y 28 inciso 1) acápite b) de la Ley\nGeneral de la Administración Pública N° 6227, artículo 3 incisos I, II y III de\nla Ley de Aguas Nº 276 del 27 de agosto de 1942, artículo 7 inciso b) de la Ley\nde Tierras y Colonización Nº 2825 del 14 de octubre de 1961, artículos 13 y 18\nde la Ley Forestal N° 7575 del 13 de febrero de 1996, artículo 37 de la Ley\nOrgánica del Ambiente N° 7554 del 04 de octubre de 1995, artículos 7 y 82 de la\nLey de Conservación de Vida Silvestre N° 7317 del 30 de octubre de 1992, la\nConvención Relativa a los Humedales de Importancia Internacional (Convención\nRAMSAR), Ley Nº 7224 del 09 de abril de 1991, artículos 1, 9, 10, 11 y 73 de la\nLey sobre la Zona Marítimo Terrestre Nº 6043 del 2 de marzo de 1977, artículo 2\nincisos h) y f) del Reglamento a la Ley sobre la Zona Marítimo Terrestre,\nDecreto Ejecutivo Nº 7841 del 16 de diciembre de 1977, y el artículo IV inciso\nr) del Manual para la clasificación de tierras dedicadas a la conservación de\nlos recursos naturales dentro de la zona marítimo terrestre de Costa Rica,\nDecreto Ejecutivo Nº 36786 del 12 de agosto del 2011.\n\nConsiderando:\n\n1º-Que es función\nesencial del Estado velar por la conservación, protección, administración y\nfomento de la sostenibilidad de los recursos naturales del país.\n\n2º-Que es una\nobligación del Estado llevar a la práctica y cumplir con el mandato del\nartículo 50 de la Constitución Política, en el sentido de proteger el derecho a\nun ambiente sano y ecológicamente equilibrado.\n\n3º-Que el Refugio\nNacional de Vida Silvestre Cipanci fue creado y delimitado mediante el Decreto\nEjecutivo N° 29398-MINAE del 22 de enero del 2001, publicado en el Alcance N°\n25 del Diario Oficial La Gaceta número 62 del 28 de marzo del 2001.\n\n4º-Que el área\nactualmente afectada al régimen del área silvestre protegida, es insuficiente\npara garantizar procesos ecológicos y de conservación a largo plazo, debido a\nla tendencia de uso de los terrenos aledaños, que por la naturaleza del\nrelieve, combinado con factores humanos de riesgo (incendios, erosión, tala y\ncaza ilegal, extracción y sobreexplotación de recursos naturales, sedimentación\ny contaminación, entre otros), hacen vulnerable al refugio.\n\n5º-Que se requiere la\nampliación de los límites del Refugio Nacional de Vida Silvestre Cipanci, como\nmedida que garantice la protección de los ecosistemas de humedales existentes y\nno contemplados en el Decreto Ejecutivo N° 29398-MINAE, mediante procesos de\nprotección y manejo sostenible a largo plazo.\n\n6º-Que\nadicionalmente, la ampliación que se decreta fortalece la voluntad estatal de\ntutelar los ecosistemas del río Tempisque, puesto que complementa la protección\nambiental dada por la existencia de otras áreas silvestres protegidas aledañas,\ncomo lo son el Humedal Zapandí, el Refugio Nacional de Vida Silvestre Laguna de\nMata Redonda, el Humedal Corral de Piedra y el Parque Nacional Palo Verde como\nun bloque de áreas protegidas en la cuenca baja del río Tempisque.\n\n7º-Que en el sector\ndel refugio administrado por el Área de Conservación Arenal Tempisque no se\npracticó ninguna modificación a la delimitación vigente, pero sí se simplificó\nsu descripción por coordenadas.\n\n8º-Que se ha\ncomprobado que la ría del río Tempisque asciende hasta el Paso del Jobo, en el\nextremo norte del canal artificial dibujado en la Hoja Cartográfica Tempisque\n(escala 1:50000), por lo cual se ha incorporado este trayecto del río como\nsitios importantes para el desarrollo de procesos ecológicos que se desarrollan\ncon la influencia mareal y fortalecen la biodiversidad íctica del Tempisque y\ndel Golfo de Nicoya.\n\n9º-Que en el sector\ndel refugio administrado por el Área de Conservación Tempisque, sí se\nrealizaron varias ampliaciones, tanto en un pequeño sector junto a la\nestructura del puente sobre el río Tempisque (el cual es de importancia\nestratégica para el área de conservación), como en manchas de manglar y franjas\nde 50 y 200 metros de ancho (según el caso), sobre las riberas de los ríos\nTempisque, Charco y Bolsón, así como del canal artificial dibujado en la Hoja\nCartográfica Tempisque (escala 1:50000).\n\n10.-Que las manchas\nde manglar y las franjas de 50 y 200 metros sobre las riberas de esos ríos y el\ncanal, constituyen la zona marítimo terrestre de la ría del río Tempisque, y\npor ende son de naturaleza demanial, pertenecen al Estado, y son inalienables e\nimprescriptibles.\n\n11.-Que previamente a\nla introducción del concepto de ría de la zona marítimo terrestre, dado la Ley sobre\nla Zona Marítimo Terrestre Nº 6043 del 2 de marzo de 1977, la Ley de Aguas Nº\n276 del 27 de agosto de 1942 y la Ley de Tierras y Colonización Nº 2825 del 14\nde octubre de 1961, ya le otorgaban la condición demanial a las porciones de\ntierra enunciadas en el Considerando anterior.\n\n12.-Que los\necosistemas ubicados en las áreas ampliadas son de alta importancia para la\nreproducción de la fauna acuática y terrestre, especialmente las diferentes\nespecies de peces, camarones y moluscos.\n\n13.-Que en aquellos\ncasos en que es posible, se fortalece la delimitación del refugio haciendo\nreferencia a los mojones oficiales del Instituto Geográfico Nacional.\n\n14.-Que según los\nartículos 2, 5 y 11 del Decreto Ejecutivo N° 33797-MJ-MOPT del 30 de marzo del\n2007, se decreta como proyección oficial para la representación gráfica\ncostarricense la Proyección Transversal de Mercator para Costa Rica, cuyo\nacrónimo es CRTM05. Por lo tanto, es indispensable referir las nuevas\ncoordenadas del Refugio Nacional de Vida Silvestre Cipanci al mencionado\nsistema.\n\n15.-Que las\nmodificaciones dispuestas en este decreto, son el producto de una serie de\ntrabajos conjuntos entre el Programa de Regularización de Catastro y Registro y\nlas áreas de conservación Arenal Tempisque y Tempisque. Por tanto,\n\nDecretan:\n\n\"REFORMA INTEGRAL DEL\nDECRETO N° 29398-MINAE\n\nDEL 22 DE ENERO DEL 2001\"\n\nArtículo 1º-Se\nreforma el artículo 1 del Decreto Ejecutivo N° 29398-MINAE del 22 de enero del\n2001, el cual se leerá de la siguiente manera:\n\n\"Declárese Refugio Nacional\nde Vida Silvestre de propiedad estatal el cual se denominará \"Refugio de Vida\nSilvestre Cipanci\" en el área que se describe a continuación:\n\nLos límites del\nRefugio Nacional de Vida Silvestre Cipanci por la siguiente descripción literal\ny de coordenadas referidas al sistema de proyección cartográfica oficial para\nCosta Rica CRTM05 y su Datum asociado CR05:\n\nSe parte de un punto\nlocalizado en la confluencia del río Lajas con el río Bebedero en el punto con\nlas coordenadas 1 E 367596 N 1141044.\n\nContinúa en dirección\nsureste aguas arriba del río Lajas sobre su ribera izquierda, hasta una\ndistancia de 50 metros en punto con las coordenadas 2 E 367643 N 1141040.\n\nDe este punto se\ncontinúa en dirección suroeste en una línea paralela a la ribera izquierda del\nrío Bebedero aguas abajo, delimitando una franja de terreno con un ancho de 50\nmetros correspondiente a la Zona Pública de dicho río, hasta el punto con las\ncoordenadas 3 E 367252 N 1139061.\n\nDe este punto se\ncontinúa el límite del Refugio en sentido sur sobre el límite del manglar según\nel insumo de Patrimonio Natural del Estado, hasta el punto con las coordenadas 4\nE 368027 N 1137758, este último punto se encuentra localizado a una\ndistancia de 50 metros desde la ribera izquierda del río Bebedero en línea\nperpendicular.\n\nSe continúa en\ndirección sureste en una línea paralela a esa ribera del río aguas abajo,\ndelimitando una franja de terreno con un ancho de 50 metros correspondiente a\nla Zona Pública, hasta el punto con las coordenadas 5 E 367668 N 1137134.\nEste último punto se encuentra localizado a una distancia de 50 metros desde la\nribera del río en línea perpendicular.\n\nDe este punto se\ncontinúa el límite del Refugio en sentido sur sobre el límite del manglar según\nel insumo de Patrimonio Natural del Estado, hasta el punto con las coordenadas 6\nE 365083 N 1134000.\n\nDe este último punto\nse continúa el límite con una línea recta hasta el punto con las coordenadas 7\nE 365447 N 1133417.\n\nSe continúa sobre el\nlímite del manglar según el insumo de Patrimonio Natural del Estado, hasta el\npunto con las coordenadas 8 E 365429 N 1130760, localizado a una\ndistancia de 50 metros desde la ribera izquierda del río Tempisque en línea\nperpendicular.\n\nDe este último punto\nse continúa en dirección suroeste en una línea paralela a esa ribera del río\naguas abajo, delimitando una franja de terreno con un ancho de 50 metros\ncorrespondiente a la Zona Pública, hasta el punto con las coordenadas 9 E\n365328 N 1130178, localizado a una distancia de 50 metros desde la ribera\nizquierda del río Tempisque en línea perpendicular.\n\nDe este punto se\ncontinúa el límite del Refugio en sentido sureste sobre el límite del manglar\nsegún el insumo de Patrimonio Natural del Estado, hasta el punto con las\ncoordenadas 10 E 365541 N 1130193.\n\nSe continúa por una\nsucesión de líneas rectas uniendo los puntos con las coordenadas:\n\n11 E\n365512 N 1130365\n\n12 E\n365587 N 1130507\n\n13 E\n365916 N 1130289\n\n14 E\n365750 N 1130137\n\n15 E\n365914 N 1129960\n\nEste último punto se\nencuentra localizado en la margen izquierda sentido norte de la Ruta Nacional\nque comunica el poblado de Monte Potrero con Puerto Alegre.\n\nSe continúa el límite del Refugio sobre la\nmargen izquierda sentido norte de la Ruta Nacional que comunica el poblado de\nMonte Potrero con Puerto Alegre hasta el punto con las coordenadas 16 E\n365735 N 1129747.\n\nDe este último punto se continúa el límite\ndel Refugio en sentido suroeste sobre el límite del manglar según el insumo de\nPatrimonio Natural del Estado, hasta el punto con las coordenadas 17 E\n365057 N 1129731, localizado a una distancia de 50 metros desde la ribera\nizquierda del río Tempisque en línea perpendicular.\n\nDe este último punto se continúa en dirección\nsuroeste en una línea paralela a esa ribera del río aguas abajo, delimitando\nuna franja de terreno con un ancho de 50 metros correspondiente a la Zona\nPública, hasta el punto con las coordenadas 18 E 364792 N 1129467,\nlocalizado a una distancia de 50 metros desde la ribera izquierda del río\nTempisque en línea perpendicular.\n\nSe continúa por una sucesión de líneas Article\n146 of the Political Constitution, and in accordance with the provisions of\nArticles 25 subsection 1), 27 subsection 1) and 28 subsection 1) paragraph b) of the\nGeneral Law of Public Administration No. 6227, Article 3 subsections I, II and III of\nthe Water Law No. 276 of August 27, 1942, Article 7 subsection b) of the Law\nof Lands and Colonization No. 2825 of October 14, 1961, Articles 13 and 18\nof the Forestry Law No. 7575 of February 13, 1996, Article 37 of the Organic\nEnvironmental Law No. 7554 of October 4, 1995, Articles 7 and 82 of the\nWildlife Conservation Law No. 7317 of October 30, 1992, the\nConvention on Wetlands of International Importance (RAMSAR\nConvention), Law No. 7224 of April 9, 1991, Articles 1, 9, 10, 11 and 73 of the\nLaw on the Maritime Terrestrial Zone No. 6043 of March 2, 1977, Article 2\nsubsections h) and f) of the Regulation to the Law on the Maritime Terrestrial Zone,\nExecutive Decree No. 7841 of December 16, 1977, and Article IV subsection\nr) of the Manual for the classification of lands dedicated to the conservation of\nnatural resources within the maritime terrestrial zone of Costa Rica,\nExecutive Decree No. 36786 of August 12, 2011.\n\nConsidering:\n\n1º-That it is an essential\nfunction of the State to ensure the conservation, protection, administration and\npromotion of the sustainability of the country's natural resources.\n\n2º-That it is an\nobligation of the State to implement and comply with the mandate of\nArticle 50 of the Political Constitution, in the sense of protecting the right\nto a healthy and ecologically balanced environment.\n\n3º-That the Cipanci\nNational Wildlife Refuge was created and delimited by Executive\nDecree No. 29398-MINAE of January 22, 2001, published in Supplement No.\n25 of the Official Gazette La Gaceta number 62 of March 28, 2001.\n\n4º-That the area\ncurrently affected by the protected wild area regime is insufficient\nto guarantee long-term ecological and conservation processes, due\nto the land-use trend of the surrounding lands, which, by the nature of the\nrelief, combined with human risk factors (fires, erosion, illegal logging and\nhunting, extraction and overexploitation of natural resources, sedimentation\nand contamination, among others), make the refuge vulnerable.\n\n5º-That the expansion\nof the boundaries of the Cipanci National Wildlife Refuge is required, as\na measure that guarantees the protection of the existing wetland ecosystems\nnot contemplated in Executive Decree No. 29398-MINAE, through long-term\nprotection and sustainable management processes.\n\n6º-That\nadditionally, the expansion decreed strengthens the state's will to\nprotect the ecosystems of the Tempisque River, since it complements the environmental protection\ngiven by the existence of other neighboring protected wild areas,\nsuch as the Zapandí Wetland, the Mata Redonda Lagoon National Wildlife Refuge, the Corral de Piedra Wetland and the Palo Verde National Park, as\na block of protected areas in the lower basin of the Tempisque River.\n\n7º-That in the sector\nof the refuge administered by the Arenal Tempisque Conservation Area, no\nmodification was made to the current delimitation, but its\ndescription by coordinates was simplified.\n\n8º-That it has been\nverified that the ria (ría) of the Tempisque River ascends to Paso del Jobo, at the\nnorthern end of the artificial canal drawn on the Tempisque Cartographic Sheet\n(scale 1:50000), for which this stretch of the river has been incorporated as\nimportant sites for the development of ecological processes that occur\nwith tidal influence and strengthen the fish biodiversity of the Tempisque and\nthe Gulf of Nicoya.\n\n9º-That in the sector\nof the refuge administered by the Tempisque Conservation Area, several\nexpansions were indeed made, both in a small sector next to the\nbridge structure over the Tempisque River (which is of strategic\nimportance for the conservation area), and in mangrove patches and strips\nof 50 and 200 meters wide (as applicable), along the banks of the\nTempisque, Charco and Bolsón rivers, as well as the artificial canal drawn on the\nTempisque Cartographic Sheet (scale 1:50000).\n\n10.-That the mangrove\npatches and the strips of 50 and 200 meters along the banks of those rivers and the\ncanal, constitute the maritime terrestrial zone of the ria (ría) of the Tempisque River,\nand therefore are of public domain (demanial) nature, belong to the State,\nand are inalienable and imprescriptible.\n\n11.-That prior to\nthe introduction of the concept of ria (ría) of the maritime terrestrial zone, given the Law on\nthe Maritime Terrestrial Zone No. 6043 of March 2, 1977, the Water Law No.\n276 of August 27, 1942 and the Law of Lands and Colonization No. 2825 of\nOctober 14, 1961, already granted public domain (demanial) status to the portions of\nland stated in the previous Considering.\n\n12.-That the\necosystems located in the expanded areas are of high importance for the\nreproduction of aquatic and terrestrial fauna, especially the different\nspecies of fish, shrimp and mollusks.\n\n13.-That in those\ncases where it is possible, the delimitation of the refuge is strengthened by\nreferencing the official landmarks (mojones) of the National Geographic Institute.\n\n14.-That according to\nArticles 2, 5 and 11 of Executive Decree No. 33797-MJ-MOPT of March 30,\n2007, the Transverse Mercator Projection for Costa Rica, whose\nacronym is CRTM05, is decreed as the official projection for Costa Rican graphic\nrepresentation. Therefore, it is essential to refer the new\ncoordinates of the Cipanci National Wildlife Refuge to the mentioned\nsystem.\n\n15.-That the\nmodifications provided in this decree are the product of a series of\njoint efforts between the Cadastre and Registry Regularization Program and\nthe Arenal Tempisque and Tempisque conservation areas. Therefore,\n\nThey Decree:\n\n\"INTEGRAL REFORM OF\nDECREE No. 29398-MINAE\n\nOF JANUARY 22, 2001\"\n\nArticle 1.-Article 1 of Executive Decree No. 29398-MINAE of January 22,\n2001 is reformed, which shall read as follows:\n\n\"Declare a State-owned National\nWildlife Refuge which shall be named \"Cipanci Wildlife\nRefuge\" in the area described below:\n\nThe boundaries of the\nCipanci National Wildlife Refuge by the following literal description\nand coordinates referenced to the official cartographic projection system for\nCosta Rica CRTM05 and its associated Datum CR05:\n\nIt begins at a point\nlocated at the confluence of the Lajas River with the Bebedero River at the point with\ncoordinates 1 E 367596 N 1141044.\n\nIt continues southeast\nupstream along the Lajas River on its left bank, for\na distance of 50 meters to the point with coordinates 2 E 367643 N 1141040.\n\nFrom this point it\ncontinues southwest in a line parallel to the left bank of the\nBebedero River downstream, delimiting a strip of land with a width of 50\nmeters corresponding to the Public Zone of said river, to the point with\ncoordinates 3 E 367252 N 1139061.\n\nFrom this point the\nboundary of the
