Ejecución del Proyecto\nTurístico Golfo Papagayo y los artículos 2 y 4 de la Ley N° 1917 del 30 de\njulio de 1955, Ley Orgánica del Instituto Costarricense de Turismo.\n\nConsiderando:\n\nI.-Que la Ley Nº 6758 del 4 de junio de 1982, Ley\nReguladora del Desarrollo y Ejecución del Proyecto Turístico Golfo de Papagayo,\nen sus artículos 12 y 13 inciso b) confiere al Instituto Costarricense de\nTurismo la potestad de establecer las condiciones y plazos en que se otorgan\nconcesiones en el Proyecto Turístico Golfo Papagayo.\n\nII.-Que\nla Ley Nº 6758 del 4 de junio de 1982, atribuyó al Instituto Costarricense de\nTurismo la función de dirección, coordinación, administración, ejecución,\ndesarrollo y control del Proyecto Turístico Golfo de Papagayo, todo a través de\nuna Oficina Ejecutora creada al efecto y adscrita al Instituto, siendo menester\ndel mismo reglamentar dicha función para una prestación más eficiente y eficaz\nde los servicios que tiene a cargo.\n\nIII.-Que\nno parece razonable exigir a los concesionarios mantener una garantía de\ncumplimiento de un 5%, cuando la ejecución del proyecto a que se ha obligado\ncontractualmente, resulta materialmente imposible por el acaecimiento de\ncircunstancias sobrevinientes ajenas a su voluntad.\n\nIV.-Que\nes necesario incorporar al artículo 16 del Reglamento a la Ley 6758, Ley para\nel Desarrollo y Ejecución del Proyecto Turístico Golfo de Papagayo, solamente\ncomo vía excepcional, la posibilidad de establecer temporalmente un porcentaje\nde garantía de cumplimiento menor al 5%.\n\nV.-Que\nresulta oportuno, por lo anteriormente señalado, reformar la reglamentación\nrelativa al otorgamiento de garantías de cumplimiento a favor de la\nAdministración por parte de los concesionarios del Proyecto Turístico Golfo de\nPapagayo. Por tanto,\n\nDecretan:\n\nREFORMA AL ARTÍCULO 16 DEL REGLAMENTO\n\nA LA LEY 6758, LEY PARA EL DESARROLLO\n\nY EJECUCIÓN DEL PROYECTO TURÍSTICO\n\nGOLFO DE PAPAGAYO\n\ntext-indent:35.4pt'>Artículo 1º-Modifíquese el artículo 16 del Decreto\nEjecutivo N° 25439 del 27 de agosto de 1996, Reglamento a la Ley 6758, Ley para\nel Desarrollo y Ejecución del Proyecto Turístico Golfo de Papagayo, para que se\nlea de la siguiente manera:\n\n\"Artículo 16.-Los adjudicatarios de concesiones, sean\npor concurso o por cesión de derechos, salvo el caso de adjudicatarios\nresultantes de un proceso de ejecución de garantía sobre una concesión sin\ninterés en su desarrollo, deberán rendir en favor del ICT una garantía de\ncumplimiento que respalde la ejecución de sus proyectos del cinco por ciento\n(5%) del valor estimado de cada etapa del proyecto a realizar que le hubiere\nsido aprobado. La fijación respectiva la hará la Dirección Ejecutiva una vez\nque se apruebe el proyecto a ejecutar.\n\nPor vía\nde excepción y previa aprobación de la Junta Directiva, será posible ajustar\ntemporalmente en un 1% la garantía de cumplimiento, cuando la ejecución del\nproyecto a que se ha obligado contractualmente el concesionario, resulta\nmaterialmente imposible por el acaecimiento de circunstancias sobrevinientes y\nno imputables a éste, lo cual deberá ser fehacientemente demostrado por el\nmismo concesionario y comprobado por la Dirección Ejecutiva, según el\nprocedimiento aprobado por el Consejo Director del Proyecto Turístico Golfo de\nPapagayo.\n\nEn el\nmomento en que cese la circunstancia sobreviniente, así comunicado\noportunamente por el concesionario o verificado por la Dirección Ejecutiva, la\ngarantía de cumplimiento deberá ser ajustada al 5% en un plazo no mayor a 30\ndías hábiles a partir del comunicado de ajuste realizado por la Dirección\nEjecutiva.\n\nEs una\nobligación del concesionario mantener vigente la garantía de cumplimiento\nmientras no haya cumplido con la totalidad de las obligaciones de desarrollo\nque le hayan sido aprobadas. Las garantías de cumplimiento cuando sean rendidas\nmediante títulos emitidos al efecto podrán tener una vigencia inferior al plazo\nde la etapa de desarrollo que se garantiza, pero deberán ser renovadas en\ntiempo y forma antes de su vencimiento. Si un día hábil antes del vencimiento\nde la garantía, el concesionario no ha prorrogado su vigencia, el ICT podrá\nhacerla efectiva en forma preventiva y mantener el dinero en una cuenta bajo su\ncustodia, el cual servirá como medio resarcitorio en caso de incumplimiento.\n\nLa\ndevolución parcial de la garantía de cumplimiento podrá operar a solicitud del\nconcesionario y por aprobación expresa del Consejo Director, previo análisis\ntécnico de la Dirección Ejecutiva. La devolución parcial podrá darse por una\núnica vez después de alcanzar al menos el 50% del avance de las obras de la\netapa que se respalda y será en proporción al cumplimiento de las obras\nejecutadas. Para la devolución parcial de la garantía de cumplimiento, el\nconcesionario deberá demostrar fehacientemente el avance de las obras, el cual\ndeberá ser coincidente con el cronograma de obras aprobado, aportando una Tabla\nde Avance de Obras que contemple la inversión realizada y su porcentaje,\nacompañada de una declaración jurada simple que afirme la veracidad de los\ndatos consignados.\n\nLa\ndevolución final de la garantía de cumplimiento será aprobada por el Consejo\nDirector con apoyo del informe técnico de la Dirección Ejecutiva sobre el cabal\ncumplimiento de las obligaciones respaldadas y no deberá exceder el plazo de 60\ndías naturales, salvo que por criterio técnico o jurídico se justifique un\nretraso en tal devolución.\n\nEn caso\nde existir incumplimientos imputables al concesionario, el ICT podrá iniciar el\nprocedimiento de ejecución de dicha garantía dentro del plazo de los diez días\nhábiles siguientes a la resolución que declare en firme el incumplimiento. La\nejecución de la garantía de cumplimiento no exime al concesionario de\nindemnizar al ICT por los daños y perjuicios que no cubra esa garantía.\n\nComo\ngarantías de cumplimiento sólo se aceptarán las indicadas en la Ley\nContratación Administrativa, Ley N° 7494 del 2 de mayo de 1995 y su\nReglamento.\"\n\nArtículo 2º-Rige a partir de su publicación en el\nDiario Oficial La Gaceta.\n\nDado en la Presidencia de la República.-San José, a\nlos tres días del mes de junio de dos mil catorce.", "body_en_text": "across the entirety of the text\n\n -\n\n Complete Text of Norm 38640\n\n Reform of the Regulation to the Law for the Development and Execution of the\nPapagayo Gulf Tourist Project\n\nComplete Text acta: FEB10\n\nNo.\n38640-MP-TUR\n\nTHE PRESIDENT OF THE REPUBLIC\n\nAND THE MINISTERS OF THE PRESIDENCY AND TOURISM\n\nBased on the powers and authorities conferred in articles 140, subsections 3) and 18) and 146 of the Political Constitution of November 7, 1949; article 28 of Law No. 6227 of May 2, 1978 and its reforms, General Law of Public Administration; Law No. 6758 of June 4, 1982, Regulatory Law for the Development and Execution of the Papagayo Gulf Tourist Project and articles 2 and 4 of Law No. 1917 of July 30, 1955, Organic Law of the Instituto Costarricense de Turismo.\n\nConsidering:\n\nI.—That Law No. 6758 of June 4, 1982, Regulatory Law for the Development and Execution of the Papagayo Gulf Tourist Project, in its articles 12 and 13 subsection b) grants the Instituto Costarricense de Turismo the power to establish the conditions and terms under which concessions are granted in the Papagayo Gulf Tourist Project.\n\nII.—That Law No. 6758 of June 4, 1982, assigned to the Instituto Costarricense de Turismo the function of direction, coordination, administration, execution, development, and control of the Papagayo Gulf Tourist Project, all through an Executing Office created for that purpose and attached to the Institute, it being necessary for the same to regulate said function for a more efficient and effective provision of the services under its charge.\n\nIII.—That it does not seem reasonable to require concessionaires to maintain a performance guarantee (garantía de cumplimiento) of 5%, when the execution of the project to which they have contractually bound themselves becomes materially impossible due to the occurrence of supervening circumstances beyond their control.\n\nIV.—That it is necessary to incorporate into article 16 of the Regulation to Law 6758, Law for the Development and Execution of the Papagayo Gulf Tourist Project, solely as an exceptional avenue, the possibility of temporarily establishing a performance guarantee percentage of less than 5%.\n\nV.—That it is opportune, for the reasons stated above, to reform the regulation concerning the granting of performance guarantees in favor of the Administration by the concessionaires of the Papagayo Gulf Tourist Project. Therefore,\n\nThey Decree:\n\nREFORM OF ARTICLE 16 OF THE REGULATION\n\nTO LAW 6758, LAW FOR THE DEVELOPMENT\n\nAND EXECUTION OF THE\n\nPAPAGAYO GULF TOURIST PROJECT\n\nArticle 1º.—Amend article 16 of Executive Decree No. 25439 of August 27, 1996, Regulation to Law 6758, Law for the Development and Execution of the Papagayo Gulf Tourist Project, so that it reads as follows:\n\n\"Article 16.—The awardees of concessions, whether by competition or by assignment of rights, except in the case of awardees resulting from a process of execution of a guarantee on a concession without interest in its development, shall provide in favor of the ICT a performance guarantee that supports the execution of their projects of five percent (5%) of the estimated value of each stage of the project to be carried out that has been approved for them. The respective determination shall be made by the Executive Directorate once the project to be executed is approved.\n\nBy way of exception and with prior approval of the Board of Directors, it shall be possible to temporarily adjust the performance guarantee to 1%, when the execution of the project to which the concessionaire has contractually bound itself becomes materially impossible due to the occurrence of supervening circumstances not attributable to the concessionaire, which must be reliably demonstrated by the concessionaire and verified by the Executive Directorate, according to the procedure approved by the Governing Council of the Papagayo Gulf Tourist Project.\n\nAt the moment the supervening circumstance ceases, as timely communicated by the concessionaire or verified by the Executive Directorate, the performance guarantee must be adjusted to 5% within a period not exceeding 30 business days from the adjustment notification made by the Executive Directorate.\n\nIt is an obligation of the concessionaire to maintain the performance guarantee in force as long as they have not fulfilled all the development obligations that have been approved. Performance guarantees, when provided through instruments issued for that purpose, may have a validity period shorter than the term of the development stage being guaranteed, but they must be renewed in a timely manner before their expiration. If one business day before the expiration of the guarantee, the concessionaire has not extended its validity, the ICT may execute it on a preventive basis and keep the funds in an account under its custody, which shall serve as a compensatory means in the event of non-compliance.\n\nPartial return of the performance guarantee may occur at the request of the concessionaire and by express approval of the Governing Council, after technical analysis by the Executive Directorate. The partial return may be granted only once after reaching at least 50% progress of the works of the stage being supported and shall be in proportion to the compliance with the executed works. For the partial return of the performance guarantee, the concessionaire must reliably demonstrate the progress of the works, which must coincide with the approved work schedule, providing a Work Progress Table that includes the investment made and its percentage, accompanied by a simple sworn statement affirming the veracity of the data recorded.\n\nThe final return of the performance guarantee shall be approved by the Governing Council, supported by the technical report of the Executive Directorate on the complete fulfillment of the guaranteed obligations, and shall not exceed a period of 60 calendar days, unless a technical or legal criterion justifies a delay in such return.\n\nIn the event of non-compliance attributable to the concessionaire, the ICT may initiate the procedure for executing said guarantee within the period of ten business days following the decision that firmly declares the non-compliance. The execution of the performance guarantee does not exempt the concessionaire from indemnifying the ICT for damages and losses not covered by that guarantee.\n\nAs performance guarantees, only those indicated in the Administrative Contracting Law, Law No. 7494 of May 2, 1995 and its Regulation shall be accepted.\"\n\nArticle 2º.—Takes effect upon its publication in the Official Gazette La Gaceta.\n\nGiven at the Presidency of the Republic.—San José, on the third day of June of two thousand fourteen." }
