Directores que responde a las\nnecesidades y requerimientos solicitados por éste Órgano Colegiado, razón por\nla cual, la Junta Directiva. Por tanto,\n\nACUERDA:\n\n1º-Aprobar el Reglamento de Operatividad de la\nComisión Nacional de Pesca Deportiva Turística, en los siguientes términos y\ncondiciones:\n\nREGLAMENTO DE OPERATIVIDAD DE LA COMISIÓN\n\nNACIONAL DE PESCA DEPORTIVA-TURÍSTICA\n\ntext-align:center'>CAPÍTULO I\n\nDisposiciones generales\n\nArtículo\n1º-Este reglamento tiene por objeto regular la operatividad de la Comisión Nacional\nde Pesca Deportiva Turística (en adelante CNPDT), del Instituto Costarricense\nde Pesca y Acuicultura con el propósito de lograr eficiencia y productividad en\nsu accionar, así como dar cumplimiento y asesorar al órgano ejecutor de la Ley\nde Pesca y Acuicultura, en la promoción, fomento y desarrollo de la actividad\nde pesca deportiva y turística, de conformidad con lo dispuesto en los\ncapítulos VII y IX de esa Ley.\n\nCAPÍTULO II\n\nConformación, deberes y responsabilidades\n\nde los miembros de la CNPDT\n\nArtículo 2º-La CNPDT será conformada mediante acuerdo\nde Junta Directiva del INCOPESCA, de la siguiente manera:\n\n1- Un representante\ny su suplente de los pescadores deportivos y/o turísticos del Pacífico Central.\n\n2- Un\nrepresentante y su suplente de los pescadores deportivos y/o turísticos del\nPacífico Norte.\n\n3- Un\nrepresentante y su suplente de los pescadores deportivos y/o turísticos del\nPacífico Sur.\n\n4- Un\nrepresentante y su suplente de los pescadores deportivos y/o turísticos de la\nzona Atlántica.\n\n5- Un representante y su suplente del Instituto\nNacional de Aprendizaje (INA).\n\n6- Un representante y su suplente del Instituto\nCostarricense de Turismo (ICT).\n\n7- Un representante y su suplente del Club Amateur de\nPesca.\n\n8- Un representante y su suplente del Club Nacional de\nPesca.\n\n9- Un\nrepresentante y su suplente de una Organización No Gubernamental afín a la\nactividad de la pesca deportiva-turística debidamente comprobada.\n\n10- Un representante y su suplente de las Marinas.\n\n11- Dos representantes de la Junta Directiva del\nINCOPESCA.\n\nArtículo 3º-Del Coordinador, Subcoordinador y\nSecretario de la CNPDT. Para la consecución de sus fines y metas, la CNPDT\nde su seno nombrará un Coordinador, Subcoordinador y Secretario, todos éstos mediante\nel voto por mayoría simple de los miembros titulares, en la primera reunión del\naño.\n\nLa\nvigencia de estos nombramientos será por un año calendario, pudiendo ser\nreelectos consecutivamente por períodos interrumpidos.\n\nArtículo 4º-Deberes\ny responsabilidades del Coordinador.\n\n1. Convocar a\nreuniones ordinarias y extraordinarias a todos(as) los(as) miembros de la\nCNPDT, así como a los invitados especiales, si los hubiere, con al menos dos\ndías de anticipación.\n\n2. Solicitar al resto\nde los(as) miembros, por un medio idóneo y con cuatro días de anticipación, los\ntemas a tratar en cada reunión.\n\n3. Preparar la agenda\nque será tratada en cada reunión, la cual tendrá al menos la siguiente\ninformación:\n\n. Comprobación del quórum.\n\n. Aprobación de la\nagenda.\n\n. Aprobación de la\nminuta anterior.\n\n. Correspondencia.\n\n. Informes de los\nmiembros.\n\n. Asuntos varios.\n\n4. Preparar la minuta\nde correspondencia.\n\n5. Moderar las\nreuniones.\n\n6. Conceder la\npalabra en el orden en que le sea solicitada. Toda intervención de otro miembro\ntendrá que esperar hasta que concluya la exposición de la persona que le\nprecedió en la exposición.\n\n7. Velar por el orden\ny el respeto durante las reuniones.\n\nArtículo 5º-Deberes y responsabilidades del\nSubcoordinador.\n\n1.\nSustituir al Coordinador temporal o permanentemente, sea por incapacidad,\nenfermedad, renuncia de éste o destitución por parte de la Junta Directiva del\nINCOPESCA.\n\n2. Coordinar las reuniones de la CNPDT, en ausencia\ndel Coordinador.\n\nArtículo 6º-Deberes y responsabilidades del\nSecretario.\n\n1.\nLlevar las minutas de las reuniones celebradas, para lo cual contará con la\ncolaboración de la Secretaría Técnica de Junta Directiva, concretamente en cuanto\na la custodia y oficialización de los libros que al efecto lleve la CNPDT.\n\n2.\nFirmar conjuntamente con el Coordinador o quien lo sustituya, las minutas de\nlas reuniones de la CNPDT.\n\nArtículo 7º-Deberes y responsabilidades de los(as)\nmiembros (as).\n\n1.\nAsistir puntualmente a las reuniones convocadas por el (la) Coordinador(a).\n\n2.\nJustificar las ausencias con al menos un día de antelación. Si se presentará alguna\nsituación inesperada, que imposibilite comunicarse con la correspondiente\nantelación, deberá hacerla del conocimiento del Coordinador de la CNPDT por el\nmedio más expedito.\n\n3.\nEnviar puntualmente al (ala) Coordinador(a), mediante el sistema más conveniente,\nlos temas de agenda que considere pertinentes, con al menos dos días de\nanticipación a la próxima reunión.\n\n4.\nCumplir con las actividades e informes que se les asignen en los acuerdos de la\nCNPDT, dentro del plazo acordado y debidamente documentados.\n\n5.\nParticipar activamente en el proceso de elaboración, dirección y seguimiento de\nlos planes, actividades o proyectos establecidos en las reuniones.\n\n6.\nGuardar confidencialidad con respecto a los temas que se conozcan en el seno de\nla Comisión, mientras no sean acuerdo firme.\n\nCAPÍTULO III\n\nDe las reuniones de CNPDT\n\nArtículo 8º-La CNPDT, se reunirá una vez al mes,\npreferiblemente los segundos miércoles de cada mes a partir de las 09:00 horas\nen sus reuniones ordinarias y extraordinariamente las veces que sea necesario.\n\nArtículo\n9º-Las reuniones de CNPDT serán presididas por el Coordinador y en su ausencia\npor su orden la presidirá el Subcoordinador, y en el defecto de éste, por\ncualquiera de sus miembros, nombrado ad hoc, para ese fin.\n\nArtículo\n10.-Las reuniones de CNPDT, darán inicio con la presencia de la mitad más uno\nde sus miembros propietarios.\n\nArtículo\n11.-Las reuniones tanto ordinarias como extraordinarias serán privadas y se\npodrá invitar a otras personas o funcionarios del INCOPESCA, cuando así se\nrequiera, para recabar opiniones expertas sobre aspectos especiales que sean\ndel conocimiento de la CNPDT.\n\nCAPÍTULO IV\n\nDe las Minutas de CNPDT\n\nArtículo 12.-De cada reunión se levantará una minuta\nque una vez ratificada por la CNPDT, será pública y contendrá la indicación de\nlas personas asistentes, así como las circunstancias del lugar y hora en que se\ncelebró, los puntos de la agenda, la forma y resultados de la votación y el\ncontenido de los acuerdos.\n\nArtículo\n13.-En el minuta, cuando así lo solicite alguno(a) de sus integrantes, se\nconsignará textualmente su intervención.\n\nArtículo\n14.-Las reuniones se iniciarán con la lectura de la minuta de la reunión\nanterior, procediendo a evaluar el estado de cumplimiento de los acuerdos\ntomados.\n\nArtículo\n15.-Las minutas se aprobarán en la siguiente reunión ordinaria y serán firmadas\npor el Coordinador y el Secretario de la CNPDT. Antes de esa aprobación,\ncarecerán de fuerza los acuerdos tomados en la respectiva reunión, salvo que se\ndispongan como acuerdo firme.\n\nArtículo 16.-Los acuerdos de CNPDT serán tomados por mayoría simple. En\ncaso de empate el Coordinador ejercerá doble voto. Para que un acuerdo quede\naprobado en firme requerirá un mínimo votación favorable de las dos terceras\npartes de los miembros.\n\nArtículo\n17.-Las minutas de la reunión anterior, así como la minuta de correspondencia,\nserán enviadas a los miembros por correo electrónico o en versión de texto, con\ndos días de anticipación.\n\nArtículo\n18.-Los miembros de la CNPDT podrán hacer constar en la minuta su voto\ncontrario al acuerdo adoptado y los motivos que lo justifiquen.\n\nArtículo\n19.-El Coordinador de la CNPDT podrá dar por agotado el tema en discusión y\nsometerlo a votación, si así se requiere, cuando considere que ha sido\nsuficientemente discutido y que no se están aportando elementos nuevos al\ndebate.\n\nArtículo\n20.-La participación de los miembros de CNPDT en los asuntos en discusión, será\npuntual y debidamente fundamentada.\n\nArtículo\n21.-En los asuntos en discusión en los que un miembro de CNPDT esté relacionado\nen alguna forma, deberá inhibirse de conocerlo antes del inicio del debate,\ndejando constancia en la minuta correspondiente. Cuando hubiere motivo de\nabstención podrá también recusarse al miembro de CNPDT.\n\nArtículo\n22.-En la revisión de la minuta cabrá moción de revisión. Dicha moción podrá\nser puesta durante el mismo acto de revisión de la reunión en que se discuta el\ntema o dentro del plazo máximo de dos meses y deberá venir debidamente\nfundamentado. El plazo para resolver la moción será de ocho días.\n\nLas\nrevisiones de forma se comunicarán por escrito a la Secretaria de CNPDT.\n\nCAPÍTULO V\n\nDisposiciones finales\n\nArtículo 23.-La aprobación como las reformas totales o\nparciales de este reglamento serán dispuestas por la Junta Directiva del\nINCOPESCA.\n\nArtículo\n24.-Rige a partir de su publicación.\n\n2º-Publíquese.\n\n3º-Acuerdo firme.",

Therefore,\n\nAGREES:\n\n1º—To approve the Operational Regulations of the\nNational Commission for Sport-Tourism Fishing, in the following terms and\nconditions:\n\nOPERATIONAL REGULATIONS OF THE NATIONAL\n\nCOMMISSION FOR SPORT-TOURISM FISHING\n\ntext-align:center'>CHAPTER I\n\nGeneral Provisions\n\nArticle\n1º—The purpose of these regulations is to govern the operations of the National Commission\nfor Sport-Tourism Fishing (hereinafter CNPDT), of the Costa Rican Institute\nof Fisheries and Aquaculture, with the aim of achieving efficiency and productivity in\nits actions, as well as complying with and advising the executing body of the Fisheries and Aquaculture Law (Ley de Pesca y Acuicultura),\nin the promotion, encouragement, and development of sport and tourism fishing\nactivity, in accordance with the provisions in Chapters VII and IX of that Law.\n\nCHAPTER II\n\nComposition, Duties, and Responsibilities\n\nof the Members of the CNPDT\n\nArticle 2º—The CNPDT shall be composed by agreement\nof the Board of Directors of INCOPESCA, in the following manner:\n\n1- A representative\nand their alternate for sport and/or tourism fishers of the Central Pacific.\n\n2- A\nrepresentative and their alternate for sport and/or tourism fishers of the\nNorth Pacific.\n\n3- A\nrepresentative and their alternate for sport and/or tourism fishers of the\nSouth Pacific.\n\n4- A\nrepresentative and their alternate for sport and/or tourism fishers of the\nAtlantic zone.\n\n5- A representative and their alternate from the National\nInstitute of Learning (INA).\n\n6- A representative and their alternate from the Costa Rican\nTourism Institute (ICT).\n\n7- A representative and their alternate from the Amateur Fishing Club (Club Amateur de Pesca).\n\n8- A representative and their alternate from the National Fishing Club (Club Nacional de Pesca).\n\n9- A\nrepresentative and their alternate from a Non-Governmental Organization related to\nsport-tourism fishing activity, duly accredited.\n\n10- A representative and their alternate from the Marinas.\n\n11- Two representatives from the Board of Directors of\nINCOPESCA.\n\nArticle 3º—On the Coordinator, Sub-coordinator, and\nSecretary of the CNPDT. To achieve its purposes and goals, the CNPDT\nshall appoint from within its membership a Coordinator, Sub-coordinator, and Secretary, all by\na simple majority vote of the full members, at the first meeting of the\nyear.\n\nThe\nterm of these appointments shall be for one calendar year, and they may be\nre-elected consecutively for uninterrupted periods.\n\nArticle 4º—Duties\nand responsibilities of the Coordinator.\n\n1. Call all\nmembers of the\nCNPDT to ordinary and extraordinary meetings, as well as any special guests,\nif there are any, with at least two days' notice.\n\n2. Request from the rest\nof the members, by a suitable means and with four days' notice, the\nagenda items to be addressed at each meeting.\n\n3. Prepare the agenda\nto be addressed at each meeting, which shall contain at least the following\ninformation:\n\n. Verification of quorum.\n\n. Approval of the\nagenda.\n\n. Approval of the\nprevious minutes.\n\n. Correspondence.\n\n. Member\nreports.\n\n. Other matters.\n\n4. Prepare the correspondence\nminutes.\n\n5. Moderate the\nmeetings.\n\n6. Grant the\nfloor in the order in which it is requested. Any intervention by another member\nmust wait until the presentation of the person who\npreceded them in speaking is concluded.\n\n7. Ensure order\nand respect during the meetings.\n\nArticle 5º—Duties and responsibilities of the\nSub-coordinator.\n\n1.\nReplace the Coordinator temporarily or permanently, whether due to incapacity,\nillness, resignation of the Coordinator, or removal by the Board of Directors of\nINCOPESCA.\n\n2. Coordinate the meetings of the CNPDT, in the absence\nof the Coordinator.\n\nArticle 6º—Duties and responsibilities of the\nSecretary.\n\n1.\nTake the minutes of the meetings held, for which purpose they shall have the\ncollaboration of the Technical Secretariat of the Board of Directors, specifically regarding\nthe custody and formalization of the books kept by the CNPDT for this purpose.\n\n2.\nSign, jointly with the Coordinator or whoever acts as their substitute, the minutes\nof the CNPDT meetings.\n\nArticle 7º—Duties and responsibilities of the\nmembers.\n\n1.\nPunctually attend the meetings called by the Coordinator.\n\n2.\nJustify absences with at least one day's notice. If any\nunforeseen situation arises that makes it impossible to communicate with the appropriate\nnotice, they must inform the Coordinator of the CNPDT by the\nmost expeditious means.\n\n3.\nPromptly send the Coordinator, through the most convenient system,\nthe agenda items they consider pertinent, with at least two days'\nnotice before the next meeting.\n\n4.\nComply with the activities and reports assigned to them in the agreements of the\nCNPDT, within the agreed-upon period and duly documented.\n\n5.\nActively participate in the process of preparation, direction, and follow-up of\nthe plans, activities, or projects established in the meetings.\n\n6.\nMaintain confidentiality regarding the matters discussed within the\nCommission, as long as they are not a firm agreement (acuerdo firme).\n\nCHAPTER III\n\nOn the Meetings of the CNPDT\n\nArticle 8º—The CNPDT shall meet once a month,\npreferably on the second Wednesday of each month starting at 09:00 hours,\nfor its ordinary meetings, and extraordinarily as many times as necessary.\n\nArticle\n9º—The CNPDT meetings shall be chaired by the Coordinator, and in their absence,\nin order, by the Sub-coordinator, and failing that, by\nany of its members, appointed ad hoc for that purpose.\n\nArticle\n10.—The CNPDT meetings shall commence with the presence of half plus one\nof its full members.\n\nArticle\n11.—Both ordinary and extraordinary meetings shall be private, and\nother persons or INCOPESCA officials may be invited, when\nrequired, to gather expert opinions on special aspects that are\nbefore the CNPDT.\n\nCHAPTER IV\n\nOn the Minutes of the CNPDT\n\nArticle 12.—Minutes shall be taken of each meeting, which\nonce ratified by the CNPDT, shall be public and shall contain the indication of\nthe persons present, as well as the circumstances of the place and time at which\nit was held, the agenda items, the manner and results of the voting, and the\ncontent of the agreements.\n\nArticle\n13.—In the minutes, when requested by any\nof its members, their intervention shall be recorded verbatim.\n\nArticle\n14.—Meetings shall begin with the reading of the minutes of the previous\nmeeting, proceeding to evaluate the status of compliance with the agreements\nadopted.\n\nArticle\n15.—The minutes shall be approved at the next ordinary meeting and shall be signed\nby the Coordinator and the Secretary of the CNPDT. Prior to such approval,\nthe agreements adopted at the respective meeting shall have no force, unless they\nare established as a firm agreement.\n\nArticle 16.—The CNPDT agreements shall be adopted by a simple majority. In\nthe event of a tie, the Coordinator shall exercise a casting vote. For an agreement to be\nfinally approved, it shall require a minimum favorable vote of two-thirds\nof the members.\n\nArticle\n17.—The minutes of the previous meeting, as well as the correspondence minutes,\nshall be sent to the members by electronic mail or in text format, with\ntwo days' notice.\n\nArticle\n18.—The members of the CNPDT may have their vote\nagainst the adopted agreement and the reasons justifying it recorded in the minutes.\n\nArticle\n19.—The Coordinator of the CNPDT may consider the matter under discussion exhausted and\nput it to a vote, if so required, when they consider that it has been\nsufficiently discussed and that no new elements are being contributed to the\ndebate.\n\nArticle\n20.—The participation of the CNPDT members in the matters under discussion shall be\npunctual and duly substantiated.\n\nArticle\n21.—In matters under discussion in which a CNPDT member is related\nin any way, they must recuse themselves from hearing it before the start of the debate,\nleaving a record in the corresponding minutes. When there is a reason for\nabstention, the CNPDT member may also be challenged.\n\nArticle\n22.—In the review of the minutes, a motion for revision may be made. Said motion may\nbe raised during the same review session of the meeting in which the\nmatter is discussed or within a maximum period of two months, and it must be duly\njustified. The period to resolve the motion shall be eight days.\n\nRevisions\nof form shall be communicated in writing to the Secretary of the CNPDT.\n\nCHAPTER V\n\nFinal Provisions\n\nArticle 23.—The approval as well as the total or partial\namendments of these regulations shall be ordered by the Board of Directors of\nINCOPESCA.\n\nArticle\n24.—It shall enter into force upon its publication.\n\n2º—Let it be published.\n\n3º—Firm agreement."
