De acuerdo a la Ley de Semillas Nº 6289, la\nOficina Nacional de Semillas debe registrar a las personas físicas o jurídicas\nque se dediquen a estas actividades.\n\nSUSTENTO LEGAL:\n\nLey de Semillas Nº 6289.\n\nArtículos 43,44, 47, 48, 50,\n51, 53, 54, 62 a 74 de Reglamento a la Ley de Semillas.\n\nReglamento para la\nImportación, Exportación y Comercialización de Semillas (Aprobado Junta\nDirectiva Sesión 546/24 enero 2005 Acuerdo 2, Artículo 4).\n\nFUNCIONARIOS RESPONSABLES:\n\nEl trámite estará a cargo en\nprimera instancia de la Sra. Cyra Bonilla Cerdas\n(ext.101). Las Sras. Laura Vindas Valverde (ext.106)\ny Vilma Solano Chaves (ext.112), atenderán en segunda instancia.\n\nREQUISITOS: dependiendo\ndel tipo de servicio, deberá aportar en particular la siguiente información y\ncumplir con los siguientes requisitos:\n\nProductores de semillas:\n\nPara obtener la condición de\nproductor de semillas, el interesado llenará el formulario que para tal efecto\nha confeccionado la Oficina Nacional de Semillas suministrando los siguientes\ndatos para cada uno de los lotes que vayan a inscribir en cada ciclo:\n\na) Nombre o razón social del\nsolicitante;\n\nb) Copia del plano\ntopográfico de la propiedad, en el cual se puedan señalar los campos destinados\na la producción de semillas, a criterio de la Oficina Nacional de Semillas;\n\nc) Área destinada a la\nproducción de semillas;\n\nd) Cultivo, variedad a\nreproducir y categoría a inscribir;\n\ne) Variedad y extensión\nsembrada en el período anterior del lote a inscribir;\n\nf) Estimación de las fechas\nde siembra y cosecha\n\nSon obligaciones de los\nproductores de semillas, para obtener tal calificación:\n\na) Presentar la solicitud\ncomo productor de semillas, en el período que para el efecto determine la\nOficina Nacional de Semillas;\n\nb) Mantener la calidad de\nlas semillas acorde con la categoría a producir y el criterio de la Oficina\nNacional de Semillas;\n\nc) Acreditar que dispondrán\nde los lotes inscritos ante la Oficina, por el tiempo necesario para producir\nla semilla;\n\nd) Suministrar a los\ninspectores de la Oficina Nacional de Semillas, la información que requieran en\nel cumplimiento de sus funciones y permitir la toma de muestras por parte de\néstos; y requieran en el cumplimiento de sus funciones y permitir la toma de\nmuestras por parte de éstos; y\n\ne) Ejecutar dentro del período\nestablecido todas las indicaciones que sobre el cultivo le sean presentadas por\nlos inspectores en cada visita a su campo.\n\nSi los cultivos cumplen con\nlas normas y requisitos establecidos, los reproductores, deberán entregar la\ntotalidad de la producción (semilla en bruto) a la empresa que se indica en la\nsolicitud de inscripción, excepto que esta empresa autorice ante la Oficina\nNacional de Semillas, la venta de la misma a otras empresas semilleristas.\n\nProcesadores de semilla:\n\nPara obtener la inscripción\ncomo procesador de semilla, el interesado deberá entregar a la Oficina Nacional\nde Semillas la siguiente información:\n\na) Nombre o razón social y\ndirección del solicitante;\n\nb) Localización de la planta\ndestinada al procesamiento y almacenamiento de semillas;\n\nc) Descripción y capacidad\ndel equipo e instalaciones disponibles para el procesamiento y almacenamiento\nde semillas;\n\nd) Indicación de las\nespecies y variedades que van a procesar;\n\ne) Acompañar el proyecto de\netiquetado y empaque a utilizar; el que será devuelto al interesado una vez que\nhaya sido estudiado por la Oficina Nacional de Semillas;\n\nf) El pago de la tasa\nestipulada; y\n\ng) Cualquier otro dato\nnecesario, a juicio de la Oficina Nacional de Semillas.\n\nPara el procesamiento de\nsemillas deberán cumplirse los siguientes requisitos:\n\na) Poseer el equipo mínimo\nde procesamiento exigido por la Oficina Nacional de Semillas;\n\nb) Contar con las\ninstalaciones adecuadas para el almacenamiento de los materiales procesados;\n\nc) Mantener la\nidentificación y ubicación en el almacén, de los lotes de semillas, según se\nexige en el presente reglamento; y\n\nd) Dirección permanente\nejercida por un asesor técnico en semillas, cuando por la especie en cuestión y\nvolumen sea necesario a juicio de la Oficina Nacional de Semillas.\n\nLos procesadores de semillas\ndeben cumplir con los siguientes requisitos:\n\na) Suministrar a los\ninspectores encargados del control oficial, la información que requieran en el\ncumplimiento de sus funciones y permitir la toma de muestras por parte de\nellos;\n\nb) Ejecutar todas las\nindicaciones que sobre la operación de su planta le sean presentadas por la\nOficina Nacional de Semillas;\n\nc) Enviar a la Oficina\nNacional de Semillas el informe actualizado de sus distribuidores de semilla en\ntodo el país y de sus labores de comercialización. Enviar mensualmente el\ndetalle del movimiento de compra-venta, incluyendo copia de las facturas.\n\nComerciantes de semilla:\n\nPara obtener la inscripción\nen el Registro de Comerciantes de Semilla, los interesados deberán presentar\nsolicitud a la Oficina Nacional de Semillas; indicando:\n\na) Nombre o razón social del\nsolicitante;\n\nb) Nombre y dirección del\nlocal comercial;\n\nc) Categoría de las semillas\nque va a distribuir; e) Descripción de las condiciones y sitios de\nalmacenamiento que garantizarán la adecuada conservación de la semilla;\n\nd)\nOrigen de las semillas (país);\n\ne) Descripción de las\ncondiciones y sitios de almacenamiento que garantizarán la adecuada\nconservación de la semilla;\n\nf) Los sitios de\nalmacenamiento para su aprobación serán objeto de inspección por la Oficina\nNacional de Semillas;\n\ng) Pago de tasa estipulada;\ny\n\nh) El permiso tendrá\nvigencia por un año.\n\nCumplidos los requisitos\nantes mencionados, la Oficina Nacional de Semillas expedirá el permiso\ncorrespondiente de comercialización.\n\nObligaciones de los\ncomerciantes de semilla:\n\nLos comerciantes de semillas\ndeben cumplir con las siguientes obligaciones:\n\na) Mantener las semillas en\ncondiciones de almacenamiento que eviten la alteración\n\nde los atributos de calidad,\nde acuerdo al análisis oficial que indica la etiqueta;\n\nb) Comercializar únicamente\nsemillas de variedades inscritas en aquellos cultivos\n\nque así se determine;\n\nc) Permitir las visitas de\ncontrol y toma de muestras que la Oficina Nacional de Semillas\n\nconsidere conveniente;\n\nd) Suministrar a la Oficina\nNacional de Semillas la información que ésta requiera;\n\ne) Llevar un control de\ncomercialización de semilla, según lo establezca la Oficina\n\nNacional de Semillas tales\ncomo número de factura, vendedor, comprador, número de\n\nlote, variedad y cantidad\nvendida;\n\nf) No podrán vender semilla\nviolando lo dispuesto en el siguiente reglamento; y\n\ng) Todo comerciante de\nsemillas será directamente responsable del cumplimiento de\n\nlas normas establecidas para\ntal efecto.\n\nImportadores de Semillas:\n\nToda persona física o\njurídica que importe semillas al país, deberá estar debidamente inscrita ante\nla Oficina Nacional de Semillas.\n\nPara obtener la inscripción\ncomo portador de semillas, el interesado deberá formular solicitud ante la\nOficina Nacional de Semillas con la siguiente información:\n\na) Nombre o razón social,\nidentificación y dirección del peticionario;\n\nb) Firma responsable\ndebidamente autenticada; y\n\nc) Semillas a importar y fin\ncon que se importan.\n\nLa importación de semilla\nsólo podrá hacerse con la autorización expresa de la Oficina Nacional de\nSemillas atendiendo el interés nacional.\n\nLas semillas sujetas a\nimportación cumplirán con los siguientes requisitos:\n\na) Las normas fitosanitarios\nestablecidas por la Dirección de Sanidad Vegetal del Ministerio de Agricultura\ny Ganadería;\n\nb) Las normas de calidad\npara el cultivo que haya establecido la Oficina Nacional de Semillas en la\ncategoría correspondiente;\n\nc) Las semillas para fines experimentales\ncomprobados, requieren autorización previa de la Oficina Nacional de Semillas;\ny\n\nd) Los que establezca la\nOficina Nacional de Semillas en el cumplimiento de sus funciones. La\nexportación de semillas; sólo podrá hacerse con la autorización de la Oficina\nNacional de Semillas atendiendo el interés público nacional.\n\nExportadores\nde semillas:\n\nLa exportación de semillas;\nsólo podrá hacerse con la autorización de la Oficina Nacional de Semillas\natendiendo el interés público nacional.\n\nLos exportadores de semillas\ndeberán registrarse ante la Oficina Nacional de Semillas, mediante solicitud\nque indicará lo siguiente:\n\na) Nombre o razón social y\ndirección del peticionario;\n\nb) Firma del responsable\ndebidamente autenticada; y\n\nc) La Oficina Nacional de\nSemillas hará las excepciones que considere necesarias.\n\nTRÁMITE:\n\n1) El usuario debe presentar\nel formulario de \"Registro de Usuario de Servicios\", debidamente completo con\nla información requerida y el pago correspondiente.\n\n \n\nNota:\n\ni)\nSi es persona jurídica: Detallar claramente el nombre y número de cédula del\nrepresentante legal y presentar una personería jurídica. También se puede\nentregar una copia del original verificada por el funcionario. Debe observarse\nque el número de cédula presente doce dígitos (sin guiones).\n\nii)\nSi es Persona Física: copia de la cédula de identidad. (Debe especificar nueve\ndígitos y ceros en lugar de guiones).\n\niii) La suma a cancelar es\nde ¢55.000,00 para productores, comercializadores, importadores y exportadores.\nLas empresas procesadoras deberán cancelar ¢365.000,00 por planta acondicionadora.\n\n \n\nEl dinero se puede recibir\npor cualquiera de las siguientes opciones:\n\na)\nDirectamente en sus instalaciones (Avenida 8 Calles 21-25, San José).\n\nb) Mediante depósito\nbancario o transferencia electrónica en cualquiera de las siguientes cuentas\ncorrientes a nombre de la Oficina Nacional de Semillas:\n\n \n\nb1- Bco. Send monthly the\ndetail of the purchase-sale movement, including copies of the invoices.\n\nSeed Merchants:\n\nTo obtain registration\nin the Seed Merchants Registry, interested parties must submit an\napplication to the National Seed Office, indicating:\n\na) Name or corporate name of the\napplicant;\n\nb) Name and address of the\ncommercial premises;\n\nc) Category of the seeds\nto be distributed; e) Description of the storage conditions and sites\nthat will guarantee the adequate preservation of the seed;\n\nd)\nOrigin of the seeds (country);\n\ne) Description of the\nstorage conditions and sites that will guarantee the adequate\npreservation of the seed;\n\nf) The storage sites,\nfor their approval, will be subject to inspection by the National Seed Office;\n\ng) Payment of the stipulated fee;\nand\n\nh) The permit will be\nvalid for one year.\n\nOnce the aforementioned\nrequirements are met, the National Seed Office will issue the corresponding\nmarketing permit.\n\nObligations of Seed\nMerchants:\n\nSeed merchants\nmust comply with the following obligations:\n\na) Keep the seeds in\nstorage conditions that prevent the alteration\n\nof quality attributes,\naccording to the official analysis indicated on the label;\n\nb) Market only\nseeds of registered varieties for those crops\n\nso determined;\n\nc) Allow control visits\nand sample taking that the National Seed Office\n\ndeems appropriate;\n\nd) Provide the National Seed Office with the information it requires;\n\ne) Keep a record of seed\nmarketing, as established by the National Seed Office,\n\nsuch as invoice number, seller, buyer, lot\n\nnumber, variety, and quantity sold;\n\nf) They may not sell seeds\nin violation of the provisions of the following regulation; and\n\ng) Every seed merchant\nwill be directly responsible for compliance with\n\nthe standards established for this purpose.\n\nSeed Importers:\n\nAny individual or legal entity\nthat imports seeds into the country must be duly registered with\nthe National Seed Office.\n\nTo obtain registration\nas a seed importer, the interested party must submit an application to the\nNational Seed Office with the following information:\n\na) Name or corporate name,\nidentification, and address of the applicant;\n\nb) Duly authenticated responsible\nsignature; and\n\nc) Seeds to import and the purpose\nfor which they are imported.\n\nSeed importation\nmay only be carried out with the express authorization of the National Seed\nOffice, considering the national interest.\n\nSeeds subject to\nimportation will comply with the following requirements:\n\na) The phytosanitary standards\nestablished by the Dirección de Sanidad Vegetal of the Ministerio de Agricultura\ny Ganadería;\n\nb) The quality standards\nfor the crop that the National Seed Office has established for the\ncorresponding category;\n\nc) Seeds for verified experimental purposes\nrequire prior authorization from the National Seed Office; and\n\nd) Those established by the\nNational Seed Office in the performance of its duties.
