En correspondencia con dicha disposición, el monto de gasto\npresupuestario máximo para el año 2014 resultante para la Comisión Nacional\npara la Gestión de la Biodiversidad, fue establecido en la suma de\n¢225.930.000,00 (doscientos veinticinco millones novecientos treinta mil\ncolones exactos) el cual fue comunicado en el oficio STAP-0727-2013 del 16 de\nabril de 2013, cifra que no contempla el gasto indicado previamente en este\ndecreto.\n\n6º-Que mediante el Decreto Ejecutivo Nº 32452-H\npublicado en La Gaceta Nº 130 de 6 de julio de 2005 y sus reformas, se\nemite el \"Lineamiento para la aplicación del artículo 6 de la Ley Nº 8131, Ley\nde la Administración Financiera de la República y Presupuestos Públicos y la\nregulación de la clase de ingresos del Sector Público denominada\nFinanciamiento\".\n\n7º-Que en relación con el superávit específico, el\nnumeral 9° del referido Decreto Ejecutivo Nº 32452-H, posibilita la utilización\nde éste, para el pago de gastos definidos en los fines establecidos en las\ndisposiciones especiales o legales aplicables a tales recursos.\n\n8º-Que por lo anterior,\nresulta necesario ampliar el gasto presupuestario máximo fijado a la Comisión\nNacional para la Gestión de la Biodiversidad para el año 2014, incrementándolo\nen la suma de ¢45.281.819,00 (cuarenta y cinco millones doscientos ochenta y un\nmil ochocientos diecinueve colones exactos).   "body_en_text": "in the entirety of the text\n\n                    -\n\nFull Text of Regulation 38646\n\n                        Increases the maximum budgetary expenditure for the National Commission for Biodiversity Management for the year 2014\n\nFull Text of record: FE739\n\nNº 38646-H\n\nTHE PRESIDENT OF THE REPUBLIC\n\nAND THE MINISTER OF FINANCE\n\nBased on the powers granted to them by articles 140 subsections 3) and 18) and 146 of the Political Constitution; articles 25 subsection 1), 27 subsection 1), and 28 subsection 2) paragraph b) of Law Nº 6227, General Law of Public Administration of May 2, 1978, and its amendments; Law Nº 8131, Law of Financial Administration of the Republic and Public Budgets of September 18, 2001, and its amendments; its Regulation, Decreto Ejecutivo Nº 32988-H-MP-PLAN of January 31, 2006, and its amendments; Law Nº 7788, Biodiversity Law of April 30, 1998, and its amendments; Decreto Ejecutivo Nº 32452-H of June 29, 2005, and its amendments; and Decreto Ejecutivo Nº 37595-H of March 18, 2013, and its amendments.\n\nConsidering:\n\n1-That through Law Nº 7788, published in La Gaceta Nº 101 of May 27, 1998, and its amendments, the National Commission for Biodiversity Management (CONAGEBIO) was created as a deconcentrated body of the Ministry of Environment and Energy with instrumental legal personality, and functions related to the conservation, ecologically sustainable use, and restoration of biodiversity.\n\n2-That through official letters OT-098-2014, OT-131-2014, and OT-162-2014, dated respectively April 28, May 30, and July 8, all of 2014, the Executive Director of the National Commission for Biodiversity Management, with the endorsement of the Minister of Environment and Energy, granted in official letter Nº DM-258-2014 of May 2, 2014, requested to increase the maximum budgetary expenditure of said institution for 2014, for a total amount of ¢45,309,544.00 (exactly forty-five million three hundred nine thousand five hundred forty-four colones), to finance various services and expenses for institutional management.\n\n3-That from said amount, the sum of ¢45,281,819.00 (exactly forty-five million two hundred eighty-one thousand eight hundred nineteen colones) is to be increased via Decreto Ejecutivo to cover expenses in the line items of Remunerations, Services, Materials and Supplies, and Current Transfers, which correspond to resources from the specific surplus.\n\n4-That the increase for the remaining ¢27,725.00 (exactly twenty-seven thousand seven hundred twenty-five colones) is not approved, as these are resources that are excluded from the maximum budgetary expenditure, according to Decreto Ejecutivo Nº 37595-H published in Alcance Nº 54 to La Gaceta Nº 57 of March 21, 2013, and its amendments.\n\n5-That through the aforementioned Decreto Ejecutivo Nº 37595-H, the General Budgetary Policy Guidelines for the year 2014 were issued, establishing in article 2, the maximum percentage by which the budgetary expenditure of public entities, ministries, and other bodies could be increased, with respect to the preceding year. In accordance with said provision, the resulting maximum budgetary expenditure amount for the year 2014 for the National Commission for Biodiversity Management was established at the sum of ¢225,930,000.00 (exactly two hundred twenty-five million nine hundred thirty thousand colones), which was communicated in official letter STAP-0727-2013 of April 16, 2013, a figure that does not include the expenditure previously indicated in this decree.\n\n6-That through Decreto Ejecutivo Nº 32452-H published in La Gaceta Nº 130 of July 6, 2005, and its amendments, the \"Guideline for the application of article 6 of Law Nº 8131, Law of Financial Administration of the Republic and Public Budgets and the regulation of the class of Public Sector revenues called Financing\" was issued.\n\n7-That in relation to the specific surplus, provision 9 of the referenced Decreto Ejecutivo Nº 32452-H makes it possible to use it for the payment of expenses defined in the purposes established in the special or legal provisions applicable to such resources.\n\n8-That due to the foregoing, it is necessary to increase the maximum budgetary expenditure set for the National Commission for Biodiversity Management for the year 2014, by the sum of ¢45,281,819.00 (exactly forty-five million two hundred eighty-one thousand eight hundred nineteen colones). Therefore,\n\nDecree:\n\nArticle 1-The maximum budgetary expenditure for the year 2014 for the National Commission for Biodiversity Management, established in accordance with Decreto Ejecutivo Nº 37595-H, published in Alcance Digital Nº 54 to La Gaceta Nº 57 of March 21, 2013, and its amendments, is hereby increased by the sum of ¢45,281,819.00 (exactly forty-five million two hundred eighty-one thousand eight hundred nineteen colones), for that period.\n\nArticle 2-It is the responsibility of the active administration of the National Commission for Biodiversity Management to comply with the provisions of article 6 of Law Nº 8131, Law of Financial Administration of the Republic and Public Budgets, published in La Gaceta Nº 198 of October 16, 2001, and its amendments, as well as in Decreto Ejecutivo Nº 32452-H, published in La Gaceta Nº 130 of July 6, 2005, and its amendments.\n\nArticle 3-It shall be effective upon its publication.\n\nGiven at the Presidency of the Republic, on the eighth day of the month of September of the year two thousand fourteen."
