  "body_es_text": "en la totalidad del texto\n\n                    -\n\n                        Texto Completo Norma 021\n\n                        Para la generación de una política nacional de aprovechamiento sostenible de\ncamarón, generación de empleo y combate a la pobreza\n\nTexto Completo acta: 103C43\n\nN° 021-P\n\nEL PRESIDENTE DE LA REPÚBLICA\n\nCon fundamento en los artículos 26 inciso b), 99 y 100 de la Ley General\nde la Administración Pública; y,\n\nConsiderando:\n\nI.-Que el artículo 50 de la Constitución Política dispone que es\nobligación del Estado procurar el mayor bienestar a todos los habitantes del\npaís, organizando y estimulando la producción y el más adecuado reparto de la\nriqueza. Asimismo, incorpora el derecho de toda persona a un ambiente sano y ecológicamente\nequilibrado.\n\nII.-Que, asimismo, el artículo 56 de la Constitución Política establece\nque el Estado debe garantizar el trabajo digno, honesto y útil para la\nsociedad.\n\nIII.-Que por Ley Nº 7416, Convenio sobre la Diversidad Biológica, los\nEstados tienen el derecho soberano de explotar sus propios recursos marinos y\ncosteros en aplicación de su propia política ambiental y la obligación de\nasegurar que las actividades que se lleven a cabo dentro de su jurisdicción o\nbajo su control no perjudiquen al medio ambiente de otros Estados o de zonas\nsituadas fuera de toda jurisdicción nacional.\n\nIV.-Que la Ley Orgánica del Ambiente indica que los recursos marinos y\ncosteros contenidos en la zona económica exclusiva, en la cual el Ministerio\ndel Ambiente y Energía en coordinación con las instituciones competentes, puede\ndelimitar zonas de protección, se sujetarán a planes de ordenamiento y manejo,\na fin de prevenir y combatir la contaminación o la degradación de los\necosistemas y especies claves.\n\nV.-Que la Ley de Creación del Instituto Costarricense de Pesca y\nAcuicultura, Ley Nº 7384, establece como función de este ente público estatal\nnormar el aprovechamiento racional de los recursos pesqueros para lograr\nmayores rendimientos económicos, y la protección de las especies marinas y de\nlas acuícolas.\n\nVI.-Que corresponde al Instituto Costarricense de Pesca y Acuicultura\n(INCOPESCA), como Institución Rectora del sector pesquero y acuícola de nuestro\npaís, establecer medidas de ordenamiento para el aprovechamiento sostenible de\nlos recursos hidrobiológicos, que permitan proteger áreas de reproducción,\nreclutamiento y de alimentación, que favorezcan el incremento de las especies y\nel aumento de su biomasa, de manera que se garantice su sostenibilidad en\nprovecho de los ecosistemas y de los pescadores.\n\nVII.-Que se reconoce el aporte, la buena fe y las propuestas voluntarias\nexpresadas por todos los sectores: pesqueros, académicos, ambientales y\ngubernamentales, en la búsqueda de una solución nacional integral (social, económica,\ncultural y ambiental) para garantizar un ordenamiento marino, sostenible,\nresponsable, con equidad y justicia que permita el aprovechamiento del camarón\nen Costa Rica, generado por el proceso de diálogo liderado por el Ministerio de\nAgricultura y Ganadería (MAG), el Instituto Costarricense de Pesca y\nAcuicultura (INCOPESCA) y el Ministerio de Ambiente y Energía (MINAE), a través\ndel Viceministerio de Aguas, Mares, Costas y Humedales.\n\nVIII.-Que se valora el compromiso y la responsabilidad asumida por parte\nde las Instituciones gubernamentales involucradas en el proceso de diálogo, la\napertura hacia la generación de acciones que promuevan el desarrollo y la\nconservación de los recursos marinos y costeros.\n\nIX.-Que es de vital importancia la adecuada y obligada coordinación\nentre las entidades e instituciones del Estado que tienen alguna\nresponsabilidad en el manejo y conservación de los recursos costeros y marinos.\nLa jurisprudencia constitucional ha enfatizado el deber de coordinación entre\nagencias públicas como un medio para preservar y garantizar los derechos\nfundamentales de las personas, a través de una acción administrativa bien\norientada, eficiente y eficaz.\n\nX.-Que este proceso y las acciones que se derivaran de él, se enmarcan\nen completo apego y respeto del Voto N° 2013-010540 y sus recomendaciones\nemitidas por la Sala Constitucional de la Corte Suprema de Justicia. Se\nreconoce además, el impacto social, cultural y económico, producto de este\npronunciamiento en particular; la afectación al derecho del trabajo a grupos\nvulnerables como jóvenes, mujeres y adultos mayores, principalmente en la\nprovincia de Puntarenas.\n\nXI.-Que la presente directriz conlleva una acción programática de\ncumplimiento e implementación total de al menos doce meses plazo. Por tanto,\n\nSe emite la siguiente,\n\nDirectriz:\n\n\"PARA LA GENERACIÓN DE UNA\nPOLÍTICA NACIONAL\n\nDE APROVECHAMIENTO SOSTENIBLE DE\nCAMARÓN,\n\nGENERACIÓN DE EMPLEO Y COMBATE\n\nA LA POBREZA\"\n\nArtículo 1º-Se instruye al Ministerio de la Presidencia para:\n\na) Conformar una Mesa de Diálogo que coordinará el Instituto\nCostarricense de Pesca y Acuicultura (INCOPESCA) y el Ministerio de Ambiente y\nEnergía, a través del Viceministerio de Aguas, Mares, Costas y Humedales, que\ntendrá los siguientes objetivos:\n\ni. Desarrollar un proceso continuo de coordinación para la\nimplementación del Plan Nacional de Desarrollo Pesquero y Acuícola.\n\nb) Mantener esa Mesa de Diálogo para el apoyo a temas importantes que\nasí lo considere la Junta Directiva y la Presidencia Ejecutiva del INCOPESCA.\n\nc) Esta Mesa de Diálogo se integrará por las siguientes instituciones:\nMinisterio de Agricultura y Ganadería (MAG), Instituto Mixto de Ayuda Social\n(IMAS), Ministerio de Trabajo y Seguridad Social (MTSS), Instituto Nacional de\nla Mujer (INAMU), Sistema de Banca de Desarrollo (SBD), Servicio Nacional de\nGuardacostas (SNG), Instituto Nacional de Aprendizaje (INA), Consejo Nacional\nde Producción (CNP), Ministerio de Educación Pública (MEP), Ministerio de Obras\nPúblicas y Transporte (MOPT), Instituto Costarricense de Puertos del Pacífico\n(INCOP), Sistema Nacional de Áreas de Conservación (SINAC), Instituto Nacional\nde Desarrollo Rural (INDER), Ministerio de Ciencia, Tecnología y Telecomunicaciones\n(MICITT) y otras instituciones que mantengan relación con el tema. Además,\nestará conformada por los representantes de los sectores pesquero, ambiental y\nacadémico identificados durante el proceso de Diálogo. Se invitará a las\nMunicipalidades de las zonas costeras a acompañar esta Mesa de Diálogo.\n\nd) Se invitará a la Defensoría de los Habitantes de la República a\nparticipar como observador y garante del proceso de elaboración de la \"Política\nNacional de Aprovechamiento Sostenible de Camarón, Generación de Empleo y\nCombate de la Pobreza\", y así garantizar que los diferentes sectores\nidentificados durante el proceso de Diálogo sean debidamente escuchados y\nanalizados sus intereses.\n\nArtículo 2º-Se instruye al INCOPESCA y al Viceministerio de Aguas,\nMares, Costas y Humedales a:\n\na) Coordinar y facilitar la Mesa de Diálogo.\n\nb) Elaborar la base de discusión para la construcción de un Proyecto de\nLey para el aprovechamiento sostenible de la pesca de camarón, generación de\nempleo y combate a la pobreza a ser discutido en la mesa de diálogo.\n\nc) Desarrollar una campaña de comunicación nacional, bajo los siguientes\nobjetivos:\n\ni. Dignificar la actividad pesquera en nuestro país.\n\nii. Visibilizar la importancia de la misma.\n\niii. Compartir el aporte social, económico y ambiental de los diferentes\nsectores pesqueros en el desarrollo nacional, la seguridad alimentaria y el\ncombate a la pobreza.\n\niv. Compartir y fortalecer la identidad cultural de las comunidades\npesqueras.\n\nArtículo 3º-El\nMinisterio de la Presidencia, en conjunto con el INCOPESCA y el Viceministerio\nde Aguas, Mares y Humedales invitarán a las Instituciones Estatales de\nEducación Superior y a las Organizaciones Ambientales, a desarrollar un\nPrograma de Investigación que, en forma conjunta con el Departamento de\nInvestigación y Desarrollo del INCOPESCA, genere la información necesaria para\nla toma de decisiones, iniciando con una línea de base, constituida por un\nprimer informe al final del primer año sobre el estado de recurso camarón por\nzona y método de pesca y así sucesivamente en los años subsiguientes.\n\nArtículo 4º-Se solicita e insta al sector semiindustrial\ncamaronero a iniciar un proceso voluntario para el uso de las medidas\npropuestas por este sector en el marco del proceso de Diálogo, que permita la\ngeneración de información para la toma de decisiones y la consolidación de esta\nDirectriz. Se solicita que estas medidas incluyan al menos:\n\na) El uso de dispositivos de localización satelital.\n\nb) El uso del 100% de dispositivos excluidores de tortuga y peces.\n\nc) El alejamiento de 15 metros de batimetría a lo largo de la costa\nPacífica.\n\nd) Respeto a las zonas de veda y aumento de los períodos de veda de 4 a\n6 meses.\n\ne) Desarrollar un programa de observadores a bordo, en coordinación con\nel INCOPESCA, para el monitoreo de capturas, descartes y tallas mínimas.\n\nf) Permitir el seguimiento por parte del INCOPESCA y otras instituciones\nde apoyo científico y académico a los desembarques en zonas oficialmente\ndefinidas por el INCOPESCA.\n\nArtículo 5º-Se solicita e insta al sector de pesca en pequeña escala\ncamaronero a iniciar un proceso voluntario para el uso de las medidas\npropuestas por este sector en el marco del proceso de Diálogo, que permita la\ngeneración de información para la toma de decisiones y la consolidación de esta\nDirectriz. Se solicita que estas medidas incluyan al menos:\n\na) El uso de artes de pesca autorizadas.\n\nb) Respeto de los períodos y zonas de veda.\n\nc) Desembarques de camarón con tallas que superen las tallas de primera\nmadurez del camarón, según se estable en el Reglamento de la Ley de Pesca y\nAcuicultura.\n\nArtículo 6º-Se insta a todas las instituciones públicas, así como las\norganizaciones no gubernamentales e iniciativas privadas, involucradas en este\nproceso a:\n\na) Comprometerse a la búsqueda de los recursos económicos para el\ncumplimiento de las medidas propuestas. Lo anterior, como un ejemplo de alianza\npúblico-privado.\n\nb) Desarrollar un modelo de reconversión productiva para aquellas\nembarcaciones para las cuales expire la licencia en este periodo (2015-2016),\ncomo una experiencia modelo y una alternativa que garantice el derecho al\ntrabajo, el cual pueda ser replicado en otras embarcaciones a futuro.\n\nArtículo 7º-Rige a partir de su publicación.\n\nDado en la Presidencia de la República, a los seis días del mes de marzo\nde dos mil quince.",
  "body_en_text": "in the entirety of the text\n\n                    -\n\n                        Full Text of Norm 021\n\n                        For the generation of a national policy for the sustainable use of\nshrimp, generation of employment and combating poverty\n\nFull Text of act: 103C43\n\nN° 021-P\n\nTHE PRESIDENT OF THE REPUBLIC\n\nBased on articles 26 subsection b), 99 and 100 of the General Public Administration Act; and,\n\nConsidering:\n\nI.-That article 50 of the Political Constitution provides that it is the obligation of the State to procure the greatest well-being for all inhabitants of the country, organizing and stimulating production and the most adequate distribution of wealth. Likewise, it incorporates the right of every person to a healthy and ecologically balanced environment.\n\nII.-That, likewise, article 56 of the Political Constitution establishes that the State must guarantee dignified, honest work that is useful to society.\n\nIII.-That by Law Nº 7416, Convention on Biological Diversity, States have the sovereign right to exploit their own marine and coastal resources in application of their own environmental policy and the obligation to ensure that activities carried out within their jurisdiction or under their control do not harm the environment of other States or of areas beyond any national jurisdiction.\n\nIV.-That the Organic Environmental Act indicates that the marine and coastal resources contained in the exclusive economic zone, in which the Ministry of Environment and Energy in coordination with the competent institutions may delimit protection zones, shall be subject to management and planning plans, in order to prevent and combat pollution or the degradation of ecosystems and key species.\n\nV.-That the Law on the Creation of the Costa Rican Institute of Fisheries and Aquaculture, Law Nº 7384, establishes as a function of this state public entity to regulate the rational use of fishery resources to achieve greater economic yields, and the protection of marine and aquaculture species.\n\nVI.-That it is the responsibility of the Costa Rican Institute of Fisheries and Aquaculture (INCOPESCA), as the Governing Institution of the fishery and aquaculture sector of our country, to establish management measures for the sustainable use of hydrobiological resources, which allow for the protection of reproduction, recruitment and feeding areas, which favor the increase of species and the increase of their biomass, in a way that guarantees their sustainability for the benefit of the ecosystems and the fishers.\n\nVII.-That the contribution, good faith and voluntary proposals expressed by all sectors: fishery, academic, environmental and governmental, are recognized, in the search for a comprehensive national solution (social, economic, cultural and environmental) to guarantee a marine management that is sustainable, responsible, with equity and justice that allows for the use of shrimp in Costa Rica, generated by the dialogue process led by the Ministry of Agriculture and Livestock (MAG), the Costa Rican Institute of Fisheries and Aquaculture (INCOPESCA) and the Ministry of Environment and Energy (MINAE), through the Vice-Ministry of Waters, Seas, Coasts and Wetlands.\n\nVIII.-That the commitment and the responsibility assumed by the governmental Institutions involved in the dialogue process, the openness towards the generation of actions that promote the development and conservation of marine and coastal resources are valued.\n\nIX.-That the adequate and mandatory coordination between the entities and institutions of the State that have some responsibility in the management and conservation of coastal and marine resources is of vital importance. Constitutional jurisprudence has emphasized the duty of coordination among public agencies as a means to preserve and guarantee the fundamental rights of persons, through well-oriented, efficient and effective administrative action.\n\nX.-That this process and the actions to be derived from it, are framed in complete adherence to and respect for Voto N° 2013-010540 and its recommendations issued by the Constitutional Chamber of the Supreme Court of Justice. In addition, the social, cultural and economic impact is recognized, product of this particular pronouncement; the impact on the right to work of vulnerable groups such as youth, women and older adults, mainly in the province of Puntarenas.\n\nXI.-That this directive entails a programmatic action of total compliance and implementation of at least twelve months term. Therefore,\n\nThe following is issued,\n\nDirective:\n\n\"FOR THE GENERATION OF A\nNATIONAL POLICY\n\nFOR THE SUSTAINABLE USE OF\nSHRIMP,\n\nGENERATION OF EMPLOYMENT AND COMBATING\n\nPOVERTY\"\n\nArticle 1º-The Ministry of the Presidency is instructed to:\n\na) Form a Dialogue Table that will be coordinated by the Costa Rican Institute of Fisheries and Aquaculture (INCOPESCA) and the Ministry of Environment and Energy, through the Vice-Ministry of Waters, Seas, Coasts and Wetlands, which will have the following objectives:\n\ni. Within a maximum of three months, draft a bill for the management of sustainable shrimp fisheries, generation of employment and combating of poverty to present it to the Legislative Assembly.\n\nii. Develop a continuous coordination process for the implementation of the National Fishery and Aquaculture Development Plan.\n\nb) Maintain that Dialogue Table for support on important issues as deemed necessary by the Board of Directors and the Executive Presidency of INCOPESCA.\n\nc) This Dialogue Table shall be composed of the following institutions: Ministry of Agriculture and Livestock (MAG), Joint Institute of Social Aid (IMAS), Ministry of Labor and Social Security (MTSS), National Institute of Women (INAMU), Development Banking System (SBD), National Coastguard Service (SNG), National Learning Institute (INA), National Production Council (CNP), Ministry of Public Education (MEP), Ministry of Public Works and Transport (MOPT), Costa Rican Institute of Pacific Ports (INCOP), National System of Conservation Areas (SINAC), National Institute of Rural Development (INDER), Ministry of Science, Technology and Telecommunications (MICITT) and other institutions related to the subject. In addition, it will be composed of the representatives of the fishery, environmental and academic sectors identified during the Dialogue process. The Municipalities of the coastal zones will be invited to accompany this Dialogue Table.\n\nd) The Ombudsman's Office of the Republic will be invited to participate as an observer and guarantor of the process of drafting the \"National Policy for the Sustainable Use of Shrimp, Generation of Employment and Combating Poverty\", and thus guarantee that the different sectors identified during the Dialogue process are duly heard and their interests analyzed.\n\nArticle 2º-INCOPESCA and the Vice-Ministry of Waters, Seas, Coasts and Wetlands are instructed to:\n\na) Coordinate and facilitate the Dialogue Table.\n\nb) Prepare the basis for discussion for the construction of a Bill for the sustainable use of shrimp fishing, generation of employment and combating poverty to be discussed at the dialogue table.\n\nc) Develop a national communication campaign, under the following objectives:\n\ni. Dignify the fishing activity in our country.\n\nii. Make visible the importance of the same.\n\niii. Share the social, economic and environmental contribution of the different fishing sectors in national development, food security and the combating of poverty.\n\niv. Share and strengthen the cultural identity of fishing communities.\n\nArticle 3º-The Ministry of the Presidency, jointly with INCOPESCA and the Vice-Ministry of Waters, Seas and Wetlands, will invite the State Institutions of Higher Education and the Environmental Organizations, to develop a Research Program that, jointly with the Department of Research and Development of INCOPESCA, generates the necessary information for decision-making, starting with a baseline, constituted by a first report at the end of the first year on the state of the shrimp resource by zone and fishing method, and so on successively in the subsequent years.\n\nArticle 4º-The semi-industrial shrimp sector is requested and urged to initiate a voluntary process for the use of the measures proposed by this sector within the framework of the Dialogue process, which allows for the generation of information for decision-making and the consolidation of this Directive. It is requested that these measures include at least:\n\na) The use of satellite tracking devices.\n\nb) The use of 100% of turtle and fish excluder devices.\n\nc) A setback of 15 meters of bathymetry along the Pacific coast.\n\nd) Respect for the closed seasons and an increase in closed season periods from 4 to 6 months.\n\ne) Develop an onboard observer program, in coordination with INCOPESCA, for the monitoring of catches, discards and minimum sizes.\n\nf) Allow monitoring by INCOPESCA and other scientific and academic support institutions of the landings in zones officially defined by INCOPESCA.\n\nArticle 5º-The small-scale shrimp fishing sector is requested and urged to initiate a voluntary process for the use of the measures proposed by this sector within the framework of the Dialogue process, which allows for the generation of information for decision-making and the consolidation of this Directive. It is requested that these measures include at least:\n\na) The use of authorized fishing gear.\n\nb) Respect for the closed season periods and zones.\n\nc) Landings of shrimp with sizes that exceed the size at first maturity of the shrimp, as established in the Regulations of the Fishery and Aquaculture Law.\n\nArticle 6º-All public institutions, as well as non-governmental organizations and private initiatives, involved in this process are urged to:\n\na) Commit to the search for economic resources for the fulfillment of the proposed measures. The foregoing, as an example of a public-private partnership.\n\nb) Develop a productive reconversion model for those vessels whose license expires in this period (2015-2016), as a model experience and an alternative that guarantees the right to work, which may be replicated in other vessels in the future.\n\nArticle 7º-It shall take effect upon its publication.\n\nGiven at the Presidency of the Republic, on the sixth day of March of two thousand fifteen."
