  "body_es_text": "en la totalidad del texto\n\n                    -\n\n                        Texto Completo Norma 099\n\n                        Creación del Área Marina de Pesca Responsable Distrito Paquera-Tambor y su\nPlan de Ordenación\n\nTexto Completo acta: FEF44\n\nINSTITUTO\nCOSTARRICENSE DE PESCA\n\nY ACUICULTURA\n\nAJDIP/099-2014.-Puntarenas, a los nueve días del mes\nde abril de dos mil catorce.\n\nConsiderando:\n\n1º-Que habiéndose recibido de parte de los representantes de la Asociación de Pescadores Artesanales\nde Paquera (APEP), Asociación Paquereña para el Aprovechamiento de los Recursos Marinos (ASPARMAR),\nAsociación de Buzos de Paquera (ABUZPA), Cámara de Turismo de Paquera (CAPATUR), Cámara de Turismo\nde Tambor (CATUCOTAMBOR), Asociación de Pescadores y Pescadoras Unidos de Playa Blanca y la\nAsociación de Pescadores de Tambor, el respaldo al trabajo final del Plan de Ordenamiento Pesquero\ncomo requisito previo para la aprobación del Área Marina de Pesca Responsable del Distrito de\nPaquera - Tambor, el cual fue elaborado por el Grupo de Trabajo Interinstitucional conformado por la\nPresidencia Ejecutiva, mediante Resolución PEP-1109-10-2012, de fecha 29 de Noviembre del 2012, para\nformular el Plan de Ordenamiento Pesquero, como requisito previo para establecer el Área Marina de\nPesca Responsable del Distrito Paquera-Tambor. Ante lo cual la Junta Directiva estableció la\ncelebración de una sesión extraordinaria a fin de conocer en detalle los alcances comprendidos en el\nPlan de Ordenamiento citado.\n\n2º-Que\nen concordancia con ello, según el Artículo 50 de la Constitución Política\ndispone que es obligación del Estado procurar el mayor bienestar a todos los\nhabitantes del país, organizando y estimulando la producción y el más adecuado\nreparto de la riqueza. Asimismo, incorpora el derecho de toda persona a un\nambiente sano y ecológicamente equilibrado.\n\n3º-Que\ncorresponde al INCOPESCA como Institución Rectora del sector pesquero y\nacuícola de nuestro país, establecer medidas de ordenamiento para el\naprovechamiento sostenible de los recursos hidrobiológicos, que permitan\nproteger áreas de reproducción, reclutamiento y de alimentación, que favorezcan\nel incremento de las especies y el aumento de su biomasa, de manera que se\ngarantice su sostenibilidad en provecho de los ecosistemas y de los pescadores.\n\n4º-Que\nde acuerdo al Código de Conducta para la Pesca Responsable, Decreto Ejecutivo\nN° 27919-MAG reconoce en su Artículo 6, la importante contribución de la pesca\nartesanal en pequeña escala a la generación de empleo, ingresos y seguridad\nalimentaria. De ahí la necesidad de que el Estado garantice apropiadamente el\nderecho de los pescadores y pescadoras, adoptando medidas de regulación que\nfavorezcan el aprovechamiento de los recursos pesqueros en las aguas de\njurisdicción nacional.\n\n5º-Que para la formulación del Plan de Ordenamiento Pesquero del Distrito Paquera-Tambor (POP-AMPR-\nD-Paquera/ Tambor), se tiene como propósito fundamental dar cumplimiento a lo establecido en el\nAcuerdo AJDIP-138-2008, de Junta Directiva del INCOPESCA y al Decreto Ejecutivo No 35502-MAG de\nfecha 01 de Octubre del 2009, como requisito previo para establecer un Área Marina de Pesca\nResponsable.\n\n6º-Que\nla propuesta de creación esta nueva AMPR responde a un nuevo modelo de gestión,\namplio, participativo y coherente que busca atender las necesidades que hoy en\ndía están teniendo las comunidades pesqueras artesanales de pequeña escala,\nparticularmente en el Distrito de Paquera-Tambor.\n\n7º-Que\nentre los objetivos y metas que persigue la Creación de ésta Área Marina de\nPesca Responsable, se tienen:\n\n- Objetivo General: El Área Marina de Pesca Responsable del Distrito de Paquera-Tambor contribuye\ncon la sostenibilidad de recursos marinos y pesqueros en la zona del Golfo de Nicoya.\n\n-\nObjetivos específicos.\n\na.\nPromover el ordenamiento pesquero y la zonificación marina participativa\nconjuntamente con las organizaciones comunitarias y pescadores, por medio del\nPlan de Ordenamiento Pesquero del Área Marina de Pesca Responsable del Distrito\nPaquera-Tambor.\n\nb.\nFomentar el aprovechamiento sostenible de los recursos pesqueros mediante el\ndesarrollo de investigación sobre métodos y artes de pesca amigables con el\nambiente, la sustitución de artes de pesca ilegales, así como el monitoreo de\nlos impactos de las nuevas medidas de regulación.\n\nc.\nContribuir con la restauración de hábitat y de los recursos pesqueros, mediante\nla implementación de proyectos sostenibles y mejoramiento de la calidad\nambiental de los ecosistemas marinos.\n\nd.\nLlevar a cabo procesos de formación, concientización y consolidación de las\norganizaciones del sector pesquero artesanal de pequeña escala, mediante la\ncapacitación a pescadores y pescadoras, sobre aspectos normativos y técnicos\ndel Código de Conducta Para la Pesca Responsable de la FAO, métodos y artes de\nartes de pesca más amigables con el ambiente, educación ambiental, asuntos\ntécnicos administrativos, operativos e infraestructura pesquera.\n\ne. Desarrollar alternativas productivas que contribuyan a mejorar la condición socioeconómica y el\ndesarrollo humano de los pescadores del AMPR D/Paquera-Tambor, y a la vez disminuir el esfuerzo\npesquero.\n\nf.\nArticular la participación (cooperación técnica y financiera, promoción de la\ncompetitividad) de diversos actores públicos - privados, vinculados al\ndesarrollo de la pesca y la acuicultura, como socios estratégicos para el\ndesarrollo del Área Marina de Pesca Responsable del Distrito de Paquera-Tambor.\n\n-\nMetas propuesta.\n\na.\nZonificación marina establecida en el Plan de Ordenamiento Pesquero del Área\nMarina de Pesca Responsable del Distrito Paquera-Tambor.\n\nb.\nMedida regulatorias actualizadas con base en los resultados derivados de las\ninvestigaciones y monitoreos de las capturas con las\nartes y métodos de pesca establecidas en el POP-AMPR-D.   "body_en_text": "throughout the entire text\n\n                    -\n\n                        Complete Text of Norm 099\n\n                        Creation of the Responsible Fishing Marine Area of the Paquera-Tambor District and its\nManagement Plan\n\nComplete Text of record: FEF44\n\nCOSTA RICAN INSTITUTE\nOF FISHERIES\n\nAND AQUACULTURE\n\nAJDIP/099-2014.-Puntarenas, on the ninth day of the month\nof April, two thousand fourteen.\n\nConsidering:\n\n1º-That having received from the representatives of the Asociación de Pescadores Artesanales de Paquera (APEP), Asociación Paquereña para el Aprovechamiento de los Recursos Marinos (ASPARMAR), Asociación de Buzos de Paquera (ABUZPA), Cámara de Turismo de Paquera (CAPATUR), Cámara de Turismo de Tambor (CATUCOTAMBOR), Asociación de Pescadores y Pescadoras Unidos de Playa Blanca, and the Asociación de Pescadores de Tambor, the endorsement of the final work of the Fisheries Management Plan (Plan de Ordenamiento Pesquero) as a prerequisite for the approval of the Responsible Fishing Marine Area of the Paquera - Tambor District, which was prepared by the Inter-institutional Working Group formed by the Executive Presidency, through Resolution PEP-1109-10-2012, dated November 29, 2012, to formulate the Fisheries Management Plan, as a prerequisite for establishing the Responsible Fishing Marine Area of the Paquera-Tambor District. In light of which the Board of Directors established the holding of an extraordinary session to learn in detail the scope comprised in the cited Management Plan.\n\n2º-That\nin accordance with this, Article 50 of the Constitución Política\nprovides that it is the obligation of the State to procure the greatest well-being for all\ninhabitants of the country, organizing and stimulating production and the most adequate\ndistribution of wealth. Likewise, it incorporates the right of every person to a\nhealthy and ecologically balanced environment.\n\n3º-That\nit is the responsibility of INCOPESCA as the Governing Institution of the fisheries and\naquaculture sector of our country, to establish management measures for the\nsustainable use of hydrobiological resources, which allow for\nthe protection of reproduction, recruitment, and feeding areas, which favor\nthe increase of species and the increase of their biomass, in a manner that\nguarantees their sustainability for the benefit of the ecosystems and the fishers.\n\n4º-That\naccording to the Code of Conduct for Responsible Fisheries, Decreto Ejecutivo\nN° 27919-MAG recognizes in its Article 6, the important contribution of small-scale artisanal\nfisheries to the generation of employment, income, and food\nsecurity. Hence the need for the State to appropriately guarantee the\nrights of fishers, adopting regulatory measures that\nfavor the use of fishery resources in the waters of\nnational jurisdiction.\n\n5º-That for the formulation of the Fisheries Management Plan of the Paquera-Tambor District (POP-AMPR-\nD-Paquera/ Tambor), the fundamental purpose is to comply with the provisions set forth in the\nAgreement AJDIP-138-2008, of the Board of Directors of INCOPESCA and Decreto Ejecutivo No 35502-MAG dated\nOctober 1, 2009, as a prerequisite for establishing a Responsible Fishing Marine\nArea.\n\n6º-That\nthe proposal for the creation of this new AMPR responds to a new management model,\nbroad, participatory, and coherent, that seeks to address the needs that\nsmall-scale artisanal fishing communities are having today,\nparticularly in the Paquera-Tambor District.\n\n7º-That\namong the objectives and goals pursued by the Creation of this Responsible Fishing Marine\nArea, are:\n\n- General Objective: The Responsible Fishing Marine Area of the Paquera-Tambor District contributes\nto the sustainability of marine and fishery resources in the Gulf of Nicoya zone.\n\n-\nSpecific objectives.\n\na.\nPromote fisheries management (ordenamiento pesquero) and participatory marine zoning\njointly with community organizations and fishers, through\nthe Fisheries Management Plan of the Responsible Fishing Marine Area of the Paquera-Tambor\nDistrict.\n\nb.\nFoster the sustainable use of fishery resources through\nthe development of research on environmentally friendly fishing methods and gear,\nthe substitution of illegal fishing gear, as well as the monitoring of\nthe impacts of the new regulatory measures.\n\nc.\nContribute to the restoration of habitat and fishery resources, through\nthe implementation of sustainable projects and improvement of the environmental\nquality of marine ecosystems.\n\nd.\nCarry out training, awareness-raising, and consolidation processes for\nsmall-scale artisanal fisheries sector organizations, through\nthe training of fishers, on regulatory and technical aspects\nof the FAO Code of Conduct for Responsible Fisheries, more environmentally friendly fishing methods and\ngear, environmental education, technical-administrative, operational matters, and fishing\ninfrastructure.\n\ne. Develop productive alternatives that contribute to improving the socioeconomic condition and\nhuman development of the fishers of the AMPR D/Paquera-Tambor, and at the same time reduce fishing\neffort.\n\nf.\nArticulate the participation (technical and financial cooperation, promotion of\ncompetitiveness) of diverse public-private actors, linked to\nthe development of fisheries and aquaculture, as strategic partners for\nthe development of the Responsible Fishing Marine Area of the Paquera-Tambor District.\n\n-\nProposed goals.\n\na.\nMarine zoning established in the Fisheries Management Plan of the Responsible Fishing\nMarine Area of the Paquera-Tambor District.\n\nb.\nRegulatory measures updated based on the results derived from the\nresearch and monitoring of catches with the\nfishing gear and methods established in the POP-AMPR-D. Prohibited gear: All types of nets (gillnets, trawl nets, trammel nets, cast nets, among others), also all gear classified as active (except purse seine with mesh opening size ≥ 2½ inches). 3. Allowable fishing methods: Manual and artisanal hook and line and purse seine. 4. Prohibited methods: All those not mentioned in point 3. 5. Existing artisanal vessels may operate, provided they meet the requirements established in the POP and the regulations in force. 6. No new artisanal fishing permits will be granted in the AMPR. 7. The operation of purse seine vessels in this zone is restricted to those with a length of less than 15 m, whose base port is within the Gulf of Nicoya. The number of vessels and their characteristics will be subject to the provisions of the specific regulations established for this fishery.  | 1. Prohibited gear: All types of nets (except cast net with mesh opening size ≥ 2½ inches), trawl nets, trammel nets, gillnets, among others, also all gear classified as active. 3. Allowable fishing methods: Manual and artisanal hook and line, handline, cast net, trap, without the use of compressed air equipment or self-contained underwater breathing apparatus. 4. Prohibited methods: All those not mentioned in point 3. 5. Existing artisanal vessels may operate, provided they meet the requirements established in the POP and the regulations in force. 6.
