  "body_es_text": "en la totalidad del texto\n\n                    -\n\n                        Texto Completo Norma 38790\n\n                        Nombra miembro de la Comisión Nacional para la Gestión de la Biodiversidad\n\nTexto Completo acta: 117FB4\n\nNº\n38790-MINAE \n\n(Este\ndecreto ejecutivo fue derogado por el artículo 1° del decreto ejecutivo N°\n40443 del 19 de mayo de 20017)\n\nEL PRESIDENTE DE LA\nREPÚBLICA \n\nY LA MINISTRA DE\nAMBIENTE Y ENERGÍA \n\nEn uso de las facultades que les confieren los\nartículos 140, incisos 3) y 18), y 146 de la Constitución Política, y la Ley de\nBiodiversidad Nº 7788 del 30 de abril de 1998. \n\nConsiderando: \n\nI.-Que la Ley de Biodiversidad Nº 7788 del 30 de abril\nde 1998, creó la Comisión Nacional para la Gestión de la Biodiversidad como un\nórgano desconcentrado del Ministerio de Ambiente y Energía, con personería\njurídica instrumental. \n\nII.-Que\nla citada Ley le asigna a esa Comisión, funciones referentes a la conservación,\nel uso ecológicamente sostenible y la restauración de la biodiversidad, que son\nde vital importancia para el desarrollo sostenible del país. \n\nIII.-Que\nel artículo 15 de la Ley de Biodiversidad, establece la forma en que se\nintegrará la Comisión, de acuerdo al nombramiento realizado por los entes y\norganizaciones que señala la ley. \n\nIV.-Que\nel Decreto Ejecutivo N° 29680-MINAE del 23 de julio del 2001, publicado en La\nGaceta N° 150 del 7 de agosto del 2001, regula el funcionamiento de esta\nComisión. \n\nV.-Que\nmediante el Decreto Ejecutivo Nº 36806-MINAET del 18 de agosto del 2011,\npublicado en La Gaceta Nº 220 del 16 de noviembre del 2011, se nombró a\nla señora Elizabeth Arnáez Serrano, como representante suplente del Consejo\nNacional de Rectores por un plazo de 3 años, el cual finalizó el 16 de\nnoviembre del 2014. Por tanto, \n\nDecretan: \n\nArtículo 1º-Nombrar como parte de los miembros que\nintegran la Comisión Nacional para la Gestión de la Biodiversidad, al siguiente\nrepresentante del Consejo Nacional de Rectores: \n\n1) Miembro Suplente: \n\na.   "body_en_text": "in the entirety of the text\n\n                    -\n\n                        Complete Text of Regulation 38790\n\n                        Appoints a member of the National Commission for Biodiversity Management\n\nComplete Text record: 117FB4\n\nNo.\n38790-MINAE \n\n(This\nExecutive Decree was repealed by Article 1 of Executive Decree No.\n40443 of May 19, 2017)\n\nTHE PRESIDENT OF THE\nREPUBLIC \n\nAND THE MINISTER OF\nENVIRONMENT AND ENERGY \n\nExercising the powers conferred by\nArticles 140, subsections 3) and 18), and 146 of the Political Constitution, and the Biodiversity\nLaw No. 7788 of April 30, 1998. \n\nWhereas: \n\nI.-That the Biodiversity Law No. 7788 of April 30,\n1998, created the National Commission for Biodiversity Management as a\ndeconcentrated body of the Ministry of Environment and Energy, with instrumental legal\npersonality. \n\nII.-That\nthe aforementioned Law assigns to that Commission functions concerning the conservation,\necologically sustainable use, and restoration of biodiversity, which are\nof vital importance for the country's sustainable development. \n\nIII.-That\nArticle 15 of the Biodiversity Law establishes the manner in which\nthe Commission shall be composed, according to the appointments made by the entities\nand organizations indicated in the law. \n\nIV.-That\nExecutive Decree No. 29680-MINAE of July 23, 2001, published in La\nGaceta No. 150 of August 7, 2001, regulates the operation of this\nCommission. \n\nV.-That\nby means of Executive Decree No. 36806-MINAET of August 18, 2011,\npublished in La Gaceta No. 220 of November 16, 2011, Ms. Elizabeth Arnáez Serrano was appointed as the alternate representative of the National Council of Rectors for a term of 3 years, which ended on November 16,\n2014. Therefore, \n\nThey Decree: \n\nArticle 1-To appoint as part of the members\ncomprising the National Commission for Biodiversity Management, the following\nrepresentative of the National Council of Rectors: \n\n1) Alternate Member: \n\na. Elizabeth Arnáez Serrano, identification number:\none-five hundred twenty-nine-four hundred eighteen.\n\nArticle 2-For the purposes of the term set forth in Article 15 of\nthe Biodiversity Law, the appointment is made for a complete period of\nthree years.\n\nArticle\n3-Hereby repealed: \n\n1)\nExecutive Decree No. 36806-MINAET of August 18, 2011, published in La\nGaceta No. 220 of November 16, 2011.\n\nArticle 4-This Decree enters into force upon its publication. \n\nExecuted at the Presidency of the Republic.-San José, at nine o'clock in the morning on\nNovember seventeenth, two thousand fourteen."
