COSTARRICENSE DE PESCA\n\nY ACUICULTURA\n\nAJDIP/355-2012.-Puntarenas, a los veinte días del mes\nde julio de dos mil doce.\n\nConsiderando:\n\n1º-Que de conformidad con el inciso c) del Artículo 127\nde la Ley de Pesca y Acuicultura, Ley Nº 8436, el INCOPESCA deberá llevar un\nregistro de carácter público de las personas físicas o jurídicas,\ncostarricenses o extranjeras, dedicadas a la actividad pesquera y acuícola.\n\n2º-Que\nde conformidad con los artículos 2, 3 y 5 (inciso II) de la Ley N° 7486, Ley de\nCreación del INCOPESCA, se establecen como actividades ordinarias del Instituto\nla coordinación y promoción del desarrollo de los sectores pesquero y acuícola;\npudiendo para ello establecer convenios de cooperación y coordinar actividades\ncon los organismos de crédito, de asistencia técnica y de cualquier otra\níndole, que conlleven a alcanzar el más alto beneficio social en ambos sectores\nproductivos.\n\n3º-Que\nde conformidad con el artículo 6 de la Ley N° 7486, Ley de Creación del\nINCOPESCA, el Instituto tendrá capacidad para comprar, vender y arrendar bienes\nmuebles o inmuebles y títulos valores; podrá recibir donaciones; tendrá,\nasimismo, capacidad para prestar, financiar, hipotecar y realizar las gestiones\ncomerciales y legales que sean de contratación, de conformidad con lo que\ndispone la Ley de la Administración Financiera y la Ley de Contratación\nAdministrativa.\n\n4º-Que\nde conformidad con el inciso d) del artículo 7 de la Ley N° 7486, Ley de\nCreación del INCOPESCA, la máxima dirección del Instituto estará a cargo de una\nJunta Directiva, compuesta por nueve miembros, dentro de los cuales estarán\ntres miembros del sector pesquero, representantes de las organizaciones de\npescadores o acuicultores de las provincias costeras del país.\n\n5º-Que\nde conformidad con los artículos 23, 24 y 26 de la Ley N° 7486, Ley de Creación\ndel INCOPESCA, la Junta Directiva del Instituto podrá crear comisiones\nasesoras, dentro del ámbito de sus actividades y entre éstas, la Comisión\nNacional Consultiva de Pesca y la Comisión de Mercadeo, las cuales estarán\nintegradas entre otros, por representantes de los sectores pesquero y acuícola\nque deberán escogerse de ternas que envíen las organizaciones de los sectores\nrespectivos.\n\n6º-Que\nde conformidad con el artículo 1 de la Ley N° 8990, Ley de Modificación de la\nLey N° 8220, Protección al ciudadano del exceso de requisitos y trámites\nadministrativos y según su Artículo 4, todo trámite o requisito, con\nindependencia de su fuente normativa, para que pueda exigirse al administrado\ndeberá constar en un reglamento y estar publicado en el Diario Oficial La\nGaceta junto con el procedimiento a seguir, los instructivos, manuales,\nformularios y demás documentos correspondientes.\n\n7º-Que\nse ha considerado oportuno y conveniente para el logro de todo lo indicado\nanteriormente, emitir las regulaciones reglamentarias pertinentes para la\nparticipación de las organizaciones pesqueras y acuícolas de nuestro país,\ndentro del quehacer del INCOPESCA. Publíquese.", "body_en_text": "in the entirety of the text\n\n -\n\nFull Text of Standard 0\n\n Regulations for the registration of fishing and aquaculture organizations\n(Agreement AJDIP/355-2012)\n\nFull Text of record: FE6B0\n\nCOSTA RICAN INSTITUTE OF FISHERIES\n\nAND AQUACULTURE\n\nAJDIP/355-2012.-Puntarenas, on the twentieth day of\nJuly of two thousand twelve.\n\nConsidering:\n\n1º-That in accordance with subsection c) of Article 127\nof the Fisheries and Aquaculture Law, Law No. 8436, INCOPESCA must maintain a\npublic registry of natural or legal persons,\nCosta Rican or foreign, engaged in fishing and aquaculture activity.\n\n2º-That\nin accordance with Articles 2, 3, and 5 (subsection II) of Law No. 7486, Law\nCreating INCOPESCA, the ordinary activities of the Institute are established as\nthe coordination and promotion of the development of the fishing and aquaculture sectors;\nbeing able to establish cooperation agreements and coordinate activities\nwith credit, technical assistance, and any other type of\norganizations, leading to the highest social benefit in both\nproductive sectors.\n\n3º-That\nin accordance with Article 6 of Law No. 7486, Law Creating\nINCOPESCA, the Institute shall have the capacity to buy, sell, and lease movable\nor immovable property and securities; it may receive donations; it shall\nalso have the capacity to lend, finance, mortgage, and carry out commercial\nand legal transactions related to contracting, in accordance with what is\nprovided in the Financial Administration Law and the Administrative\nContracting Law.\n\n4º-That\nin accordance with subsection d) of Article 7 of Law No. 7486, Law\nCreating INCOPESCA, the highest management of the Institute shall be in charge of a\nBoard of Directors, composed of nine members, among which there shall be\nthree members from the fishing sector, representatives of the organizations of\nfishers or aquaculturists from the country's coastal provinces.\n\n5º-That\nin accordance with Articles 23, 24, and 26 of Law No. 7486, Law Creating\nINCOPESCA, the Institute's Board of Directors may create advisory\ncommissions, within the scope of its activities, including the National\nConsultative Commission on Fisheries and the Marketing Commission, which shall be\ncomposed, among others, of representatives from the fishing and aquaculture\nsectors, who must be chosen from shortlists submitted by the organizations of the\nrespective sectors.\n\n6º-That\nin accordance with Article 1 of Law No. 8990, Law Amending\nLaw No. 8220, Protection of the citizen from excess requirements and administrative\nprocedures and according to its Article 4, any procedure or requirement,\nregardless of its normative source, must be set forth in a regulation\nand published in the Official Gazette La\nGaceta along with the procedure to follow, instructions, manuals,\nforms, and other corresponding documents in order to be demanded of the administered party.\n\n7º-That\nit has been deemed opportune and convenient for the achievement of all the above,\nto issue the pertinent regulatory provisions for the\nparticipation of fishing and aquaculture organizations of our country,\nwithin the work of INCOPESCA. By reason of the foregoing, the Board of Directors.\nTherefore,\n\nAGREES:\n\n1º-To approve\nthe following regulations:\n\nREGULATIONS FOR THE REGISTRATION\n\nOF FISHING AND AQUACULTURE ORGANIZATIONS\n\nArticle 1º-To be subject to any project,\ncredit, economic aid, technical assistance, loan, lease,\ndonation, cooperation agreement, or benefit of any other kind, whether\ndirectly from INCOPESCA or through other public or private entities at the behest\nof this institute, or for its members to participate on its\nbehalf as representatives within the Board of Directors of INCOPESCA\nor another institutional commission, it shall be mandatory for every\nfishing or aquaculture organization to be duly registered and maintain\nits current Legal Status (Personería Jurídica) with INCOPESCA.\n\nArticle\n2º-Fishing and aquaculture organizations, to be registered within\nthe INCOPESCA registry, must submit to the\nExtension and Training Department the Registration Form designed for this purpose.\n\nArticle\n3º-The information contained in said form shall be of a private nature and shall\nbe considered for administrative, technical, and legal purposes as a\nSworn Statement (Declaración Jurada).\n\nArticle\n4º-Whether due to the expiration of the term of the Legal Status (Personería Jurídica) or the\nappointment of new members of the Board of Directors, fishing and\naquaculture organizations must update the corresponding information.\n\nArticle\n5º-The Extension and Training Department, with the support of\nthe Regional Directorates and Offices and Aquaculture Stations, shall be responsible for keeping and maintaining\nup to date the Registry of Fishing and Aquaculture Organizations of our country, as well\nas certifying the current status of a given fishing and\naquaculture organization, when so required by any public or private entity.\n\nArticle\n6º-INCOPESCA, within its ordinary budget, shall allocate\nthe necessary economic resources to obtain from the National Registry a\nLiteral Certification (Certificación Literal) of each of the fishing and aquaculture organizations for\nregistry, filing, and control purposes.\n\nArticle 7º-Firm agreement.
