reservaciones en el Parque\nNacional Chirripó\n\nTexto Completo acta: 107536\n\nSISTEMA\nNACIONAL DE ÁREAS DE CONSERVACIÓN\n\nResolución N° ACLA-P-D-434-2015.-Ministerio de\nAmbiente y Energía.-Sistema Nacional de Áreas de Conservación.-Área de\nConservación la Amistad Pacífico, San Isidro de El General, a las diez horas del\nveintinueve de setiembre del dos mil quince.\n\nResultando:\n\n1°-Que de conformidad con el artículo 32 de la Ley\nOrgánica del Ambiente, al Ministerio del Ambiente y Energía le compete la\nadministración de las Áreas Silvestres Protegidas estatales.\n\n2°-Que\nel artículo 22 de la Ley de Biodiversidad, delega en el SINAC la competencia de\nadministrar las Áreas Silvestres Protegidas de carácter estatal, el cual\nestablece que el Sistema Nacional de Áreas de Conservación (SINAC) es un\nsistema de gestión y coordinación institucional, desconcentrado y\nparticipativo, con personería jurídica instrumental que integra las\ncompetencias en materia forestal, vida silvestre, áreas protegidas y adscrito\nal Ministerio de Ambiente y Energía, con el fin de dictar políticas, planificar\ny ejecutar procesos dirigidos a lograr la sostenibilidad en el manejo de los\nrecursos naturales de Costa Rica.\n\n3°-Que\nel Parque Nacional Chirripó es administrado por el Área de Conservación La\nAmistad Pacífico (ACLA-P), mismo que se creó mediante Ley N° 5773, con una\nsuperficie de 43.700, así mismo ampliado mediante Decreto Ejecutivo N° 13496-A\ndel 31 de marzo de 1982.\n\n4°-Que\nel Área de Conservación La Amistad Pacífico dictó las resoluciones\nACLA-P-D-193-2014 de las 9 horas del 21 de mayo del 2014, publicada en La\nGaceta N° 110 del día martes 10 de junio del 2014 y vigente a partir del 23\nde junio del 2014, y ACLA-P-D-02-2015 de las 15:00 horas del 6 de enero del\n2015, publicada en La Gaceta N° 18 del martes 27 de enero del 2015, en\nlas que se establecen las disposiciones para el proceso de reservaciones del\nParque Nacional Chirripó.\n\nConsiderando:\n\nI.-Que el sistema de reservaciones para el Parque Nacional Chirripó que\nse viene utilizando desde el 2011, implica el uso de una línea telefónica\ndefinida como 2742-5083, siendo la única forma de acceso al sistema de\nreservaciones en la actualidad conforme a la normativa indicada.\n\nII.-Que\na partir del 2011, el Instituto Costarricense de Electricidad (ICE) advirtió\ndel problema que se presenta por la saturación de la central telefónica a nivel\nde la Región Brunca ya que para el periodo de reservaciones del Parque Nacional\nChirripó, se da un porcentaje muy elevado de llamadas sin contestar es decir de\npulsaciones, llegando a un 99 % de llamadas sin contestar lo que genera\nrebosamiento del sistema.\n\nIII.-Que\nuna primera medida paliativa fue la instalación de una PBX donde se le\nincorporaron 3 troncales, con el propósito de incorporar a dos personas más al\nmecanismo de reservaciones para con ello poder atender un mayor número de\nllamadas entrantes, sin embargo esto no solucionó el problema.\n\nPosteriormente,\ncon entrada en funcionamiento del contrato de Servicios no esenciales en el\nParque Nacional Chirripó, se tomó otra medida paliativa para evitar el\nrebosamiento de la central telefónica de la Región Brunca, la cual consistió en\ncambiar de dos periodos de reservaciones al año a cuatro periodos, con el fin\nde balancear las distribuciones de llamadas por parte de los miles de usuarios,\nsin embargo esta medida tampoco solventó el problema.\n\nIV.-Que\na raíz de lo anterior el ICE propone una solución al tema haciendo la\ninstalación de un servicio 905 que puede llevar a descongestionar en parte las\nllamadas, por lo que propuso el cambio del número 2742-5083 que se usa actualmente\npor uno nuevo que será el 905-Chirrip o bien 905-2447747 para todos los\nusuarios a nivel Nacional y para los usuarios a nivel internacional será por\nmedio del número 506- 2742-5348.\n\nV.-Que\nconforme a la resolución ACLA-P-D-02-2015 en su Resuelve primero se dispuso la\nampliación de la disposición primera del procedimiento de reservaciones\nestablecido en la resolución ACLA-P-D-193-2014, que es la que se procede a\nmodificar parcialmente en este acto, para establecer como nuevo número de\nservicio para las reservaciones de ingreso al Parque Nacional Chirripó el\nnúmero 905-Chirrip dejando sin efecto el número telefónico anterior a partir de\nla fecha que se dirá.\n\nVI.-Que\nen concordancia con los periodos de reservación establecidos en la Resolución\nACLA-P-D-193-2014, en el punto 5º de las Disposiciones Generales, el proceso de\nreservación utilizando el número 905-Chirrip iniciará el día lunes 2 de\nnoviembre del 2015, fecha que se define para no afectar el periodo de\nreservaciones que inicia en la primera semana del mes de octubre del 2015 y\npermitirle a la Administración un tiempo prudencial para comunicar el cambio a\nlos   "body_en_text": "in the entirety of the text\n\n                    -\n\n                        Full Text of Norm 434\n\n                        Amendment Establishes the procedure for reservations in Chirripó\nNational Park\n\nFull Text of record: 107536\n\nNATIONAL\nSYSTEM OF CONSERVATION AREAS\n\nResolution No. ACLA-P-D-434-2015.-Ministry of\nEnvironment and Energy.-National System of Conservation Areas.-La Amistad Pacífico Conservation Area, San Isidro de El General, at ten o'clock on the\ntwenty-ninth of September, two thousand fifteen.\n\nWhereas:\n\n1°-That in accordance with Article 32 of the Organic Environmental Law, the Ministry of Environment and Energy is responsible for the\nadministration of state-owned Protected Wild Areas.\n\n2°-That\nArticle 22 of the Biodiversity Law delegates to SINAC the authority to\nadminister state-owned Protected Wild Areas, which establishes that the National System of Conservation Areas (SINAC) is a system of institutional management and coordination, deconcentrated and\nparticipatory, with instrumental legal personality that integrates\ncompetencies in forestry, wildlife, and protected areas matters, and is attached\nto the Ministry of Environment and Energy, for the purpose of issuing policies, planning,\nand executing processes aimed at achieving sustainability in the management of\nthe natural resources of Costa Rica.\n\n3°-That\nChirripó National Park is administered by the La Amistad Pacífico Conservation Area (ACLA-P), which was created by Law No. 5773, with an\narea of 43,700, and was also expanded by Executive Decree No. 13496-A\nof March 31, 1982.\n\n4°-That\nthe La Amistad Pacífico Conservation Area issued resolutions\nACLA-P-D-193-2014 at 9:00 a.m. on May 21, 2014, published in La\nGaceta No. 110 on Tuesday, June 10, 2014, and effective as of June 23,\n2014, and ACLA-P-D-02-2015 at 3:00 p.m. on January 6, 2015,\npublished in La Gaceta No. 18 on Tuesday, January 27, 2015, in\nwhich the provisions for the reservation process for Chirripó National Park are established.\n\nConsidering:\n\nI.-That the reservation system for Chirripó National Park\nthat has been in use since 2011 involves the use of a telephone line\ndesignated as 2742-5083, this being the only means of access to the\nreservation system currently in effect according to the regulations indicated.\n\nII.-That\nas of 2011, the Instituto Costarricense de Electricidad (ICE) warned\nof the problem arising from the saturation of the telephone exchange at the\nlevel of the Brunca Region, given that during the reservation period for Chirripó National Park, there is a very high percentage of unanswered calls, that is,\nring attempts, reaching up to 99% of unanswered calls, which causes\noverflow of the system.\n\nIII.-That\na first palliative measure was the installation of a PBX with\n3 trunk lines added, with the purpose of adding two more people to the\nreservation mechanism in order to thereby handle a greater number of\nincoming calls; however, this did not solve the problem.\n\nSubsequently,\nwith the commencement of the Non-essential Services contract at\nChirripó National Park, another palliative measure was taken to prevent the\noverflow of the Brunca Region telephone exchange, which consisted of\nchanging from two reservation periods per year to four periods, in order\nto balance the distribution of calls from the thousands of users;\nhowever, this measure also did not resolve the problem.\n\nIV.-That\nas a result of the foregoing, ICE proposes a solution to the issue by\ninstalling a 905 service that can partially decongest\nthe calls, for which reason it proposed changing the number 2742-5083 currently in use\nto a new one, which will be 905-Chirrip or 905-2447747 for all\nusers nationwide, and for international users, it will be\nthrough the number 506-2742-5348.\n\nV.-That\npursuant to resolution ACLA-P-D-02-2015, in its first Resolves clause, an\nextension of the first provision of the reservation procedure\nestablished in resolution ACLA-P-D-193-2014 was ordered, which is the one that is being\npartially modified in this act, to establish as the new service number for entry reservations to Chirripó National Park the\nnumber 905-Chirrip, rendering the previous telephone number without effect as of the\ndate stated herein.\n\nVI.-That\nin accordance with the reservation periods established in Resolution\nACLA-P-D-193-2014, in point 5 of the General Provisions, the\nreservation process using the number 905-Chirrip will begin on Monday, November 2,\n2015, a date defined so as not to affect the\nreservation period beginning in the first week of October 2015 and\nto allow the Administration a reasonable period of time to communicate the change to users.\n\nVII.-That\nconsequently, with the entry into force of the new service with the telephone\nnumber 905-Chirrip, the possibility of making reservations\nthrough the number 2742-5083 is rendered without effect.\n\nVIII.-That\nin accordance with Title Three of the General Law on Public Administration,\nit is possible for the administration to make decisions by virtue of the sovereign\npower that is inherent to it. Therefore:\n\nTHE DIRECTOR OF THE LA AMISTAD PACÍFICO\n\nCONSERVATION AREA,\n\nRESOLVES:\n\ntext-indent:24.0pt'>1°-To modify the first provision, subsection 1.1, of the\nreservation procedure established in resolution ACLA-P-D-193-2014 and\nextended by resolution ACLA-P-D-02-2015, so that henceforth it reads as\nfollows:\n\nOf the procedure:\n\nFirst: Natural or legal persons wishing to\nobtain admission rights to enter Chirripó National Park may\nmake their reservations only through the authorized means\ndetailed in this resolution, which are:\n\n1.1.\nBy telephone, calling number 905-Chirrip or 905-2447747\nfor all users nationwide, and number 506-2742-5348 for\ninternational users.\n\n2°-The telephone number 905-Chirrip will enter into\noperation on Monday, November 2, 2015.\n\n3°-Against this resolution, the ordinary remedies of revocation and/or appeal are available,\nin accordance with Articles 343 and following\nof the General Law on Public Administration, which shall be resolved, the\nrevocation by the same body that issued it and the appeal by the\nNational Council of Conservation Areas.
