Asimismo, incorpora el derecho de toda persona\na un ambiente sano y ecológicamente equilibrado.\n\n3º-Que\ncorresponde al INCOPESCA como Institución Rectora del sector pesquero y\nacuícola de nuestro país, establecer medidas de ordenamiento para el\naprovechamiento sostenible de los recursos hidrobiológicos, que permitan\nproteger áreas de reproducción, reclutamiento y de alimentación, que favorezcan\nel incremento de las especies y el aumento de su biomasa, de manera que se\ngarantice su sostenibilidad en provecho de los ecosistemas y de los pescadores.\n\n4º-Que\nde acuerdo al Código de Conducta para la Pesca Responsable, Decreto Ejecutivo\nNº 27919-MAG reconoce en su artículo 6, la importante contribución de la pesca\nartesanal en pequeña escala a la generación de empleo, ingresos y seguridad\nalimentaria. De ahí la necesidad de que el Estado garantice apropiadamente el\nderecho de los pescadores y pescadoras, adoptando medidas de regulación que\nfavorezcan el aprovechamiento de los recursos pesqueros en las aguas de\njurisdicción nacional.\n\n5º-Que\npara la formulación del Plan de Ordenamiento Pesquero del Área Marina de Pesca\nResponsable de Costa de Pájaros, se tiene como propósito fundamental dar\ncumplimiento a lo establecido en el Acuerdo AJDIP-138-2008, de Junta Directiva\ndel INCOPESCA y al Decreto Ejecutivo No 35502-MAG de fecha 01 de octubre del\n2009, como requisito previo para establecer un Área Marina de Pesca\nResponsable.\n\n6º-Que\nentre los objetivos y metas que persigue la Creación de esta Área Marina de\nPesca Responsable, se tienen:\n\n- Objetivo General: Establecer el Área Marina de Pesca\nResponsable de Costa de Pájaros que sea administrada por medio del Plan de\nOrdenamiento Pesquero bajo la tutela de los pescadores artesanales de la zona.\n\n- Objetivos específicos:\n\n1. Promover el ordenamiento pesquero y la zonificación\nmarina participativa con las organizaciones comunitarias y pescadores, por\nmedio del Plan de Ordenamiento Pesquero del Área Marina de Pesca Responsable en\nCosta de Pájaros.\n\n2. Fomentar el aprovechamiento sostenible de los\nrecursos pesqueros mediante la investigación sobre métodos y artes de pesca\namigables con el ambiente, la sustitución de artes de pesca ilegales, así como\nel monitoreo de los impactos de las nuevas medidas de regulación en el AMPR.\n\n3. Contribuir con la restauración de hábitat y de los\nrecursos pesqueros en el área de la AMPR, mediante la implementación de\nproyectos sostenibles y mejoramiento de la calidad ambiental de los ecosistemas\nmarinos.\n\n4. Llevar a cabo procesos de formación,\nconcientización y consolidación de las organizaciones del sector pesquero\nartesanal mediante la capacitación a pescadores y pescadoras, sobre aspectos\nnormativos y técnicos del Código de Conducta para la pesca responsable, métodos\ny artes de artes de pesca más selectivos y amigables con el ambiente, educación\nambiental, asuntos técnicos administrativos, operativos e infraestructura\npesquera.\n\n5. Desarrollar alternativas productivas que\ncontribuyan a mejorar la condición socioeconómica y el desarrollo humano de los\npescadores del AMPR Costa de Pájaros, y a la vez disminuir el esfuerzo\npesquero.\n\n6. Antonio Porras Porras, Director\nGeneral Técnico.\n\n3º-Acuerdo\nfirme.\n\n4º-Rige a partir de su publicación.", "body_en_text": "throughout the entire text\n\n-\n\nComplete Text of Regulation 182\n\nCreation of the Costa de Pájaros Responsible Fishing Marine Area and its Operation Plan\n\nComplete Text of Record: 10611C\n\nCOSTA RICAN INSTITUTE OF FISHERIES\n\nAND AQUACULTURE\n\nAJDIP/182-2014.-Puntarenas, on the thirtieth day of May, two thousand fourteen.\n\nConsidering:\n\n1º-Whereas having received from the representatives of the Association of Fishermen for the Recovery of Marine Resources and Responsible Fishing -ASOPECOPA, the endorsement of the final work of the Fisheries Management Plan (Plan de Ordenamiento Pesquero) as a prerequisite for the approval of the Costa de Pájaros Responsible Fishing Marine Area, which was prepared by the Interinstitutional Working Group formed by Agreement No. AJDI/281-2013 of July 19, 2013, to formulate the proposal for the Fisheries Management Plan (Plan de Ordenamiento Pesquero), as a prerequisite for establishing the Costa de Pájaros Responsible Fishing Marine Area.\n\n2º-Whereas in accordance with this, Article 50 of the Political Constitution provides that it is the duty of the State to procure the greatest well-being for all the inhabitants of the country, organizing and stimulating production and the most adequate distribution of wealth. Likewise, it incorporates the right of every person to a healthy and ecologically balanced environment.\n\n3º-Whereas it is the responsibility of INCOPESCA, as the Governing Institution of the fisheries and aquaculture sector of our country, to establish management measures for the sustainable use of hydrobiological resources, which allow for the protection of reproduction, recruitment, and feeding areas, that favor the increase of species and the increase of their biomass, in a manner that guarantees their sustainability for the benefit of ecosystems and fishers.\n\n4º-Whereas according to the Code of Conduct for Responsible Fisheries, Executive Decree No. 27919-MAG recognizes in its Article 6, the important contribution of artisanal, small-scale fisheries to employment generation, income, and food security. Hence the need for the State to appropriately guarantee the right of fishers, adopting regulatory measures that favor the use of fishery resources in waters of national jurisdiction.\n\n5º-Whereas for the formulation of the Fisheries Management Plan (Plan de Ordenamiento Pesquero) of the Costa de Pájaros Responsible Fishing Marine Area, the fundamental purpose is to comply with the provisions of Agreement AJDIP-138-2008, of the Board of Directors of INCOPESCA, and Executive Decree No. 35502-MAG dated October 1, 2009, as a prerequisite for establishing a Responsible Fishing Marine Area.\n\n6º-Whereas among the objectives and goals pursued by the Creation of this Responsible Fishing Marine Area, are the following:\n\n- General Objective: To establish the Costa de Pájaros Responsible Fishing Marine Area to be administered through the Fisheries Management Plan (Plan de Ordenamiento Pesquero) under the stewardship of the artisanal fishers of the area.\n\n- Specific Objectives:\n\n1. To promote fisheries management and participatory marine zoning with community organizations and fishers, through the Fisheries Management Plan (Plan de Ordenamiento Pesquero) of the Responsible Fishing Marine Area in Costa de Pájaros.\n\n2. To encourage the sustainable use of fishery resources through research on environmentally friendly fishing methods and gear, the replacement of illegal fishing gear, as well as the monitoring of the impacts of new regulatory measures in the AMPR.\n\n3. To contribute to the restoration of habitat and fishery resources in the AMPR area, through the implementation of sustainable projects and improvement of the environmental quality of marine ecosystems.\n\n4. To carry out training, awareness-raising, and consolidation processes for artisanal fishing sector organizations through training for fishers, on regulatory and technical aspects of the Code of Conduct for Responsible Fisheries, more selective and environmentally friendly fishing methods and gear, environmental education, administrative and operational technical matters, and fisheries infrastructure.\n\n5. To develop productive alternatives that contribute to improving the socioeconomic condition and human development of the fishers of the Costa de Pájaros AMPR, and at the same time reduce fishing effort (esfuerzo pesquero).\n\n6. To articulate the participation (technical and financial cooperation, promotion of competitiveness) of diverse public-private actors, linked to the development of fisheries and aquaculture, as strategic partners for the development of the Costa de Pájaros Responsible Fishing Marine Area.\n\nFor its part, among the proposed goals, are the following:\n\n1) Marine zoning established in the Fisheries Management Plan (Plan de Ordenamiento Pesquero) of the Costa de Pájaros Responsible Fishing Marine Area.\n\n2) Regulatory measures updated based on the results derived from the research and monitoring of catches with the fishing gear and methods established in the POP of the Costa de Pájaros AMPR.\n\n3) The fishery resources and habitat of the Costa de Pájaros AMPR restored as a result of the reduction of fishing effort (esfuerzo pesquero) and the implementation of programs, projects, and established regulatory measures.\n\n4) Percentage of trained fishers contributing to the consolidation of the AMPR.\n\n5) Percentage of strengthened Fishing Organizations to invigorate the AMPR.\n\n6) Percentage of productive alternatives developed to improve the socioeconomic condition of fishers and that contribute to reducing fishing effort (esfuerzo pesquero).\n\n7º-Whereas it being of vital importance to the Board of Directors to strengthen and implement this type of fisheries governance model, and having received from the Technical General Directorate a favorable opinion for the establishment of this Marine Area, as evidenced in official communication DGT-078-09-2014, the Board of Directors, Therefore;\n\nAGREES:\n\n1º-To approve the Creation of the Costa de Pájaros Responsible Fishing Marine Area and its Management Plan, in accordance with the following terms and conditions:\n\nFigure 1.
