\nla flota de comercial excepto la de pesca turística y la pesca deportiva. Las\nfaenas de pesca de la flota pesquera nacional, utilizando palangre y carnada\nviva, en especial en cuanto a zonas y fechas, quedan sometidas a las\nregulaciones del presente acuerdo.\n\nArtículo 2º-El presente acuerdo establece\ndisposiciones y regulaciones técnicas de acatamiento obligatorio. Las\ninfracciones en contra de este acuerdo se sancionarán de conformidad con lo\nestablecido en la Ley de Pesca y Acuicultura.\n\nPara efectos de este acuerdo se considera:\n\nPesca comercial: Aquella actividad pesquera que se\nrealiza para obtener beneficios económicos producto de la venta en puerto de\nlos productos pesqueros capturados.\n\nPesca comercial de carnada viva: Es la actividad que\nse realiza con el propósito de capturar y comercializar especies permitidas de\nproductos hidrobiológicos para ser utilizados como carnada viva.\n\nPesca Deportiva: Aquella actividad pesquera que se\nrealiza sin fines de lucro y con propósito de deporte, distracción, placer,\nrecreo, turismo o pasatiempo, con el fin de capturar, con un aparejo de pesca\npersonal apropiado para el efecto, recursos acuáticos pesqueros en aguas\ncontinentales, jurisdiccionales o en la zona económica exclusiva, sin fines\ncomerciales.\n\nPesca Turística: Actividad pesquera comercial, que\nrealizan personas físicas nacionales o extranjeras, con el fin de capturar, con\nun aparejo de pesca personal apropiado para el efecto, recursos acuáticos\npesqueros en aguas continentales, jurisdiccionales o en la zona económica\nexclusiva, con fines comerciales y propósitos exclusivamente turísticos,\nllevados a cabo de forma permanente.\n\nCarnada Viva: Especies de tallas pequeñas que se\nutilizan en el palangre o floteo, en cañas o cuerdas de mano con el objeto de\npropiciar la captura de otras especies de interés comercial de mayor tamaño.\n\nArtículo 3º-Las embarcaciones que se dediquen a la\npesca comercial de carnada viva para su comercialización o venta, deberán\ncontar con la respectiva licencia de pesca comercial otorgada por el INCOPESCA.\n\nNo\nrequerirán de licencia de pesca para carnada viva las embarcaciones con\nlicencia comercial de pesca pequeña escala, pesca mediana escala, pesca\navanzada y pesca turística; así como las embarcaciones o personas físicas que\nse dediquen a la pesca deportiva y que utilicen carnada viva, para ser\nutilizada en sus propias faenas de pesca.\n\nArtículo 4. Se establece una\nzona de prohibición para la pesca y almacenamiento de carnada viva en viveros,\na la flota comercial excepto la pesca turística y la pesca pequeña escala; así\ncomo a la pesca deportiva, salvo en las Áreas Marinas de Pesca Responsable que\nasí lo autoricen; según la siguiente demarcación y características:\n\na. En el Golfo Dulce a partir de una línea\nimaginaria comprendida entre Cabo Matapalo (08°22'14\",16 Latitud Norte,\n83°17'43\",01 Longitud Oeste) y Punta Banco (08°21'18\",21 Latitud\nNorte, 83°08'41\",05 Longitud Oeste), y de esta línea aguas adentro hasta\nel final del Golfo Dulce (hacia Rincón de Osa, 08°41'24\",83 Latitud Norte,\n83°29'00\",29 Longitud Oeste), a embarcaciones que no cuenten con los\nrespectivos permisos de pesca vigentes para tal fin.\n\nb. En el Golfo de Nicoya a partir de una línea\nimaginaria comprendida entre Punta Peñón (09°53'31\" Latitud Norte,\n84°43'52\" Longitud Oeste) e Isla Negritos (09°49'14\" Latitud Norte,\n84°49'35\" Longitud Oeste), y de esta línea aguas adentro hasta la\ndesembocadura del Río Tempisque (10°15'21\",6 Latitud Norte,\n85°15'59\",24 Longitud Oeste), a aquellas embarcaciones que no cuenten con\nlos respectivos permisos de pesca vigentes para tal fin.\n\nc. En el Golfo de Papagayo a partir de una línea\nimaginaria comprendida entre Cabo Velas (10°21'14\",52 Latitud Norte,\n85°52'35\",74 Longitud Oeste) a Punta Blanca (10°53'23\",73 Latitud\nNorte, 85°57'00\",04 Longitud Oeste), y de esta línea aguas adentro, a\naquellas embarcaciones que no cuenten con los respectivos permisos de pesca\nvigentes para tal fin.\n\n(Así\nreformado mediante acuerdo N° AJDIP/252-2023 del 17 de\noctubre del 2023)\n\nArtículo 5: En las zonas fuera\nde las áreas creadas en los incisos a, b, y c, del artículo 4 de esta\nregulación, en un área delimitada por una línea imaginaria paralela a la costa\na partir de la línea de pleamar hasta las 30 millas aguas afuera del océano\npacífico costarricense, se prohíbe la realización de faenas de pesca comercial,\nutilizando palangre (long line) de superficie con carnada viva como arte de\npesca, a las flotas de pesca comercial, pequeña escala, mediana escala y\navanzada ya que será considerado como pesca dirigida a la captura de Pez Vela.\n\nQuedan autorizadas tanto la\nflota comercial turística y pequeña escala que no utilice como arte de pesca\npalangre de superficie, así como la pesca deportiva, a realizar actividades de\npesca utilizando carnada viva dentro de esas 30 millas, de conformidad con su\nautonomía de navegación en concordancia con las condiciones y especificaciones\nque le autorice su licencia de pesca vigente.\n\nEn las 30 millas indicadas en el primer párrafo de este\nartículo, las embarcaciones pertenecientes a la flota de pesca comercial de\nmediana escala y la pesca comercial de avanzada podrán capturar carnada en los\nsitios autorizados y transportarla en viveros para su utilización en faenas de\npesca propias de la embarcación, nunca podrán realizar actividades de pesca con\ncarnada viva utilizando palangre de superficie dentro de las 30 millas establecidas\nen esta regulación.\n\n(Así\nreformado mediante acuerdo N° AJDIP/252-2023 del 17 de octubre del 2023)\n\nArtículo 6º-Cuando dentro de las zonas indicadas en\nlos artículos 4 y 5, se realice la captura de las especies de picudos, pez vela\n(Istiophorus platypterus), marlín rosado (Tetrapturus audax),\nmarlín blanco (Makaira nigricans), pez espada (Xiphias gladius),\npor pescadores deportivos y turísticos y el pez esté aún con vida, este será\nliberado cortando el reinal o la línea lo más cercano posible del anzuelo, sin\nsacar del agua el espécimen capturado.\n\nCuando se capture de manera\nincidental pez vela por parte de la flota comercial excepto la turística y este\naún con vida este será liberado cortando el reinal o la línea lo más cercano\nposible del anzuelo, sin sacar del agua el espécimen capturado.\n\nArtículo 7º-A las personas que a bordo de\nembarcaciones debidamente autorizadas al efecto realicen faenas de pesca\nturística y pesca deportiva, se les prohíbe colocar sobre la borda los\nejemplares capturados para efectos fotográficos, así como el uso de bicheros o\nganchos para arrimar los ejemplares de picudos capturados.\n\nNo\naplica la prohibición establecida en este artículo, cuando se trate de capturas\nque deban registrarse para efectos de récord mundiales o en torneos de pesca\ndeportiva y turística avalados por INCOPESCA.\n\nArtículo 8º-En caso de producirse pesca\nincidental de Pez Vela (Istiophorus platypterus) en la actividad de pesca\ncomercial no turística, sin que hubiere sido posible la devolución al mar del\nejemplar aún vivo; solo se permitirá la comercialización del producto en estado\nfresco o congelado para consumo humano exclusivamente en el mercado nacional.\nPara efectos de lo anterior, la pesca incidental no podrá exceder el 10% (peso\neviscerado), de la captura total de la embarcación por cada viaje de pesca\ncomercial no turística realizado.\n\nSe prohíbe la exportación de Pez Vela\n(Istiophorus platypterus), en concordancia con lo señalado en el párrafo\nanterior, medida de ordenación pesquera que será revisada anualmente.\n\n(Así\nreformado mediante acuerdo N° AJDIP/017-2023 del 31 de enero de 2023)\n\nArtículo 9º-Para los efectos de la aplicación de lo\ndispuesto en el artículo 8, se considera pesca incidental, aquella en la cual\nlos ejemplares de pez vela son capturados utilizando palangre sin mediar el uso\nde carnada viva, siempre que no correspondan a más del 15% de la captura total\nde la embarcación por cada viaje realizado de pesca comercial excepto la pesca\ncomercial turística.\n\nArtículo 10.-Toda\nembarcación con licencia de pesca comercial, que hubiese capturado pez vela de\nmanera incidental, estará obligada a solicitar de previo a la descarga, la\nrespectiva inspección en puerto, siguiendo para esto los procedimientos\nestablecidos por el INCOPESCA.\n\nCuando en la descarga del producto se detecte Pez Vela que\nexcede o sobrepasa el 15% de la captura total permitida como pesca incidental,\nel funcionario del INCOPESCA a cargo de la inspección no autorizará la\ncomercialización de ese producto y deberá proceder conforme lo establece la\nlegislación por infracciones a la Ley de Pesca y Acuicultura.\n\nArtículo 11.-Para el transporte y comercialización de\npez vela en el territorio nacional, los vehículos de transporte estarán\nobligados a portar y presentar a las autoridades; as well as the\ntechnical criteria of the General Technical Directorate of INCOPESCA and the\nexperience generated by the application of the agreements indicated in\nconsidering 4 of this provision, it is considered necessary to establish these\nmanagement measures to regulate the use of live bait by the\ncommercial fishing fleet and sport fishing.\n\nVI.-That in\ncompliance with the provisions of Article 50 of the Political Constitution of\nCosta Rica, as well as the application of the principles of sustainable\ndevelopment, precautionary, preventive, and democratic access to fishery\nresources, and in accordance with the provisions of Law 7384, the Law Creating the\nCosta Rican Institute of Fisheries and Aquaculture, and Law 8436, the Fisheries and\nAquaculture Law, the Board of Directors of INCOPESCA considers it of special interest to\nregulate the sustainable use and exploitation of live bait by\nthe commercial fishing fleet and sport fishing. Therefore,\n\nTHE\nBOARD OF DIRECTORS OF THE COSTA RICAN INSTITUTE OF FISHERIES AND AQUACULTURE\n\nAGREES\n\nMANAGEMENT MEASURES FOR THE USE OF\n\nLIVE BAIT FOR THE COMMERCIAL FISHING\n\nFLEET AND SPORT FISHING IN THE\nCOSTA RICAN\n\nPACIFIC OCEAN.\n\nArticle 1º-Fishing\ntargeting sailfish in the Costa Rican Pacific Ocean is prohibited, using surface longline adapted for that purpose and with live bait as\nfishing gear, in the areas expressly established in this agreement, for the\ncommercial fleet except tourist fishing and sport fishing. The\nfishing operations of the national fishing fleet, using longline and live\nbait, especially regarding areas and dates, are subject to the\nregulations of this agreement.\n\nArticle 2º-This agreement establishes\ntechnical provisions and regulations of mandatory compliance. The\ninfractions against this agreement shall be sanctioned in accordance with the provisions\nof the Fisheries and Aquaculture Law.\n\nFor the purposes of this agreement, the following is considered:\n\nCommercial fishing: That fishing activity undertaken\nto obtain economic benefits from the port sale of\nthe captured fishery products.\n\nCommercial fishing for live bait: It is the activity\ncarried out with the purpose of capturing and marketing permitted species of\naquatic biological products for use as live bait.\n\nSport Fishing: That fishing activity carried out\nnon-profit and for the purpose of sport, distraction, pleasure,\nrecreation, tourism, or pastime, with the aim of capturing, with a\npersonal fishing tackle appropriate for the purpose, aquatic fishery\nresources in inland, jurisdictional waters, or in the exclusive economic zone, without commercial\npurposes.\n\nTourist Fishing: Commercial fishing activity, carried out\nby national or foreign natural persons, with the aim of capturing, with\na personal fishing tackle appropriate for the purpose, aquatic fishery\nresources in inland, jurisdictional waters, or in the exclusive economic zone, with commercial\npurposes and exclusively tourist purposes,\ncarried out on a permanent basis.\n\nLive Bait: Small-sized species used\nin longline or drift fishing, on rods or hand lines, with the object of\nfacilitating the capture of other commercially important species of larger size.\n\nArticle 3º-Vessels engaged in\ncommercial fishing for live bait for its commercialization or sale, shall\nhave the respective commercial fishing license granted by INCOPESCA.\n\nA\nlive bait fishing license shall not be required for vessels\nwith small-scale commercial fishing, medium-scale fishing, advanced-scale\nfishing, and tourist fishing licenses; nor for vessels or natural persons\nengaged in sport fishing and using live bait, for use\nin their own fishing operations.\n\nArticle 4. A\nprohibition zone is established for the fishing and storage of live bait in live wells,\nfor the commercial fleet except tourist fishing and small-scale fishing; as well\nas for sport fishing, except in the Marine Areas of Responsible Fishing that\nso authorize; according to the following delimitation and characteristics:\n\na. In Golfo Dulce, from an imaginary\nline drawn between Cabo Matapalo (08°22'14\".16 North Latitude,\n83°17'43\".01 West Longitude) and Punta Banco (08°21'18\".21 North\nLatitude, 83°08'41\".05 West Longitude), and from this line inland waters up to\nthe end of Golfo Dulce (towards Rincón de Osa, 08°41'24\".83 North Latitude,\n83°29'00\".29 West Longitude), for vessels that do not have the\nrespective valid fishing permits for that purpose.\n\nb. In the Golfo de Nicoya, from an imaginary\nline drawn between Punta Peñón (09°53'31\" North Latitude,\n84°43'52\" West Longitude) and Isla Negritos (09°49'14\" North Latitude,\n84°49'35\" West Longitude), and from this line inland waters up to the\nmouth of the Río Tempisque (10°15'21\".6 North Latitude,\n85°15'59\".24 West Longitude), for those vessels that do not have their\nrespective valid fishing permits for that purpose.\n\nc. In the Golfo de Papagayo, from an imaginary\nline drawn between Cabo Velas (10°21'14\".52 North Latitude,\n85°52'35\".74 West Longitude) and Punta Blanca (10°53'23\".73 North\nLatitude, 85°57'00\".04 West Longitude), and from this line inland waters, for\nthose vessels that do not have their respective valid fishing permits\nfor that purpose.\n\n(As\namended by agreement No. AJDIP/252-2023 of October\n17, 2023)\n\nArticle 5: In the zones outside\nof the areas created in subsections a, b, and c of Article 4 of this\nregulation, in an area delimited by an imaginary line parallel to the coast\nfrom the high-water mark out to 30 nautical miles offshore of the Costa Rican\nPacific Ocean, commercial fishing operations using surface longline (long line) with live bait as fishing\ngear are prohibited for the small-scale, medium-scale, and advanced-scale\ncommercial fishing fleets, as this shall be considered fishing targeting the Sailfish.\n\nBoth the commercial tourist\nfleet and the small-scale fleet that do not use surface longline as fishing\ngear, as well as sport fishing, are authorized to carry out fishing\nactivities using live bait within those 30 miles, in accordance with their\nnavigation autonomy in concordance with the conditions and specifications\nauthorized by their valid fishing license.\n\nWithin the 30 miles indicated in the first paragraph of this\narticle, vessels belonging to the medium-scale commercial fishing fleet and advanced-scale commercial fishing may capture bait in\nauthorized sites and transport it in live wells for use in their own\nvessel fishing operations; they may never carry out fishing activities with\nlive bait using surface longline within the 30 miles established\nin this regulation.\n\n(As\namended by agreement No. AJDIP/252-2023 of October 17, 2023)\n\nArticle 6º-When, within the zones indicated in\nArticles 4 and 5, the capture of billfish species, sailfish\n(Istiophorus platypterus), striped marlin (Tetrapturus audax),\nblue marlin (Makaira nigricans), swordfish (Xiphias gladius),\nby sport fishers and tourists, occurs and the fish is still alive, it shall be\nreleased by cutting the leader or line as close as possible to the hook, without\nremoving the captured specimen from the water.\n\nWhen sailfish is incidentally\ncaptured by the commercial fleet except the tourist fleet, and it is\nstill alive, it shall be released by cutting the leader or line as close as\npossible to the hook, without removing the captured specimen from the water.\n\nArticle 7º-Persons on board\nvessels duly authorized for this purpose who engage in tourist\nfishing and sport fishing operations are prohibited from placing\nthe captured specimens over the gunwale for photographic purposes, as well as the use of gaffs or\nhooks to bring the captured billfish specimens alongside.\n\nThe prohibition established in this article does not\napply when the captures are to be recorded for world record purposes or in sport\nand tourist fishing tournaments endorsed by INCOPESCA.\n\nArticle 8º-In the event of incidental\nfishing of Sailfish (Istiophorus platypterus) during non-tourist commercial fishing\nactivity, and it was not possible to return the\nstill-living specimen to the sea;
