Estado.\n\nII.-Que\nla salud de la población es un bien de interés público tutelado por el Estado,\ncorrespondiéndole al Poder Ejecutivo, por medio del Ministerio de Salud, la\nnormación, planificación y coordinación de todas las actividades públicas y\nprivadas relativas a la salud.\n\nIII.-Que\nla competencia rectora del Ministerio de Salud debe conducir a la articulación,\nfortalecimiento y modernización de las políticas, la legislación, los planes,\nprogramas y proyectos, así como a la movilización y sinergia de las fuerzas\nsociales, institucionales y comunitarias que impactan los determinantes de la\nsalud en la población.\n\nIV.-Que\nel Estado, a través de sus instituciones y demás entes de la Administración\nPública, se encuentran en la obligación de satisfacer un servicio público\nesencial, como lo es la salud de la población nacional.\n\nV.-Que\nel agua constituye un bien de utilidad pública y su utilización para el consumo\nhumano tendrá prioridad sobre cualquier otro uso, por lo que todo sistema de\nabastecimiento de agua destinada al uso y consumo de la población, deberá\nsuministrar agua potable, en forma continua, y en cantidad suficiente para\nsatisfacer las necesidades de las personas.\n\nVI.-Que\nlas autoridades del Ministerio de Salud y el Instituto de Acueductos y\nAlcantarillados, mediante estudios realizados en el territorio indígena Cabécar\nde Tayní, Valle de la Estrella, Limón, han detectado que el único acueducto que\nexiste solo tiene caudal para abastecer la población de la comunidad de Cerere,\nlo cual resulta insuficiente para atender la demanda existente en el resto del\nterritorio.\n\nVII.-Que\nlas autoridades del Ministerio de Obras Públicas y Transportes, mediante\nestudios realizados en el territorio indígena Cabécar de Tayní, Valle de la\nEstrella, Limón, han comprobado que la ausencia de caminos y puentes para\nllegar a esas comunidades hacen difícil o imposible el suministro de los\nservicios primarios de salud de los habitantes de ese territorio, lo que ha\ncausado que la mortalidad infantil en esas comunidades sea muy superior al\npromedio nacional.\n\nVIII.-Que\ndebido a las condiciones geográficas y al crecimiento demográfico que ha\nexperimentado el territorio indígena Cabécar de Tayní, Valle de la Estrella,\nProvincia de Limón, resulta insuficiente el suministro de agua potable apta\npara consumo humano, para las comunidades de Cerere, Gavilán, Boca Cohen,\nJabui, Moi, Alto Cohen, Calveri, Cuchei, Isla Cohen, Bajo Cohen, Surui, Arroceros,\nCunabli, Nimarí, Bella Vista e Isla Cariari.\n\nIX.-Que\nlas deficiencias en el suministro de agua potable en dichas comunidades,\nrepresentan un peligro potencial en la proliferación de enfermedades que\npodrían afectar la salud de alrededor de 5.000 personas.\n\nX.-Que\nes competencia de este Ministerio, abordar la situación mencionada, ya que\nrepresenta una situación de riesgo para la salud de los habitantes el\nterritorio indígena Cabécar de Tayní, y las comunidades de Cerere, Gavilán,\nBoca Cohen, Jabui, Moi, Alto Cohen, Calveri, Cuchei, Isla Cohen, Bajo Cohen,\nSurui, Arroceros, Cunabli, Nimarí, Bella Vista e Isla Cariari.\n\nXI.-Que\nel derecho a la salud de las personas es un derecho fundamental de aplicación\ninmediata y su tutela obligada por parte del Estado, un deber ineludible.\n\nXII.-Que\nlas normas legales que establecen la competencia del Ministerio de Salud en\nmateria de salud, consagran potestades de imperio implícitas para que aquel\npueda dictar todas las medidas legales que fueren necesarias para enfrentar y\nresolver los estados de emergencia sanitarios.\n\nXIII.-Que\nlas autoridades públicas están obligadas a aplicar el principio precautorio en\nmateria sanitaria en el sentido de que deben tomar las medidas preventivas que\nfueren necesarias para evitar daños graves o irreparables a la salud de los\nhabitantes.\n\nXIV.-Que\nse debe brindar agilidad técnica y administrativa para buscar soluciones a la\nproblemática que tienen los habitantes del territorio indígena Cabécar de\nTayní, y las comunidades de Cerere, Gavilán, Boca Therefore:\n\nTHEY DECREE:\n\nDECLARATION\nOF HEALTH EMERGENCY IN THE CABECAR INDIGENOUS TERRITORY OF TAYNI, VALLE DE LA\nESTRELLA, LIMÓN, AND THE COMMUNITIES OF CERERE, GAVILÁN, BOCA COHEN, JABUI, MOI,\nALTO COHEN, CALVERI, CUCHEI, ISLA COHEN, BAJO COHEN, SURUI, AROCEROS, CUNABLI,\nNIMARÍ, BELLA VISTA, AND ISLA CARIARI, DUE TO DEFICIENCIES IN THE SUPPLY OF\nWATER SUITABLE FOR HUMAN CONSUMPTION AND LACK OF ACCESS TO PROVIDE HEALTH SERVICES\nAND DECLARATION OF PUBLIC AND NATIONAL INTEREST FOR THE CONSTRUCTION OF THE AQUEDUCTS\nFOR THE SUPPLY OF POTABLE WATER IN THE CABÉCAR INDIGENOUS TERRITORY OF TAYNÍ,\nAND THE COMMUNITIES OF CERERE, GAVILÁN, BOCA COHEN, JABUI, MOI, ALTO COHEN,\nCALVERI, CUCHEI, ISLA COHEN, BAJO COHEN, SURUI, ARROCEROS, CUNABLI, NIMARÍ,\nBELLA VISTA, AND ISLA CARIARI, AS WELL AS THE CONSTRUCTION OF BRIDGES OVER THE RÍOS\nCERERE (sector Cerere), LA ESTRELLA (sector Gavilán-Calveri), AND COHEN (sectors\nBajo Cohen, Isla Cariari, and Isla Cariari Cuchei)\n\nArticle\n1°—A health emergency is hereby declared in the Cabécar Indigenous Territory of Tayní, and\nthe communities of Cerere, Gavilán, Boca Cohen, Jabui, Moi, Alto Cohen,\nCalveri, Cuchei, Isla Cohen, Bajo Cohen, Surui, Arroceros, Cunabli, Nimarí,\nBella Vista, and Isla Cariari, due to deficiencies in the supply of potable\nwater, which represents a potential danger for the proliferation of\ndiseases that could affect the health of approximately 5,000 people.\n\nArticle 2°—The\nconstruction of bridges over the ríos Cerere (sector Cerere), La Estrella\n(sector Gavilán-Calveri), and Cohen (sectors Bajo Cohen, Isla Cariari, and Isla\nCariari-Cuchei) is hereby declared of public and national interest, to be\ncarried out by the Ministry of Works and Transport, with the objective of facilitating access to the affected communities so that their inhabitants can be provided the best possible primary health service.\n\nArticle\n3°—The construction of aqueducts\nfor the supply of potable water in the Cabécar Indigenous Territory of Tayní,\nand the communities of Cerere, Gavilán, Boca Cohen, Jabui, Moi, Alto Cohen,\nCalveri, Cuchei, Isla Cohen, Bajo Cohen, Surui, Arroceros, Cunabli, Nimarí,\nBella Vista, and Isla Cariari is hereby declared of public and national interest, to be\ncarried out by the Costa Rican Institute of Aqueducts and Sewers, with the objective of providing potable water to the\naffected communities under the best conditions of quality, quantity,\nand continuity.\n\nArticle\n4°—Public authorities and the general population are hereby obligated\nto comply with the provisions, whether general or specific, issued by\nhealth authorities, until the current problems are resolved.\n\nArticle\n5°—Dependencies of the Public Sector and the Private Sector, non-governmental\norganizations, and international bodies, within the respective legal\nframework, may contribute economic, material, and human resources, to\nthe extent of their capabilities, to the solution of problems\nrelated to deficiencies in the supply of potable water, and the absence\nof roads and bridges in the aforementioned communities.\n\nArticle\n6°—This decree shall be effective from its publication.\n\nGiven at the Presidency of the Republic.—San José on the twenty-fifth day\nof the month of May of two thousand fifteen." }
