Requisitos para el Registro\", que a continuación se transcriben:\n\nRESOLUCIÓN N°\n346-2014 (COMIECO-LXVIII)\n\nEL CONSEJO DE\nMINISTROS\n\nDE INTEGRACIÓN ECONÓMICA\n\nConsiderando:\n\nQue de conformidad\ncon los artículos 38, 39 y 55 del Protocolo al Tratado General de Integración Económica\nCentroamericana -Protocolo de Guatemala-, modificado por la Enmienda del 27 de\nfebrero de 2002, el Consejo de Ministros de Integración Económica tiene bajo su\ncompetencia los asuntos de la Integración Económica Centroamericana y, como\ntal, le corresponde aprobar los actos administrativos del Subsistema Económico;\n\nQue de acuerdo con el\nartículo 15 de ese mismo instrumento jurídico regional, los Estados Parte\ntienen el compromiso de constituir una Unión Aduanera entre sus territorios, la\nque se alcanzará de manera gradual y progresiva, sobre la base de programas que\nse establezcan al efecto, aprobados por consenso;\n\nQue en el marco del\nproceso de conformación de la Unión Aduanera, los Estados Parte han alcanzado importantes\nacuerdos en materia de requisitos para el registro de plaguicidas botánicos de\nuso agrícola, que requieren la aprobación del Consejo;\n\nQue los Estados\nParte, en su calidad de Miembros de la Organización Mundial del Comercio (OMC),\nnotificaron al Comité de Obstáculos Técnicos al Comercio y al Comité de Medidas\nSanitarias y Fitosanitarias, de conformidad con lo establecido en el Acuerdo\nsobre Obstáculos Técnicos al Comercio y el Acuerdo sobre Medidas Sanitarias y\nFitosanitarias, el Proyecto de Reglamento Técnico Centroamericano RTCA\n65.05.62:11 Plaguicidas Botánicos de Uso Agrícola. Requisitos para el Registro;\n\nQue los Estados\nParte, concedieron un plazo prudencial a los Estados Miembros de la OMC para\nhacer observaciones al proyecto de Reglamento notificado tal y como lo exige el\nnumeral 4), párrafo 9 del artículo 2 del Acuerdo sobre Obstáculos Técnicos al\nComercio y el Anexo C, numeral 5 inciso d) del Acuerdo sobre Medidas Sanitarias\ny Fitosanitarias, observaciones que fueron debidamente analizadas y atendidas\nen lo pertinente;\n\nQue de conformidad\ncon el Acuerdo sobre Obstáculos Técnicos al Comercio y el Acuerdo sobre Medidas\nSanitarias y Fitosanitarias, los Miembros preverán un plazo prudencial entre la\naprobación de los reglamentos técnicos y su entrada en vigor, con el fin de dar\ntiempo a los productores para adaptar sus productos o sus métodos de producción\na lo establecido en los reglamentos;\n\nQue de conformidad\ncon el párrafo 3 del artículo 55 del Protocolo de Guatemala, se recabó la\nopinión del Comité Consultivo de Integración Económica,\n\nPor tanto:\n\nCon fundamento en lo\ndispuesto en los artículos 1, 3, 5, 7, 15, 26, 30, 36, 37, 38, 39, 46, 52 y 55\ndel Protocolo al Tratado General de Integración Económica Centroamericana\n-Protocolo de Guatemala,\n\nRESUELVE:\n\n1. Requisitos para el Registro, por el Subgrupo de Medidas de\nNormalización e Insumos Agropecuarios. La oficialización de este reglamento\ntécnico, conlleva la ratificación por el Consejo de Ministros de Integración\nEconómica Centroamericana (COMIECO).\n\nMIEMBROS\nPARTICIPANTES DEL COMITÉ\n\nPor El Salvador:\n\nMAG\n\nPor Guatemala:\n\nMAGA\n\nPor Nicaragua:\n\nIPSA\n\nPor Costa Rica:\n\nSFE-MAG\n\nPor Honduras:\n\nSAG-SENASA\n\nPor Panamá:\n\nMIDA\n\n1. OBJETO\n\nEstablecer los\nrequisitos para otorgar el registro de plaguicidas botánicos de uso agrícola.\n\n2. CAMPO DE\nAPLICACIÓN\n\nAplica al registro\nplaguicidas botánicos de uso agrícola, que sean fabricados, formulados,\nenvasados, reempacados o reenvasados, importados, exportados, distribuidos y\ncomercializados en los Estados Parte de la Región Centroamericana. Estas\nactividades serán reguladas conforme a la normativa de cada Estado Parte.\n\nSe exceptúa del\nregistro, los plaguicidas botánicos con fines experimentales.\n\n3. DEFINICIONES Y\nTERMINOLOGÍA\n\nPara los efectos de\nla interpretación de este RTCA se tendrá en consideración las definiciones\nsiguientes.\n\n3.1 Actualización de\nregistros: proceso\nmediante el cual los titulares de los registros de plaguicidas botánicos\notorgados antes de la entrada en vigencia del presente reglamento y que se\nencuentren vigentes y los contemplados en el transitorio I y II, aportarán a la\nANC, la información requerida en los mencionados transitorios.\n\n3.2 Autoridad\nNacional Competente (ANC): Ministerio, Secretaría de Agricultura o cualquier otra\nautoridad que por mandato de ley otorgue el registro de plaguicidas botánicos\nde uso agrícola.\n\n3.3 Almacenamiento: acción de almacenar,\nreunir, conservar, guardar o depositar plaguicidas en bodegas, almacenes,\naduanas o vehículos, bajo las condiciones estipuladas en el presente\nreglamento.\n\n3.4 Certificado de\nregistro o libre venta: documento oficial que acredita el registro de un\nplaguicida botánico en el país de origen de la formulación o para su venta o\nuso.\n\n3.5 Eficacia del\nproducto: grado\ndel efecto deseado que tiene un plaguicida botánico en el control de la plaga\nobjetivo.\n\n3.6 Envase o empaque:\nrecipiente\nadecuado que está en contacto directo con el plaguicida botánico para\nconservarlo, identificarlo y que facilite su transporte.\n\n3.7 Etiqueta: material impreso o\ninscripción gráfica, escrito en caracteres legibles, que identifica, enumera\nsus componentes y describe el producto contenido en el envase o empaque que\nacompaña.\n\n3.8 Extracto\nbotánico: sustancias\nderivadas de las diferentes partes de las plantas que tienen propiedades\nbiocidas o repelentes.\n\n3.9 Formulador: persona física\n(natural, individual) o jurídica que se dedica a la elaboración de plaguicidas\nbotánicos de uso agrícola.\n\n3.10 Fabricante: persona física\n(natural, individual) o jurídica que se dedica a la síntesis de extractos\nbotánicos de uso agrícola.\n\n3.11 Ingrediente activo: sustancia con acción\nbiocida o repelente, contenida en el extracto botánico utilizado como insumo\npara formular plaguicidas botánicos de uso agrícola.\n\n3.12 Ingrediente\ninerte: sustancia\nsin acción biocida sobre las plagas o sin efecto sobre el metabolismo de la\nplanta que se utiliza como portador o acondicionador de un plaguicida botánico.\n\n3.13 Marca: cualquier signo\nvisible, apto para distinguir los productos o los servicios de una empresa, con\nrespecto a los productos o servicios de otras empresas.\n\n3.14 Panfleto: material impreso que\nse adhiere al envase de cada presentación comercial de un plaguicida botánico\nde uso agrícola, que contiene información complementaria a la etiqueta.\n\n3.15 Período de\ncarencia: tiempo\nque debe transcurrir entre la última aplicación de un plaguicida botánico y la\ncosecha del cultivo en que se aplicó.\n\n3.16 Período de\nreingreso: tiempo\nque debe transcurrir entre el tratamiento o aplicación de un plaguicida y el\ningreso de personas y animales al área o cultivo tratado.\n\n3.17 Plaga: cualquier especie,\nraza o biotipo vegetal o animal o agente patógeno dañino para las plantas o\nproductos vegetales.\n\n3.18 Producto\nformulado: producto\ncomercial que ha sido preparado a partir de un extracto vegetal más los otros\ncomponentes de la formulación, siguiendo las normas de calidad establecidas.\n\n3.19 Reenvasado o\nreempacado: acción\nde transferir el producto de su envase original a otras presentaciones.\n\n3.20 Regente: profesional en\nciencias agrícolas que asume la responsabilidad técnica en los procesos de\nregistro, uso y comercialización de los plaguicidas botánicos ante la ANC.\n\n3.21 Solicitante: persona\nfísica (natural, individual) o jurídica que solicita a la Autoridad Nacional\nCompetente el registro de un plaguicida botánico de uso agrícola, con fines\ncomerciales.\n\n3.22 Registro: proceso\nadministrativo, técnico y legal mediante el cual toda solicitud de registro de\nun plaguicida botánico es evaluada por la ANC, previo a su inscripción.\n\n3.23 Titular del\nregistro: persona\nfísica (natural, individual) o jurídica, propietaria del registro de un\nplaguicida botánico de uso agrícola, ante la ANC.\n\n4. DISPOSICIONES\nGENERALES\n\n4.1 La persona física\n(natural, individual) o jurídica, que pretenda, fabricar, formular, importar,\nenvasar, reenvasar, reempacar, exportar, almacenar, comercializar, registrar,\nmodificar o renovar el registro de plaguicidas botánicos de uso agrícola, debe\nestar registrado como tal ante la ANC de acuerdo a la legislación vigente de\ncada Estado Parte de la Región Centroamericana.\n\n4.2 Para trámites de\nregistro, el representante legal del titular del registro o solicitante, deberá\ntener domicilio en el territorio nacional.\n\n4.3 Los plaguicidas\nbotánicos de uso agrícola, deberán estar registrados ante la ANC previo a su importación,\nexportación, extracción, formulación, envasado, reenvasado, reempacado o\ncomercialización.\n\n4.4 El expediente de\nregistro de un plaguicida botánico de uso agrícola, debe contener información\nadministrativa y técnica de acuerdo a los requisitos establecidos en el\npresente reglamento.\n\n4.5 La información\ncontenida en los documentos presentados para sustentar un registro y que estén\nredactados en idioma diferente al español, serán admisibles por la ANC\nacompañados de su traducción al idioma español, los documentos indicados en\nnumerales 5.1.b y 5.1.c redactados en idioma diferente al español deberán de\npresentarse con su respectiva traducción oficial al idioma español.\n\n4.6 Si el certificado de\ncomposición cualitativa-cuantitativa contiene información que el solicitante\nconsidera que tiene carácter de confidencialidad, puede solicitarlo ante la\nANC, quien valorará dicha petición, de acuerdo a la legislación que regula esta\nmateria, en cada Estado Parte de la Región Centroamericana.\n\n4.7 El costo del (los)\nanálisis de laboratorio para la obtención del registro, así como el control de\ncalidad serán cubiertos por el solicitante o por el titular del registro.\n\n4.8 La vigencia de los\nregistros de plaguicidas botánicos de uso agrícola, será de diez años a partir\nde la fecha en que se otorgue el registro. Lo establecido en este artículo\naplicará para las renovaciones y aquellos registros de plaguicidas botánicos de\nuso agrícola, que cumplan con lo indicado en el transitorio I, II y III.\n\n4.9 La solicitud de registro\nde un plaguicida botánico de uso agrícola, se aceptará para un solo producto,\nel cual podrá tener una o varias marcas comerciales; un solo formulador y\norigen.\n\n4.10 Todo plaguicida\nbotánico de uso agrícola que sea importado o comercializado en la región debe\ntener adherida o litografiada en su envase o empaque la etiqueta y adherido el\npanfleto, tal como fue aprobada por la ANC.\n\n4.11 Los certificados o\nconstancias, que sustenten la solicitud de registro de un plaguicida botánico\nde uso agrícola, deben haber sido emitidos dentro del plazo de un año, a la\nfecha de su presentación ante la ANC. Estos documentos deben presentarse\ndebidamente legalizados.\n\n4.12 El solicitante debe\njustificar ante la ANC, basado en criterios técnicos y científicos, el no\ncumplimiento de algún requisito de la información estipulada que constituye los\nrequisitos técnicos del producto, cuando demuestre que no aplica. Para el\nefecto la ANC valorará los argumentos bajo criterios técnicos y científicos,\nsegún sea la naturaleza del requisito debiendo notificarlo al solicitante.\n\n4.13 El registrante podrá\nutilizar una marca de un producto registrado por él ante la ANC, para\nidentificar a un plaguicida botánico de uso agrícola, de diferente composición,\nconcentración o formulación cuando seguida de la marca se indique el nombre\ncomún del (los) extracto(s) botánico(s) que contenga(n), la concentración o la\nformulación del producto.\n\n4.14 Se podrá utilizar una\nmarca ya registrada ante la ANC con fines de registro de un plaguicida botánico\npor un tercero, siempre que el propietario de la misma lo autorice.\n\n4.15 La ANC no otorgará el\nregistro de un plaguicida botánico de uso agrícola, cuando:\n\na) No cumpla con lo\nestablecido en el presente reglamento.\n\nb) Un producto con\nuna marca igual a otro ya registrado ante la ANC, que contenga diferente\ningrediente activo en su composición, a excepción de lo indicado en el numeral\n4.13 y 4.14\n\nc) Un producto que\nutilice como marca el(los) nombre(s) común(es) del o los extracto(s)\nbotánico(s), diferentes a los que se describen en la composición\ncualitativa-cuantitativa del producto.\n\nd) Se ha demostrado o\ncomprobado que el uso del producto causa daño a la salud, ambiente y\nagricultura.\n\ne) Se utilice una\nmarca o términos que induzcan a confusión o no correspondan con las\ncaracterísticas o identificación del plaguicida botánico a registrar.\n\n4.16 Cuando se demuestre\nmediante justificación técnica - científica de posible riesgo a la salud,\nambiente y agricultura, la ANC podrá solicitar información adicional al\nsolicitante o al titular del registro. Asimismo requerir dictámenes técnicos de\notras entidades competentes.\n\nLo anterior se podrá\nsolicitar en cualquier etapa del proceso de registro, modificación, renovación\no actualización, inclusive durante la vigencia del registro.\n\n4.17 La solicitud de\nregistro de un plaguicida botánico de uso agrícola deberá acompañarse con tres\ncopias del proyecto de etiqueta y panfleto redactadas en el idioma español.\n\n4.18 La etiqueta y\npanfleto deberá ser aprobada por la ANC previo a la comercialización del\nplaguicida botánico.\n\n4.19 La información de\npropiedades físicas y químicas así como las pruebas de eficacia biológica debe\nsuministrarse a través de datos provenientes de estudios realizados sobre el\nproducto a ser registrado.\n\nLa\ninformación toxicológica y ecotoxicológica debe suministrarse a través de datos\nprovenientes de estudios realizados sobre el producto o el ingrediente activo\ndel extracto botánico a ser registrado, salvo que el solicitante pueda\njustificar basándose en información científica especializada y reconocida\ninternacionalmente, que el uso solicitado de dicho extracto botánico carece de\nefectos nocivos sobre la salud humana o animal, así como de incidencia sobre el\nambiente. Para el efecto la ANC bajo criterios técnico-científicos valorará la\njustificación.\n\nLa ANC podrá aceptar\npara su valoración, datos referenciados provenientes de estudios toxicológicos,\necotoxicológicos, realizados para plaguicidas botánicos formulados ya\nregistrados. Para ello el extracto botánico y los ingredientes inertes del\nproducto a registrar deberán encontrarse dentro de la concentración mínima y\nmáxima reportada en el certificado de composición del producto previamente\nregistrado (producto de referencia), siempre que se cuente con la autorización\ndel titular de esa información o que haya vencido el plazo de protección de\ndatos de dicha información, de conformidad con la legislación interna de cada\nEstado Parte. La empresa registrante podrá justificar técnica y científicamente\nante la ANC las variaciones en las concentraciones del extracto botánico e\nidentidad de los ingredientes inertes, ésta valorará bajo criterios\ntécnico-científicos dicha justificación para determinar si dichas variaciones\nno significan un incremento en el riesgo para la salud humana y el ambiente a\npartir del producto de referencia.\n\n4.20 El extracto botánico\nutilizado para la formulación de plaguicidas botánicos de uso agrícola, deben estar\nregistrados ante la ANC previo a su importación u obtención, debiendo cumplir\ncon los requisitos según el reglamento que se listan a continuación:\n\na) Solicitud.\n\nb) Certificado de\nregistro o libre venta, en original, extendido por la ANC del país de origen\ndel plaguicida botánico o cualquier otra entidad que demuestre que está\nfacultada legalmente para la emisión de los mismos.\n\nEn el caso que el\nproducto no esté registrado o no se comercialice en el país de origen del\nplaguicida botánico, se debe presentar certificado de origen o constancia\nextendida por la ANC o cualquier otra entidad que demuestre que este facultada\nlegalmente para la emisión de la misma, indicando las razones por las cuales el\nproducto no se encuentra registrado o no se comercializa libremente en el país\nde origen del plaguicida botánico o constancia de la ANC que indique que el\ncomercializador está autorizado para dicha actividad.\n\nNOTAS:\n\n1. Cuando estos\ncertificados sean emitidos por única vez por parte de la ANC del país de origen,\nel solicitante podrá presentar fotocopia debidamente legalizada y a la vez\nadjuntar el documento que acredite dicha disposición.\n\n2.\nCuando en estos certificados se incluyen dos o más productos, el solicitante\npodrá entregar fotocopias de los mismos y deberán ser autenticados.\n\nc. Identidad del\nproducto.\n\nd. Certificado de\ncomposición cuali-cuantitativa.\n\ne. Métodos\nanalíticos.\n\nf. Información de\nseguridad.\n\n5. DEL REGISTRO DE\nPLAGUICIDAS BOTÁNICOS\n\n5.1 Se establecen los\nsiguientes requisitos administrativos:\n\na) Solicitud de\nconformidad con el Anexo A (Normativo).\n\nb) Certificado de\nregistro o libre venta, en original, extendido por la ANC del país de origen de\nformulación del plaguicida botánico o cualquier otra entidad que demuestre que\nestá facultada legalmente para la emisión de los mismos.\n\nEn el caso que el\nproducto no esté registrado o no se comercialice en el país de origen de\nformulación del plaguicida botánico, se debe presentar certificado de origen o constancia\nextendida por la ANC o cualquier otra entidad que demuestre que este facultada\nlegalmente para la emisión de la misma, indicando las razones por las cuales el\nproducto no se encuentra registrado o no se comercializa libremente en el país\nde origen de formulación del plaguicida botánico o constancia de la ANC que\nindique que el formulador está autorizado para formular plaguicidas botánicos\nde uso agrícola.\n\nSe exceptúa del\ncumplimiento de este requisito, cuando el plaguicida botánico de uso agrícola\nsea formulado en un Estados Parte de la región centroamericana donde se\npretenda registrar.\n\nNOTAS:\n\n1) Cuando estos\ncertificados sean emitidos por única vez por parte de la ANC del país de\norigen, el solicitante podrá presentar fotocopia debidamente legalizada y a la\nvez adjuntar el documento que acredite dicha disposición.\n\n2) Si en un\ncertificado de registro o libre venta original se incluyen dos o más productos,\nel solicitante podrá entregar fotocopias del certificado original que deberán\nser autenticadas o cotejada con el original en el país donde será registrado.\n\nc) Certificado de\ncomposición, en original, emitido y firmado por el responsable de la\nformulación del producto, indicando el contenido mínimo o máximo del\ningrediente activo, expresado en porcentaje m/m o porcentaje m/v, según el\nestado físico del producto; así como los nombres y concentraciones de los\ningredientes inertes y contaminantes.\n\nd) Certificado de\nanálisis del plaguicida botánico, que reporte la concentración del ingrediente\nactivo, en original, proporcionado por el formulador, de una muestra de un lote\nen particular, firmado por el profesional responsable.\n\ne) Proyecto(s) de\netiqueta(s) y panfleto, según el Anexo B (Normativo). El tamaño de la etiqueta\ndebe ser proporcional al tamaño del envase y su texto de forma legible en\nespañol y autorizada por la ANC.\n\n5.2 Se establecen los\nsiguientes requisitos técnicos:\n\n5.2.1 Identidad del\ningrediente activo del extracto botánico.\n\na) Nombre común y\nsinónimo de la planta de donde se extrae.\n\nb) Nombre científico\ny variedad de la planta de donde se extrae.\n\n5.2.2 Generalidades\ndel producto formulado.\n\na) País de origen del\nextracto botánico.\n\nb) Nombre común y\nquímico cuando corresponda del ingrediente activo.\n\nc) Indicar el nombre\ncomún y químico cuando corresponda de los ingredientes inertes.\n\nd) Indicar la\nconcentración en porcentaje m/m o porcentaje m/v según su estado físico.\n\ne) Describir el\nproceso de formulación.\n\n5.2.3 Propiedades\nfísico-químicas del producto formulado.\n\na) Color.\n\nb) Olor.\n\nc) Estado físico.\n\nd) pH.\n\ne) Estabilidad en\nalmacenamiento y plazo de conservación,\n\ne. 1) Efecto de la\nluz, temperatura y humedad.\n\ne.2)\nPlazo de conservación a la temperatura recomendada.\n\nf) Inflamabilidad.\n\ng) Corrosividad.\n\nh) Granulometría\n(tamaño de partículas en micras para gránulos y polvos).\n\ni) Densidad.\n\nj) Solubilidad.\n\nk) Humectabilidad,\npara polvos humectables.\n\n1) Persistencia de\nespuma (para productos que se aplican con agua).\n\nm) Suspensibilidad\npara polvos humectables y concentrados en solución.\n\nn) Estabilidad en la\nemulsión para concentrados emulsionables.\n\n5.2.4 Aspectos\nrelacionados a la utilidad y aplicación del producto formulado.\n\n5.2.4.1 Uso\nagronómico.\n\na) Ámbito de\naplicación (campo, condiciones controladas).\n\nb) Nombre común y científico\nde los cultivos a proteger.\n\nc) Nombre común y\ncientífico de las plagas a controlar.\n\nd) Tipo de equipo y\nmétodo de aplicación a utilizar.\n\ne) Tipo de boquillas\na utilizar.\n\nf) Forma de\npreparación de la mezcla.\n\ng) Forma de aplicación\n(indicando si el producto va dirigido al suelo, follaje, riego por goteo u\notro).\n\nh) pH óptimo de la\nmezcla a aplicar,\n\ni) Modo y mecanismo\nde acción,\n\nj) Condiciones\nfitosanitarias. Estadíos y niveles de plaga y desarrollo fenológico, en las que\nse recomienda aplicarlo.\n\nk) Condiciones\nambientales para su uso (condiciones de temperatura, humedad u otros).\n\nl) Dosis en\nkilogramos o litros por área y volumen de mezcla a utilizar según el tipo y\nequipo de aplicación.\n\nm) Intervalo de\naplicación.\n\nn) Número máximo de\naplicaciones por ciclo del cultivo.\n\no) Período de\ncarencia (intervalo entre la última aplicación y la cosecha).\n\np) Período de\nreingreso al área tratada.\n\nq) Incompatibilidad\ncon otras sustancias químicas, biológicas y otras biotecnológicas usadas en la\nproducción vegetal.\n\nr) Fitotoxicidad.\n\ns) Para plaguicidas\nformulados que se registren en cualquier Estado Parte de la Región\nCentroamericana, se requerirá la presentación de los resultados de los ensayos\nde eficacia biológica para el control de la(s) plaga(s) solicitadas, realizados\nde acuerdo con el Protocolo Patrón para Ensayo de Eficacia Biológica de\nplaguicidas de uso agrícola vigente.\n\nt) En el caso de\nensayos realizados en el exterior, se aceptarán para su valoración por parte de\nla ANC, aquellos que se hayan conducido en condiciones agroecológicas similares\na las que requiere el cultivo y la manifestación de la plaga y aprobado por la\nANC del país donde se realizó el ensayo.\n\n5.2.5 Toxicología.\n\nNOTA:\n\nLas guías de estudio\nque se mencionan en cada uno de los apartados son las recomendadas, sin embargo\npueden utilizarse otras guías internacionalmente reconocidas.\n\n5.2.5.1 Para los requisitos\nsolicitados en este numeral y el 5.2.5.2 (toxicología y ecotoxicología) se debe\npresentar un informe del estudio de acuerdo a la estructura señalada en la guía\nutilizada. En casos donde la guía o el protocolo utilizado no señalen cómo\npresentar la información, se debe utilizar el siguiente formato:\n\na) Título del\nestudio, nombre y número de la guía utilizada.\n\nb) Fecha de\nrealización.\n\nc) Autor.\n\nd) Nombre del\nlaboratorio y firma del responsable de estudio.\n\ne) Nombre del\npatrocinador.\n\nf) Identidad del\nproducto o ingrediente activo utilizado, concentración y tipo de formulación y\norigen.\n\ng) Guía o protocolo\nde referencia, introducción, materiales, métodos, resultados, discusión y\nconclusiones.\n\nh) Los laboratorios\nque desarrollen los estudios e información, antes descrita deberán al menos,\nestar avalados por la ANC del país donde se realizó el estudio.\n\n5.2.5.1.1 Concentración letal\nmedia aguda por inhalación (CL50), expresada en mg/l o mg/m³. Guía\nTécnica OECD 403.\n\nEste informe se\nrequerirá solamente cuando el producto sea:\n\n- un gas o un gas\nlicuado,\n\n- pueda utilizarse\ncomo fumigante,\n\n- pueda incluirse en\nun aerosol o un preparado que desprenda vapor,\n\n- pueda utilizarse\ncon un equipo de nebulización,\n\n- tenga una presión\nde vapor mayor a 1x10-2 Pa y vaya a incluirse en preparados empleados en\nespacios cerrados.\n\n- pueda incluirse en\npreparados en forma de polvo con una proporción mayor al 1% de peso de\npartículas de un diámetro menor a 50 micrómetros, o\n\n- pueda incluirse en\npreparados que se apliquen de forma que se genere una cantidad mayor al 1% en\npeso de partículas o gotas de un diámetro menor a 50 micrómetros.\n\n5.2.5.1.2 Informe de irritación\ndérmica. La prueba debe mostrar el potencial de irritación a piel del IAGT,\nincluyendo reversibilidad potencial de los efectos observados. Guía Técnica\nOECD 404.\n\nEste informe se\nrequerirá en todos los casos, excepto cuando:\n\n- se conozca de\nantemano que el material es corrosivo,\n\n- presente un pH\nmenor a 2 o mayor a 11.5.\n\n- se conozca que no\ncausa efectos en la piel aportando una justificación técnica.\n\n- sea un gas o\naltamente volátil.\n\n5.2.5.1.3 Irritación ocular. La\nprueba debe mostrar el potencial de irritación a piel del IAGT, incluyendo\nreversibilidad potencial de los efectos observados. Guía Técnica OECD 405.\n\nEste informe se\nrequerirá en todos los casos, excepto cuando:\n\n- se conozca de\nantemano que el material es corrosivo.\n\n- presente un pH\nmenor a 2 o mayor a 11.5.\n\n- se conozca que no\ncausa efectos oculares aportando una justificación técnica.\n\n5.2.5.1.4 Sensibilización de\npiel. Guía Técnica OECD 406. Este estudio se requerirá en todos los casos,\nexcepto cuando se conozca que el producto es un conocido sensibilizante. Para\nlos requisitos solicitados en el punto 5.2.5.1 se debe presentar un informe del\nestudio de acuerdo a la estructura señalada en la guía utilizada. En casos donde\nel protocolo utilizado no señale cómo presentar la información, se debe\nutilizar el siguiente formato:\n\na) Declaración de\nBuenas Prácticas de Laboratorio, ISO 17025, que la prueba este acreditada o que\nel laboratorio este aprobado por la ANC.\n\nb) Características de\nla sustancia en prueba, que debe incluir estado físico, pureza y cuando proceda\notras características relevantes (incluyendo isomerización), identificación\nincluyendo número CAS. Debe declararse el vehículo utilizado (cuando proceda) y\njustificar la escogencia de dicho vehículo si es diferente al agua.\n\nc) Anímales\nutilizados, identificando la especie/variedad usada, estatus microbiológico de\nlos animales cuando se conozca, número, edad y sexo de los animales (incluyendo\ncuando sea necesario, la explicación del uso de machos en lugar de hembras);\nfuente de los animales, condiciones de cautiverio (temperatura, periodos de\nluz, humedad relativa), dieta, entre otros.\n\nd) Condiciones de la\nprueba. Detalles de la formulación de la sustancia incluyendo la forma física\ndel material usado, detalles de la administración de la sustancia incluyendo\nvolúmenes y tiempos de dosificación.\n\ne) Resultados.\nInformación sobre respuesta observada por dosis para cada animal, tales como\nsignos de toxicidad, mortalidad, naturaleza, severidad y duración de los\nefectos, tabulaciones de peso corporal y cambios en el peso, peso individual de\nlos animales al inicio de la dosificación, y semanalmente después, y tiempo de\nmuerte o sacrificio. Hallazgos toxicológicos en necropsia e histopatológicos\npara cada animal (si está disponible).\n\nf) Discusión e\ninterpretación de los resultados.\n\ng) Conclusiones,\n\n5.2.5.2 Efectos\ntóxicos sobre otras especies.\n\nInforme de los\nestudios ecotoxicológicos:\n\n5.2.5.2.1 Toxicidad oral aguda\nen aves (Guía OPPTS 850.2100).\n\n5.2.5.2.2 Toxicidad aguda en\npeces (de preferencia pruebas con especies de hábitats con temperaturas\ncálidas). (Guías OECD 203, OPPTS 850.1075).\n\n5.2.5.2.3 Toxicidad aguda en Daphnia\nsp. (Guías OECD 202, OPPTS 850.1010).\n\n5.2.5.2.4 Informe del estudio\nsobre el efecto en el crecimiento de algas. (Guías OECD 201, OPPTS 850.5400).\n\n5.2.5.2.5 Toxicidad aguda para\nlas abejas (vía oral y por contacto). (Guías OECD 213 y 214).\n\n5.2.5.2.6 Toxicidad para lombriz de\ntierra. (Guías OECD 207, OPPTS 850.6200).\n\n5.2.6 Síntomas de\nintoxicación y primeros auxilios.\n\na) Vías de\npenetración (ocular, dermal, oral, inhalación).\n\nb) Efectos en el\norganismo (daños que pueda causar en el cuerpo y los diferentes órganos).\n\nc) Diagnóstico y\nsintomatología.\n\nd) Antídoto y\ntratamiento médico.\n\ne) Primeros auxilios\n(en caso de intoxicación ocular, dermal, oral, inhalación).\n\nf) Observación\ndirecta de casos accidentales (proporcionar información en caso de existir\nintoxicaciones).\n\n5.2.7 Características\nde los envases (con fines de identificar las diferentes presentaciones del\nproducto).\n\na) Tipo de envase.\n\nb) Material.\n\nc) Capacidad.\n\nd) Resistencia.\n\n5.2.8 Información de\nseguridad.\n\na) Procedimientos\npara la destrucción del extracto botánico, producto de su metabolismo, producto\nformulado, indicando las condiciones físicas o químicas especificas para\nobtener su desactivación o descomposición.\n\nb) Eliminación de\nresiduos.\n\nc) Métodos\nrecomendados y precauciones de manejo, en general durante la fabricación, formulación\nalmacenamiento, transporte, uso y manipulación del extracto botánico/producto.\n\nd) Información sobre\nequipo de protección personal.\n\ne) Procedimientos de\nlimpieza y descontaminación de equipos de aplicación y áreas contaminadas.\n\nf) Condiciones para\nel almacenamiento, transporte y uso del producto.\n\ng) Procedimientos en\ncasos de emergencias.\n\nh) Procedimientos\npara descontaminación y eliminación de envases.\n\n5.2.9 Métodos\nanalíticos.\n\nSe debe presentar los\nmétodos de análisis para la determinación cualitativa y cuantitativa del\ningrediente activo presente en el plaguicida formulado.\n\n6. REGISTRO DE\nPLAGUICIDAS BOTÁNICOS CON FINES EXCLUSIVOS DE EXPORTACIÓN\n\nLos plaguicidas\nbotánicos con fines exclusivos de exportación, deberán cumplir con los\nsiguientes requisitos:\n\n1. Formulario de\nsolicitud.\n\n2. Certificado de\ncomposición, en original, emitido y firmado por el responsable de la\nformulación del producto, indicando el contenido del ingrediente activo con\nacción biocida o repelente, expresado en porcentaje m/m o porcentaje m/v, según\nel estado físico del producto; así como los nombres y concentraciones de los\ningredientes inertes y contaminantes.\n\n3. Hoja de datos de\nseguridad.\n\n4. Arte de etiqueta,\ncon el cual se comercializará en el país de destino.\n\n7. CAUSALES Y\nREQUISITOS PARA MODIFICACIÓN DE REGISTROS\n\n7.1 El registro de un\nplaguicida botánico de uso agrícola puede ser modificado por las siguientes\ncausales:\n\na) Cambio de titular.\n\nb) Cambio de nombre o\nrazón social del titular del registro, del fabricante o formulador.\n\nc) Cambio o adición\nde marca (nombre del producto).\n\nd) Adición de las\npresentaciones de los envases o empaques.\n\ne) Cambio del uso\nagronómico.\n\n7.2 Para efectos de\nmodificación al registro, el titular deberá presentar la solicitud; explicar\nlas razones e indicar que la composición y las propiedades físico-químicas del\nproducto no sufren modificación alguna.\n\nSegún el caso, se\ndeben presentar los siguientes requisitos:\n\na) Cambio de titular\n\na.l) Documento legal\nque acredite la cesión o traspaso de dicho registro.\n\na.2) Proyecto de\netiqueta(s) y panfleto atendiendo la capacidad del envase.\n\nb) Cambio de nombre o\nrazón social del titular del registro, del fabricante o formulador.\n\nb.l) Documento legal\nque acredite el cambio del nombre, o razón social del titular del registro, del\nfabricante o formulador.\n\nb.2) Proyecto de\netiqueta(s) atendiendo la capacidad del envase, deberá presentarse cuando el\nnombre del titular, el fabricante o el formulador, aparecen en la etiqueta.\n\nc) Cambio o adición\nde marca (nombre del producto).\n\nc.l) Proyecto de\netiqueta(s) y panfleto atendiendo la capacidad del envase, con la nueva marca.\n\nc.2) Certificado de\nmarca cuando exista.\n\nd) Adición de las\npresentaciones de comercialización para efectos de etiquetado.\n\nd.l) Tipo de envase,\nmaterial del envase y capacidad del envase.\n\nd.2) Proyecto de\netiqueta(s) atendiendo la capacidad del envase.\n\ne) Cambio del uso\nagronómico.\n\ne.l) Proyecto de\npanfleto con la modificación solicitada.\n\ne.2) Pruebas de\neficacia biológica del producto, para la inclusión de un nuevo uso que aplique\npara una plaga no contemplada en el registro original, modificación de la\ndosificación, intervalo de aplicación o periodo de carencia.\n\n7.3. Toda modificación al\nregistro que implique un cambio en la etiqueta o el panfleto del producto, la\nANC otorgará un plazo de un año para agotar las existencias del producto\netiquetado en el comercio o de las etiquetas.\n\n7.4 La modificación al\nregistro de un determinado plaguicida botánico de uso agrícola, se hará\nmediante resolución administrativa por la ANC. Se emitirá un nuevo certificado\nde registro en los casos que sean necesarios, conservando el número, fecha de\nregistro y de vencimiento.\n\n8. SUSPENSIONES Y\nCANCELACIONES DE REGISTROS\n\n8.1 Suspensión de\nregistro.\n\nEl registro de un\nplaguicida botánico y las autorizaciones que de él se deriven, puede ser\nsuspendido a través del procedimiento administrativo, si se determina alguna de\nlas causales de suspensión del registro indicadas en el numeral siguiente.\n\n8.1.1 El registro de un\nplaguicida botánico de uso agrícola serán objeto de suspensión cuando:\n\na) El titular del\nregistro o el representante legal, comercialice el producto con una etiqueta,\nno autorizada por la ANC.\n\nb) El registro de la\npersona física o jurídica se encuentre vencido.\n\nc) El titular del\nregistro no proporcione en el plazo otorgado por la ANC, la información\nrequerida, según el numeral 4.16 de este reglamento.\n\nd) Cuando en un\nsegundo muestreo de control de calidad el producto no cumpla con las normas de\ncalidad vigentes.\n\ne) Cuando el titular\ndel registro de un plaguicida botánico, no presente en el plazo establecido la actualización\nde su registro, de conformidad con lo indicado en el transitorio I.\n\nNOTA:\n\nSuspendido el\nregistro de un plaguicida botánico de uso agrícola, el producto no se podrá\ncomercializar, extraer, formular, importar, exportar, envasar, reenvasar o reempacar,\na excepción que éstas acciones sean necesarias para corregir la causal por la\ncual se suspendió el registro. En los casos en que la suspensión sea por\ncalidad del producto, el titular del registro deberá presentar ante la ANC la\nmedida correctiva y el plazo para cumplirla, misma que será valorada por la\nANC.\n\n8.1.2 El titular del registro tendrá un plazo\nde tres (3) meses a partir de la notificación para corregir las causas que\noriginaron dicha suspensión.\n\n8.2 Cancelaciones de\nregistros.\n\n8.2.1 Generalidades\nde la cancelación del registro.\n\nEl registro de un\nplaguicida botánico y las autorizaciones que de él se deriven, pueden ser\ncancelados a través del procedimiento administrativo establecido, si se\ndetermina alguna de las causales de cancelación del registro indicadas en el\nnumeral 8.2.2.\n\n8.2.2 Causales de\ncancelación de registro.\n\nLa ANC cancelará, de\noficio o a solicitud de parte del administrado, el registro de plaguicidas\nbotánicos cuando:\n\na) En un tercer\nanálisis del control de calidad, el resultado no concuerde con lo declarado en\nel registro, en aquellos casos en que previamente el producto ha sido\nsuspendido de acuerdo a lo establecido en el numeral 8.1.1 literal d).\n\nb) Se demuestre\ntécnica y científicamente que el producto aun siendo utilizado bajo las\nrecomendaciones del uso aprobado, representa un riesgo inaceptable para la\nsalud, el ambiente y la agricultura; o se demuestre que el producto es ineficaz\npara los usos que se autorizaron en el registro correspondiente.\n\nc) El registro haya\nsido otorgado con vicios de nulidad absoluta, evidente y manifiesta y no haya\ncumplido con requisitos que se señalan en este reglamento.\n\nd) Lo solicite su\ntitular.\n\ne) Las solicitudes de\nrenovación de plaguicidas botánicos de uso agrícola, no sean aprobadas, así\nmismo, también la no presentación de la solicitud de renovación; conforme lo\nestablecido en el numeral 9.1.\n\nf) Las causas que\ndieron motivo a la suspensión del registro no se subsanen en el plazo\nestablecido en el numeral 8.1.2 de este reglamento.\n\n9. RENOVACIÓN DEL\nREGISTRO\n\n9.1 El titular del\nregistro de un plaguicida botánico de uso agrícola, debe solicitar la\nrenovación del registro ante la ANC previo a su fecha de vencimiento.\n\n9.2 Para la renovación\ndel registro de un producto inscrito con requisitos establecidos por este\nreglamento, se debe presentar lo solicitado en el numeral 5.1 del presente\nreglamento.\n\n10. DISPOSICIONES\nTRANSITORIAS\n\nTransitorio I.\n\nPara los plaguicidas\nbotánicos inscritos con anterioridad a la entrada en vigencia del presente\nreglamento y que tengan un plazo de vencimiento deben solicitar su renovación,\nantes de la fecha de su vencimiento y presentar lo solicitado en los numerales\n5.1 y 5.2 del presente reglamento.\n\nTransitorio II.\n\nEl titular que desee\nactualizar sus registros antes de su vencimiento, podrá realizarlo presentando\nla información de los numerales 5.1 y 5.2 del presente reglamento.\n\nTransitorio III.\n\nEl solicitante de un\nregistro de plaguicidas botánicos de uso agrícola, que inicia el trámite con anterioridad\na la entrada en vigencia del presente reglamento, concluirán el mismo\ncumpliendo con los requisitos y procedimientos establecidos en el reglamento\nrespectivo al momento de presentada la solicitud, o bien acogerse a lo\nestablecido en el presente reglamento.\n\n11. Ingredientes inertes (suma total) en porcentaje masa/masa\n(m/m) si es un sólido o masa/masa (m/m) o masa/volumen (m/v) si es un líquido.\n\ní Las abreviaturas de m/m o m/v deberán ir\nsobre los dígitos que indican los porcentajes.\n\ní Total. Suma de los ingredientes del\nproducto en porcentaje.\n\n8. Contiene: gramos de ingrediente activo por\nkilogramo o litro de producto comercial.\n\n9. Contenido neto: expresado en litros o\nkilogramos o submúltiplos.\n\n10. En la parte central de la etiqueta y de\nacuerdo con la clasificación de plaguicidas por su peligrosidad, se colocará la\npalabra o figura según su categoría toxicológica.\n\n11. Leyenda: \"EN CASO DE INTOXICACIÓN LLEVE EL\nPACIENTE AL MÉDICO Y DELE ESTA ETIQUETA O EL PANFLETO\".\n\n11.1 Leyenda: \"ANTÍDOTO\": indicar nombre de antídoto si existe, en caso de no\nexistir, incluir la leyenda: NO TIENE.\n\n12. Nombre y dirección del formulador\n\n13. Título: país, número de registro y fecha de\nregistro.\n\n14. Título: número de lote.\n\n15. Título: fecha de formulación.\n\n16. Título: fecha de vencimiento.\n\n17. Para envases menores de un kilogramo o un\nlitro, se podrá utilizar la etiqueta de dos cuerpos cuando se garantice la\nlegibilidad de la información; en el caso de los envases cilíndricos, las\netiquetas deberán abarcar el 100% de la superficie.\n\nEl tamaño de la etiqueta para envases o empaques no cilíndricos, cuya\ncapacidad sea menor de un litro o un kilogramo, la etiqueta debe abarcar la\nparte frontal de los mismos, en el caso de los envases o empaques con un\ncontenido entre medio kilogramo y menores de un kilogramo, se podrá utilizar la\netiqueta de dos cuerpos.\n\nEn los casos de envases o empaques con etiqueta de dos cuerpos ésta\ndeberá abarcar el 100% de las mismas,\n\n18. PICTOGRAMA\n\n21.2 Según sea el caso PICTOGRAMA\n\n21.2.1 TÓXICO PARA PECES Y CRUSTÁCEOS.\n\n21.2.2 TÓXICO PARA PECES.\n\n21.2.3 TÓXICO PARA CRUSTÁCEOS.\n\n21.3 Leyenda:\n\nNO CONTAMINE RÍOS, LAGOS Y ESTANQUES CON ESTE PRODUCTO O CON ENVASES O\nEMPAQUES VACÍOS.\n\n21.4 TÓXICO PARA ABEJAS.\n\n21.5 TÓXICO PARA AVES.\n\n22. Título: AVISO DE GARANTÍA: indicarlo.\n\n23. Título: PAÍS, NÚMERO DE REGISTRO Y FECHA DE\nREGISTRO: indicarlos.\n\n24. Título: NÚMERO DE LOTE: indicarlo.\n\n25. La banda de color que identifica la categoría toxicológica debe ir\nsituada al pie y a lo largo del margen inferior y debe ser de un 15% de la\naltura de la misma, no se permite imprimir información en esta franja, con\nexcepción de la leyenda de la categoría toxicológica. De acuerdo con la\ntoxicidad, la etiqueta llevará en la banda en tinta indeleble la coloración que\nse indica en el numeral correspondiente de este anexo.\n\nLa etiqueta de los plaguicidas botánicos para uso agrícola, para envases\no empaques iguales o mayores de un kilogramo o de un litro y de tres cuerpos\npresentará redactada en español, claramente impresa la información, en el\nsiguiente orden:\n\nCUERPO IZQUIERDO\n\n1. Leyenda:\n\níALTO! LEA EL PANFLETO ANTES DE USAR EL PRODUCTO.\n\n2. Leyendas:\n\n2.1. PRECAUCIONES Y ADVERTENCIAS DE USO:\n\nNO ALMACENAR ESTE PRODUCTO EN\n\nCASAS DE HABITACIÓN. PICTOGRAMA\n\nMANTÉNGASE BAJO LLAVE FUERA DEL\n\nALCANCE DE LOS NIÑOS.\n\n2.2. Luego deberá colocarse cualesquiera de las tres leyendas que a\ncontinuación se describen, dependiendo del tipo de formulación del plaguicida y\nse utilizará el o los pictogramas respectivos según sea el caso.\n\nUTILICE EL SIGUIENTE EQUIPO DE\n\nPROTECCIÓN AL MANIPULAR EL\n\nPRODUCTO, CARGA Y APLICACIÓN. PICTOGRAMAS\n\nUTILICE EL SIGUIENTE EQUIPO\n\nDE PROTECCIÓN AL MANIPULAR EL\n\nPRODUCTO, DURANTE LA PREPARACIÓN\n\nDE LA MEZCLA, CARGA Y APLICACIÓN. PICTOGRAMAS\n\nUTILICE EL SIGUIENTE EQUIPO DE\n\nPROTECCIÓN AL MANIPULAR EL\n\nPRODUCTO Y SU APLICACIÓN. PICTOGRAMAS\n\n2.3. Para envases en los cuales se utilizará la etiqueta de dos cuerpos se\ndebe cubrir el 100 por ciento de la cara anterior y posterior.\n\nc) En envases o empaques mayores de cuatro litros o cinco kilogramos\nhasta diecinueve litros o veinticinco kilogramos se hará según lo indicado en\nel literal b), pero el tamaño de la etiqueta deberá abarcar por lo menos el\nveinticinco por ciento de la superficie.\n\nd) En ningún caso el tamaño podrá ser inferior al de una etiqueta para\nenvases o empaques menores de cuatro litros o cinco kilogramos.\n\ne) En envases o empaques de capacidad mayor de diecinueve litros o\nveinticinco kilogramos, la etiqueta deberá tener un tamaño que sea, como mínimo\nigual al de los envases o empaques de diecinueve litros o veinticinco\nkilogramos.\n\nEl orden del contenido y la forma de las etiquetas de los plaguicidas\nbotánicos para uso en la agricultura, es el siguiente:\n\n1. El texto de las etiquetas se expresará con letras negras sobre fondo\nblanco, se exceptúan de esta regla, aquellas etiquetas litografiadas en envases\no empaques de material de color diferente al blanco para aquellos plaguicidas\nfotosensibles y la leyenda sobre la banda de color para plaguicidas categoría\nIII, según numeral correspondiente de este anexo.\n\n2. El logotipo de la compañía formuladora o distribuidora será del 4% del\nárea total de la etiqueta. Se podrán utilizar los colores distintivos del\nlogotipo que estén debidamente registrados y será ubicado en el cuerpo central.\n\n3. Las empresas que posean figuras debidamente registradas podrán\nimprimirlas en la parte central de la etiqueta. Esto no deberá alterar el\ncontenido escrito de la misma.\n\n4. Los colores de estas figuras deberán ser los mismos de las de la banda\ntoxicológica.\n\n5. Se deberá utilizar el valor de mayor toxicidad del producto formulado\nsegún su DL 50 oral o dermal para la clasificación toxicológica que le\ncorresponda en el cuadro que para el efecto ha establecido la OMS.\n\n6. En las etiquetas para envases de 250 ml o menores, la información\nreferida al formulador, número y fecha de registro, fecha de vencimiento,\nnúmero de lote y los países donde se encuentra registrado el producto, se podrá\ndesplazar a otro espacio disponible, con el propósito de aumentar el tamaño de\nla letra y hacer más legible la etiqueta.\n\nEl contenido de los panfletos de plaguicidas botánicos para uso en la\nagricultura, debe presentarse:\n\na) Un solo modelo de contenido de la información para los tres modelos\nde etiqueta.\n\nb) El panfleto deberá incorporarse a las presentaciones de los envases o\nempaques de cada plaguicida botánico, dichos envases o empaques deberán siempre\ntener impresa o litografiada la respectiva etiqueta, de acuerdo a los modelos\nde etiquetas.\n\nc) Para cada presentación de envase o empaque de un plaguicida, deberá\nestar acompañada de su correspondiente panfleto. La industria de plaguicidas\npara uso en la agricultura, será la responsable total de este cumplimiento ante\nla ANC.\n\nd) Las características de forma y posición de títulos y leyendas del\npanfleto se realizará según el orden siguiente:\n\n1. Leyenda:\n\n\"!ALTOí LEA EL PANFLETO ANTES DE USAR EL PRODUCTO Y CONSULTE AL\nPROFESIONAL EN CIENCIAS AGRÍCOLAS\"\n\n2. Marca (nombre del producto), escrito únicamente con letras, seguido de\nla concentración del ingrediente activo, expresado en números y las siglas de\nla formulación del plaguicida. DEFINITIONS AND\nTERMINOLOGY\n\nFor the purposes of\nthe interpretation of this RTCA, the following definitions shall be taken into consideration.\n\n3.1 Update of\nregistrations: process\nby which the holders of registrations for botanical pesticides\ngranted before the entry into force of this regulation and that are\nin force and those contemplated in transitional provisions I and II, shall provide the\nANC with the information required in the mentioned transitional provisions.\n\n3.2 Competent\nNational Authority (ANC): Ministry, Secretariat of Agriculture, or any other\nauthority that by legal mandate grants the registration of botanical pesticides for agricultural use.\n\n3.3 Storage: action of storing,\ncollecting, preserving, keeping, or depositing pesticides in warehouses, stores,\ncustoms, or vehicles, under the conditions stipulated in this\nregulation.\n\n3.4 Certificate of\nregistration or free sale: official document that certifies the registration of a\nbotanical pesticide in the country of origin of the formulation or for its sale or\nuse.\n\n3.5 Product efficacy: degree\nof the desired effect that a botanical pesticide has on the control of the target\npest.\n\n3.6 Container or packaging:\nadequate\ncontainer that is in direct contact with the botanical pesticide to\npreserve it, identify it, and facilitate its transport.\n\n3.7 Label: printed material or\ngraphic inscription, written in legible characters, that identifies, lists\nits components, and describes the product contained in the accompanying container or packaging.\n\n3.8 Botanical\nextract: substances\nderived from the different parts of plants that have biocidal\nor repellent properties.\n\n3.9 Formulator: natural\n(individual) person or legal entity dedicated to the preparation of botanical pesticides for agricultural use.\n\n3.10 Manufacturer: natural\n(individual) person or legal entity dedicated to the synthesis of botanical extracts for agricultural use.\n\n3.11 Active ingredient: substance with biocidal\nor repellent action, contained in the botanical extract used as an input\nto formulate botanical pesticides for agricultural use.\n\n3.12 Inert\ningredient: substance\nwithout biocidal action on pests or without effect on the metabolism of the\nplant that is used as a carrier or conditioner for a botanical pesticide.\n\n3.13 Brand: any visible\nsign, suitable for distinguishing the products or services of a company, with\nrespect to the products or services of other companies.\n\n3.14 Pamphlet: printed material that\nis adhered to the container of each commercial presentation of a botanical pesticide\nfor agricultural use, containing information complementary to the label.\n\n3.15 Pre-harvest\ninterval: time\nthat must elapse between the last application of a botanical pesticide and the\nharvest of the crop to which it was applied.\n\n3.16 Re-entry\nperiod: time\nthat must elapse between the treatment or application of a pesticide and the\nentry of persons and animals to the treated area or crop.\n\n3.17 Pest: any species,\nrace, or biotype of plant or animal or pathogenic agent harmful to plants or\nplant products.\n\n3.18 Formulated\nproduct: commercial\nproduct that has been prepared from a plant extract plus the other\ncomponents of the formulation, following established quality standards.\n\n3.19 Refilling or\nrepackaging: action\nof transferring the product from its original container to other presentations.\n\n3.20 Regent: professional in\nagricultural sciences who assumes the technical responsibility in the processes\nof registration, use, and marketing of botanical pesticides before the ANC.\n\n3.21 Applicant: natural\n(individual) person or legal entity that requests from the Competent National Authority\nthe registration of a botanical pesticide for agricultural use, for commercial\npurposes.\n\n3.22 Registration: administrative,\ntechnical, and legal process by which any application for registration of\na botanical pesticide is evaluated by the ANC, prior to its inscription.\n\n3.23 Registration\nholder: natural\n(individual) person or legal entity, owner of the registration of a\nbotanical pesticide for agricultural use, before the ANC.\n\n4. GENERAL\nPROVISIONS\n\n4.1 The natural\n(individual) person or legal entity intending to manufacture, formulate, import,\npackage, refill, repackage, export, store, market, register,\nmodify, or renew the registration of botanical pesticides for agricultural use must\nbe registered as such before the ANC in accordance with the current legislation of\neach State Party of the Central American Region.\n\n4.2 For registration\nproceedings, the legal representative of the registration holder or applicant must\nhave domicile in the national territory.\n\n4.3 Botanical\npesticides for agricultural use must be registered before the ANC prior to their importation,\nexportation, extraction, formulation, packaging, refilling, repackaging, or\nmarketing.\n\n4.4 The registration\nfile for a botanical pesticide for agricultural use must contain administrative\nand technical information according to the requirements established in this\nregulation.\n\n4.5 The information\ncontained in the documents presented to support a registration and that are\ndrafted in a language other than Spanish shall be admissible by the ANC\naccompanied by their translation into Spanish; the documents indicated in\nsubsections 5.1.b and 5.1.c drafted in a language other than Spanish must be\npresented with their respective official translation into Spanish.\n\n4.6 If the qualitative-quantitative\ncomposition certificate contains information that the applicant\nconsiders to be confidential, they may request it from\nthe ANC, which shall evaluate said petition, in accordance with the legislation governing this\nmatter, in each State Party of the Central American Region.\n\n4.7 The cost of the\nlaboratory analysis (analyses) for obtaining the registration, as well as the quality\ncontrol, shall be covered by the applicant or by the registration holder.\n\n4.8 The validity of\nregistrations for botanical pesticides for agricultural use shall be ten years from\nthe date on which the registration is granted. What is established in this article\nshall apply to renewals and those registrations of botanical pesticides for\nagricultural use that comply with the provisions in transitional provisions I, II, and III.\n\n4.9 The application for registration\nof a botanical pesticide for agricultural use shall be accepted for a single product,\nwhich may have one or several commercial brands; a single formulator and\norigin.\n\n4.10 Every botanical\npesticide for agricultural use that is imported or marketed in the region must\nhave its label adhered or lithographed on its container or packaging and the\npamphlet adhered, as approved by the ANC.\n\n4.11 The certificates or\nattestations supporting the application for registration of a botanical pesticide\nfor agricultural use must have been issued within a period of one year prior\nto the date of their submission to the ANC. These documents must be presented\nduly legalized.\n\n4.12 The applicant must\njustify before the ANC, based on technical and scientific criteria, the non-\ncompliance with any requirement of the stipulated information that constitutes the\ntechnical requirements of the product, when demonstrating that it does not apply. To\nthat end, the ANC shall evaluate the arguments under technical and scientific criteria,\naccording to the nature of the requirement and must notify the applicant.\n\n4.13 The registrant may\nuse a brand of a product registered by him/her before the ANC to\nidentify a botanical pesticide for agricultural use, of different composition,\nconcentration, or formulation when, followed by the brand, the common\nname of the botanical extract(s) it contains, the concentration, or the\nformulation of the product is indicated.\n\n4.14 A brand already registered before the ANC may be used for the purpose of registering a botanical pesticide\nby a third party, provided that the owner of the same authorizes it.\n\n4.15 The ANC shall not grant the\nregistration of a botanical pesticide for agricultural use when:\n\na) It does not comply with the provisions\nestablished in this regulation.\n\nb) A product with\na brand identical to another already registered before the ANC, containing a different\nactive ingredient in its composition, except as indicated in subsection\n4.13 and 4.14\n\nc) A product that\nuses as a brand the common name(s) of the botanical\nextract(s), different from those described in the qualitative-quantitative\ncomposition of the product.\n\nd) It has been demonstrated or\nproven that the use of the product causes damage to health, the environment, and\nagriculture.\n\ne) A brand or terms are used that induce confusion or do not correspond to the\ncharacteristics or identification of the botanical pesticide to be registered.\n\n4.16 When it is demonstrated\nthrough technical-scientific justification of a possible risk to health,\nthe environment, and agriculture, the ANC may request additional information from the\napplicant or the registration holder. Likewise, it may require technical opinions from\nother competent entities.\n\nThe foregoing may be\nrequested at any stage of the registration, modification, renewal,\nor update process, including during the validity of the registration.\n\n4.17 The application for\nregistration of a botanical pesticide for agricultural use must be accompanied by three\ncopies of the draft label and pamphlet drafted in the Spanish language.\n\n4.18 The label and\npamphlet must be approved by the ANC prior to the marketing of the\nbotanical pesticide.\n\n4.19 Information on physical\nand chemical properties as well as biological efficacy tests must\nbe provided through data from studies conducted on the\nproduct to be registered.\n\nToxicological\nand ecotoxicological information must be provided through data\nfrom studies conducted on the product or the active ingredient\nof the botanical extract to be registered, unless the applicant can\njustify, based on specialized and internationally recognized scientific information, that the requested use of said botanical extract lacks\nharmful effects on human or animal health, as well as any impact on the\nenvironment. To that end, the ANC, under technical-scientific criteria, shall evaluate the\njustification.\n\nThe ANC may accept\nfor its evaluation, referenced data from toxicological and\necotoxicological studies conducted for already registered formulated\nbotanical pesticides. For this, the botanical extract and the inert ingredients of the\nproduct to be registered must fall within the minimum and\nmaximum concentration reported in the composition certificate of the previously\nregistered product (reference product), provided that the authorization\nof the holder of that information is available or that the data protection period\nfor said information has expired, in accordance with the internal legislation of each\nState Party. The registering company may justify technically and scientifically\nbefore the ANC the variations in the concentrations of the botanical extract and\nthe identity of the inert ingredients; it shall evaluate, under\ntechnical-scientific criteria, said justification to determine if such variations\ndo not signify an increase in the risk to human health and the environment relative\nto the reference product.\n\n4.20 The botanical extract\nused for the formulation of botanical pesticides for agricultural use must\nbe registered before the ANC prior to its importation or procurement and must comply\nwith the requirements according to the regulation listed below:\n\na) Application.\n\nb) Certificate of\nregistration or free sale, in original, issued by the ANC of the country of origin\nof the botanical pesticide or any other entity that demonstrates it is\nlegally empowered to issue the same.\n\nIn the event that the\nproduct is not registered or not marketed in the country of origin of the\nbotanical pesticide, a certificate of origin or attestation must be presented,\nissued by the ANC or any other entity that demonstrates it is legally empowered\nto issue the same, indicating the reasons why the\nproduct is not registered or not freely marketed in the country\nof origin of the botanical pesticide, or an attestation from the ANC indicating that the\nmarketer is authorized for said activity.\n\nNOTES:\n\n1. When these\ncertificates are issued only once by the ANC of the country of origin,\nthe applicant may present a duly legalized photocopy and, at the same\ntime, attach the document accrediting said provision.\n\n2.\nWhen two or more products are included in these certificates, the applicant\nmay deliver photocopies of the same, and they must be authenticated.\n\nc. Product identity.\n\nd. Qualitative-quantitative\ncomposition certificate.\n\ne. Analytical\nmethods.\n\nf. Safety\ninformation.\n\n5. REGISTRATION OF\nBOTANICAL PESTICIDES\n\n5.1 The following administrative requirements are established:\n\na) Application in\naccordance with Annex A (Normative).\n\nb) Certificate of\nregistration or free sale, in original, issued by the ANC of the country of origin\nof formulation of the botanical pesticide or any other entity that demonstrates it is\nlegally empowered to issue the same.\n\nIn the event that the\nproduct is not registered or not marketed in the country of origin of\nformulation of the botanical pesticide, a certificate of origin or attestation must be presented,\nissued by the ANC or any other entity that demonstrates it is legally empowered\nto issue the same, indicating the reasons why the\nproduct is not registered or not freely marketed in the country\nof origin of formulation of the botanical pesticide, or an attestation from the ANC that\nindicates that the formulator is authorized to formulate botanical pesticides\nfor agricultural use.\n\nCompliance with\nthis requirement is exempted when the botanical pesticide for agricultural use\nis formulated in a State Party of the Central American region where it is\nintended to be registered.\n\nNOTES:\n\n1) When these\ncertificates are issued only once by the ANC of the country of\norigin, the applicant may present a duly legalized photocopy and, at the same\ntime, attach the document accrediting said provision.\n\n2) If an\noriginal certificate of registration or free sale includes two or more products,\nthe applicant may deliver photocopies of the original certificate which must\nbe authenticated or collated with the original in the country where it will be registered.\n\nc) Certificate of\ncomposition, in original, issued and signed by the person responsible for the\nformulation of the product, indicating the minimum or maximum content of the\nactive ingredient, expressed in percentage m/m or percentage m/v, according to the\nphysical state of the product; as well as the names and concentrations of the\ninert ingredients and contaminants.\n\nd) Certificate of\nanalysis of the botanical pesticide, reporting the concentration of the active\ningredient, in original, provided by the formulator, from a sample of a particular\nlot, signed by the responsible professional.\n\ne) Draft(s) of\nlabel(s) and pamphlet, according to Annex B (Normative). The size of the label\nmust be proportional to the size of the container and its text legible in\nSpanish and authorized by the ANC.\n\n5.2 The following technical requirements are established:\n\n5.2.1 Identity of the\nactive ingredient of the botanical extract.\n\na) Common name and\nsynonym of the plant from which it is extracted.\n\nb) Scientific name\nand variety of the plant from which it is extracted.\n\n5.2.2 General information\non the formulated product.\n\na) Country of origin of the\nbotanical extract.\n\nb) Common and chemical name, where applicable, of the active ingredient.\n\nc) Indicate the common\nand chemical name, where applicable, of the inert ingredients.\n\nd) Indicate the\nconcentration in percentage m/m or percentage m/v according to its physical state.\n\ne) Describe the\nformulation process.\n\n5.2.3 Physicochemical\nproperties of the formulated product.\n\na) Color.\n\nb) Odor.\n\nc) Physical state.\n\nd) pH.\n\ne) Storage stability and shelf life,\n\ne. 1) Effect of\nlight, temperature, and humidity.\n\ne.2) Shelf\nlife at the recommended temperature.\n\nf) Flammability.\n\ng) Corrosiveness.\n\nh) Particle size distribution (particle size in microns for granules and powders).\n\ni) Density.\n\nj) Solubility.\n\nk) Wettability,\nfor wettable powders.\n\nl) Foam persistence\n(for products applied with water).\n\nm) Suspensibility\nfor wettable powders and solution concentrates.\n\nn) Emulsion stability\nfor emulsifiable concentrates.\n\n5.2.4 Aspects related\nto the utility and application of the formulated product.\n\n5.2.4.1 Agronomic\nuse.\n\na) Scope of\napplication (field, controlled conditions).\n\nb) Common and scientific name\nof the crops to be protected.\n\nc) Common and scientific name of the pests to be controlled.\n\nd) Type of equipment and\napplication method to be used.\n\ne) Type of nozzles\nto be used.\n\nf) Method of\npreparing the mixture.\n\ng) Method of application\n(indicating if the product is directed to the soil, foliage, drip irrigation, or\nother).\n\nh) Optimal pH of the\nmixture to be applied,\n\ni) Mode and mechanism\nof action,\n\nj) Phytosanitary\nconditions. Pest stages and levels and phenological development, at which\nits application is recommended.\n\nk) Environmental\nconditions for its use (conditions of temperature, humidity, or others).\n\nl) Dose in\nkilograms or liters per area and volume of mixture to be used according to the type and\napplication equipment.\n\nm) Application\ninterval.\n\nn) Maximum number of\napplications per crop cycle.\n\no) Pre-harvest\ninterval (interval between the last application and harvest).\n\np) Re-entry\nperiod to the treated area.\n\nq) Incompatibility\nwith other chemical, biological, and biotechnological substances used in\nplant production.\n\nr) Phytotoxicity.\n\ns) For formulated\npesticides registered in any State Party of the Central American\nRegion, the presentation of the results of the\nbiological efficacy trials for the control of the requested pest(s) shall be required, conducted\nin accordance with the current Standard Protocol for Biological Efficacy Testing of\npesticides for agricultural use.\n\nt) In the case of\ntrials conducted abroad, those that have been conducted under agroecological conditions similar\nto those required by the crop and the manifestation of the pest and approved by the\nANC of the country where the trial was conducted shall be accepted for evaluation by\nthe ANC.\n\n5.2.5 Toxicology.\n\nNOTE:\n\nThe study guidelines\nthat are mentioned in each of the sections are the recommended ones; however,\nother internationally recognized guidelines may be used.\n\n5.2.5.1 For the requirements\nrequested in this subsection and 5.2.5.2 (toxicology and ecotoxicology), it is necessary to\npresent a study report according to the structure indicated in the guideline\nused. In cases where the guideline or protocol used does not indicate how to\npresent the information, the following format must be used:\n\na) Study title,\nname and number of the guideline used.\n\nb) Date of\ncompletion.\n\nc) Author.\n\nd) Name of the\nlaboratory and signature of the person responsible for the study.\n\ne) Name of the\nsponsor.\n\nf) Identity of the\nproduct or active ingredient used, concentration and type of formulation, and\norigin.\n\ng) Reference guideline\nor protocol, introduction, materials, methods, results, discussion, and\nconclusions.\n\nh) The laboratories\nthat develop the studies and information described above must at\nleast be endorsed by the ANC of the country where the study was conducted.\n\n5.2.5.1.1 Acute median lethal\nconcentration by inhalation (LC50), expressed in mg/l or mg/m³. OECD Technical\nGuideline 403.\n\nThis report shall be\nrequired only when the product is:\n\n- a gas or a liquefied gas,\n\n- can be used\nas a fumigant,\n\n- can be included in\nan aerosol or a preparation that releases vapor,\n\n- can be used\nwith a fogging equipment,\n\n- has a vapor\npressure greater than 1x10-2 Pa and is to be included in preparations used in\nclosed spaces.\n\n- can be included in\npreparations in powder form with a proportion greater than 1% by weight of\nparticles with a diameter less than 50 micrometers, or\n\n- can be included in\npreparations applied in a way that generates a quantity greater than 1% by\nweight of particles or drops with a diameter less than 50 micrometers.\n\n5.2.5.1.2 Dermal irritation report. The\ntest must show the skin irritation potential of the IAGT,\nincluding the potential reversibility of the observed effects. OECD Technical\nGuideline 404.\n\nThis report shall be\nrequired in all cases, except when:\n\n- it is known\nbeforehand that the material is corrosive,\n\n- it has a pH\nless than 2 or greater than 11.5,\n\n- it is known that it\ndoes not cause effects on the skin, providing a technical justification,\n\n- it is a gas or\nhighly volatile.\n\n5.2.5.1.3 Ocular irritation. The\ntest must show the skin irritation potential of the IAGT,\nincluding the potential reversibility of the observed effects. OECD Technical\nGuideline 405.\n\nThis report shall be\nrequired in all cases, except when:\n\n- it is known\nbeforehand that the material is corrosive,\n\n- it has a pH\nless than 2 or greater than 11.5,\n\n- it is known that it\ndoes not cause ocular effects, providing a technical justification.\n\n5.2.5.1.4 Skin sensitization. OECD Technical Guideline 406. This study shall be required in all cases, except when the product is known to be a known sensitizer. For the requirements requested in point 5.2.5.1, a study report must be submitted in accordance with the structure indicated in the guideline used. In cases where the protocol used does not specify how to present the information, the following format must be used:\n\na) Declaration of Good Laboratory Practices, ISO 17025, that the test is accredited or that the laboratory is approved by the ANC.\n\nb) Characteristics of the test substance, which must include physical state, purity, and where applicable other relevant characteristics (including isomerization), identification including CAS number. The vehicle used must be declared (where applicable) and the choice of said vehicle must be justified if it is different from water.\n\nc) Animals used, identifying the species/variety used, microbiological status of the animals when known, number, age, and sex of the animals (including, when necessary, the explanation for the use of males instead of females); source of the animals, housing conditions (temperature, light periods, relative humidity), diet, among others.\n\nd) Test conditions. Details of the substance formulation including the physical form of the material used, details of the substance administration including volumes and dosing times.\n\ne) Results. Information on the response observed per dose for each animal, such as signs of toxicity, mortality, nature, severity, and duration of effects, tabulations of body weight and weight changes, individual animal weight at the start of dosing, and weekly thereafter, and time of death or sacrifice. Toxicological findings at necropsy and histopathological findings for each animal (if available).\n\nf) Discussion and interpretation of the results.\n\ng) Conclusions.\n\n5.2.5.2 Toxic effects on other species.\n\nReport of the ecotoxicological studies:\n\n5.2.5.2.1 Acute oral toxicity in birds (OPPTS Guideline 850.2100).\n\n5.2.5.2.2 Acute toxicity in fish (preferably tests with species from warm-temperature habitats). (OECD Guidelines 203, OPPTS 850.1075).\n\n5.2.5.2.3 Acute toxicity in Daphnia sp. (OECD Guidelines 202, OPPTS 850.1010).\n\n5.2.5.2.4 Study report on the effect on algae growth. (OECD Guidelines 201, OPPTS 850.5400).\n\n5.2.5.2.5 Acute toxicity to bees (oral and contact routes). (OECD Guidelines 213 and 214).\n\n5.2.5.2.6 Toxicity to earthworms. (OECD Guidelines 207, OPPTS 850.6200).\n\n5.2.6 Symptoms of poisoning and first aid.\n\na) Routes of entry (ocular, dermal, oral, inhalation).\n\nb) Effects on the organism (damages it may cause to the body and different organs).\n\nc) Diagnosis and symptomatology.\n\nd) Antidote and medical treatment.\n\ne) First aid (in case of ocular, dermal, oral, or inhalation poisoning).\n\nf) Direct observation of accidental cases (provide information if poisonings exist).\n\n5.2.7 Characteristics of the containers (for the purpose of identifying the different presentations of the product).\n\na) Type of container.\n\nb) Material.\n\nc) Capacity.\n\nd) Resistance.\n\n5.2.8 Safety information.\n\na) Procedures for the destruction of the botanical extract, its metabolism product, formulated product, indicating the specific physical or chemical conditions to achieve its deactivation or decomposition.\n\nb) Waste disposal.\n\nc) Recommended methods and handling precautions, in general during manufacture, formulation, storage, transport, use, and handling of the botanical extract/product.\n\nd) Information on personal protective equipment.\n\ne) Cleaning and decontamination procedures for application equipment and contaminated areas.\n\nf) Conditions for the storage, transport, and use of the product.\n\ng) Emergency procedures.\n\nh) Procedures for decontamination and disposal of containers.\n\n5.2.9 Analytical methods.\n\nThe analysis methods for the qualitative and quantitative determination of the active ingredient present in the formulated pesticide must be submitted.\n\n6. REGISTRATION OF BOTANICAL PESTICIDES FOR EXCLUSIVE EXPORT PURPOSES\n\nBotanical pesticides for exclusive export purposes must comply with the following requirements:\n\n1. Application form.\n\n2. Certificate of composition, in original, issued and signed by the person responsible for the product formulation, indicating the content of the active ingredient with biocidal or repellent action, expressed as percentage m/m or percentage m/v, depending on the physical state of the product; as well as the names and concentrations of inert ingredients and contaminants.\n\n3. Safety data sheet.\n\n4. Label artwork, with which it will be marketed in the destination country.\n\n7. GROUNDS AND REQUIREMENTS FOR MODIFICATION OF REGISTRATIONS\n\n7.1 The registration of a botanical pesticide for agricultural use may be modified on the following grounds:\n\na) Change of holder.\n\nb) Change of name or corporate name of the registration holder, manufacturer, or formulator.\n\nc) Change or addition of brand (product name).\n\nd) Addition of container or packaging presentations.\n\ne) Change of agronomic use.\n\n7.2 For the purposes of modifying the registration, the holder must submit the application; explain the reasons and indicate that the composition and the physical-chemical properties of the product do not undergo any modification.\n\nDepending on the case, the following requirements must be submitted:\n\na) Change of holder\n\na.1) Legal document accrediting the assignment or transfer of said registration.\n\na.2) Draft label(s) and pamphlet addressing the container capacity.\n\nb) Change of name or corporate name of the registration holder, manufacturer, or formulator.\n\nb.1) Legal document accrediting the change of name, or corporate name of the registration holder, manufacturer, or formulator.\n\nb.2) Draft label(s) addressing the container capacity, must be submitted when the name of the holder, manufacturer, or formulator appears on the label.\n\nc) Change or addition of brand (product name).\n\nc.1) Draft label(s) and pamphlet addressing the container capacity, with the new brand.\n\nc.2) Brand certificate when it exists.\n\nd) Addition of marketing presentations for labeling purposes.\n\nd.1) Type of container, container material, and container capacity.\n\nd.2) Draft label(s) addressing the container capacity.\n\ne) Change of agronomic use.\n\ne.1) Draft pamphlet with the requested modification.\n\ne.2) Biological efficacy trials of the product, for the inclusion of a new use that applies to a pest not contemplated in the original registration, modification of the dosage, application interval, or pre-harvest interval.\n\n7.3. For any modification to the registration that implies a change in the product label or pamphlet, the ANC shall grant a period of one year to deplete the stocks of the labeled product in commerce or of the labels.\n\n7.4 The modification to the registration of a specific botanical pesticide for agricultural use shall be made by administrative resolution by the ANC. A new registration certificate shall be issued in cases where necessary, retaining the number, registration date, and expiration date.\n\n8. SUSPENSIONS AND CANCELLATIONS OF REGISTRATIONS\n\n8.1 Suspension of registration.\n\nThe registration of a botanical pesticide and the authorizations derived therefrom may be suspended through the administrative procedure, if any of the grounds for suspension of the registration indicated in the following numeral are determined.\n\n8.1.1 The registration of a botanical pesticide for agricultural use shall be subject to suspension when:\n\na) The registration holder or the legal representative markets the product with a label not authorized by the ANC.\n\nb) The registration of the natural or legal person is expired.\n\nc) The registration holder does not provide, within the period granted by the ANC, the required information, according to numeral 4.16 of this regulation.\n\nd) When in a second quality control sampling the product does not comply with current quality standards.\n\ne) When the registration holder of a botanical pesticide does not submit the update of its registration within the established period, in accordance with what is indicated in Transitory Provision I.\n\nNOTE:\n\nOnce the registration of a botanical pesticide for agricultural use is suspended, the product may not be marketed, extracted, formulated, imported, exported, packaged, repackaged, or re-packaged, except when these actions are necessary to correct the ground for which the registration was suspended. In cases where the suspension is due to product quality, the registration holder must submit to the ANC the corrective measure and the period to comply with it, which shall be evaluated by the ANC.\n\n8.1.2 The registration holder shall have a period of three (3) months from the notification to correct the causes that originated said suspension.\n\n8.2 Cancellations of registrations.\n\n8.2.1 General aspects of registration cancellation.\n\nThe registration of a botanical pesticide and the authorizations derived therefrom may be cancelled through the established administrative procedure, if any of the grounds for cancellation of the registration indicated in numeral 8.2.2 are determined.\n\n8.2.2 Grounds for cancellation of registration.\n\nThe ANC shall cancel, ex officio or at the request of the administered party, the registration of botanical pesticides when:\n\na) In a third quality control analysis, the result does not match what was declared in the registration, in those cases where the product has previously been suspended in accordance with the provisions of numeral 8.1.1 paragraph d).\n\nb) It is technically and scientifically demonstrated that the product, even when used under the recommendations of the approved use, represents an unacceptable risk to health, the environment, and agriculture; or it is demonstrated that the product is ineffective for the uses that were authorized in the corresponding registration.\n\nc) The registration was granted with defects of absolute, evident, and manifest nullity and did not comply with requirements set forth in this regulation.\n\nd) Its holder requests it.\n\ne) The renewal applications for botanical pesticides for agricultural use are not approved, as well as the failure to submit the renewal application; in accordance with the provisions of numeral 9.1.\n\nf) The causes that gave rise to the suspension of the registration are not remedied within the period established in numeral 8.1.2 of this regulation.\n\n9. RENEWAL OF REGISTRATION\n\n9.1 The holder of the registration of a botanical pesticide for agricultural use must request the renewal of the registration before the ANC prior to its expiration date.\n\n9.2 For the renewal of the registration of a product registered with requirements established by this regulation, what is requested in numeral 5.1 of this regulation must be submitted.\n\n10. TRANSITORY PROVISIONS\n\nTransitory Provision I.\n\nFor botanical pesticides registered prior to the entry into force of this regulation and that have an expiration period, they must request their renewal before their expiration date and submit what is requested in numerals 5.1 and 5.2 of this regulation.\n\nTransitory Provision II.\n\nThe holder who wishes to update their registrations before their expiration may do so by submitting the information from numerals 5.1 and 5.2 of this regulation.\n\nTransitory Provision III.\n\nThe applicant for a registration of botanical pesticides for agricultural use, who initiates the procedure prior to the entry into force of this regulation, shall conclude it by complying with the requirements and procedures established in the respective regulation at the time the application was submitted, or may avail themselves of what is established in this regulation.\n\n11. Companies that possess duly registered figures may print them on the central part of the label. This must not alter the written content thereof.\n\n4. The colors of these figures must be the same as those of the toxicological band.\n\n5. The highest toxicity value of the formulated product according to its oral or dermal LD 50 must be used for the toxicological classification that corresponds to it in the table established for this purpose by the WHO.\n\n6. On labels for containers of 250 ml or less, the information referring to the formulator, registration number and date, expiration date, batch number, and the countries where the product is registered, may be moved to another available space, for the purpose of increasing the font size and making the label more legible.\n\nThe content of the pamphlets for botanical pesticides for use in agriculture must be presented as follows:\n\na) A single model of information content for the three label models.\n\nb) The pamphlet must be incorporated into the presentations of the containers or packages of each botanical pesticide; said containers or packages must always have the respective label printed or lithographed, according to the label models.\n\nc) For each presentation of a container or package of a pesticide, it must be accompanied by its corresponding pamphlet. The pesticide industry for use in agriculture shall be entirely responsible for this compliance before the ANC.\n\nd) The characteristics of form and position of titles and legends of the pamphlet shall be carried out according to the following order:\n\n1. Title: DENSIDAD: declare the product density value and its corresponding temperature.\n\n8.
