aprovechamiento de la radiodifusión sonora y televisiva, por\nsus aspectos informativos, culturales y recreativos, constituye una actividad\nprivada de interés público.\n\n2°-Que los servicios de radiodifusión sonora o televisiva definidos en\nel artículo 29 de la Ley General de Telecomunicaciones, son los de acceso\nlibre; estos se entienden como servicios de radiodifusión sonora o televisión\nconvencional, de programación comercial, educativa o cultural, que pueden ser\nrecibidos libremente por el público, en general, sin pago de derechos de\nsuscripción, y sus señales se transmiten en un solo sentido a varios puntos de\nrecepción simultánea.\n\n3°-Que existe una concentración importante de torres de radio y\ntelevisión ubicadas en el punto más alto del Volcán Irazú, dentro del Parque\nNacional Volcán Irazú, que a su vez forma parte del Área de Conservación\nCordillera Volcánica Central, amparado bajo la supervisión del Sistema Nacional\nde Áreas de Conservación.\n\n4°-Que durante el año 2014, principalmente a partir de junio se han\nestado produciendo deslizamientos de tierra y rocas desde la parte superior del\nflanco oeste del volcán Irazú. Los deslizamientos\nde mayor tamaño han sido registrados en las estaciones\nsísmicas ubicadas en la cima del volcán, dicho monitoreo\nha sido registrado por el Área de conservación Cordillera Volcánica\nCentral (ACCVC), el Observatorio Vulcanológico\ny Sismológico de Costa Rica (OVSICORI) y por la Comisión Nacional de Emergencias.\n\n5°-Que producto de los deslizamientos presentados y un agrietamiento en\nla corona superior del macizo, se ha visto comprometida la estabilidad de los\nterrenos sobre los cuales se encuentran al menos ocho torres de radio y de\ntelevisión de diversos operadores, lo anterior ha sido constatado por las\ninstituciones citadas en el considerando anterior.\n\n6°-Que el Poder Ejecutivo en el ejercicio de su potestad de dirección en\nmateria de gobierno, y como órgano rector en materia de Telecomunicaciones,\ntiene la obligación de proteger los derechos de los proveedores y de los\nusuarios de los servicios de telecomunicaciones, asegurando eficiencia,\nigualdad, continuidad, calidad, mayor y mejor cobertura, mayor y mejor información,\nmás y mejores alternativas en la prestación de los servicios, así como\ngarantizar la privacidad y confidencialidad en las comunicaciones, de acuerdo\ncon nuestra Constitución Política.\n\n7°-Que el Poder Ejecutivo considera necesario, asimismo, implementar\nmedidas de emergencia para evitar interrupción total o parcial de la señal de\nradio y televisión, que podría ocurrir en el eventual caso de un deslizamiento\nde grandes magnitudes en el Parque Nacional Volcán Irazú, que tenga como\nresultado la perdida de las torres de radio y televisión ahí ubicadas.\n\n8°-Que el Jerarca deberá velar por el cumplimiento de las medidas de\nemergencia para colaborar con el logro de los objetivos contenidos en esta\ndirectriz. Articles 4, 25, 27\nof Law No. 6227, General Law of Public Administration, published in the official\ngazette La Gaceta No. 102, Supplement No. 90 of May 30, 1978; and Articles 5,\n25 and 27 of Law No. 8488, National Law on Emergencies and Risk Prevention,\npublished in the Official Gazette La Gaceta No. 8 of January 11, 2006.\n\nConsidering:\n\n1°—That the use of sound and television broadcasting, for its\ninformational, cultural, and recreational aspects, constitutes a private\nactivity of public interest.\n\n2°—That the sound or television broadcasting services defined in\nArticle 29 of the General Telecommunications Law are those of free access;\nthese are understood as sound broadcasting or conventional television services,\nwith commercial, educational, or cultural programming, which may be freely\nreceived by the public, in general, without payment of subscription rights, and\ntheir signals are transmitted in a single direction to several points of\nsimultaneous reception.\n\n3°—That there is a significant concentration of radio and television\ntowers located at the highest point of the Irazú Volcano, within the Irazú\nVolcano National Park, which in turn forms part of the Cordillera Volcánica\nCentral Conservation Area, protected under the supervision of the National\nSystem of Conservation Areas.\n\n4°—That during the year 2014, mainly starting in June, landslides of\nearth and rocks have been occurring from the upper part of the western flank of\nthe Irazú volcano. The largest landslides have been recorded at the seismic\nstations located on the summit of the volcano; said monitoring has been\nrecorded by the Cordillera Volcánica Central Conservation Area (ACCVC), the Costa\nRican Volcanological and Seismological Observatory (OVSICORI), and by the\nNational Emergency Commission.\n\n5°—That as a result of the landslides that have occurred and a crack in\nthe upper crown of the massif, the stability of the lands on which at least\neight radio and television towers of various operators are located has been\ncompromised, as has been confirmed by the institutions cited in the preceding\nwhereas clause.\n\n6°—That the Executive Branch, in the exercise of its power of direction\nin matters of government, and as the governing body in matters of\nTelecommunications, has the obligation to protect the rights of providers and\nusers of telecommunications services, ensuring efficiency, equality,\ncontinuity, quality, greater and better coverage, greater and better\ninformation, more and better alternatives in the provision of services, as well\nas guaranteeing privacy and confidentiality in communications, in accordance\nwith our Political Constitution.\n\n7°—That the Executive Branch also considers it necessary to implement\nemergency measures to prevent total or partial interruption of the radio and\ntelevision signal, which could occur in the eventual case of a large-magnitude\nlandslide in the Irazú Volcano National Park, resulting in the loss of the\nradio and television towers located there.\n\n8°—That the Head of Entity must ensure compliance with the emergency\nmeasures to collaborate in achieving the objectives contained in this\ndirective. Therefore,\n\nThey issue the following\ndirective\n\nADDRESSED TO THE:\n\nMINISTRY\nOF ENVIRONMENT AND ENERGY, MINISTRY\n\nOF\nSCIENCE, TECHNOLOGY AND TELECOMMUNICATIONS,\n\nNATIONAL\nENVIRONMENTAL TECHNICAL SECRETARIAT, NATIONAL\n\nSYSTEM\nOF CONSERVATION AREAS, NATIONAL\n\nCOMMISSION\nFOR RISK PREVENTION AND EMERGENCY\n\nRESPONSE,\nSUPERINTENDENCY\n\nOF\nTELECOMMUNICATIONS AND OTHER\n\nPERTINENT\nINSTITUTIONS\n\nArticle 1—As of the effectiveness of this\nDirective, all support is urgently requested from the foregoing institutions\nso that they give immediate priority to addressing the solution to the\nemergency situation faced due to the possible landslide and loss of the radio\nand television towers located in the Irazú Volcano National Park.\n\nArticle 2—It is the responsibility of the\ninstitutions subject to this Directive to immediately seek effective\ncommunication channels to achieve an emergency solution to the problem, taking\ninto consideration the public interest implicit in the need not to leave a\nsignificant population of our country without radio and television signals.\n\nArticle 3—The Ministry of Environment and Energy and\nthe National System of Conservation Areas are instructed to immediately issue\nthe instructions they deem pertinent to expedite processes that provide a\nresponse to the emergency, within the scope of their respective competencies.\n\nArticle 4—The National Environmental Technical\nSecretariat and the National System of Conservation Areas are instructed to\nprovide immediate support in light of the eventual possibility of carrying out\nsome type of relocation of the existing radio and television towers in the\nIrazú Volcano National Park to another site within the same park, the foregoing\nin respect of and in full compliance with the approved Management Plan for the\nPark, regarding the eventual environmental impact that may or may not be\ngenerated.\n\nArticle 5—It is the responsibility of the Ministry\nof Science, Technology and Telecommunications and the Superintendency of\nTelecommunications to manage, on a priority basis, the corresponding studies on\nthe affectation or changes that could arise with the eventual relocation of the\nradio and television towers to other sites with respect to the frequencies that\nare used by the different operators.\n\nArticle 6—Both the National Emergency Commission\nand the Costa Rican Volcanological and Seismological Observatory must provide\nlogistical and priority support in addressing this eventual national emergency.\n\nArticle 7—In general, all the aforementioned\ninstitutions and those that are pertinent to the matter are requested to handle\non a priority basis within their departments, and in full adherence to the\nprinciple of legality, but with the celerity the case requires, any\napplication or requirement necessary to seek an immediate solution to the\neventual emergency that could arise.\n\nArticle 8—Effective as of its publication.\n\nGiven at the Presidency of the Republic, on the\nfifth day of February, two thousand fifteen." }
