Asimismo está\ncomprometido en la reducción de los impactos ambientales negativos que genera\nsu propio accionar.\n\nV.-Que según el\nacuerdo tomado en la sesión 02-2015 del Consejo Sectorial de Ambiente, Energía,\nMares y Ordenamiento Territorial, del 3 de marzo del 2015, el cual fue\ndebidamente comunicado a todos los jerarcas el día 15 abril del 2015, se dio un\nplazo de 6 meses para que las instituciones públicas se pongan al día con la\nelaboración, entrega e implementación del Programa de Gestión Ambiental\nInstitucional (PGAI) ante la Dirección de Gestión de la Calidad Ambiental\n(DIGECA)\n\nVI.-Que según el acta\nde sesión ordinaria número cuarenta y seis del Consejo de Gobierno celebrada el\n14 de abril del 2015 se acuerda que con el objetivo de cumplir con la meta de\nque cada institución desarrolle e implemente su plan de gestión ambiental\ninstitucional (PGAI) se comisiona al Ministro de Ambiente y Energía y a su\nequipo preparar una directriz dirigida al Gobierno Central, que incluya un plan\nde contingencia con medidas prácticas de lo que se debe hacer para cumplir con\nello.\n\nPor tanto, emiten la siguiente:\n\nDIRECTRIZ DIRIGIDA A\nTODOS LOS/AS JERARCAS DEL\n\nGOBIERNO CENTRAL CON EL PROPÓSITO DE\nMEJORAR\n\nEL DESEMPEÑO EN LA IMPLEMENTACIÓN DE\nLOS\n\nPROGRAMAS DE GESTIÓN AMBIENTAL\n\nINSTITUCIONAL\n\nArtículo\n1º-Atendiendo las obligaciones establecidas en el Decreto Ejecutivo N° 36499,\ntodas las instituciones que conforman el Gobierno Central deben: a) contar con\nuna Comisión Ambiental Institucional activa; b) elaborar y entregar ante el\nMINAE su respectivo Programa de Gestión Ambiental Institucional (PGAI); c)\nestar al día con su implementación; y d) entregar los informes de avance\ncorrespondientes ante el MINAE.\n\nAquellas\ninstituciones que a la fecha de publicación de la presente Directriz aún no\ncuenten con Comisión Ambiental Institucional deberán proceder a nombrarla e\niniciar de inmediato con las acciones correspondientes para dar cumplimiento\ncon el Decreto Ejecutivo N° 36499.\n\nArtículo 2º-Para cumplir con lo dispuesto en el artículo 1 de la presente Directriz, las\ninstituciones del Gobierno Central deberán aplicar, según lo establecido en el artículo 9° del\nDecreto Ejecutivo N° 36499, las herramientas emitidas por la Comisión Técnica Evaluadora de los PGAI\n(CTE) disponibles en el sitio http://www. digeca.go.cr/areas/herramientas-para-elaborar-pgai; en\nespecial la Guía para la elaboración de los PGAI, los Protocolos de Evaluación Ambiental, las Hojas\nde Registro (agua, electricidad, combustibles, papel y residuos sólidos valorizables), las Guías\nAmbientales de medidas prácticas de ahorros, la Guía del Ministerio de Hacienda sobre Compras\nPúblicas Sustentables y la Plantilla de Informes de Avance.\n\n \n\n(Nota de Sinalevi: Por\nlo extenso de su contenido y tipo de formato la Guía para la elaboración de los\nPGAI, pueden  ser consulta aquí)\n\n \n\n(Nota de Sinalevi: Por\nlo extenso de su contenido y tipo de formato los Protocolos de Evaluación\nAmbiental, pueden ser consultados aquí)\n\n \n\n(Nota de Sinalevi: Por\nlo extenso de su contenido y tipo de formato las Hojas de Registro (agua,\nelectricidad,\ncombustibles,\npapel\ny residuos\nsólidos valorizables), pueden ser consultados dando clic en cada nombre\nantes mencionado)\n\n \n\n(Nota de Sinalevi: Por\nlo extenso de su contenido y tipo de formato las Guías Ambientales de medidas\nprácticas de ahorros (Guía\nde agua, Guía\nde emisiones, Guía\nde energía, Guía\nde residuos), pueden ser consultados dando clic en cada nombre antes\nmencionado)\n\n \n\n(Nota de Sinalevi: La\nGuía del Ministerio de Hacienda sobre Compras Públicas Sustentables, puede ser\nconsultada en el siguiente links: Disponible\nen la Página Web de COMPRARED)\n\n \n\n \n\n(Nota de Sinalevi: Por\nlo extenso de su contenido y tipo de formato la Plantilla de Informes de Avance, puede\nser consultada aquí)\n\nArtículo 3º-En procura de mejorar la implementación de los PGAI del Gobierno Central, la CTE ofrece\nun Plan de Contingencia (Anexo II de esta Directriz), esto para promover un mejor desempeño en la\ngestión ambiental de las instituciones que aún no han alcanzado calificación verde, lo anterior\nsegún el semáforo de PGAI disponible en el sitio http://www.digeca.go.cr/ areas/semaforo-de-\nimplementacion-pgai. El listado de instituciones a considerar en el Plan de Contingencia se presenta\nen el Anexo I de la presente Directriz.\n\n \n\n(Nota de Sinalevi:\nPor el tipo de formato el semáforo de PGAI, puede ser consultado aquí)\n\nArtículo\n4º-Es obligación de las instituciones contempladas en el Anexo I de esta\ndirectriz cumplir con los plazos establecidos en el Plan de Contingencia del\nAnexo II, el cual pretende facilitar el avance hacia un mejor desempeño en\nmateria ambiental por parte de estas instancias.\n\nArtículo\n5º-Se establece un plazo de un mes que comenzará a regir al día siguiente de la\npublicación de esta Directriz en el Diario Oficial La Gaceta para que\nlas instituciones del Gobierno Central atiendan lo solicitado en esta directriz\ny estén participando del Plan de Contingencia propuesto. Este plan estará disponible en el sitio\nhttp://www.digeca.go.cr/areas/ programas-de-gestion-ambiental-institucional\n\n(2) La distribución de capacitaciones está disponible en http:// www.digeca.go.cr/areas/oferta-de-\ncapacitacion", "body_en_text": "in the entirety of the text\n\n -\n\n Complete Text of Standard 031\n\n The institutions that make up the Central Government must have an\nactive Institutional Environmental Commission; prepare and submit to MINAE their respective Institutional\nEnvironmental Management Program (PGAI)\n\nComplete Text of record: 106F02\n\nDIRECTIVE\n\nNo. 031-MINAE\n\nTHE PRESIDENT OF THE\nREPUBLIC\n\nAND THE MINISTER OF ENVIRONMENT AND ENERGY\n\nIn exercise of the\npowers conferred upon them by Articles 50, 140, subsections 3) and 18) and 146 of the\nPolitical Constitution; the National Planning Law, No. 5525 of May 2,\n1974; Articles 4, 11, 25, 26 subsection b), 27, 98, 99, and 100 of the General\nPublic Administration Law, No. 6227 of May 2, 1978;\nArticles 1 and 2 of the Organic Law of the Ministry of Environment and Energy, No.\n7152 of June 5, 1990; the United Nations Framework Convention on Climate\nChange Law, No. 7414 of June 13, 1994; Law No. 8219 of March 8,\n2002, approving the Kyoto Protocol to the United Nations Framework\nConvention on Climate Change, the Law for the Regulation of\nthe Rational Use of Energy, No. 7447 of November 3, 1994;\nArticles 1, 2, 49 through 72 of the Organic Law of the Environment, Law No. 7554 of October 4,\n1995; Executive Decree No. 36499-MINAE, Regulation for the Preparation of\nInstitutional Environmental Management Programs in the Public Sector of Costa\nRica, of March 17, 2011; the Law for the Protection of Citizens from Excess\nRequirements and Administrative Procedures, No. 8220 of March 4, 2002;\nExecutive Decree No. 35669-MINAET, Organic Regulation of the Ministry of\nEnvironment and Energy of December 4, 2009; Articles 1, 2, 262, 263, 275,\n276 and 344 of the General Health Law, No. 5395, of October 30, 1973,\nArticles 1 and 2 of the Organic Law of the Ministry of Health, No. 5412 of November 8,\n1973; Articles 1, 2, 3, 7, 8, 12, 14, 28 and 30 of the Law for\nIntegrated Waste Management, Law No. 8839 of June 24, 2010; and\nArticle 27 of Executive Decree No. 37567, of the General Regulation to the Law\nfor Integrated Waste Management of November 2, 2012.\n\nWhereas:\n\nI.-That Law No. 8839,\nLaw for Integrated Waste Management, in its Article 28 establishes the\nobligation for all Public Administration institutions to\nimplement environmental management systems (sistemas de gestión ambiental) in all their offices.\n\nII.-That the General\nRegulation to the Law for Integrated Waste Management in its Article 27 indicates\nthat Public Administration institutions, in order to comply with Article 28\nof Law No. 8839, must prepare and implement Institutional Environmental Management Programs (Programas de Gestión Ambiental\nInstitucional), as established in the Regulation for the Preparation of\nInstitutional Environmental Management Programs in the Public Sector of Costa\nRica, Executive Decree No. 36499.\n\nIII.-That Executive\nDecree No. 36499, \"Regulation for the preparation of Institutional Environmental\nManagement Programs in the Public Sector of Costa Rica,\" defines its scope,\nprocedures to be followed by public institutions, as well as\nfollow-up mechanisms by the Ministry of Environment and Energy and the\nMinistry of Health, through the Technical Evaluation Commission (Comisión Técnica Evaluadora) of the\nInstitutional Environmental Management Programs.\n\nIV.-That in\naccordance with public spending reduction measures and the provisions\nof Law No. 8292, \"General Internal Control Law\" of July 31, 2002, the\nCosta Rican public sector must improve efficiency in the administration of\ndiverse resources, seeking savings and making efficient use of water,\nelectricity, fuel, and paper, among others. It is also\ncommitted to reducing the negative environmental impacts generated\nby its own actions.\n\nV.-That according to the\nagreement reached in session 02-2015 of the Sectoral Council for Environment, Energy,\nSeas, and Territorial Planning, of March 3, 2015, which was\nduly communicated to all heads of institutions on April 15, 2015, a\n6-month deadline was given for public institutions to become current with the\npreparation, submission, and implementation of the Institutional Environmental Management Program\n(PGAI) before the Directorate of Environmental Quality Management\n(DIGECA).\n\nVI.-That according to the record\nof ordinary session number forty-six of the Governing Council held on\nApril 14, 2015, it was agreed that with the objective of meeting the goal\nthat each institution develop and implement its institutional environmental management plan\n(PGAI), the Minister of Environment and Energy and his\nteam are commissioned to prepare a directive addressed to the Central Government, which includes a contingency\nplan with practical measures of what must be done to comply with\nthis.\n\nTherefore, they issue the following:\n\nDIRECTIVE ADDRESSED TO\nALL HEADS OF INSTITUTIONS OF THE\n\nCENTRAL GOVERNMENT WITH THE PURPOSE OF IMPROVING\n\nPERFORMANCE IN THE IMPLEMENTATION OF\n\nINSTITUTIONAL ENVIRONMENTAL MANAGEMENT\n\nPROGRAMS\n\nArticle\n1.-In accordance with the obligations established in Executive Decree No. 36499,\nall institutions that make up the Central Government must: a) have\nan active Institutional Environmental Commission (Comisión Ambiental Institucional); b) prepare and submit to\nMINAE their respective Institutional Environmental Management Program (PGAI); c)\nbe current with its implementation; and d) submit the corresponding progress\nreports (informes de avance) to MINAE.\n\nThose\ninstitutions that, as of the date of publication of this Directive, still do\nnot have an Institutional Environmental Commission must proceed to appoint one and\nimmediately begin the corresponding actions to comply\nwith Executive Decree No. 36499.\n\nArticle 2.-In order to comply with the provisions of Article 1 of this Directive, the\ninstitutions of the Central Government must apply, as established in Article 9 of\nExecutive Decree No. 36499, the tools issued by the Technical Evaluation Commission (CTE) for PGAI\navailable on the site http://www.digeca.go.cr/areas/herramientas-para-elaborar-pgai; especially\nthe Guide for the preparation of PGAI, the Environmental Assessment Protocols, the\nRecord Sheets (water, electricity, fuels, paper, and recoverable solid waste), the Environmental\nGuides for practical saving measures, the Ministry of Finance Guide on Sustainable\nPublic Procurement, and the Progress Report Template.\n\n \n\n(Sinalevi Note: Due to\nthe length of its content and format type, the Guide for the preparation of\nPGAI can be consulted here)\n\n \n\n(Sinalevi Note: Due to\nthe length of its content and format type, the Environmental Assessment\nProtocols can be consulted here)\n\n \n\n(Sinalevi Note: Due to\nthe length of its content and format type, the Record Sheets (water,\nelectricity,\nfuels,\npaper,\nand recoverable solid\nwaste) can be consulted by clicking on each name\nmentioned above)\n\n \n\n(Sinalevi Note: Due to\nthe length of its content and format type, the Environmental Guides for practical\nsaving measures (Water\nGuide, Emissions\nGuide, Energy\nGuide, Waste\nGuide) can be consulted by clicking on each name mentioned\nabove)\n\n \n\n(Sinalevi Note: The\nMinistry of Finance Guide on Sustainable Public Procurement can be\nconsulted at the following links: Available\non the COMPRARED Website)\n\n \n\n \n\n(Sinalevi Note: Due to\nthe length of its content and format type, the Progress Report Template can\nbe consulted here)\n\nArticle 3.-In an effort to improve the implementation of the Central Government's PGAI, the CTE offers\na Contingency Plan (Anexo II of this Directive), to promote better performance in\nthe environmental management of institutions that have not yet achieved a green rating, according\nto the PGAI performance dashboard (semáforo de PGAI) available on the site http://www.digeca.go.cr/areas/semaforo-de-\nimplementacion-pgai. The list of institutions to be considered in the Contingency Plan is presented\nin Anexo I of this Directive.\n\n \n\n(Sinalevi Note:\nDue to the format type, the PGAI performance dashboard can be consulted here)\n\nArticle\n4.-It is the obligation of the institutions listed in Anexo I of this\ndirective to comply with the deadlines established in the Contingency Plan of\nAnexo II, which aims to facilitate progress towards better environmental\nperformance by these entities.\n\nArticle\n5.-A period of one month is established, which will take effect the day after the\npublication of this Directive in the Official Gazette La Gaceta, so that\nthe Central Government institutions may attend to what is requested in this directive\nand be participating in the proposed Contingency Plan. For such purposes,\nthey must contact the Directorate of Environmental Quality Management\n(DIGECA) of MINAE.\n\nArticle\n6.-It shall take effect upon its publication in the Official Gazette La Gaceta.\n\nIssued at the Presidency of the Republic.-San José, on the 25th day of the month\nof May of the year two thousand fifteen.\n\nANEXO I\n\nList of Ministries\nto include in the Contingency Plan\n\n1.
