Por su parte, aunque todo su territorio está regado por ríos, su red\nhidrológica dominada por el río Tempisque y afluentes, disminuyedominada por el\nrío Tempisque y afluentes, disminuye notablemente durante la estación seca,\ncondición que se prolonga en general, por cinco o seis meses al año. \n\n2°-Que\nlas limitaciones hídricas naturales que posee la vertiente Pacífico Norte, se\nven acentuadas ante la presencia de fenómenos naturales como El Niño y La Niña\n-ENOS-, además del efecto del Cambio Climático; provocando la modificación del\npatrón de las lluvias que altera significativamente el equilibrio en los\nsistemas hidrológicos, así como la recarga y descarga de agua en los mantos\nacuíferos, afectando finalmente la disponibilidad hídrica para atender\noportunamente la demanda de dicho recurso, para el consumo humano de las\ncomunidades, para el creciente desarrollo agroproductivo y el auge\nturístico, \n\n3°-Que\nse evidencia una tradicional inacción del Estado en la Vertiente Pacífico Norte\nen la inversión oportuna de infraestructura hidráulica estratégica y gestión\ndel agua, que pone en riesgo inminente el Derecho Humano al acceso al agua, lo\nque obliga a tomar a la brevedad políticas efectivas al respecto. \n\n4°-Que\nel Plan Nacional de Desarrollo 2015-2018, \"Alberto Cañas Escalante\", contempla\ncomo acción estratégica el desarrollo y ejecución del \"Programa Integral para\nel Abastecimiento de Agua para Guanacaste (Pacífico Norte)\" conocido como PIAAG\nque tiene como objetivo asegurar el aprovechamiento óptimo del recurso hídrico en\nla vertiente Pacífico Norte, para satisfacer las demandas de agua por parte de\nlas comunidades y las distintas actividades productivas, así como el\nmejoramiento del acceso al agua en cantidad y calidad adecuadas. Para ello el\nPIAAG contempla cuatro ejes estratégicos: \n\nI.\nSeguridad hídrica para las comunidades (Derecho Humano acceso al agua -\nsistemas de Acueductos y Alcantarillados y Acueductos Comunales - ASADAS) \n\nII.\nSeguridad alimentaria (Incremento de la producción alimentaria con sistemas de\nriego) \n\nIII.\nNecesidades de agua de los ecosistemas (Promover la sostenibilidad de los\necosistemas) \n\nIV.\nGestión de aprovechamiento sostenible (Mejorar el aprovechamiento del agua\ndisponible, con prioridad el agua subterránea) \n\n5°-Que el PIAAG integra una serie de acciones\nestratégicas para el desarrollo de infraestructura hidráulica, promoción y\ndesarrollo de alternativas tecnológicamente novedosas, así como actividades de\nconservación y uso eficiente del agua, todo con el fin de atender y mejorar el\nacceso de este recurso en el inmediato, corto, mediano y largo plazo. \n\n6°-Que\nresulta de interés público la ejecución de los proyectos de infraestructura y\nde gestión que se integran en el PIAAG, que permitirán ampliar y hacer\nsostenible la oferta hídrica disponible en Guanacaste - Pacífico Norte.\nProyectos entre los cuales están: Sistema de Abastecimiento de Agua de la\nMargen Derecha del Río Tempisque y Comunidades Costeras, Embalse Las Loras,\nEmbalse La Cueva, así como proyectos de mejora, ampliación y nuevos acueductos\npoblacionales ejecutados por el Instituto Costarricense de Acueductos y\nAlcantarillados y las Asociaciones Administradoras de Acueductos Comunales,\npara atender la demanda de agua de las comunidades de los cantones de la\nProvincia de Guanacaste y los Distritos Lepanto, Paquera y Cóbano de la\nProvincia de Puntarenas; además del abastecimiento de los desarrollos\nturísticos costeros, así como otros proyectos que forman parte de los ejes\nestratégicos del PIAGG, entre los que están los relacionados con actividades de\ndesarrollo tecnológico de instrumentos como la implementación de un Sistema de\nMonitoreo de Agua Subterránea en Tiempo Real y el Sistema de Información para\nla Gestión Integrada de los Recursos Hídricos, la regulación y promoción de\nalternativas novedosas de acceso al agua como cosecha de lluvia y\ndesalinización; entre otras actividades de gestión. \n\n7°-Que\nen razón de lo anterior, se requiere declarar de interés público el citado\nPrograma, toda vez que el país requiere incrementar todos los esfuerzos\nnecesarios para el aprovechamiento óptimo y sostenible de los recursos\nhídricos, de tal forma que pueda satisfacer adecuadamente las necesidades\nbásicas de los ciudadanos, las cuales muestran una tendencia creciente,\nproducto del aumento de población, impacto turístico, cambio climático,\ncompetitividad agroproductividad y demanda alimentaria, entre otras razones. In turn, although its entire territory is irrigated by rivers, its hydrological network, dominated by the Tempisque River and its tributaries, diminishesdominated by the Tempisque River and its tributaries, noticeably diminishes during the dry season, a condition that generally extends for five or six months of the year. \n\n2°-That the natural water limitations that the North Pacific watershed possesses are accentuated by the presence of natural phenomena such as El Niño and La Niña -ENSO-, in addition to the effect of Climate Change; causing a modification of rainfall patterns that significantly alters the equilibrium in hydrological systems, as well as the recharge and discharge of water in the aquifers (mantos acuíferos), ultimately affecting water availability (disponibilidad hídrica) to timely meet the demand for said resource, for human consumption in communities, for growing agro-productive development, and the tourism boom. \n\n3°-That a traditional inaction by the State is evident in the North Pacific Watershed regarding timely investment in strategic hydraulic infrastructure and water management, which places the Human Right to access to water at imminent risk, requiring effective policies to be adopted in this regard as soon as possible. \n\n4°-That the National Development Plan 2015-2018, \"Alberto Cañas Escalante\", contemplates as a strategic action the development and execution of the \"Integrated Program for the Water Supply for Guanacaste (North Pacific)\" known as PIAAG, which aims to ensure the optimal use of the water resource in the North Pacific watershed, to satisfy the water demands of communities and the different productive activities, as well as improving access to water in adequate quantity and quality. To this end, the PIAAG contemplates four strategic pillars (ejes estratégicos): \n\nI. Water security (Seguridad hídrica) for communities (Human Right to access water - Aqueduct and Sewer systems and Communal Aqueducts - ASADAS) \n\nII. Food security (Increment of food production with irrigation systems) \n\nIII. Water needs of ecosystems (Promote ecosystem sustainability) \n\nIV. Management for sustainable use (Improve the use of available water, with priority on groundwater) \n\n5°-That the PIAAG integrates a series of strategic actions for the development of hydraulic infrastructure (infraestructura hidráulica), promotion and development of technologically novel alternatives, as well as conservation and efficient water use activities, all in order to address and improve access to this resource in the immediate, short, medium, and long term. \n\n6°-That the execution of the infrastructure and management projects that are integrated into the PIAAG, which will allow expanding and making sustainable the water supply available in Guanacaste - North Pacific, is of public interest. Projects among which are: the Water Supply System for the Right Bank of the Tempisque River and Coastal Communities, Las Loras Reservoir (Embalse Las Loras), La Cueva Reservoir (Embalse La Cueva), as well as improvement, expansion, and new community water supply projects executed by the Costa Rican Institute of Aqueducts and Sewers and the Administrative Associations of Communal Aqueducts, to meet the water demand of the communities of the cantons of the Province of Guanacaste and the Districts of Lepanto, Paquera, and Cóbano of the Province of Puntarenas; in addition to the water supply for coastal tourism developments, as well as other projects that form part of the strategic pillars of the PIAAG, among which are those related to technological development activities of instruments such as the implementation of a Real-Time Groundwater Monitoring System and the Information System for Integrated Water Resource Management, the regulation and promotion of novel alternatives for access to water such as rainwater harvesting and desalination; among other management activities. \n\n7°-That by reason of the foregoing, it is necessary to declare said Program of public interest, given that the country needs to increase all necessary efforts for the optimal and sustainable use of water resources, in such a way that it can adequately satisfy the basic needs of citizens, which show a growing trend, resulting from population increase, tourism impact, climate change, agro-productivity competitiveness, and food demand, among other reasons.
