  "body_es_text": "en la totalidad del texto\n\n                    -\n\n                        Texto Completo Norma 38665\n\n                        Crea Comisión de alto nivel para la ejecución del Programa Integral de\nAbastecimiento de Agua para Guanacaste (Pacífico Norte)\n\nTexto Completo acta: FEF83\n\nN° 38665-MP-MIDEPLAN-MINAE-MAG\n\nEL PRESIDENTE DE LA REPÚBLICA,\n\nEL MINISTRO DE LA PRESIDENCIA, LA MINISTRA DE\n\nPLANIFICACIÓN NACIONAL Y POLÍTICA ECONÓMICA,\n\nEL MINISTRO DE AGRICULTURA Y GANADERÍA\n\nY EL MINISTRO DE AMBIENTE Y ENERGÍA\n\nEn el ejercicio de las facultades que les confieren los artículos 140,\nincisos 3) y 18) y 146 de la Constitución Política; el artículo 28, párrafo 2\ninciso b) de la ley Nº 6227, que es Ley General de la Administración Pública\ndel 2 de mayo de 1978; el artículo 2º inciso c) Ley Orgánica del Ambiente Nº\n7554, del 4 de octubre de 1995; Ley de Aguas Nº 276, del 27 de agosto de 1942,\nLey 6877 de 18 de julio de 1983, Ley de Creación del Servicio Nacional de Aguas\nSubterráneas Riego y Avenamiento, el Título III de la Ley Nº 7064 del 29 de\nabril de 1987, Ley de Fomento a la Producción Agropecuaria FODEA.\n\n \n\nConsiderando:\n\n \n\n1º-Que es de vital importancia la adecuada y obligada coordinación entre\nlas entidades e instituciones del Estado que tienen competencia en el manejo y\nconservación de los recursos hídricos, siendo la coordinación entre\ninstituciones públicas un medio para preservar y garantizar los derechos\nfundamentales de las personas, a través de una acción administrativa bien\norientada, eficiente y eficaz.\n\n2º-Que mediante los Decretos Ejecutivos Nº 34678-MP-MINAE-MAG, Nº\n34679-MP-MINAE y 34677-MP-MAG-MINAE, fueron declarados de Interés Público y\nConveniencia Nacional los Proyectos denominados \"Presa-Embalse regulatorio del\ncanal del oeste del Distrito de Riego Arenal-Tempisque, identificado como\n\"Embalse Piedras\", el de \"Abastecimiento de Agua Potable para la Margen\nOccidental del Río Tempisque a partir del Sistema Arenal\" y la \"Presa Embalse\nLa Cueva\".\n\n3º-Que es fundamental para el Estado costarricense ordenar el\naprovechamiento de los recursos hídricos en las cuencas hidrológicas Número\n74-19 Río Tempisque, Número 69-18 Ríos de la Península, Número 76-20 Río\nBebedero, Número 78-21 Río Abangares que integran la Vertiente Pacífico Norte,\npara asegurar la sostenibilidad de su desarrollo económico, social y ambiental.\n\n4º-Que el Gobierno de la República ha relanzado el \"Programa Integral\npara el Abastecimiento de Agua para Guanacaste (Pacífico Norte)\", integrado por\nuna serie de acciones estratégicas para el desarrollo de infraestructura y\ngestión de conservación y uso eficiente del agua para mejorar el acceso de este\nrecurso en el inmediato, corto, mediano y largo plazo a la población de la\nzona. Por lo que se procura mejorar las condiciones de vida de los habitantes\nde la Vertiente Pacífico Norte, ya que ésta es una de las zonas de menor\nriqueza hídrica del país y pese a que todo su territorio está irrigado por\nríos, el caudal de su red hidrográfica, dominada por el río Tempisque y sus\nafluentes, disminuye notablemente durante la estación seca, que se prolonga, en\ngeneral, por cinco o seis meses al año.\n\n5º-Que en razón de las limitaciones hídricas naturales que posee la\nVertiente Pacífico Norte, aunado a la necesidad de satisfacer la demanda de\ndicho recurso para uso doméstico de las comunidades existentes, el desarrollo\nhabitacional, el desarrollo agropecuario y productivo en general, el\ncrecimiento turístico y las necesidades que deben ser satisfechas; y los\nfenómenos naturales que requieren medidas de adaptación ante el cambio\nclimático, que modifican el patrón de las lluvias y alteran por consiguiente la\nrecarga de los mantos acuíferos, se ha visualizado la necesidad de obtener el\nmáximo aprovechamiento posible de las aguas.\n\n6º-Que el Decreto 38536-MP-PLAN dicta el nuevo reglamento orgánico del\nPoder Ejecutivo y establece la organización del Sistema Nacional de\nPlanificación a través de 14 sectores, siendo uno de ellos el Sector Ambiente,\nEnergía, Mares y Ordenamiento territorial y constituido por el Ministerio de Ambiente\ny Energía (MINAE), Ministerio de Vivienda y Asentamientos Humanos (MIVAH),\nMinisterio de Agricultura y Ganadería (MAG), Ministerio de Obras Públicas y\nTransportes (MOPT), Instituto Costarricense de Turismo (ICT), Instituto\nCostarricense de Electricidad (ICE), Instituto Costarricense de Acueductos y\nAlcantarillados (AYA), Instituto Nacional de Vivienda y Urbanismo (INVU),\nInstituto de Desarrollo Rural (INDER), Instituto Costarricense de Pesca y\nAcuicultura (INCOPESCA), Refinadora Costarricense de Petróleo S. A. (RECOPE),\nComisión Nacional de Prevención de Riesgos y Atención de Emergencias (CNE),\nServicio Nacional de Guardacostas del Ministerio de Seguridad Pública. Además\npor su competencia en materia de agua, para el desarrollo de este programa forma\nparte del sector el Servicio Nacional de Aguas Subterráneas, Riego y\nAvenamiento. Siendo el ministro rector el jerarca del Ministerio de Ambiente y\nEnergía.\n\n7º-Que este \"Programa Integral para el Abastecimiento de Agua para Guanacaste\n(Pacífico Norte)\", tiene como objetivo asegurar el aprovechamiento óptimo del\nrecurso hídrico en la Vertiente Pacífico Norte, para satisfacer las demandas\ndel recurso por parte de las distintas actividades, así como el mejoramiento\ndel acceso al agua en cantidad y calidad adecuada.\n\n8º-Que el \"Programa Integral para el Abastecimiento de Agua para\nGuanacaste (Pacífico Norte)\" está contemplado en el Plan Nacional de Desarrollo\n2015-2018 Alberto Cañas Escalante como un programa específico del Sector de\nAmbiente, Energía, Mares y Ordenamiento Territorial y en el Plan Nacional para\nla Gestión Integrada de los Recursos Hídricos (PNGIRH 2008-2030) ambos bajo la\nRectoría del Ministro de Ambiente y Energía. Por tanto,\n\n \n\nDecretan:\n\nLA CONSTITUCIÓN DE LA COMISIÓN DE ALTO NIVEL\n\nPARA LA EJECUCIÓN DEL PROGRAMA INTEGRAL\n\nDE ABASTECIMIENTO DE AGUA PARA\n\nGUANACASTE (PACÍFICO NORTE)\n\nArtículo 1º-Créase la Comisión de Alto Nivel para la Ejecución del\nPrograma Integral de Abastecimiento de Agua para Guanacaste (Pacífico Norte) en\nadelante COMISIÓN DE ALTO NIVEL, integrada de la siguiente manera:\n\n1.   Ministro (a) de Ambiente y\nEnergía, quien actuará como coordinador;\n\n2.  Ministro (a) de Planificación\nNacional y Política Económica\n\n3.  Ministro (a) de Agricultura y\nGanadería;\n\n4.  Presidente Ejecutivo del\nInstituto Costarricense de Electricidad;\n\n5.  Presidente Ejecutivo del\nInstituto Costarricense de Acueductos y Alcantarillados;\n\n6.  Gerente General del Servicio\nNacional de Aguas Subterráneas, Riego y Avenamiento.\n\nArtículo 2º-Objetivo de la Comisión. Coordinar y apoyar la ejecución del\n\"Programa Integral de Abastecimiento de Agua para Guanacaste (Pacífico Norte)\",\nel cual contará con una Secretaría Técnica para realizar todas las acciones\nnecesarias para el cumplimiento de su objetivo.\n\nArtículo 3º-Funciones de la Comisión de Alto Nivel:\n\n1.  Articular, integrar y\nconciliar las políticas e instrumentos de planificación emitidos en materia\nhídrica; impulsando su implementación a través de las instituciones con las competencias\nen materia hídrica.\n\n2.   Tomar acuerdos y recomendar\nal Presidente de la República las directrices necesarias que aseguren el\ncumplimiento del Programa.\n\n3.  Aprobar el Programa con sus\nrespectivos proyectos y presupuestos suministrados por las instituciones\nresponsables de ejecución.\n\n4.  Coordinar el proceso de\ncumplimiento y evaluación permanente del Programa, que permita ajustar de ser\nnecesario, los lineamientos y el plan de acción para asegurar la efectiva\nejecución del Programa.\n\n5.  Conocer y aprobar los informes\nde avance del Programa que le sean elevados a su consideración por la\nSecretaría Técnica.\n\n6.  Promover y aprobar los\nconvenios interinstitucionales que se requieran para la buena marcha del\nPrograma.\n\n7.  Presentar periódicamente al\nPresidente de la República informes de avance de ejecución del Programa.\n\nLa Comisión de Alto Nivel, a través de su coordinador podrá cuando\nconsidere pertinente, convocar el apoyo técnico de las Universidades Públicas\nsegún sea la temática a tratar.\n\nArtículo 4º-Crease la Secretaría Técnica adscrita al Despacho del\nMinistro de Ambiente en su condición de Rector del Sector Ambiente, Energía,\nMares y Ordenamiento Territorial, con el objetivo de llevar a cabo las acciones\nnecesarias para el cumplimiento del Programa Integral de Abastecimiento de Agua\npara Guanacaste (Pacífico Norte), según lo disponga la Comisión de Alto Nivel y\nestará integrada por los funcionarios que el Jerarca designe de la siguiente\nmanera:\n\n1.  Un representante de la Dirección\nde Agua del MINAE; quien coordinará la Secretaría Técnica.\n\n2.  Un representante del Instituto\nCostarricense de Turismo; (ICT).\n\n3.  Un representante del\nMinisterio de Planificación Nacional y Política Económica (MIDEPLAN).\n\n4.   Un representante del\nInstituto Costarricense de Electricidad; (ICE).\n\n5.  Un representante del Instituto\nCostarricense de Acueductos y Alcantarillados;(AYA).\n\n6.  Un representante de Servicio\nNacional de Aguas Subterráneas, Riego y Avenamiento; (SENARA).\n\n7.  Un representante del Instituto\nMeteorológico Nacional; (IMN).\n\n8.  Un representante de la\nSecretaría Técnica Nacional Ambiental, (SETENA).\n\n9.  Un representante del Sistema\nNacional de las Áreas de Conservación, (SINAC).\n\n10.  Un representante de la\nComisión Nacional de Prevención de Riesgos y Atención de Emergencias, (CNE).\n\n11.  Un representante del\nInstituto de Fomento y Asesoría Municipal (IFAM).\n\nArtículo 5º-Funciones de la Secretaría Técnica:\n\na.  Elaborar y diseñar el\ncontenido del Programa con sus respectivos proyectos, presupuestos e\ninstituciones responsables para la implementación efectiva del mismo y someterlo\na aprobación de la Comisión de Alto Nivel.\n\nb.  Elaborar la hoja de ruta para\nla ejecución del programa.\n\nc.  Dar seguimiento a la ejecución\ndel Programa aprobado por la Comisión de Alto Nivel.\n\nd.  Coordinar con los usuarios de\nagua, municipalidades e instituciones del Estado, así como con las comunidades\nen general, las acciones relacionadas con el uso y aprovechamiento del agua,\nconforme el Programa.\n\ne.   Garantizar la adecuada\ncoordinación intersectorial e interinstitucional, para la atención y\nseguimiento del Programa y hoja de ruta.\n\nf.  Coordinar las actividades\ntécnicas, administrativas y financieras de la Comisión de Alto Nivel.\n\ng.  Evaluar e informar\ntrimestralmente a la Comisión de Alto Nivel sobre el avance de las actividades,\nobras y proyectos, contemplados en el Programa.\n\nh.  Velar porque los proyectos\ncumplan con la normativa y directrices emitidas en la materia.\n\ni.    Realizar inspecciones\nperiódicas debiendo levantar el acta respectiva, a fin de verificar el avance\nde las acciones, obras y proyectos.\n\nArtículo 6º-La Administración Pública Central y Descentralizada, y las\nmunicipalidades de la provincia de Guanacaste de los cantones de Liberia,\nNicoya, Santa Cruz, Bagaces, Carrillo, Cañas, Abangares, Tilarán, Nandayure, La\nCruz, Hojancha y los distritos de Lepanto, Paquera y Cóbano de la provincia de\nPuntarenas, con jurisdicción dentro de los límites de las cuencas hidrológicas\nNúmero 74-19 Río Tempisque, Número 69-18 Ríos de la Península, Número 76-20 Río\nBebedero y Número 78-21 Río Abangares que conforman la Vertiente Pacífico\nNorte, dentro del marco de coordinación interinstitucional, deberán contribuir,\nde acuerdo con las potestades que la legislación vigente les atribuye, en forma\nprioritaria y efectiva, con la colaboración que le requiera la Comisión de Alto\nNivel a fin de contribuir al desarrollo del Programa.\n\nPara el cumplimiento de lo anterior la Comisión de Alto Nivel podrá\nvalorar los casos excepcionales en los que se pueda dejar de aplicar lo dispuesto\nen el artículo 3 de la Directriz Presidencial 9-H, del 14 de julio del 2014 y\nsus modificaciones, en razón de la conveniencia y necesidad, previa\njustificación que deberá venir sustentada por los respectivos Ministros o\nJerarcas y sometida a consideración del Ministro de Hacienda y del Presidente\nde la República.\n\nArtículo 7º-Los entes y órganos públicos dentro de las atribuciones que\nles da el Ordenamiento Jurídico darán un trato prioritario y expedito a los\nprocesos necesarios para la implementación del Programa.\n\nArtículo 8º-Cada Institución que conforma tanto la Comisión de Alto\nNivel como la Secretaría Técnica, con competencias específicas en la aplicación\ny desarrollo de los fines, objetivos y metas del Programa Integral de\nabastecimiento de agua para Guanacaste (Pacífico Norte), pondrá a disposición\nde la misma los recursos necesarios y deberá incorporarlo en los planes\noperativos institucionales, y destinar los recursos presupuestarios y\neconómicos necesarios para atender la realización de sus acciones de acuerdo a\nsu competencia y procedencia legal para el cumplimiento del objetivo señalado\nen este Decreto.\n\nArtículo 9º-Con el fin de promover la consulta y participación ciudadana\nen la ejecución del Programa Integral de Abastecimiento de Agua para Guanacaste\nse promoverán comisiones de diálogo con los diputados, gobiernos locales y\nsociedad civil.\n\nArtículo 10.-Deróguense el Decreto Ejecutivo Nº 36008-MP-MAG-MINAET\npublicado en La Gaceta 98 del 21 de mayo del 2010 y el Decreto Ejecutivo\n37987-MP-MINAE-PLAN-MAG, publicado en La Gaceta 207 del 28 de octubre del 2013.\n\nArtículo 11.-Rige a partir de su publicación.\n\nDado en la Presidencia de la República, a los ocho días del mes de\noctubre del dos mil catorce.",
  "body_en_text": "in the entirety of the text\n\n                    -\n\n                        Full Text of Norm 38665\n\n                        Creates a High-Level Commission for the Execution of the Comprehensive Program for\nWater Supply for Guanacaste (North Pacific)\n\nFull Text of record: FEF83\n\nNo. 38665-MP-MIDEPLAN-MINAE-MAG\n\nTHE PRESIDENT OF THE REPUBLIC,\n\nTHE MINISTER OF THE PRESIDENCY, THE MINISTER OF\n\nNATIONAL PLANNING AND ECONOMIC POLICY,\n\nTHE MINISTER OF AGRICULTURE AND LIVESTOCK\n\nAND THE MINISTER OF ENVIRONMENT AND ENERGY\n\nIn the exercise of the powers conferred upon them by Articles 140, subsections 3) and 18) and 146 of the Political Constitution; Article 28, paragraph 2, subsection b) of Law No. 6227, which is the General Law of Public Administration of May 2, 1978; Article 2, subsection c) of the Organic Law of the Environment No. 7554, of October 4, 1995; Water Law No. 276, of August 27, 1942, Law 6877 of July 18, 1983, Law Creating the National Service of Groundwater, Irrigation and Drainage (Servicio Nacional de Aguas Subterráneas Riego y Avenamiento), Title III of Law No. 7064 of April 29, 1987, Law for the Promotion of Agricultural Production FODEA.\n\n \n\nConsidering:\n\n \n\n1º-That the adequate and mandatory coordination between State entities and institutions that have competence in the management and conservation of water resources is of vital importance, with coordination among public institutions being a means to preserve and guarantee the fundamental rights of individuals, through well-directed, efficient, and effective administrative action.\n\n2º-That through Executive Decrees No. 34678-MP-MINAE-MAG, No. 34679-MP-MINAE, and 34677-MP-MAG-MINAE, the Projects called \"Regulatory Reservoir-Dam of the western canal of the Arenal-Tempisque Irrigation District, identified as 'Embalse Piedras'\", the \"Potable Water Supply for the Western Margin of the Tempisque River from the Arenal System\", and the \"La Cueva Reservoir-Dam\" were declared of Public Interest and National Convenience.\n\n3º-That it is fundamental for the Costa Rican State to order the use of water resources in hydrological basins Number 74-19 Tempisque River, Number 69-18 Rivers of the Peninsula, Number 76-20 Bebedero River, Number 78-21 Abangares River that make up the North Pacific Watershed (Vertiente Pacífico Norte), to ensure the sustainability of its economic, social, and environmental development.\n\n4º-That the Government of the Republic has relaunched the \"Comprehensive Program for Water Supply for Guanacaste (North Pacific)\" (Programa Integral para el Abastecimiento de Agua para Guanacaste (Pacífico Norte)), composed of a series of strategic actions for infrastructure development and management for water conservation and efficient use to improve access to this resource in the immediate, short, medium, and long term for the population of the area. Therefore, it seeks to improve the living conditions of the inhabitants of the North Pacific Watershed, since this is one of the areas of least water wealth in the country and, despite the fact that its entire territory is irrigated by rivers, the flow of its hydrographic network, dominated by the Tempisque River and its tributaries, decreases notably during the dry season, which generally lasts for five or six months of the year.\n\n5º-That due to the natural water limitations of the North Pacific Watershed, coupled with the need to satisfy the demand for said resource for domestic use in existing communities, housing development, agricultural and productive development in general, tourism growth and the needs that must be met; and the natural phenomena that require adaptation measures in the face of climate change, which modify rainfall patterns and consequently alter the recharge of aquifers (mantos acuíferos), the need to obtain the maximum possible use of the waters has been envisioned.\n\n6º-That Decree 38536-MP-PLAN dictates the new organic regulation of the Executive Branch and establishes the organization of the National Planning System through 14 sectors, one of them being the Environment, Energy, Seas and Territorial Planning Sector, composed of the Ministry of Environment and Energy (MINAE), the Ministry of Housing and Human Settlements (MIVAH), the Ministry of Agriculture and Livestock (MAG), the Ministry of Public Works and Transportation (MOPT), the Costa Rican Tourism Institute (ICT), the Costa Rican Electricity Institute (ICE), the Costa Rican Institute of Aqueducts and Sewers (AYA), the National Housing and Urbanism Institute (INVU), the Rural Development Institute (INDER), the Costa Rican Institute of Fisheries and Aquaculture (INCOPESCA), the Costa Rican Petroleum Refinery S. A. (RECOPE), the National Commission for Risk Prevention and Emergency Response (CNE), the National Coast Guard Service of the Ministry of Public Security. Furthermore, due to its competence in water matters, for the development of this program the National Service of Groundwater, Irrigation and Drainage is part of the sector. The presiding minister being the head of the Ministry of Environment and Energy.\n\n7º-That this \"Comprehensive Program for Water Supply for Guanacaste (North Pacific)\", has the objective of ensuring the optimal use of the water resource in the North Pacific Watershed, to satisfy the demands for the resource from the different activities, as well as the improvement of access to water in adequate quantity and quality.\n\n8º-That the \"Comprehensive Program for Water Supply for Guanacaste (North Pacific)\" is contemplated in the National Development Plan 2015-2018 Alberto Cañas Escalante as a specific program of the Environment, Energy, Seas and Territorial Planning Sector and in the National Plan for Integrated Water Resources Management (PNGIRH 2008-2030), both under the Direction of the Minister of Environment and Energy. Therefore,\n\n \n\nThey Decree:\n\nTHE CONSTITUTION OF THE HIGH-LEVEL COMMISSION\n\nFOR THE EXECUTION OF THE COMPREHENSIVE PROGRAM\n\nFOR WATER SUPPLY FOR\n\nGUANACASTE (NORTH PACIFIC)\n\nArticle 1.-The High-Level Commission for the Execution of the Comprehensive Program for Water Supply for Guanacaste (North Pacific) hereinafter HIGH-LEVEL COMMISSION (COMISIÓN DE ALTO NIVEL), is created, composed as follows:\n\n1.   Minister of Environment and Energy, who shall act as coordinator;\n\n2.  Minister of National Planning and Economic Policy\n\n3.  Minister of Agriculture and Livestock;\n\n4.  Executive President of the Costa Rican Electricity Institute;\n\n5.  Executive President of the Costa Rican Institute of Aqueducts and Sewers;\n\n6.  General Manager of the National Service of Groundwater, Irrigation and Drainage.\n\nArticle 2.-Objective of the Commission. To coordinate and support the execution of the \"Comprehensive Program for Water Supply for Guanacaste (North Pacific)\", which shall have a Technical Secretariat (Secretaría Técnica) to carry out all necessary actions for the fulfillment of its objective.\n\nArticle 3.-Functions of the High-Level Commission:\n\n1.  To articulate, integrate, and reconcile the policies and planning instruments issued in water matters; promoting their implementation through the institutions with competencies in water matters.\n\n2.   To make agreements and recommend to the President of the Republic the necessary guidelines that ensure compliance with the Program.\n\n3.  To approve the Program with its respective projects and budgets provided by the institutions responsible for execution.\n\n4.  To coordinate the process of permanent compliance and evaluation of the Program, allowing for the adjustment, if necessary, of the guidelines and the action plan to ensure the effective execution of the Program.\n\n5.  To hear and approve the progress reports of the Program that are submitted for its consideration by the Technical Secretariat.\n\n6.  To promote and approve the inter-institutional agreements required for the smooth running of the Program.\n\n7.  To periodically present to the President of the Republic reports on the progress of the Program’s execution.\n\nThe High-Level Commission, through its coordinator, may, when deemed pertinent, convene the technical support of the Public Universities according to the subject matter to be addressed.\n\nArticle 4.-The Technical Secretariat attached to the Office of the Minister of Environment, in their capacity as Head of the Environment, Energy, Seas and Territorial Planning Sector, is created, with the objective of carrying out the actions necessary for the fulfillment of the Comprehensive Program for Water Supply for Guanacaste (North Pacific), as provided by the High-Level Commission, and shall be composed of the officials that the Head designates in the following manner:\n\n1.  A representative from the Water Directorate (Dirección de Agua) of MINAE; who shall coordinate the Technical Secretariat.\n\n2.  A representative from the Costa Rican Tourism Institute; (ICT).\n\n3.  A representative from the Ministry of National Planning and Economic Policy (MIDEPLAN).\n\n4.   A representative from the Costa Rican Electricity Institute; (ICE).\n\n5.  A representative from the Costa Rican Institute of Aqueducts and Sewers; (AYA).\n\n6.  A representative from the National Service of Groundwater, Irrigation and Drainage; (SENARA).\n\n7.  A representative from the National Meteorological Institute; (IMN).\n\n8.  A representative from the National Environmental Technical Secretariat, (SETENA).\n\n9.  A representative from the National System of Conservation Areas, (SINAC).\n\n10.  A representative from the National Commission for Risk Prevention and Emergency Response, (CNE).\n\n11.  A representative from the Institute for Municipal Development and Advisory (IFAM).\n\nArticle 5.-Functions of the Technical Secretariat:\n\na.  To elaborate and design the content of the Program with its respective projects, budgets, and responsible institutions for its effective implementation and submit it for approval to the High-Level Commission.\n\nb.  To elaborate the roadmap for the execution of the program.\n\nc.  To follow up on the execution of the Program approved by the High-Level Commission.\n\nd.  To coordinate with water users, municipalities and State institutions, as well as with communities in general, the actions related to the use and utilization of water, pursuant to the Program.\n\ne.   To guarantee adequate intersectoral and inter-institutional coordination, for the attention and follow-up of the Program and roadmap.\n\nf.  To coordinate the technical, administrative, and financial activities of the High-Level Commission.\n\ng.  To evaluate and report quarterly to the High-Level Commission on the progress of activities, works, and projects, contemplated in the Program.\n\nh.  To ensure that the projects comply with the regulations and guidelines issued on the matter.\n\ni.    To carry out periodic inspections, drawing up the respective record (acta), in order to verify the progress of the actions, works, and projects.\n\nArticle 6.-The Central and Decentralized Public Administration, and the municipalities of the province of Guanacaste in the cantons of Liberia, Nicoya, Santa Cruz, Bagaces, Carrillo, Cañas, Abangares, Tilarán, Nandayure, La Cruz, Hojancha and the districts of Lepanto, Paquera and Cóbano of the province of Puntarenas, with jurisdiction within the limits of the hydrological basins Number 74-19 Tempisque River, Number 69-18 Rivers of the Peninsula, Number 76-20 Bebedero River and Number 78-21 Abangares River that make up the North Pacific Watershed, within the framework of inter-institutional coordination, must contribute, in accordance with the powers that current legislation attributes to them, in a priority and effective manner, with the collaboration requested by the High-Level Commission in order to contribute to the development of the Program.\n\nFor the fulfillment of the foregoing, the High-Level Commission may assess the exceptional cases in which the provisions of Article 3 of Presidential Directive 9-H, of July 14, 2014, and its amendments may be waived, due to convenience and need, with prior justification that must be supported by the respective Ministers or Heads and submitted for consideration to the Minister of Finance and the President of the Republic.\n\nArticle 7.-Public entities and bodies, within the attributions granted to them by the Legal System, shall give priority and expeditious treatment to the processes necessary for the implementation of the Program.\n\nArticle 8.-Each Institution that makes up both the High-Level Commission and the Technical Secretariat, with specific competencies in the application and development of the purposes, objectives, and goals of the Comprehensive Program for water supply for Guanacaste (North Pacific), shall make available to it the necessary resources and must incorporate it into the institutional operational plans, and allocate the necessary budgetary and economic resources to attend to the execution of its actions according to its competence and legal origin for the fulfillment of the objective stated in this Decree.\n\nArticle 9.-In order to promote consultation and citizen participation in the execution of the Comprehensive Program for Water Supply for Guanacaste, dialogue commissions shall be promoted with deputies, local governments, and civil society.\n\nArticle 10.-Executive Decree No. 36008-MP-MAG-MINAET published in La Gaceta 98 of May 21, 2010, and Executive Decree 37987-MP-MINAE-PLAN-MAG, published in La Gaceta 207 of October 28, 2013, are hereby repealed.\n\nArticle 11.-It shall be effective as of its publication.\n\nGiven at the Presidency of the Republic, on the eighth day of October, two thousand fourteen."
