  "body_es_text": "en la totalidad del texto\n\n                    -\n\n                        Texto Completo Norma 39114\n\n                        Oficializa Plan de Acción de la Estrategia Nacional de Cambio Climático\n\nTexto Completo acta: 1063F9\n\nN°\n39114-MINAE\n\nEL PRESIDENTE DE LA REPÚBLICA\n\nY EL MINISTRO DE AMBIENTE Y ENERGÍA\n\ntext-indent:24.0pt'>En ejercicio de las atribuciones que les confieren los\nartículos 140, incisos 3), 18) 20) y 146 de la Constitución Política, los artículos\n4 y 27 de la Ley General de Administración Pública del 2 de mayo de 1978, los\nartículos 2 inciso c) y 3) de la Ley Orgánica del Ambiente N° 7554 del 4 de\noctubre de 1995, el artículo 2 de la Ley Orgánica del Ministerio del Ambiente y\nEnergía, del 5 de junio de 1990 y el Decreto Ejecutivo 38536-MP-PLAN del 25 de\njulio del 2014.\n\nConsiderando:\n\n1º-Que la Estrategia Nacional de Cambio Climático, fue\noficializada por el Ministerio de Ambiente y Energía, en el año 2009, como el\nmarco referencial para la agenda nacional de cambio climático en el nivel\nnacional e internacional, compuesta por los componentes estratégicos de\nmitigación y adaptación, y sus ejes transversales de métricas, desarrollo de\ncapacidades y transferencia tecnológica, sensibilización pública, educación y\ncambio cultural y financiamiento.\n\n2º-Que\nel Plan de Acción de la Estrategia Nacional de Cambio Climático fue presentado\nen un acto público en el mes de noviembre del 2012 por el Ministro de Ambiente\ny Energía, el Vicepresidente de la Republica, con acompañamiento de la\nDirección de Cambio Climático.\n\n3º-Que\nla Contraloría General de la República, mediante el \"Informe final de la\nauditoría de carácter especial acerca del avance en la implementación de la\nEstrategia Nacional de Cambio Climático\", DFOE-AE-0626\n(11961)/DFOE-AE-IF-11-2014 de fecha 10 de noviembre del 2014, establece la\ndisposición 4.3 dirigida al Ministro Rector, para que proceda a oficializar el\nPlan de Acción de la Estrategia Nacional de Cambio Climático, en el marco del Reglamento\nOrgánico del Poder Ejecutivo, a efecto de que este Plan con sus objetivos,\nmetas y acciones generales sean obligatorios para las instituciones públicas\ninvolucradas.\n\n4º-Que\nel Reglamento Orgánico del Poder Ejecutivo, Decreto Ejecutivo 38536-MP-PLAN,\nestablece la agrupación de instituciones por sector con acciones afines y\ncomplementarias entre sí en áreas del quehacer público, regido por una o un\nMinistro Rector, establecido con el fin de imprimir un mayor grado de\ncoordinación, eficacia y eficiencia en la Administración Pública.\n\n5º-Que\nde conformidad con la norma citada, la rectoría del sector Ambiente, Energía,\nMares y Ordenamiento Territorial, es ejercida por el Ministro de Ambiente y\nEnergía, a quien le corresponde la potestad junto con el Presidente de la\nRepública de coordinar, articular y conducir las actividades del sector, bajo\nla orientación del Plan Nacional de Desarrollo.\n\n6º-Que\nes de interés del Gobierno de la República, emitir el siguiente decreto a\nefecto de oficializar el Plan de Acción de la Estrategia Nacional de Cambio\nClimático y se instruya su cumplimiento obligatorio.   "body_en_text": "en la totalidad del texto\n\n                    -\n\n                        Complete Text of Regulation 39114\n\n                        Formalizes the Action Plan of the National Climate Change Strategy\n\nComplete Text record: 1063F9\n\nN°\n39114-MINAE\n\nTHE PRESIDENT OF THE REPUBLIC\n\nAND THE MINISTER OF ENVIRONMENT AND ENERGY\n\nIn exercise of the powers conferred upon them by articles 140, subsections 3), 18), 20) and 146 of the Political Constitution, articles 4 and 27 of the General Law of Public Administration of May 2, 1978, articles 2 subsection c) and 3) of the Organic Law of the Environment No. 7554 of October 4, 1995, article 2 of the Organic Law of the Ministry of Environment and Energy of June 5, 1990, and Executive Decree 38536-MP-PLAN of July 25, 2014.\n\nConsidering:\n\n1º-That the National Climate Change Strategy was formalized by the Ministry of Environment and Energy in 2009 as the reference framework for the national climate change agenda at the national and international levels, composed of the strategic components of mitigation and adaptation, and their cross-cutting axes of metrics, capacity building and technology transfer, public awareness, education and cultural change, and financing.\n\n2º-That the Action Plan of the National Climate Change Strategy was presented at a public event in November 2012 by the Minister of Environment and Energy and the Vice President of the Republic, with the support of the Directorate of Climate Change.\n\n3º-That the Office of the Comptroller General of the Republic, through the \"Final report of the special audit on the progress in the implementation of the National Climate Change Strategy,\" DFOE-AE-0626 (11961)/DFOE-AE-IF-11-2014 dated November 10, 2014, establishes provision 4.3 addressed to the Rector Minister, to proceed to formalize the Action Plan of the National Climate Change Strategy, within the framework of the Organic Regulation of the Executive Branch, so that this Plan with its objectives, goals, and general actions are mandatory for the public institutions involved.\n\n4º-That the Organic Regulation of the Executive Branch, Executive Decree 38536-MP-PLAN, establishes the grouping of institutions by sector with related and complementary actions in areas of public activity, governed by a Rector Minister, established with the aim of imprinting a greater degree of coordination, effectiveness, and efficiency in the Public Administration.\n\n5º-That in accordance with the cited regulation, the stewardship of the Environment, Energy, Seas, and Land-Use Planning sector is exercised by the Minister of Environment and Energy, who is vested with the authority, together with the President of the Republic, to coordinate, articulate, and conduct the sector's activities, under the guidance of the National Development Plan.\n\n6º-That it is in the interest of the Government of the Republic to issue the following decree in order to formalize the Action Plan of the National Climate Change Strategy and to instruct its mandatory compliance. Therefore,\n\nThey Decree\n\nFORMALIZATION OF THE ACTION PLAN\n\nOF THE NATIONAL CLIMATE CHANGE STRATEGY\n\nArticle 1º-Formalize, for purposes of mandatory application, the Action Plan of the National Climate Change Strategy, as a strategic sectoral instrument for actions in the area of climate change, in accordance with the Strategy.\n\nThe Action Plan and the National Climate Change Strategy will be available on the website of the Ministry of Environment and Energy, Directorate of Climate Change at the following address: http://www.minae.go.cr and the printed version shall be kept in the institutional archive of the Directorate of Climate Change.\n\n \n\n(Note from Sinalevi: Due to the type of format, the Action Plan and the National Climate Change Strategy can be consulted at the following link)\n\nArticle 2º-On a mandatory basis, the public institutions that make up the Environment, Energy, Seas, and Land-Use Planning Sector must implement the Plan with its corresponding objectives, goals, and general actions. The ministerial, organizational, or sectoral plans that derive from it must be coordinated with the Directorate of Climate Change of the Ministry of Environment and Energy.\n\nArticle 3º-The public institutions that make up the Environment, Energy, Seas, and Land-Use Planning Sector must carry out the necessary internal and external, budgetary, and administrative procedures to have the resources for compliance with this guideline and reflect them in their Annual Operating Plans in accordance with the current National Development Plan.\n\nArticle 4º-The Directorate of Climate Change of the Ministry of Environment and Energy shall be responsible for monitoring the execution of the Action Plan of the National Climate Change Strategy in coordination with the Sectoral Secretariat of Environment, Energy, Seas, and Land-Use Planning.\n\nArticle 5º-In order to monitor the implementation control and degree of progress of the actions adopted, the public institutions that make up the Environment, Energy, Seas, and Land-Use Planning Sector must facilitate and report the necessary information to the Directorate of Climate Change of the Ministry of Environment and Energy and to the Sectoral Secretariat of Environment, Energy, Seas, and Land-Use Planning.\n\nArticle 6º-It shall be effective upon its publication.\n\nGiven in the province of Guanacaste, on the twenty-fifth day of July, two thousand fifteen."
