A., cédula jurídica N° 3-101- 053949-23, para\nutilizarla en su inmueble inscrito bajo matrícula de Folio Real 5-12838-000,\nrealizando la captación en propiedad de Ganadera Abancari S.R.L. (finca N°\n5-17733-000). Folio 19. \n\nII.-Que mediante\nresolución N° R-0541-2009-AGUAS-MINAET de las 10:15 horas del 13 de julio del\n2009, el Departamento de Aguas del Ministerio de Ambiente, Energía y Telecomunicaciones\naprobó el traspaso de la concesión de aprovechamiento de aguas a nombre de\nAgroturismo Brisas del Lago Sociedad Anónima. Lo anterior por cuanto se indica\n\"que de la certificación registral aportada se demostró que la finca a favor de\nla cual se pretende que se otorgue el traspaso, finca Folio Real 124739-000\ntiene como antecedente de dominio la finca a la que se otorgó originalmente la\nconcesión es decir, la finca Folio Real 12838-000. Folio 23. \n\nIII.-Que el señor\nEzzio Segnini Lamas, representante de la empresa Agroturismo Brisas del Lago S.\nA. presentó solicitud de imposición de servidumbre de acueducto en la finca\n17733- 000 partido de Guanacaste ante este Despacho, en apego a lo establecido\nen la Ley de Aguas N° 276 del 27 de agosto de 1942 y sus reformas. Folio\n1. \n\nIV.-Que mediante\nresolución N° 840-2010-DMG de las 10:00 horas del 24 de marzo del 2010, del\nMinisterio de Gobernación y Policía (órgano designado para efectuar las\ndiligencias de imposición de servidumbre de acueducto) confiere audiencia\nal representante del reclamado fundo sirviente a fin de que dentro de 30 días\nsiguientes a la notificación de la presente resolución, haga valer sus\nderechos, ofrezca pruebas y señale lugar y/o medios para atender\nnotificaciones. Folio 54. Que la representación de la compañía Ganadera\nAbancari S.R.L. se pronunció al respecto. \n\nV.-Que luego de\nresolver situaciones previas (nulidades) que provocan el enderezamiento del\nprocedimiento, esto mediante resoluciones N° 264-2012-DMG, (folio 294) N°\n265-2012-DMG (folio 300) así como la N° 484-2012-DMG, (folio 294), mediante\nresolución N° 571-2012-DMG (folio 324) se rechazaron las oposiciones de\nGanadera Abancari S.R.L. continuándose con las diligencias de la imposición\nforzosa de servidumbre incoada por Agroturismo Brisas del Lago S. A. \n\nVI.-Que mediante\noficio DAJG-255-2014 del 13 de marzo del 2014, emitido por la Dirección de\nAsesoría Jurídica del Ministerio de Gobernación y Policía, se puso en\nconocimiento de las partes el Avalúo AA-010-2014 de fecha 12 de febrero del\n2014, realizado por el Perito Valuador, Ing. José Luis Palacios Alvarado,\nexpediente N° 002-2013 del Área de Valoración Administrativa, del Ministerio de\nHacienda Regional de Puntarenas. Folio 407. Así mismo mediante oficio 427-2014-\nDAJG, del 9 de mayo del 2014, de esa misma Dirección se le indica a la compañía\nGanadera Abancari S.R.L., que según el avalúo mencionado debe indicar el número\nde cuenta y Banco a efectos de que la empresa Agroturismo Brisas del Lago S. A.\nproceda a realizar el depósito por concepto de indemnización por la imposición\nde la servidumbre de aguas. Folio 423. \n\nVII.-Que mediante\noficio 562-2014-DAJG, del 10 de junio del 2014 la Dirección de Asesoría\nJurídica del Ministerio de Gobernación y Policía, señala que ya se realizó el\ndepósito según el avalúo rendido por el Departamento de Valoraciones del\nMinisterio de Hacienda, sobre el monto de indemnización correspondiente al\npropietario del fundo sirviente, el cual asciende a la suma de ¢187.170,52.\nDicha suma fue cancelada mediante depósito N° 02789714 en la cuenta N°\n100-01-142-000529-7 del Banco Nacional de Costa Rica y a nombre de Forestal Río\nGrande Sociedad Anónima, según lo solicitara el representante de la empresa\nGanadera Abancari S.R.L. Folio 19.\n\nII.-That by\nresolution No. R-0541-2009-AGUAS-MINAET at 10:15 a.m. on July 13,\n2009, the Water Department of the Ministry of Environment, Energy and Telecommunications\napproved the transfer of the water use concession to the name of\nAgroturismo Brisas del Lago Sociedad Anónima. Folio 23.\n\nIII.-That Mr.\nEzzio Segnini Lamas, representative of the company Agroturismo Brisas del Lago S.\nA., filed a request for imposition of an aqueduct easement (servidumbre de acueducto) on farm\n17733- 000, Guanacaste district, before this Office, in compliance with the provisions of\nthe Water Law No. 276 of August 27, 1942 and its amendments. Folio\n1.\n\nIV.-That by\nresolution No. 840-2010-DMG at 10:00 a.m. on March 24, 2010, of the\nMinistry of Governance and Police (the body designated to carry out the\nproceedings for the imposition of aqueduct easements) grants a hearing\nto the representative of the respondent servient tenement (fundo sirviente) so that within 30 days\nfollowing notification of this resolution, they may assert their\nrights, offer evidence, and indicate a place and/or means for receiving\nnotifications. Folio 54. That the representation of the company Ganadera\nAbancari S.R.L. responded in this regard.\n\nV.-That after\nresolving prior situations (nullities) that led to the rectification of the\nprocedure, this by resolutions No. 264-2012-DMG, (folio 294) No.\n265-2012-DMG (folio 300) as well as No. 484-2012-DMG, (folio 294), by\nresolution No. 571-2012-DMG (folio 324) the oppositions of\nGanadera Abancari S.R.L. were rejected, continuing with the proceedings for the forced\nimposition of easement initiated by Agroturismo Brisas del Lago S. A.\n\nVI.-That by\nofficial letter DAJG-255-2014 of March 13, 2014, issued by the Legal\nAdvisory Directorate of the Ministry of Governance and Police, the parties were informed\nof Appraisal (Avalúo) AA-010-2014 dated February 12,\n2014, carried out by the Expert Appraiser (Perito Valuador), Eng. José Luis Palacios Alvarado,\nfile No. 002-2013 of the Administrative Valuation Area, of the Regional\nMinistry of Finance of Puntarenas. Folio 407. Likewise, by official letter 427-2014-\nDAJG, of May 9, 2014, from that same Directorate, the company\nGanadera Abancari S.R.L. is informed that, according to the aforementioned appraisal, it must indicate the account\nnumber and Bank so that the company Agroturismo Brisas del Lago S. Folio 423.\n\nVII.-That by\nofficial letter 562-2014-DAJG, of June 10, 2014, the Legal Advisory\nDirectorate of the Ministry of Governance and Police indicates that the deposit\nhas already been made according to the appraisal rendered by the Valuations Department of the\nMinistry of Finance, for the amount of compensation corresponding to the\nowner of the servient tenement, which amounts to the sum of ¢187,170.52.\nSaid sum was paid by deposit No. 02789714 into account No.\n100-01-142-000529-7 of the Banco Nacional de Costa Rica and in the name of Forestal Río\nGrande Sociedad Anónima, as requested by the representative of the company\nGanadera Abancari S.R.L. Folio 430.\n\nVIII.-That in\naccordance with the studies carried out by the Ministry of Governance and\nPolice and the water use concession granted by resolution\nNo. R-054- 2007-AGUAS-MINAE of February 5, 2007, cited in the first considering clause\nof this decree, Articles 99 and following of the Water Law No.\n276 of August 27, 1942 and its amendments, and Article 383 and following of the\nCivil Code, it is appropriate to decree the constitution of the corresponding\naqueduct easement.\n\nTherefore, they decree:\n\nIMPOSITION OF AQUEDUCT EASEMENT\n\nON PROPERTY IN THE GUANACASTE DISTRICT\n\nUNDER REGISTRATION N° 017733-000\n\nArticle 1.-To impose an aqueduct easement for the\nterm of ten years, according to the terms of the concession, that is, until February 6,\n2017, on the property (inmueble) registered in the Property Registry,\nGuanacaste district, under registration N° 017733-000, land with a house and\nothers, located in the province of Guanacaste, canton 07 Abangares, district 03\nSan Juan.
