de\nalmendro.\n\nConsiderando:\n\nI.-Que la Ley N° 449,\ndispone que el Instituto Costarricense de Electricidad, tiene como\nresponsabilidad fundamental encauzar el aprovechamiento de la energía\nhidroeléctrica con el fin de fortalecer la economía nacional y promover el\nmayor bienestar para el pueblo de Costa Rica, además de dar solución pronta y\neficaz a la escasez de fuerza eléctrica en el país, cuando ella exista, y\nprocurar que haya en todo momento energía disponible para satisfacer la demanda\nnormal y para impulsar el desarrollo de nuevas industrias, el uso de la\nelectricidad en las regiones rurales y su mayor consumo doméstico.\n\nII.-Que de acuerdo\ncon lo indicado en el Plan Nacional de Desarrollo 2011-2014, se tienen como\nmetas estratégicas aumentar la producción y mejorar la competitividad del país,\nasí como consolidar el posicionamiento ambiental con una matriz energética\nsostenible con un 95% de energía eléctrica renovable y un desempeño ambiental\nóptimo.\n\nIII.-Que el \"Proyecto\nLínea de Transmisión Cariblanco- Trapiche (230 kV)\", actualmente en\nconstrucción, cuenta con la Declaratoria de Conveniencia Nacional mediante el\nDecreto Ejecutivo Nº 37681-MINAE del 25 de febrero de 2013, y se constituirá en\nel enlace para la transmisión eléctrica entre la zona atlántica y el centro del\npaís, e interconectar la subestación de Cariblanco (230 kV), General (230 kV),\nLeesville (230 kV) y Trapiche (230 kV), adicionando 155,45 km de líneas de\ntransmisión al Sistema Nacional Interconectado.\n\nIV.-Que para la\nconstrucción de las obras del \"Proyecto Línea de Transmisión Cariblanco -\nTrapiche 230 kV\" y obras asociadas, la Secretaría Técnica Nacional Ambiental\notorgó las siguientes licencias ambientales (viabilidades ambientales):\n\na) EsIA Proyecto\nReconstrucción LT Trapiche-Leesville y Ampliación ST Trapiche. Expediente\nAdministrativo N° 697-2010-SETENA. Resolución N° 888-2011-SETENA\n\nb) EsIA Proyecto LT\nCariblanco-Leesville. Expediente N° 239-2005-SETENA. Resolución N°\n1411-2006-SETENA y Resolución N° 2107-2008-SETENA (prórroga de la Viabilidad\nAmbiental) conocido como LT Cariblanco-PI Sucio.\n\nc) EsIA Proyecto LT\nPI Sucio-PH General. Expediente N° D1- 1542-2008-SETENA. Resolución N°\n872-2011-SETENA.\n\nV.-Que el Proyecto\nLínea de Transmisión Cariblanco- Trapiche (230 kV), es el principal enlace para\nla transmisión y operación del Proyecto Hidroeléctrico Reventazón (292 MW) y su\nintegración con el Sistema Eléctrico Nacional, que forma parte del Plan de\nExpansión de Generación Eléctrica del país.\n\nVI.-Que en el\n\"Proyecto Línea de Transmisión Cariblanco- Trapiche 230 kV\", existe la\nnecesidad de realizar la corta, poda o la eliminación de árboles de cualquier\nespecie en forma racional y proporcionada, tales como especies declaradas en\nveda o en peligro de extinción según el Decreto Ejecutivo N° 25700 y la especie\nAlmendro de montaña (Dipteryx panamensis), Decreto Ejecutivo 25167-MINAE\ny Decreto Ejecutivo 25663-MINAE.\n\nVII.-La especie\nAlmendro de montaña (Dipteryx panamensis) previamente identificada\ndentro del área de influencia directa por el Estudio de Impacto Ambiental de la\nLínea de Transmisión Cariblanco-Trapiche, es una especie que por su altura,\nubicación, condición de copa y crecimiento, presenta condiciones de riesgos\ncomo descargas eléctricas a tierra y desconexión de la línea de transmisión. La\ndistancia entre la copa de los árboles y los cables eléctricos a energizar no\ndebe ser inferior a 5 metros, de lo contrario se producen situaciones de riesgo\nen la salud, la vida de las personas y de la fauna asociada al sitio, producida\npor la entrada en operación del proyecto de transmisión.\n\nVIII.-Que en relación\na las medidas de compensación asociada con la corta de árboles del proyecto LT\nCariblanco-Trapiche, el ICE estableció un convenio con el Fondo Nacional de\nFinanciamiento Forestal para asignar fondos al Sistema de Pago de Servicios\nAmbientales para proyectos de reforestación por un monto de treinta y ocho\nmillones cuatrocientos doce mil ciento cincuenta y ocho colones\n(₡38.412.158,00), lo que indica que bajo dicho convenio se han\nreforestado 69,3 has y se han plantado 60.000 árboles de especies nativas. Las\nedades de las especies oscilan entre uno y dos años.\n\nIX.-Que el artículo 2\ninciso c) de la Ley Orgánica del Ambiente N° 7554 establece que el Estado\nvelará por la utilización racional de los elementos ambientales, con el fin de\nproteger y mejorar la calidad de vida de los habitantes del territorio\nnacional. Asimismo tiene la obligación de propiciar un desarrollo económico y\nambientalmente sostenible, entendido como el desarrollo que satisface las\nnecesidades humanas básicas sin comprometer las opciones de las generaciones\nfuturas. Executive Decree No.\n25167-MINAE of April 23, 1996, Restriction on the timber harvesting of almendro trees; and Executive Decree 25663-MINAE of October 8,\n1996, Restriction on the cutting or harvesting of the almendro tree.\n\nConsidering:\n\nI.-That Law No. 449\nprovides that the Costa Rican Institute of Electricity has as its\nfundamental responsibility to channel the use of hydroelectric\nenergy in order to strengthen the national economy and promote the\ngreatest well-being for the people of Costa Rica, in addition to providing a prompt and\neffective solution to the scarcity of electric power in the country, when it exists, and\nto ensure that energy is available at all times to satisfy normal\ndemand and to promote the development of new industries, the use of\nelectricity in rural regions, and its greater domestic consumption.\n\nII.-That in accordance\nwith what is indicated in the National Development Plan 2011-2014, the strategic\ngoals are to increase production and improve the country's competitiveness,\nas well as to consolidate environmental positioning with a sustainable energy\nmatrix comprising 95% renewable electricity and optimal environmental\nperformance.\n\nIII.-That the \"Cariblanco-Trapiche Transmission Line Project (230 kV)\", currently under\nconstruction, has the Declaration of National Convenience through\nExecutive Decree No. 37681-MINAE of February 25, 2013, and will become\nthe link for electric transmission between the Atlantic zone and the center of the\ncountry, and will interconnect the Cariblanco (230 kV), General (230 kV),\nLeesville (230 kV), and Trapiche (230 kV) substations, adding 155.45 km of transmission\nlines to the National Interconnected System.\n\nIV.-That for the\nconstruction of the works of the \"Cariblanco - Trapiche 230 kV Transmission Line Project\"\nand associated works, the National Environmental Technical Secretariat (SETENA)\ngranted the following environmental licenses (viabilidades ambientales):\n\na) EsIA (Environmental Impact Study) Reconstrucción LT Trapiche-Leesville y Ampliación ST Trapiche Project. The\ndistance between the crown of the trees and the electrical cables to be energized must not\nbe less than 5 meters; otherwise, risk situations arise for\nthe health and life of people and the fauna associated with the site, caused\nby the entry into operation of the transmission project.\n\nVIII.-That in relation\nto the compensation measures associated with the cutting of trees for the LT\nCariblanco-Trapiche project, ICE established an agreement with the National Forestry Financing Fund (Fondo Nacional de Financiamiento Forestal) to allocate funds to the payment for environmental services (Pago de Servicios Ambientales) system for reforestation projects in the amount of thirty-eight\nmillion four hundred twelve thousand one hundred fifty-eight colones\n(₡38,412,158.00), which indicates that under said agreement,\n69.3 ha have been reforested and 60,000 trees of native species have been planted. The\nages of the species range between one and two years.\n\nIX.-That Article 2\nsubsection c) of the Organic Law of the Environment No. 7554 establishes that the State\nshall ensure the rational use of environmental elements, in order to\nprotect and improve the quality of life of the inhabitants of the national\nterritory. Likewise, it has the obligation to promote economically and\nenvironmentally sustainable development, understood as development that satisfies\nbasic human needs without compromising the options of future\ngenerations. Therefore;\n\nThey decree:\n\nAddition and\namendment to Executive Decree No. 37681-MINAE\n\nof February 25, 2013, which Declares\nof National\n\nConvenience and Public Interest the\nconstruction of the\n\n\"Cariblanco-\nTrapiche 230 kv Transmission Line Project,\" its associated works, and\n\nassociated distribution works in\n\nthe construction, operation,\nand maintenance phases\n\nArticle\n1.-Amend Article 2 of Executive Decree No. 37681-MINAE of February 25,\n2013, so that it shall henceforth read as follows:\n\nArticle\n2. By virtue of the declaration of public interest and national convenience\nof the work for the development and construction of the \"Cariblanco - Trapiche 230 kV Transmission Line Project\"\nand associated works, the Costa Rican Institute of Electricity (ICE) may\ncarry out the cutting, pruning, or elimination of trees\nof any species located on forest-covered land (terrenos cubiertos de bosque), provided they are\nnot located within State Natural Heritage (Patrimonio Natural del Estado), land under agricultural use\nwithout forest, and/or protection areas defined in Article 33 of the Forestry Law (Ley Forestal)\nNo. 7575, including trees under a ban (veda) according to DE 25700-MINAE and\nAlmendro de montaña trees (Dipteryx panamensis), whose cutting is\nrestricted by Executive Decrees No. 25167-MINAE of April 23,\n1996, and 25663-MINAE of October 8, 1996.\n\nArticle 2.-It shall become effective upon its publication.\n\nIssued at the Presidency of the Republic.-San José, on the\ntwenty-ninth day of the month of September of two thousand fourteen." }
