En este\nsentido, los Humedales reportan resultados débiles; y las restantes categorías\nde manejo presentan calificación moderada en este indicador.\"\n\nIV.-Que\nes obligación del Estado garantizar, defender y preservar el derecho a un\nambiente sano y ecológicamente equilibrado. Por consiguiente, el Estado, a través\ndel Ministerio del Ambiente y Energía, tiene la obligación de evitar cualquier\nriesgo o peligro que amenace la permanencia de los ecosistemas de humedal, y el\nde generar una articulación apropiada en el manejo, así como el fomentar la\nparticipación de actores relevantes.\n\nV.-Que\npor Acuerdo Presidencial N° 002-P del 8 de mayo del 2014 publicado en el Diario\nOficial La Gaceta N° 88 de 9 de mayo del 2014, se oficializó el\nViceministro de Aguas, Mares, Costas y Humedales, donde el Señor Ministro de\nAmbiente y Energía mediante Directriz DM-726-2014 del 17 de diciembre del 2014\nasignó, entre otras, la competencia de garantizar y articular esfuerzos\ninstitucionales de coordinación de políticas, estrategias y planes, promoviendo\nla participación de diversos sectores que permitan un abordaje integral en la\ngestión de los recursos hídricos, marinos y costeros.\n\nVI.-Que\nse hace necesario reformular a nivel nacional la estructura técnica asesora y\nsus funciones para que colabore en lo relacionado con la problemática de los\nhumedales y que facilite los procesos de planificación para el uso racional de\nlos mismos.\n\nDecretan:\n\nMODIFICACIÓN AL DECRETO EJECUTIVO\n\nN° 36427-MINAET DEL 25 DE ENERO DEL 2011\n\ntext-indent:24.0pt'>Artículo 1°-Modifíquense los Artículos 3, 4 y 5 del\nDecreto Ejecutivo N° 36427-MINAET del 25 de enero del 2011, para que en\nadelante se lean así:\n\n\"Artículo\n3. El (la) titular del Ministerio del Ambiente y Energía, contará con un\nConsejo Nacional Asesor sobre Humedales, que estará integrado por las\nsiguientes autoridades:\n\na) El\n(la) titular del Viceministerio de Aguas, Mares, Costas y Humedales del\nMinisterio del Ambiente y Energía o su representante, quien preside.\n\nb) Coordinador Nacional de la Autoridad Administrativa de la Convención de Ramsar en adelante\nllamada Convención.\n\nc)\nCoordinador Nacional Gubernamental de la Comisión de Educación y\nConcientización del Público (CECOP) de la Convención.\n\nd)\nCoordinador Nacional No Gubernamental de la Comisión de Educación y\nConcientización del Público (CECOP ONG) de la Convención.\n\ne)\nCoordinador Nacional del Grupo de Examen Científico Técnico (GECT) de la\nConvención.\n\nf) El\n(la) Director(a) del Sistema Nacional de Áreas de Conservación o su\nrepresentante.\n\ng) El\n(la) Director(a) del Centro de Gestión Ambiental del Instituto Costarricense de\nElectricidad o su representante.\n\nh) El\n(la) Presidente(a) Ejecutivo del Instituto Costarricense de Pesca y Acuicultura\no su representante.\n\ni) El\n(la) Presidente(a) Ejecutivo del Instituto Nacional de Innovación y Transferencia\nen Tecnología Agropecuaria o su representante.\n\nj) Un\nrepresentante del Instituto Costarricense de Acueductos y Alcantarillados\n(AYA).\n\nk) Un representante del Centro de Investigación en Ciencias del Mar y Limnología de la Universidad\nde Costa Rica (CIMAR).\n\nl) El\nDirector de Ciencias Biológicas de la Universidad Nacional, o su representante.\n\nm) Un\nrepresentante de la Comisión Nacional de Asuntos Indígenas (CONAI).\n\nn) Dos\nrepresentantes de las organizaciones no gubernamentales del Sector ambiental,\nque desarrollen proyectos que tengan relación con los humedales.\n\no) El\n(la) coordinador(a) del Programa Nacional de Humedales, quien coordinará las\nacciones y velará la ejecución de los acuerdos del Consejo Nacional Asesor\nsobre Humedales. Así mismo llevará la Secretaría del comité.\n\nEl periodo de vigencia de los miembros designados será\npor cuatro años, excepto de los Coordinadores Nacionales que serán designados\npor el periodo que duren sus nombramientos en los puestos representativos ante\nla Convención.\n\nPara la\ndesignación de los representantes de las organizaciones no gubernamentales, el\nMinistro de Ambiente y Energía realizará una convocatoria pública, por\ncualquier medio escrito, radiofónico o digital, a las organizaciones no\ngubernamentales legalmente constituidas y que desarrollen proyectos que tengan\nrelación con los humedales; para que acrediten un representante a través de una\nnota de su respectivo representante legal. De quienes postulen, el Ministro con\nbase en la experiencia acreditada y proyectos desarrollados relacionados con el\ntema, elegirá a los dos representantes.\n\nEl\nConsejo Nacional Asesor sobre Humedales podrá integrar en carácter de asesores,\na las personas que estime conveniente para el buen funcionamiento del mismo. El\nConsejo decidirá, mediante acuerdo unánime de sus miembros, la designación y\nperiodo de nombramiento de dichos asesores.\"\n\n \"Artículo 4. El Consejo Nacional Asesor de\nHumedales, tendrá las siguientes funciones:\n\na)\nAsesorar y apoyar al Ministro(a) de Ambiente y Energía y los otros entes\ngubernamentales encargados de su administración, en la promoción, educación,\nplanificación, desarrollo sostenible y uso racional de los humedales.\n\nb)\nApoyar a los coordinadores nacionales de CECOP para promover el desarrollo y la\nejecución de los programas y planes de acción nacional y locales de\ncomunicación, educación, concienciación y participación dirigidos al uso\nracional y sustentable de los humedales.\n\nc)\nColaborar con las instancias gubernamentales en la búsqueda de recursos\nfinancieros y logísticos para la conservación y el uso racional de las áreas de\nhumedal.\n\nd) Apoyar las acciones para la aplicación nacional de la Convención en Sitios Ramsar y demás\necosistemas de humedal y coordinar acciones con la Secretaría de la Convención a través del\ncoordinador nacional y la Autoridad Administrativa y otros entes internacionales, en materia de\nhumedales.\n\ne)\nPromover la identificación de humedales y apoyar su inclusión en la lista de\nHumedales de Importancia Internacional (Lista de Ramsar)\ncon la previa designación de la Autoridad Administrativa.\n\nf)\nGestionar la ayuda técnica de expertos para la preparación de los Informes\nNacionales ante la Conferencia de las Partes Contratantes para que el\ncoordinador nacional realice la compilación.\n\ng)\nCoordinar la ayuda de expertos para el asesoramiento en el tema de humedales a\ntravés del Coordinador Nacional GECT, para la preparación de documentos\ntécnicos sobre diversos aspectos relacionados con la materia.\n\nh)\nColaborar con el Sistema Nacional de Áreas de Conservación y el Programa\nNacional de Humedales mediante los mecanismos de justificación y el\nProcedimiento de Orientación para la Gestión, en el caso de inclusión o\nexclusión de sitios Ramsar en el registro Montreux, al presentarse cambios en las características\necológicas, el cual debe ser comunicado a la Convención por la Autoridad\nAdministrativa,\n\ni) Dar\nseguimiento a la aplicación de las Resoluciones y Recomendaciones adoptadas por\nla Conferencia de las Partes Contratantes de Ramsar.\n\nj) Los\ndemás que sobre la materia le señale el Ministro(a) de Ambiente y Energía.\"\n\nArtículo 5°-El SINAC y las demás dependencias\npúblicas, que por su naturaleza estén autorizadas para ello, le proporcionarán\nal \"Programa Nacional de Humedales\" los recursos materiales y humanos que sean\nnecesarios para su adecuado funcionamiento siendo este el responsable de la\nejecución de los acuerdos y lineamientos del Consejo Nacional Asesor sobre\nHumedales en el ámbito de sus competencias. However, year after year, they degrade at an accelerated rate, making it necessary to modify the way policies, actions, and plans are being generated, in order to achieve integrated management in accordance with the commitments acquired by the country.\n\nIII.-That the Office of the Comptroller General, in report No. DFOE-AE-IF-16-2014 of December 15, 2014, \"determined the moderate performance of SINAC in promoting cooperation among public institutions, non-governmental actors, local communities, and indigenous peoples for their contribution to the management of continental Protected Wild Areas, to the detriment of optimizing efforts for the conservation and sustainable use of biodiversity. In this regard, Wetlands report weak results; and the remaining management categories present a moderate rating on this indicator.\"\n\nIV.-That it is the State's obligation to guarantee, defend, and preserve the right to a healthy and ecologically balanced environment. Consequently, the State, through the Ministry of Environment and Energy, has the obligation to avoid any risk or danger that threatens the permanence of wetland ecosystems, and to generate appropriate articulation in management, as well as to foster the participation of relevant stakeholders.\n\nV.-That by Presidential Agreement No. 002-P of May 8, 2014, published in the Official Gazette La Gaceta No. 88 of May 9, 2014, the Vice-Ministry of Water, Seas, Coasts, and Wetlands was formalized, where the Minister of Environment and Energy, through Directive DM-726-2014 of December 17, 2014, assigned, among others, the competence to guarantee and articulate institutional efforts for the coordination of policies, strategies, and plans, promoting the participation of diverse sectors that allow for a comprehensive approach to the management of water, marine, and coastal resources.\n\nVI.-That it is necessary to reformulate at the national level the technical advisory structure and its functions so that it collaborates on matters related to wetland issues and facilitates planning processes for their wise use.\n\nThey Decree:\n\nMODIFICATION TO EXECUTIVE DECREE\n\nNo. 36427-MINAET OF JANUARY 25, 2011\n\nArticle 1.-Amend Articles 3, 4, and 5 of Executive Decree No. 36427-MINAET of January 25, 2011, so that henceforth they read as follows:\n\n\"Article 3. The head of the Ministry of Environment and Energy shall have a National Advisory Council on Wetlands, which shall be composed of the following authorities:\n\na) The head of the Vice-Ministry of Water, Seas, Coasts, and Wetlands of the Ministry of Environment and Energy or their representative, who shall preside.\n\nb) National Coordinator of the Administrative Authority of the Ramsar Convention, hereinafter called the Convention.\n\nc) Governmental National Coordinator of the Commission on Education and Public Awareness (CECOP) of the Convention.\n\nd) Non-Governmental National Coordinator of the Commission on Education and Public Awareness (CECOP ONG) of the Convention.\n\ne) National Coordinator of the Scientific and Technical Review Panel (STRP) of the Convention.\n\nf) The Director of the National System of Conservation Areas (SINAC) or their representative.\n\ng) The Director of the Environmental Management Center of the Costa Rican Electricity Institute (ICE) or their representative.\n\nh) The Executive President of the Costa Rican Institute of Fisheries and Aquaculture or their representative.\n\ni) The Executive President of the National Institute for Innovation and Transfer in Agricultural Technology or their representative.\n\nj) A representative of the Costa Rican Institute of Aqueducts and Sewers (AyA).\n\nk) A representative of the Center for Research in Marine Sciences and Limnology of the University of Costa Rica (CIMAR).\n\nl) The Director of Biological Sciences of the National University, or their representative.\n\nm) A representative of the National Commission for Indigenous Affairs (CONAI).\n\nn) Two representatives from non-governmental organizations in the environmental sector that develop projects related to wetlands.\n\no) The coordinator of the National Wetlands Program, who shall coordinate actions and ensure the implementation of the agreements of the National Advisory Council on Wetlands. They shall also serve as the Secretary of the committee.\n\nThe term of office for the designated members shall be four years, except for the National Coordinators, who shall be designated for the duration of their appointments in their representative positions before the Convention.\n\nFor the designation of the representatives of non-governmental organizations, the Minister of Environment and Energy shall issue a public call, by any written, radio, or digital means, to legally constituted non-governmental organizations that develop projects related to wetlands, so that they accredit a representative through a note from their respective legal representative. From those who apply, the Minister, based on accredited experience and projects developed related to the subject, shall select the two representatives.\n\nThe National Advisory Council on Wetlands may integrate, in an advisory capacity, persons it deems appropriate for its proper functioning. The Council shall decide, by unanimous agreement of its members, the designation and term of appointment of such advisors.\"\n\n\"Article 4. The National Advisory Council on Wetlands shall have the following functions:\n\na) Advise and support the Minister of Environment and Energy and the other governmental entities responsible for its administration, in the promotion, education, planning, sustainable development, and wise use of wetlands.\n\nb) Support the CECOP national coordinators to promote the development and execution of national and local communication, education, awareness, and participation programs and action plans aimed at the wise and sustainable use of wetlands.\n\nc) Collaborate with governmental bodies in the search for financial and logistical resources for the conservation and wise use of wetland areas.\n\nd) Support actions for the national implementation of the Convention in Ramsar Sites and other wetland ecosystems and coordinate actions with the Convention Secretariat through the national coordinator and the Administrative Authority and other international entities on wetland matters.\n\ne) Promote the identification of wetlands and support their inclusion in the List of Wetlands of International Importance (Ramsar List) with the prior designation of the Administrative Authority.\n\nf) Arrange technical assistance from experts for the preparation of National Reports for the Conference of the Contracting Parties so that the national coordinator compiles them.\n\ng) Coordinate the assistance of experts for advisory services on wetlands through the STRP National Coordinator, for the preparation of technical documents on various aspects related to the subject.\n\nh) Collaborate with the National System of Conservation Areas and the National Wetlands Program through the justification mechanisms and the Management Guidance Procedure, in the case of inclusion or exclusion of Ramsar sites from the Montreux Record, should changes in ecological characteristics occur, which must be communicated to the Convention by the Administrative Authority.\n\ni) Follow up on the implementation of the Resolutions and Recommendations adopted by the Ramsar Conference of the Contracting Parties.\n\nj) Others that the Minister of Environment and Energy may assign on the matter.\"\n\nArticle 5.-SINAC and the other public agencies, which by their nature are authorized to do so, shall provide the \"National Wetlands Program\" with the material and human resources necessary for its proper functioning, it being responsible for the implementation of the agreements and guidelines of the National Advisory Council on Wetlands within the scope of its competencies. Likewise, the Ministries and State Institutions are authorized, with powers to do so, to collaborate with technical, administrative, and financial resources with the National Wetlands Program.\"\n\nArticle 2.-Effectiveness. This Decree shall enter into force 15 business days after its publication.\n\nGiven at the Presidency of the Republic, on the twenty-ninth day of April two thousand fifteen." }
